Así mismo, se aprobó la convocatoria correspondiente al ejercicio de 2023 que se rige por las bases señaladas anteriormente.Se podrán consultar éstas y los anexos en la web municipal del Ayuntamiento de Ciutadella de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;1. Normas generales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;1.1. En fecha 9 de agosto de 2018 y&amp;nbsp;BOIB&amp;nbsp;n.º 98 se publica la aprobación definitiva de la modificación del Reglamento de régimen de uso de los huertos urbanos de Ciutadella de Menorca. Por lo tanto, las bases reguladoras se aprueban de acuerdo con el mencionado Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;1.2. El objeto de estas bases es regular el otorgamiento mediante convocatoria pública del uso temporal de los huertos urbanos de Sa Vinyeta destinados a personas que cumplan los requisitos que más adelante se detallan y quieran disponer de una parcela de huerto por un periodo de cuatro años, sin posibilidad de prórroga.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.3. En el supuesto de que un huerto quede sin trabajar más de 6 meses por la persona adjudicataria sin que haya una comunicación expresa y motivada al Ayuntamiento de Ciutadella de Menorca, éste quedará libre y podrá ser adjudicado nuevamente a otra persona usuaria en una nueva convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.4. Las licencias municipales otorgadas en virtud de este reglamento tendrán la naturaleza de autorizaciones de uso privativo del dominio público, regulado en el Reglamento de bienes de las corporaciones locales, aprobado mediante real decreto 1372/1986, y en la Ley 33/2003 de patrimonio de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.5. Estas licencias se otorgan salvo el derecho de propiedad y sin perjuicio de otro y, por lo tanto, no supone, en ningún caso, la transmisión del dominio de la parcela de huerto utilizada, que continuará siendo propiedad del Ayuntamiento de Ciutadella de Menorca, tanto respecto al terreno como respecto a todas las instalaciones existentes en el momento de otorgamiento de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.6. La persona adjudicataria solo tendrá la posesión del huerto municipal que se le asigne, por el plazo que se determine y en los términos que prevé la licencia o el documento de formalización de la adjudicación y el resto de artículos del reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.7. Las licencias otorgadas tienen carácter personal, y, en ningún caso, las personas titulares podrán ceder, alienar, grabar o disponer, a título oneroso o gratuito, los derechos que se deriven de la autorización de uso, ni transmitirlo a terceros.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.8. La ubicación de los huertos está emplazada a Sa Vinyeta, en el término municipal de Ciutadella de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.9. Cada parcela de huerto consta de unos 40 metros cuadrados aproximadamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Personas destinatarias de los huertos&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los huertos urbanos van dirigidos a personas a partir de 55 años de edad y pensionistas en el momento de la solicitud. Se entiende pensionista aquella persona que percibe cualquier tipología de pensión, en la modalidad de contributiva o no. Además, tienen que estar empadronadas en el municipio de Ciutadella y no tienen que disponer, como mínimo desde la fecha de finalización del plazo de presentación de la solicitud de adjudicación, de otro huerto privado, y tienen que estar al corriente en cuanto al cumplimiento de las obligaciones tributarias, con la Seguridad Social y con la hacienda pública municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Parcelas disponibles&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Hay disponibles en esta convocatoria 6 parcelas para personas a título individual, concretamente las parceles número 4, número 6, número 10, número 11, número 13 y la número 19.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Requisitos y condiciones de las personas aspirantes&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.1. Para poder optar a la adjudicación de una parcela, habrá que tener las condiciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Ser persona física igual o mayor de 55 años y pensionista.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) En la fecha de inicio del proceso de solicitudes, estar empadronada en el municipio de Ciutadella de Menorca.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Se podrá presentar una solicitud por núcleo de convivencia, entendiéndose por núcleo convivencial aquellas personas que conviven en un mismo domicilio y mantienen una relación de alianza o filiación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) No disponer, en calidad de propietario, de ningún otro huerto ni terreno de cultivo. Este extremo se acreditará mediante la presentación de una declaración responsable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e) No haberse adjudicado otra parcela u otro huerto a un miembro del mismo núcleo de convivencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.2. A efectos de establecer una puntuación con las personas solicitantes que tienen los requisitos y en caso de haber más solicitantes que parcelas disponibles, se establece el baremo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se valorará el cómputo mensual de ingresos económicos del núcleo de convivencia, calculados a partir del vigente IPREM. Se dará una mayor puntuación en el acceso a una parcela del huerto urbano a las personas o a los núcleos de convivencia con ingresos económicos más bajos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Ingresos económicos del núcleo de convivencia igual o inferiores a 700,00 € mensuales (IPREM anual 2023 -14 pagas-): 5 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Ingresos superiores a 700,00 € e inferiores a 875,00 € (125% de IPREM): 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Ingresos superiores a 875,00 € e inferiores a 1.050,00 € (150% de IPREM): 2 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por otro lado, se valorará con 5 puntos en el caso