    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Ejecutivo del Consejo Insular de Ibiza, en sesión ordinaria el dia 3 de noviembre de 2023, aprobó la siguiente propuesta de la consejera ejecutiva del Departamento de Promoción Económica, Cooperació Municipal y Recursos Humanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“(...)&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;APROBAR y suscribir el Convenio de colaboración entre el Consejo Insular de Ibiza y la Cámara de Comercio, Industria, Navegación y Servicios de Ibiza y Formentera para la financiación de gastos de estructura y actuaciones del año 2023, con CSV número 14615534260546254076.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGUNDO.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;APROBAR la dotación económica de la subvención por un importe total máximo de cien mil euros (100,000,00 €), con cargo a la aplicaicón presupuestária 4220,48966 del vigente presupuesto a favor de la Cámara de Comercio, Indústria, Navegación y Servicios de Ibiza y Formentera, con CIF núm. Q0700521H.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCERO.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.PUBLICAR el presente convenio en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín oficial de las Islas Baleares &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;(BOIB), y en la Base Nacional de Datos de Subvenciones (BNDS), una vez aprobado, de conformidad con lo establecido en el art. 18 de la ley 38/2003, de 17 de noveimbre, general de subvenciones, en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Islas Baleares &lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;y en el Portal detransparencia del Consejo Insular de Ibiza (http://transparència.conselldeivissa.info), de conformidad con lo establecido en los artículos 5,4 y 8,1, de la ley 19/2013, de 9 de diciembre, de tranparencia, acceso a la información pública i buen gobierno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Partes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vicente Marí Torres, presidente del Consejo Insular de Ibiza (en adelante, Consejo), por nombramiento del Pleno de 23 de junio de 2023, actuando en nombre y representación de esta institución, de conformidad con lo dispuesto en el artículo 52 del Reglamento Orgánico del Consejo Insular de Ibiza, el artículo 34 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local (LBRL), y el artículo 20 de la Ley 4/2022, de 28 de junio, de consejos insulares, asistido por el secretario general de esta Corporación, en ejercicio de sus funciones de fe pública que le atribuye el artículo 92 bis&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;de la LBRL.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Juan Guasch Serra, presidente de la Cámara de Comercio, Industria, Servicios y Navegación de Ibiza y Formentera (en adelante, Cámara), nombrado en consejo insular de la Cámara en fecha 28 de junio de 2022, por razón de su cargo, según las atribuciones conferidas por el artículo 12 de la Ley 4/2014, de 1 de abril, Básica de las Cámaras Oficiales de Comercio, Industria, Servicios y Navegación (Ley de Cámaras) y la Ley 1/2017, de 12 de mayo, que regula la Cámara Oficial de Comercio, Industria y Navegación de Ibiza y Formentera (Ley de Cámaras IB), y en el ejercicio que le atribuye el artículo 36 de su Reglamento de régimen interno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El Consejo y la Cámara tienen entre sus finalidades el desarrollo de estrategias de promoción económica y desarrollo local y de fomento del espíritu emprendedor, auto empleo y la creación de empresas en el ámbito de la isla de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Consejo, de conformidad con el artículo 30 de la Ley de Cámaras IB, modificado por el Decreto Ley 9/ 2021, de 23 de diciembre, y por la Ley 2/2022, de 6 de junio, de medidas urgentes en determinados sectores de actividad administrativa, puede firmar convenios para financiar las cámaras de comercio, incluidos los gastos de funcionamiento y estructura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Por otra parte, la Cámara es una corporación de derecho público dependiente de la tutela de la Consejería de Empresa, Ocupación y Energía del Gobierno de las Islas Baleares, que representa los intereses del comercio, la industria, la navegación y los servicios de su demarcación y tiene el objeto, las funciones y las atribuciones que determina la Ley Básica de Cámaras) y las normas que la despliegan; la Ley de Cámaras IB, y la normativa que la desarrolla, y las disposiciones del Reglamento de régimen interior de la Cámara Oficial de Comercio, Industria, Servicios y Navegación de Ibiza y Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Cámara goza de la naturaleza de ente local y tiene plena capacidad y personalidad jurídica independiente para el cumplimiento de sus fines propios y se rige por el principio de cooperación y colaboración; y en su actuación, por los criterios de eficiencia y servicio a la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Además del ejercicio de las competencias de carácter público que le atribuye la legislación vigente y de las que le puedan encomendar y delegar las administraciones públicas, la Cámara tiene entre sus funciones, la de prestar servicios a las empresas que operan las actividades de comercio, industria, servicios y navegación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Que desde sus inicios, la Cámara viene desarrollando diversas actividades amparadas en la normativa vigente, como, por ejemplo: emitir distintos certificados; formaciones; apoyo al comercio como consultoría, comunicación y difusión de iniciativas; organización de campañas; concursos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Cámara participa en las diferentes entidades y organismos de la administración de los que forma parte, como órgano consultivo, acudiendo puntualmente a sus sesiones, con una participación activa en cuanto a recogida de opinión y criterios de los sectores empresariales de nuestras islas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Cámara es miembro activo del Instituto de Mediación de las Islas Baleares (IMIB), integrada por el Colegio de Abogados de Baleares (ICAIB) y las tres cámaras de comercio, impulsando la mediación como sistema de resolución de conflictos de forma extrajudicial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En el Presupuesto del Consejo del año 2023, consta una subvención nominativa a la Cámara, sede Ibiza, por importe de 100.000 €, con cargo a la aplicación presupuestaria 4220.48966.