&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;(…)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PROPUESTA DE ACUERDO:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;«PRIMERO&lt;/strong&gt;.- APROBAR y SUSCRIBIR el Convenio específico y sus anexos entre el Consejo Insular de Ibiza y el Ayuntamiento de Eivissa, con NIF núm. P0702600-H, para la ejecución del Plan estratégico de inversiones municipales (PLAN 5), año 2023 que consta en el expediente núm. 2023/00017830D, con CSV 14615535127712501613.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SEGUNDO&lt;/strong&gt;.- APROBAR la dotación económica de la subvención por un importe máximo de 1.421.621,52 euros con cargo a la aplicación presupuestaria 9420 7620002 del vigente presupuesto, para hacer frente a las obligaciones económicas previstas en el convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;TERCERO&lt;/strong&gt;.- DESIGNAR como representantes del Consejo Insular de Ibiza en la Comisión Bilateral del Convenio de colaboración entre el Consejo Insular de Ibiza y el Ayuntamiento de Eivissa para la ejecución del Plan estratégico de inversiones municipales ( PLAN 5), las siguientes personas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;• Maria Fajarnés Costa, consejera ejecutiva del Departamento de Promoción Económica y Empresarial, y Cooperación Municipal, que ejercerá las funciones de presidenta de la Comisión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;• Rebeca Miguel Climent, técnica media de gestión del Departamento de Presidencia y Gestión Ambiental, que actuará como vocal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;• Concepción Rebollo Laserna, asesora jurídica y jefa de Servicio del Departamento de Presidencia y Gestión Ambiental, que actuará como secretaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;CUARTO&lt;/strong&gt;.- PUBLICAR en el Portal de transparencia del Consejo Insular de Ibiza (http://transparencia.conselldeivissa.info), de conformidad con lo establecido en los artículos 5.4 y 8.1 de la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno, así como en el Boletín Oficial de las Islas Baleares (BOIB) y en la Base Nacional de Datos de Subvenciones (BNDS), una vez aprobado, de conformidad con lo establecido en artículo 18 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones. Y dar cumplimiento a lo establecido en el artículo 53 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, en lo que se refiere a la remisión del convenio firmado a la Sindicatura de Cuentas, como órgano de fiscalización externa competente de la Comunidad Autónoma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;CONVENIO EJECUTIVO ESPECÍFICO DEL PLAN ESTRATÉGICO DE INVERSIONES MUNICIPALES DEL CONSEJO INSULAR DE IBIZA (PLA5) PARA EL MUNICIPIO DE IBIZA CORRESPONDIENTE AL AÑO 2023&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PARTES: &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por un lado, el señor Vicent Marí Torres, presidente del Consejo Insular de Ibiza por nombramiento del Pleno reunido en sesión extraordinaria de 25 de junio de 2023, en nombre y representación de esta entidad, en virtud de las atribuciones que le confieren el artículo 9 de la Ley 4/2022, de 28 de junio de consejos insulares; los artículos 34 y 41.3 de la Ley 7/1985, de 2 de abril, que regula las bases de régimen local, y el arte. 52 del Reglamento orgánico de esta Corporación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por otra parte, el señor Rafael Triguero Costa, alcalde del Ayuntamiento de Eivissa por nombramiento del Pleno de 17 de junio de 2023, en nombre y representación de esta entidad, actuando en virtud de las facultades previstas en el artículo 21.1. b) de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Las partes se reconocen mutuamente la capacidad necesaria para formalizar este Convenio de conformidad con los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ANTECEDENTES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. &lt;/strong&gt;La Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, en su artículo 36, establece que es competencia de las diputaciones o entidades equivalentes, como es el caso de los Consejos Insulares de acuerdo con el artículo 41 de la citada ley, la asistencia y la cooperación jurídica, económica y técnica a los municipios, así como la cooperación en el fomento del desarrollo económico y social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; La Ley 7/1985 también prevé la competencia de asegurar la prestación integral y adecuada en todo el territorio insular de los servicios de competencia municipal y, en este sentido, el Consejo Insular de Ibiza puede otorgar subvenciones y ayudas con cargo a sus fondos propios para la realización y mantenimiento de obras e inversiones de competencia municipal, las cuales se podrán instrumentar mediante planes específicos u otro tipo de instrumentos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. &lt;/strong&gt;La Ley 4/2022, de 28 de junio, de consejos insulares, en el artículo 102 de la Sección 3ª Competencias propias en relación con los municipios y otras entidades locales, del TÍTULO VII, establece como competencias propias de los consejos insulares, entre otros:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;“&lt;em&gt;(...)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) La asistencia y la cooperación jurídica, económica y técnica, especialmente a los de menor capacidad económica y de gestión (...)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;(...)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e) La colaboración en el desarrollo económico y social de los municipios, así como en la planificación municipal.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;(...)”&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. &lt;/strong&gt;La Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, establece en su artículo 47.1 que son convenios los acuerdos con efectos jurídicos adoptados por las administraciones públicas, los organismos públicos y entidades de derecho público vinculados o dependientes o universidades públicas entre sí o con sujetos de derecho privado para una finalidad común.