REGULADORA DE LA UTILIZACIÓN PRIVATIVA Y APROVECHAMIENTO ESPECIAL DEL DOMINIO PÚBLICO LOCAL</strong></span></span></span></p> <p><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 1. Fundamento legal y naturaleza</span></span></strong></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Este Ayuntamiento en uso de la facultad que le concede el artículo 133.2 de la Constitución Española, y en ejercicio de la potestad reglamentaria que le atribuye el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, y de acuerdo con el que dispone los artículos 15 a 19 del Real decreto legislativo 2/004, de 5 de marzo, por el que se aprueba el Texto Refundido de la Ley Reguladora de Haciendas Locales (TRLRHL), establece las tasas por utilización privativa y aprovechamiento especial del dominio público local que se especifican en el cuadro de tarifas contenidas en el artículo 6.º de esta ordenanza.</span></span></span></p> <p><span style="line-height:1"><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 2. Hecho imponible</span></span></strong></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Constituye el hecho imponible de estas tasas la utilización privativa o el aprovechamiento especial del dominio público local consistente en:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Instalación de lugares de venta los días señalados para mercado.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Instalación de paradas, barracas, casetas de venta y espectáculos.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. Ocupación del subsuelo, el suelo y el voladizo.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. Instalación de quioscos.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5. Ocupación de terrenos de uso público con mercancías, materiales de construcción, contenedores, vallas, andamios, puntales, caballetes y otras instalaciones análogas, calas, raídas y cualquier removida en la vía pública del pavimento o de las aceras.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">6. Ocupación de terrenos de uso público con mesas, sillas y otros elementos con finalidad lucrativa.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">7. Reserva de dominio público por el tráfico de vehículos rodados relacionados con obras o cualquier otro análogo.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8. Producciones audiovisuales</span></span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 3. Sujetos pasivos</span></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Son sujetos pasivos contribuyentes las personas físicas y jurídicas, así como las entidades a las cuales se refiere el artículo 36 de la Ley 58/2003, de 17 de diciembre, General Tributaría (LGT) que disfrutan, utilicen o aprovechen el dominio público local objeto de las tasas previstas en esta ordenanza.</span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 4. Responsables</span></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Responderán solidariamente de las obligaciones tributarias del sujeto pasivo las personas físicas y jurídicas a las cuales se refiere el artículo 42 de la LGT.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Serán responsables subsidiarios los administradores de las sociedades y los síndicos, interventores o liquidadores de quiebras, concursos, sociedades y entidades en general, en los supuestos y con la medida que establece el artículo 43 de la LGT.</span></span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 5. Beneficios fiscales</span></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">De acuerdo con el que establece el artículo 9 del TRLRHL, no se podrán reconocer otras exenciones, reducciones o bonificaciones que las expresamente previstas en las normas con rango de ley, las derivadas de la aplicación de tratados internacionales, y las que se puedan establecer en esta ordenanza fiscal en los supuestos expresamente previstos por la ley.</span></span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 6. font-size:12px"><span style="color:#000000">• Filmaciones de películas cinematográficas, reportajes, documentales, imágenes de videoclips musicales o similar, efectuadas con finalidad lucrativa que requieran la ocupación de la vía pública sin limitación, con aparatos o vehículos (grúas, focos estáticos, grupos electrógenos, cadalsos, escenarios, decorados, camiones, etc.), que produzcan problemas para el tráfico rodado o de peatones, sin limitaciones de medios ni del personal que interviene, siempre que se acredite que el producto resultante contribuye a la promoción de la ciudad y se haga constar expresamente la colaboración del municipio de Porreres y se libre una copia para el archivo: 0 €.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">• Filmaciones de concursos de televisión y spots publicitarios o similar, efectuadas con finalidad lucrativa que requieran la ocupación de la vía pública sin limitación, con aparatos o vehículos (grúas, focos estáticos, grupos electrógenos, cadalsos, escenarios, decorados, camiones, etc.), que produzcan dificultades para el tráfico rodado o de peatones, sin limitaciones de medios ni del personal que interviene: 250€/día. En circunstancias especiales, en el caso de los concursos de televisión, se podrá eximir el pago de la tasa en el supuesto de que se acredite que el producto resultante contribuye a la promoción de la ciudad y se haga constar expresamente la colaboración del municipio de Porreres y se libre una copia para el archivo.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">• Fotografías comerciales (catálogos, anuncios...) sin asentamiento fijo (no fotografía ambulante): 50 €/día.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">• Fotografías comerciales (catálogos, anuncios...) sin asentamiento fijo (no fotografía ambulante), con licencias de validez de 3 a 12 meses hasta el 31 de diciembre del año en curso: 200 €.</span></span></span></p> <p>​​​​​​​<strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 7. Devengo</span></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Las tasas se meritan en el momento de solicitar el uso privativo o el aprovechamiento especial.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Cuando se produzca el uso privativo o el aprovechamiento especial sin solicitar la licencia o autorización, las tasas se meritarán en el momento de inicio del aprovechamiento, sin perjuicio de la interposición de la correspondiente sanción.</span></span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 8. Gestión</span></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Las personas o entidades interesadas en la concesión de aprovechamiento regulados a esta ordenanza tendrán que solicitar previamente la correspondiente licencia o autorización rellenando el formulario correspondiente, aportar la documentación requerida en cada caso, formular declaración en la cual conste la superficie de aprovechamiento, la duración prevista y los elementos que se instalarán y hacer el ingreso del importe correspondiente. En casos excepcionales y, previa autorización de la alcaldía o concejalía delegada, se podrá pagar en efectivo.