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta subvención nominativa está prevista en el Plan Estratégico de Subvenciones del Consejo para los años 2023-2025, publicado en el BOIB núm 12, de 26 de enero de 2023, con la finalidad de apoyar a la Cámara financiando el ejercicio de sus funciones público-administrativas dirigidas a las empresas de su circunscripción desarrolladas en el año 2023 y así preservar su continuidad con la labor de promoción y defensa de los intereses generales del comercio en la isla de&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Que los gastos totales de la Cámara en funcionamiento y estructura para el año 2023 en la isla de Ibiza objeto de la presente subvención serán de 279.372,75 €, según constan en la relación de gastos del Anexo I del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Que es voluntad de ambas instituciones que todos los ciudadanos y ciudadanas de la Isla de Ibiza puedan beneficiarse del asesoramiento y apoyo proporcionado por la Cámara.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las partes se reconocen mutuamente la capacidad legal necesaria para formalizar este convenio, de acuerdo con las siguientes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cláusulas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.-Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es objeto del presente convenio entre el Consejo y la Cámara, establecer los términos y condiciones para el otorgamiento de una subvención nominativa para garantizar su continuidad y ayudar económicamente en su funcionamiento y estructura financiando el desarrollo de las funciones público-administrativas durante el ejercicio 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con esta colaboración público-privada, se facilita todo un sistema de desarrollo de la actividad económica y empresarial, poniendo a disposición de las empresas la información y los medios necesarios para mejorar su gestión y aumentar su competitividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.-Financiación&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Este convenio instrumenta una subvención nominativa excepcional y directa y está prevista en los Presupuestos del Consejo del año 2023 a la Cámara, de conformidad con lo establecido en el art. 48 de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público (LRJSP), en el art. 22.2 a) de la Ley 38/2003, de 17 de noviembre, General de Subvenciones (LGS) y en el art. 65 del RD 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones (RLGS); y teniendo en cuenta el Decreto Ley 9/2021, de 23 de diciembre, que modifica la Ley de Cámaras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.- Obligaciones de las partes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ambas partes nos comprometemos a todos los efectos a ejecutar las actividades objeto de este convenio, de conformidad con los principios de buena administración, buena fe y presunción de legalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.1. Además, la Cámara se compromete a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Continuar realizando desde enero hasta el 31 de diciembre del año 2023, las actuaciones propias de la Cámara, que fundamentan la concesión de la presente subvención, que son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Asesoramiento a empresas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Asesoría personalizada a los emprendedores en relación con los trámites necesarios para crear y gestionar una empresa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Atención a consultas sobre temas relativos a los arrendamientos de locales de negocio e industria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Asesoramiento sobre defensa de los derechos de usuarios y consumidores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(La oficina existente en Ibiza sólo da cobertura a las cuestiones que plantean los particulares. Existe un vacío en cuanto a la asistencia a las empresas que la Cámara suple dando cobertura en la medida de lo posible a sus consultas y quejas).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Consulta e información de registro de denominaciones en la Oficina de Marcas y Patentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Publicidad en colaboración con el Registro Mercantil Central. Información Registral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificados de buenas prácticas empresariales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Apoyo al Comercio:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Consultoría en temas relacionados con regulación y normativa de zonas turísticas, horarios, días de apertura.