58470 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#333333"><strong>1.</strong> La Presidencia del Instituto Mallorquín de Asuntos Sociales (en lo sucesivo IMAS) mediante Resolución de 30 de diciembre de 2022, aprobó la convocatoria por el procedimiento ordinario de la concertación social del Servicio de acogida residencial básica para infancia y adolescencia (BOIB núm.2 de 5 de enero de 2023), por un total de 202 plazas, número establecido con carácter estimativo, con las necesidades del IMAS</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#333333"><strong>2.</strong> Mediante Resolución de la Presidencia del IMAS, de día 22 de febrero de 2023 (BOIB n.º 25, de 25 de febrero de 2023) se adjudicaron las plazas convocadas, conforme a la distribución siguiente:</span></span></span></p> <table border="1" style="background:transparent; font-size:12px"><span style="line-height:100%"><span style="color:#333333">La vigencia de estos Acuerdos, se estableció en la estipulación tercera, en dos años, desde el 1 de&nbsp;marzo de 2023 hasta 28 de febrero de 2025, con posibilidad de prórroga, por el mismo plazo.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#333333"><strong>4.</strong> En fecha 6 de septiembre de 2023 el jefe del Servicio de Infancia y Familia, con el visto bueno de la directora insular de Centros y Programas de Atención Integral a la Infancia y Adolescencia emitió informe relativo a la necesidad de ampliar 8 plazas de la concertación social del Servicio de acogida residencial básica para infancia y adolescencia, por los motivos que exponen.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5.</strong> El 11 de septiembre de 2023, emitió informe el Servicio de Autorizaciones, Registro e inspección de Centros y Servicios Sociales en el cual se indican las plazas acreditadas existentes en la isla, del Servicio de acogida residencial básica para infancia y adolescencia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el mencionado informe, también se informa de la inexistencia de expediente sancionador en materia de servicios sociales por infracciones de las que constan en los artículos 128 y 129 de la Ley 4/2009, de Servicios Sociales de las Islas Baleares durante los últimos 24 meses, de ninguno de las entidades que tienen acreditado el servicio.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atendido el informe indicado en el antecedente anterior y la Resolución de la Presidencia del IMAS, de día 22 de febrero de 2023 (BOIB n.º 25, de 25 de febrero de 2023), se extrae que solo las entidades GRUPO DE EDUCADORAS DE CALLE Y TRABAJO(GREC) y FUNDACIÓN ALDABA tienen plazas acreditadas y disponibles para atender usuarios del Servicio de acogida residencial básica para infancia y adolescencia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.</strong> Realizado el preceptivo trámite de audiencia a ambas entidades , la entidad GREC ha manifestado no estar interesada y la entidad ALDABA ha manifestado su conformidad a la ampliación de plazas en la concertación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>7.</strong> En fecha 18 de septiembre de 2023 el jefe del Servicio de Infancia y Familia, con el visto bueno de la directora insular de Centros y Programas de Atención Integral a la Infancia y Adolescencia emitió informe propuesta complementario por el cual recoge lo expuesto anteriormente y una vez realizados estos trámites propone que se realice la tramitación para ampliar el Acuerdo de acción concertada del Servicio de acogida residencial básica para infancia y adolescencia con&nbsp;ALDABA, por un total de 8 plazas, de acuerdo con el apartado 15.1 de los Pliegos de prescripciones técnicas que rigen esta concertación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>8.</strong> Dado que el gasto tiene carácter plurianual, el Servicio de Contabilidad y Presupuestos emitió Informe de autorización al gasto en fecha de 18 de octubre de 2023 y se ha previsto un gasto total máximo de 684.574,72€ (IVA exento) .</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>9.</strong> La duración de esta ampliación tiene una duración prevista desde el 11 de noviembre de 2023, hasta la finalización de la concertación, en 28 de febrero de 2025, en caso de que las necesidades de la ampliación se mantengan, pudiéndose prorrogar, si lo hace la concertación social del Servicio de acogida residencial básica para infancia y adolescencia.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>10.</strong> El Servicio Juridico Administrativo y la Intervención Delegada han emitido sendos informes favorables al aumento de plazas del servicio mencionado a favor de la entidad ALDABA.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Consideraciones jurídicas</strong></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cuanto a la competencia;</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#333333"><strong>1.</strong> El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.2.28 de los Estatutos del IMAS (BOIB n.º 67, de 18 de mayo de 2019).</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#333333">En cuanto al fondo;</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.</strong> La Ley 4/2009, de 11 de junio, de Servicios Sociales de las Islas Baleares (BOIB n.º 89, de 18 de junio de 2009).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3.</strong> La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Islas Baleares (BOIB n.º 146 de 22 de noviembre de 2018).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.</strong> El Decreto 48/2017, de 27 de octubre, por el cual se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#333333"><strong>5. </strong>El Acuerdo de acción concertada de día 22 de febrero de </span><span style="color:null">2023 (CSV:K9AA R72NVEA9 JFLCFM2H), formal</span><span style="color:#333333">izado con la entidad ALDABA.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.</strong> Los Pliegos de prescripciones técnicas que rigen la concertación social del Servicio de acogida residencial básica para infancia y adolescencia, aprobados por la Resolución de 30 de diciembre de 2022 (BOIB núm.2 de 5 de enero de 2023), por la cual se aprobó la convocatoria del mencionado concierto (CSV:K9AA RLU7 9XHTRZWTVMAD).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cuanto al procedimiento;</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>7.</strong> La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Islas Baleares (BOIB n.º 146 de 22 de noviembre de 2018).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>9.</strong> El artículo 214 del Real decreto legislativo 2/2004, de 5 de marzo, por el cual se aprueba el Texto refundido de la Ley reguladora de las Haciendas Locales, y atendido el acuerdo de aprobación del régimen de fiscalización e intervención limitada previa de requisitos básicos y conocimiento de ingresos del Consejo Insular de Mallorca y de las entidades de su sector público sujetos a función interventora de fecha 12 de diciembre de 2019, el expediente ha sido sometido a la Intervención Delegada del IMAS para la emisión del preceptivo informe de fiscalización previa ( BOE n.º 59 de 9 de marzo de 2004).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Segundo.</strong> NOTIFICAR esta resolución a la entidad ALDABA. así como a la Dirección Insular de Centros y Programas de Atención Integral a la Infancia y Adolescencia, a la Intervención Delegada y al Servicio de Presupuestos y Contabilidad.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Tercero.</strong> PUBLICAR esta Resolución en el Boletín Oficial de las Islas Baleares, en el Tablón de anuncios del IMAS y en la Sede electrónica del Consejo de Mallorca.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consejo de Mallorca de 11 de abril de 2019 (BOIB n.º 67, de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Consejo Insular de Mallorca, dentro del plazo de un mes, contador a partir del día siguiente al de la notificación de la presente resolución.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso-administrativo ante el Juzgado de lo contencioso-administrativo, en el plazo de dos meses, contadores a partir del día siguiente al de la notificación de la desestimación del mencionado recurso.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso-administrativo ante el Juzgado de lo contencioso-administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#333333">No obstante lo anterior, se puede ejercitar, si es el caso, cualquier otro recurso que se estime pertinente.