de las personas que viven solas en un domicilio, según datos extraídos del padrón de habitantes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para poder valorar la puntuación, las personas solicitantes tendrán que presentar los ingresos económicos de los miembros del núcleo convivencial: declaración de la renta o, en caso de no presentarla, certificado de la pensión o de las pensiones concedidas y del resto de ingresos procedentes de alquileres o cualquier otro percibidos. Por otro lado, el Ayuntamiento de Ciutadella comprobará de oficio la situación convivencial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Presentación de solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;Se podrá presentar la solicitud, según el modelo normalizado, a la Oficina de Atención al Ciudadano para que quede registrada la entrada así como de forma telemática, tal como lo prevé la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;LPAC&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;39/2015. Tendrá que ir dirigida al Servicio de Atención Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las personas que soliciten una parcela tendrán que presentar los documentos acreditativos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Hoja de inscripción para obtener una parcela del Huerto Urbà (anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Declaración responsable (anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Fotocopia del DNI.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Declaración de la renta o, si no tiene, certificado de la pensión o de las pensiones que perciba la persona solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Plazo de presentación y enmienda de las solicitudes&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;6.1. El plazo de presentación de solicitudes será de 20 días hábiles a partir del día siguiente a haberse publicado esta convocatoria en el&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;BOIB&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.2. Si de la revisión de la solicitud y de la documentación aportada se deduce que esta es incompleta o defectuosa, el órgano competente requerirá la persona solicitante para que, en el plazo de diez días, como expresa el artículo 26 de la Ley de régimen jurídico de las administraciones públicas y del procedimiento administrativo común, aporte la documentación necesaria o enmiende los defectos observados. En este requerimiento se indicará que, si en el plazo establecido no se enmiendan las deficiencias, se desestimará la solicitud mediante resolución previa dictada en los términos que prevé el artículo 42 del cuerpo legal mencionado, y que el expediente se archivará de acuerdo con el artículo 71 del mismo cuerpo legal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Procedimiento de concesión de parcelas de huerto a Sa Vinyeta&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.1. El sistema de adjudicación de las licencias de uso privativo del dominio público sobre parcelas municipales de huerto se hará en función de la puntuación obtenida, así como viene establecido en el punto 4.2 de la presente convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.2. El personal técnico municipal de Servicios Sociales y de Medio Ambiente, junto con la Secretaría municipal, valorará la admisión de las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.3. En caso de empate en la puntuación resultante y si existen más solicitudes que parcelas de huerto disponibles, el orden y, por tanto, la adjudicación se determinará por sorteo y la selección de la parcela también se adjudicará por el mismo procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.4. Una vez aceptada la solicitud, en la fecha y en el lugar que se comunique oportunamente y en un acto público, tendrá lugar el sorteo a partir del cual se aprobarán las adjudicaciones de las licencias de uso privativo de parcelas del huerto municipal en caso de empate de puntuación y de exceso de solicitudes frente al número de parcelas. De igual forma se sortearán la asignación de las parcelas. Se sacará un boletín con un número y, a partir de este, se contarán los números posteriores para adjudicar la totalidad de los huertos urbanos sacados a concurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Formalización de las adjudicaciones&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La persona que ejerce la alcaldía o la concejalía delegada aprobará las adjudicaciones de las varias licencias de uso privativo del dominio público de los huertos municipales, a la vista del informe emitido por el personal técnico y de la Secretaría Municipal, una vez efectuado, si procede, el sorteo público. Se notificará a todas las personas participantes, su licitación. Así mismo se publicará la lista en el tablón de anuncios y en la web municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El documento administrativo que formalizará las adjudicaciones de las licencias de uso privativo (anexo III) contendrá el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Datos de la persona.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Finalidad de uso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Superfície, localización y número de la parcela.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Derechos y obligaciones de la persona adjudicataria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Duración de la autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La formalización de este documento que se firmará una vez adjudicada la parcela de huerto, supone el reconocimiento formal por parte de las personas del derecho de propiedad del Ayuntamiento de Ciutadella de la finca que se le asigna, así como todas las instalaciones inseparables del terreno y la total aceptación del régimen jurídico que prevé este reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Entrega de autorizaciones&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#333333"&gt;&lt;span style="background-color:null"&gt;Las personas adjudicatarias tendrán que recoger los títulos acreditativos de su derecho otorgados por el A- yuntamiento de Ciutadella dentro del plazo de 30 días a contar desde la notificación de la adjudicación.