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Comunicación y difusión de iniciativas de interés para el sector a petición de distintos agentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Jornadas divulgativas con la Cámara de España del sistema de certificación de las Cámaras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mediación y Arbitraje:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Cámara es miembro activo del Instituto de Mediación de las Islas Baleares (IMIB), integrada por el Colegio de Abogados de Baleares (ICAIB) y las tres Cámaras de Comercio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Participación activa en la toma de decisiones de este órgano que regula e impulsa la mediación como sistema de resolución de conflictos de forma extrajudicial en Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contribución económica a su sostenimiento, dado que la institución hasta ahora ha contado con el apoyo verbal del Gobierno y otras entidades, pero sin ayuda o impulso económico alguno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La mediación, a pesar de ser una herramienta de futuro, está muy lejos de ser todavía una alternativa a la solución jurisdiccional, y, por tanto, necesita el apoyo y los medios necesarios de difusión para garantizar este servicio durante el ejercicio 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Emitir certificados:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Emisión y comprobación de certificados de pertenencia al Censo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Verificación y certificación del cumplimiento normativo de las empresas en cuanto a Censo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Efectuar alegaciones a proyectos a solicitud de grupos empresariales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Participación activa en las Mesas del Gobierno y del propio Consejo, aportando todas las opiniones recogidas entre las empresas del sector.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Reconocimiento y apoyo a las empresas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Impulso a la plataforma de afectados por la modificación del Reglamento de Costas que proyecta el Ministerio de Transición Ecológica y el Reto Demográfico:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Además de las funciones que corresponden a la Cámara por su funcionamiento:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sesiones del Pleno y del Comité Ejecutivo, con el certificado de asistencias, recoger opiniones y levantar y custodiar las actas. Dar asistencia, resolver y ejecutar las cuestiones y tareas que encomienda el plenario de la Corporación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Efectuar y controlar todo el gasto de la corporación, así como su adecuación a los procedimientos establecidos por la ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Procedimiento Electoral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Redactar y elaborar todo el material de difusión y publicidad de la corporación, tanto revistas, artículos, mantenimiento como actualización de contenidos en la página web.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Difusión y presencia en Facebook y X, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estar al corriente de las obligaciones tributarias y de la Seguridad Social ante la Administración del Estado, así como estar al corriente de las obligaciones tributarias o de otro tipo ante el Consejo, o declaración responsable otorgada ante la autoridad administrativa competente o notario público de estarlo. Se podrá autorizar al Consejo para conseguir esta documentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Someterse a las actuaciones de comprobación, a efectuar por el órgano concedente, así como cualquier otra de comprobación y control financiero que puedan realizar los órganos de control competentes, tanto nacionales como comunitarios, aportando cuanta información les sea requerida en el ejercicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Comunicar al órgano concedente la obtención de otras subvenciones, ayudas, ingresos o recursos que financien las actividades subvencionables, de cualesquiera administraciones o entes públicos o privados, nacionales o internacionales. Esta comunicación deberá realizarse tan pronto como se conozca y, en todo caso, con anterioridad a la justificación de la aplicación dada a los fondos percibidos. Asimismo, se comunicará cualquier alteración de las condiciones tenidas en cuenta para la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Disponer de los libros contables, registros diligenciados y otros documentos debidamente auditados en los términos exigidos por la legislación mercantil y sectorial aplicable a la persona o entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Conservar los documentos justificativos de la aplicación de los fondos recibidos, incluidos los documentos electrónicos, en tanto puedan ser objeto de las actuaciones de control y comprobación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cumplir con las obligaciones de transparencia y suministro de información en los términos previstos en la normativa sobre transparencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que se produzcan rendimientos financieros de los fondos entregados, éstos incrementarán el importe de la subvención concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Asimismo, la Cámara queda obligada al cumplimiento de las restantes condiciones establecidas en el artículo 14 de la LGS, y las que se establecen en la misma resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.2. El Consejo, por su parte, se compromete a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Destinar la cantidad de cien mil euros (100.000,00 €) a la Cámara, con cargo a la partida presupuestaria 4220.48966.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Comprobar el cumplimiento de la adecuada justificación de la subvención, así como de la realización de las funciones público-administrativas y el cumplimiento de la finalidad que determinen la concesión o el disfrute de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Inspeccionar los gastos subvencionables, sin perjuicio de las competencias que pudieran corresponder, por normativa legal o reglamentaria, a otros organismos o instituciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.-Pago&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo aportará como máximo 100.000,00 euros e irán a cargo de la partida 4220.48966, según se prevé en el Presupuesto del Consejo del año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El pago de la subvención nominativa del Consejo a la Cámara objeto del presente convenio, se efectuará en un único pago del 100% de la cuantía por importe de 100.000 € a la firma del convenio y una vez tramitado el pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En relación con la presentación de garantía, dado que la beneficiaria es un ente instrumental de derecho público vinculada a una administración pública, de conformidad con lo establecido en el artículo 42.2 del RLGS, queda exonerada la Cámara de la presentación de garantía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5.