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Los servicios técnicos del Ayuntamiento comprobarán e investigarán las declaraciones formuladas por los interesados, concediéndose las autorizaciones en caso de no encontrar diferencias con las peticiones de las licencias. Si se detectaran diferencias se notificarán las mismas a los interesados y se emitirán, si procede, las liquidaciones complementarias que se procedan, concediéndose las autorizaciones una vez resueltas las diferencias por los interesados y, si procede, realizados los ingresos complementarios que procedan.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. No se consentirá en ningún caso la ocupación de la vía pública hasta que se haya abonado y obtenido por los interesados la licencia correspondiente. En los casos que la ocupación implique reservas de estacionamiento, las solicitudes efectuadas con una anterioridad inferior a 48 horas no serán autorizadas.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4. Los terrenos ocupados se tendrán que dejar en iguales condiciones de limpieza y salubridad en las que se encontraron. En caso contrario, se llevarán a cabo las medidas sancionadoras y correctivas legalmente aplicables.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5. Las autorizaciones tendrán carácter general y no podrán ser cedidas o subarrendadas a terceros. El incumplimiento de este mandato dará lugar a la anulación de la licencia, sin perjuicio de las cuantías corresponda abonar a los interesados.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">6. En caso de renuncia de la ocupación se tendrá que comunicar al registro de entrada del Ayuntamiento con anterioridad a la fecha prevista de ocupación para tener derecho a la devolución de ingresos indebidos.</span></span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Artículo 9. Infracciones y sanciones</span></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1) Constituye infracción de estas Ordenanzas toda acción u omisión que contravenga o deje sin cumplimiento cualquiera de sus disposiciones.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2) Las denuncias por contravención al que se ha preceptuado serán formuladas a través de comunicados de servicios o de oficio ante la alcaldía por la Policía Local u otro personal dependiente del Ayuntamiento al cual corresponda o por cualquier vecino al cual se cause perjuicio o que, movido por el interés público, presente la correspondiente denuncia por escrito. Esta denuncia se tiene que dirigir a Alcaldía y se tiene que expresar las causas, el nombre y linajes y el domicilio de los denunciantes, con las consecuencias para este si de las investigaciones que se practiquen, en resulta falsa la denuncia.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3) Cuando la infracción denunciada o advertida se encuentre expresamente penada por la ley o por ordenanzas específicas aprobadas por el Ayuntamiento, se aplicará el que establece el precepto que regula el caso.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4) Las infracciones al que establecen las presentes Ordenanzas, salvo el que dispone el párrafo anterior, se castigarán con multa variable dentro de los límites específicos que señala la legislación local aplicable a esta materia.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5) Además de la imposición de multas y otras sanciones descritas en estas Ordenanzas, en caso de infracción se pueden decretar según corresponda, las siguientes medidas adicionales:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) La suspensión de trabajos de ejecución de obra, instalación o actividad que se realicen sin licencia.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Ordenar al infractor que, en el plazo que se señale, introduzca a las obras, las instalaciones, servicios, etc., las rectificaciones que hagan falta para ajustarlos a las condiciones de la licencia, las disposiciones de las Ordenanzas u otra normativa legal de aplicación.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) Disponer la reparación, la reposición o la demolición de las obras e instalaciones hechas por parte del Ayuntamiento, directa o indirectamente, a cargo, en todo caso, del infractor.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Impedir los usos indebidos para los cuales no se haya obtenido licencia de ocupación o que no se ajusten a sus condiciones y a las disposiciones de las Ordenanzas y otras normas legales de aplicación.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">e) A intervenir y retirar todo objeto depositado a la vía pública sin la debida autorización, o cuando exceda los límites de esta, o no se sigan las órdenes e indicaciones dadas por los Agentes de Policía Local con el ejercicio de sus funciones.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">6) En caso de incumplimiento de las órdenes a que se refieren los apartados anteriores, y sin perjuicio de la adopción de medidas para su ejecución subsidiaria, pueden imponerse multas coercitivas reiteradas por intervalos de tiempos suficientes para el cumplimiento del que se ha ordenado.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">7) Cuando no haya un procedente sancionador específico para la materia de que se trate se observará el que disponga la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público., en todo caso regirán los principios básicos a los cuales se tiene que someter el ejercicio de la potestad sancionadora de la Administración establecido en esta Ley.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">8) Si no se hace efectivo el pago de las multas en el plazo señalado para su exacción se ejecutará por vía de apremio.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">9) Los interesados podrán interponer contra las multas que impone la Alcaldía los recursos que autoriza la legislación vigente.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">10) Cuadro de infracciones y sanciones:</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) No tener el cartel municipal de licencia de obra en un lugar visible a la obra y con los datos legibles: 60€.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Realizar ocupación u obra a la vía pública sin permiso municipal (por día): 60€.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) Por cada mes que se exceda en la reposición del pavimento en el estado original desprendido del plazo fijado por la autoridad o agente una vez finalizada la ocupación: 60€.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Obras mal cerradas, mal señalizadas y acumulaciones de materiales en la calle en contradicción con la presente ordenanza, o indicaciones de los Agentes de la Autoridad: Por cada día 100€.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">e) Cualquier otro que contravenga esta ordenanza no recogida expresamente a los presentes cuadro de infracciones: 60€.</span></span></span></p> <p><strong><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