-Justificación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para la justificación del convenio, la Cámara deberá presentar la documentación que a continuación se relaciona entre el 15 de enero de 2023 y el 29 de febrero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Memoria explicativa sobre el desarrollo de las actuaciones que se hayan llevado a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Certificado de la secretaria general de la Cámara de los gastos efectuados con cargo a la cuantía aportada por el Consejo, en el que se indique que no se han recibido otras subvenciones o ingresos por el objeto subvencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Una memoria económica justificativa del coste de las actividades realizadas que debe contener:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Relación de gastos de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Justificantes de gasto y pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificado acreditativo de la prorrata del IVA, si procede.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Copia de las nóminas, así como de sus justificantes de pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Justificantes de pago de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Justificante acreditativo de la retención del IRPF a los autónomos, si corresponde.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​4. Para justificar el pago de las facturas y nóminas objeto de la subvención se debe presentar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una copia del documento bancario que acredite la transferencia o el pago domiciliado en el que figure la fecha del pago, el importe pagado, el concepto del pago de tal forma que se identifique éste con la factura o nómina, y el número de factura abonada, así como los datos del ordenante y del destinatario, que deben coincidir con el beneficiario y con el emisor de la factura, respectivamente. En caso de pagos realizados mediante tarjeta de crédito, por la naturaleza del pago no será necesario hacer constar el número de factura ni el concepto del pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de facturas emitidas en moneda extranjera, el documento bancario que acredite el pago deberá fijar el tipo de cambio a euros aplicable el día del pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Declaración responsable de no incurrir en ninguna de las prohibiciones para ser beneficiario establecidas en el artículo 13 de la LGS, y en el artículo 10 del TRLGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los gastos subvencionables deben ajustarse a lo que establece el artículo 31 de la LGS, entendiendo como tales los que de forma indubitada respondan al desarrollo de las funciones público-administrativas, resulten estrictamente necesarios y se hagan en el plazo de ejecución definido . En ningún caso el coste de adquisición de los gastos subvencionables podrá ser superior al valor de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;* Los gastos que se podrán tener en cuenta en el objeto de la presente subvención son aquellos que se hayan hecho y desarrollado entre el 1 de enero hasta el 31 de diciembre de 2023 relacionados con la isla de Ibiza, y pagados en el mismo período y hasta el 31 de enero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Concretamente, se consideran gastos subvencionables los de personal, de viaje y desplazamiento, asesoramiento y servicios externos y otros gastos corrientes, vinculados al ejercicio de sus funciones público-administrativas de la Cámara . Se entiende por:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Gastos de personal. Los costes generados por el abono de retribuciones brutas que incluyen las percepciones salariales de: salario base, complementos de antigüedad, complementos derivados de la actividad (por conocimientos especiales, por turnos de trabajo, nocturnidad, penosidad, et.), pagas extras, complementos personales, incentivos a la producción, horas extraordinarias y resto de complementos personales, incentivos a la producción, horas extraordinarias y demás complementos y pluses que convencionalmente o por sentencia judicial correspondan. Las cotizaciones sociales e impuestos con cargo al trabajador y la seguridad social con cargo a la empresa son consideradas gastos de personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Desplazamiento, alojamiento y manutención. Las cuantías de estos gastos no podrán exceder de las establecidas legalmente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Gastos de asesoramiento y servicios externos de carácter corriente necesarios para el desarrollo de la actividad público-administrativa objeto de la subvención. La razonabilidad del coste se aplicará no superando las medias de precios de mercado de la materia que origina el gasto. Este apartado incluye el gasto derivado de la revisión de la cuenta justificativa por la persona auditora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Gastos relacionados con las acciones y actividades desarrolladas por la Cámara objeto del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Otros gastos corrientes necesarios para el desarrollo de las funciones público-administrativas, como:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Alquiler de la sede, incluida la comunidad, u otras instalaciones y/o equipos donde se desarrollen estas funciones público-administrativas o de apoyo para el cumplimiento de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Suministros de electricidad, calefacción, agua, teléfono, fax e Internet.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Servicios de limpieza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Mantenimiento de edificios, equipos de oficina y equipos informáticos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Material de oficina, amortización de equipos y otros gastos consumibles de oficina.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Suscripciones de prensa y de plataformas legislativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Gastos de dominios corporativos de internet, plataformas de reuniones y mantenimiento de programas informáticos (nóminas, control horario, contabilidad, etc.).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Servicios de asesoría laboral, fiscal y jurídica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Seguros de los edificios y/o instalaciones y los de responsabilidad civil vinculados al desarrollo de las funciones de la Cámara.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Gastos de operativa bancaria, tales como comisiones de cuentas o por servicios bancarios (transferencias).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Gastos relacionados con el Registro Mercantil.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Suministros de equipos de protección individual (EPIS) y medidas de prevención de COVID.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Gastos de amortización, siempre que estén vinculados a elementos necesarios para el ejercicio de las funciones público-administrativas para el período subvencionable y se calculen de conformidad con las normas de contabilidad generalmente aceptadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por tal motivo, será necesario presentar las tablas de amortización de los bienes objeto de la amortización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En ningún caso serán gastos subvencionables, y, por tanto, no podrán formar parte de los gastos subvencionables, los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.&amp;nbsp;Los intereses deudores de las cuentas bancarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2.&amp;nbsp;Los intereses, recargos y sanciones administrativas y penales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.&amp;nbsp;Los gastos de procedimientos judiciales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.&amp;nbsp;Gastos correspondientes a obras o adquisición de bienes y equipamientos inventariables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los tributos son gastos subvencionables cuando la Cámara beneficiaria de la subvención los abone efectivamente. En ningún caso se considerarán gastos subvencionables los impuestos indirectos cuando sean susceptibles de recuperación o compensación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En los términos establecidos en el artículo 31.3 de la LGS, cuando el importe del gasto subvencionable supere las cuantías establecidas en la legislación sobre contratos del sector público para contrato menor, la entidad beneficiaria deberá solicitar, como mínimo, tres ofertas de diferentes personas o entidades proveedoras, con carácter previo a la contracción del compromiso para la prestación del servicio o entrega del bien, salvo que por sus especiales características no exista en el mercado suficientes números de entidades que las realicen, presten o suministren.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La elección de la oferta presentada se realizará de acuerdo con criterios de eficiencia y economía, debiendo justificarse expresamente en una memoria la elección cuando no recaiga en la propuesta económica más ventajosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformidad con lo que establece el artículo 29 de la LGS, la Cámara no podrá subcontratar la actividad subvencionada a terceros. No se considera subcontratación la concertación a terceros cuando el objeto del contrato no se espera que deba ser realizado personalmente por el beneficiario, bien porque no constituya el objeto de su actividad o bien porque los elementos personales del beneficiario no hayan resultado esenciales en la valoración de la actividad subvencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El importe de las subvenciones en ningún caso podrá ser de tal cuantía que, aisladamente, o en concurrencia con subvenciones o ayudas de otras administraciones públicas, o de otros entes públicos o privados, nacionales o internacionales, supere el coste del actividad a desarrollar por la persona o entidad beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6.-Mecanismos de seguimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El seguimiento y evaluación del desarrollo de este convenio, así como la resolución de las incidencias que las partes detecten, se articulará a partir de reuniones de coordinación de carácter técnico promovidas a instancia de cualquiera de las dos partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las controversias que puedan plantearse sobre la interpretación y ejecución de este convenio se intentarán resolver por mutuo acuerdo de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.-Modificación del convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cualquier modificación que altere las condiciones establecidas en este convenio se pactará por acuerdo escrito de las partes. En cualquier caso, el documento en el que se formalice la posible modificación se adjuntará a este convenio como una adenda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.-Compatibilidad&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En ningún caso el importe de la aportación de la ayuda podrá superar los gastos de las funciones público-administrativas, según el presupuesto obrado en el Anexo I del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9.-Difusión de la colaboración del Consejo &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cumplimiento de los artículos 11.1 y 34.4 del RLGS, la Cámara se compromete a que en los carteles, anuncios, folletos, stands y en todo el material relativo a las actividades objeto de este convenio, figurará expresamente la colaboración del Consejo y su logotipo. También hará constar esta subvención en su memoria anual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10.-Reintegro y revocación de la ayuda&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si con la documentación presentada no se llega a justificar el 100% del gasto previsto para la actividad objeto del convenio, la ayuda se reducirá proporcionalmente al gasto justificado, de modo que la ayuda cubra sólo los gastos correctamente justificados .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de la obligación de justificar la finalidad de la ayuda económica recibida en la forma y los plazos establecidos supondrá, además de la revocación, la imposibilidad de recibir ayudas del Consejo mientras no se realice la devolución del importe reclamado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si durante la instrucción del expediente o en el transcurso de los cuatro años posteriores a la concesión de la ayuda se observaran incumplimientos parciales o totales de las actividades objeto de este convenio, el importe subvencionado podrá ser sometido a reintegro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En este sentido, de conformidad con el artículo 17.3 n) de la LGS, en relación con el artículo 37.2 de la misma ley, y los artículos 13 n) y 44 del RLGS, se establecen los siguientes criterios de graduación del posible incumplimiento material de la actividad objeto de esta subvención, y siempre que la beneficiaria acredite una actuación inequívoca tendente a la satisfacción de sus compromisos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano instructor aplicará estos criterios para determinar la cantidad que finalmente tendrá que percibir la entidad beneficiaria, o en su caso, el importe a reintegrar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con lo que dispone el artículo 43 del RLGS, se revocará la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumpla total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. En tal caso, quedará sin efecto el acto de concesión, como consecuencia de la revocación, y procederá reintegrar total o parcialmente la ayuda recibida por la entidad beneficiaria y, en su caso, la exigencia del interés de demora, en los casos previstos en el artículo 44 del RLGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El reintegro se realizará por el procedimiento regulado en las disposiciones generales sobre procedimientos administrativos contenidas en el Título IV de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, sin perjuicio de las especialidades que se establecen en la LGS y en el RLGS, en el que debe garantizarse la audiencia a las entidades interesadas. Las cantidades reintegrables tendrán la consideración de ingresos de derecho público y podrán ser exigidas por la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El régimen de infracciones y sanciones administrativas aplicables será el establecido en el Título IV de la LGS y en el Título V del RLGS. Todo ello sin perjuicio de las responsabilidades penales o civiles en las que pueda incurrirse.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11.- Órgano competente para instruir y resolver el procedimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Departamento de Promoción Económica, Cooperación Municipal y Recursos Humanos del Consejo es el competente para instruir el procedimiento de este convenio, de conformidad con el Decreto de Presidencia núm. 2023000467, de estructura del gobierno del Consejo Insular de Ibiza y creación de departamentos, de fecha 28 de junio de 2023 (BOIB núm. 88, de 29 de junio de 2023) que atribuye al Departamento de Promoción Económica, Cooperación Municipal y Recursos Humanos, "La actividad competencial propia del Consejo Insular en materia de cooperación y asistencia local en los municipios de la isla, recogidas tanto en la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, como en la Ley 8/1993, de 1 de diciembre, de atribución de competencias a los Consejos Insulares en materia de régimen local".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformidad con el artículo 28 m) de la LCI, corresponde al consejo ejecutivo aprobar las convocatorias de ayudas y subvenciones, y como éste es un caso de concesión directa se puede entender que también es competencia de este órgano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cuanto a la firma de este instrumento jurídico, es de aplicación el artículo 33.2 k) -en concordancia con el apartado y&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la LCI, y con los artículos ya citados de la misma ley-.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.- Régimen jurídico y jurisdicción competente&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El presente convenio no tiene carácter contractual sino que articula una subvención, y debe regirse por sus cláusulas, y en todo lo no previsto en el mismo, por la LRJSP, por la LGS, por el RLGS, y por el TRLGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la realización de las actividades objeto de este convenio deben observarse las prescripciones contenidas en la Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos y Garantía de los Derechos Digitales, en el Reglamento (UE) 2016/ 679 del Parlamento y del Consejo, de 27 de abril de 2016, relativo a la Protección de las Personas Físicas en lo que se refiere al tratamiento de datos personales y a la libre circulación de estos datos y por el que se deroga la Directiva 95/46/ CE (Reglamento General de Protección de Datos -DOUE 4/5/2016-), y en el resto de legislación vigente en materia de protección de datos personales que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las partes que suscribimos este convenio nos comprometemos a intentar resolver en común las diferencias que puedan surgir en su aplicación y su interpretación. Pero si esto no fuera posible, las cuestiones litigiosas que puedan afectar a la interpretación y ejecución del presente convenio serán de conocimiento y competencia del orden jurisdiccional contencioso-administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13.- Publicidad del convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