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.&lt;/strong&gt; En otro caso, en el marco de los principios generales que deben regir las relaciones entre las diferentes administraciones públicas de dicha Ley 40/2015, de 1 de octubre, se dispone en el artículo 3 que las administraciones públicas, en sus relaciones , se rigen por los principios de cooperación, colaboración y coordinación, y en su actuación por los criterios de eficacia y servicio efectivo a los ciudadanos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.&lt;/strong&gt; Por su parte, la Ley 4/2022, de 28 de junio, de consejos insulares (BOIB nº88 de 7 de julio de 2022), en su artículo 117, sobre «Relaciones &lt;span style="color:#000000"&gt;Interadministrativas&lt;/span&gt;», prevé que, los consejos insulares se relacionan con el resto de administraciones públicas de acuerdo con los principios establecidos en la legislación básica del Estado, y especialmente los de lealtad institucional, respecto a la autonomía, colaboración, cooperación y coordinación y el artículo 120 establece en su apartado 1, que de acuerdo con la legislación básica del Estado, los consejos insulares y sus entidades instrumentales pueden suscribir convenios con sujetos de derecho público y privado, sin que ello implique cesión de la titularidad de la competencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. &lt;/strong&gt;&lt;span style="color:#000000"&gt;El Ayuntamiento goza de la naturaleza de ente local y tiene plena capacidad y personalidad jurídica independiente para el cumplimiento de sus fines propios y se rige por el principio de cooperación y colaboración, y en su actuación por los criterios de eficiencia y servicio a la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Asimismo, en cuanto a la competencia de los municipios en materia de desarrollo económico local, el artículo 29 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears, prevé, en su punto 1 , que “Además de las competencias derivadas de la legislación básica del Estado y del ejercicio de las que puedan ser delegadas por el Estado, por la comunidad autónoma, por los consejos y por otras administraciones, esta ley garantiza a los municipios un núcleo de competencias propias que deben ser ejercidas por estas entidades con plena autonomía, sujeta sólo al control de constitucionalidad y legalidad”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. &lt;/strong&gt;Es voluntad del Consejo financiar y cooperar económicamente con los ayuntamientos de la isla de Ibiza en distintos proyectos de inversión municipal. En este sentido, quiere fomentar, principalmente, la inversión en los ayuntamientos que pueda ser declarada Inversión Financieramente Sostenible (en adelante IFS) de conformidad con lo dispuesto en la disposición adicional decimosexta del texto refundido del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales, en concordancia con lo que establece la disposición adicional sexta de la Ley Orgánica 2/2012, de 27 de abril, de estabilidad presupuestaria y sostenibilidad financiera , o bien otros tipos de obras de las que se considere existe un interés público para su ejecución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9.&lt;/strong&gt; &lt;span style="color:#000000"&gt;El Consejo de Alcaldes de fecha 22 de febrero de 2023 acordó la firma de los correspondientes convenios reguladores para la ejecución del Plan estratégico de inversiones municipales (PLAN 5) con cada uno de los ayuntamientos de la isla de Ibiza, y la distribución económica del Plan 5 para cada municipio, para el año 2023, del que resulta la siguiente distribución para el Ayuntamiento de Eivissa:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Los miembros del Consejo de Alcaldes acuerdan que el porcentaje de ayuda económica que recibirá cada obra será de hasta el 75% en todos los municipios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10.&lt;/strong&gt; El Plan estratégico de subvenciones del Consejo Insular de Ibiza (2023-2025), aprobado por acuerdo del Consejo Ejecutivo de fecha 23 de enero de 2023, publicado en el BOIB núm. 12 de fecha 26 de enero de 2023, y modificado por Decreto de Presidencia del día 28 de marzo de 2023 y publicado en el BOIB nº 50 del día 20 de abril de 2023, prevé una línea de subvenciones a los ayuntamientos de la isla de Ibiza en relación con el Plan estratégico de inversiones municipales (PLAN 5) por un importe total de siete millones noventa y siete mil ochocientos cuatro euros con cuarenta céntimos (7.097.804,40 €).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11.&lt;/strong&gt; El Consejo Insular de Ibiza &lt;span style="color:#000000"&gt;ha previsto, en la aplicación presupuestaria 9420 7620002 del presupuesto del año 2023, la cuantía de siete millones noventa y siete mil ochocientos cuatro euros con cuarenta céntimos (7.097.804,40 €) con el objetivo de otorgar ayudas económicas a los ayuntamientos de la isla de &lt;/span&gt;&lt;span style="color:#000000"&gt;Ibiza&lt;/span&gt;&lt;span style="color:#000000"&gt;, para impulsar y ejecutar diferentes inversiones y obras de mejora en los municipios dentro del Plan estratégico de inversiones municipales de la isla de Ibiza (PLAN 5).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;CLÁUSULAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primera.- OBJETO DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El objeto del convenio es establecer la cooperación económica por parte del Consejo Insular de Ibiza con el Ayuntamiento de Eivissa (en adelante el Ayuntamiento), de acuerdo con lo establecido en la Ley 20/2006, de 15 de diciembre, &lt;span style="color:#000000"&gt;municipal y de régimen local&lt;/span&gt; de las Illes Balears, en lo referente a cooperación local, en la realización de inversiones y obras que aseguren y mejoren los servicios que son competencia municipal, concediendo una ayuda económica, proveniente de los fondos propios del Consejo Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En este sentido, se fomentará la inversión en los ayuntamientos que pueda ser declarada Inversión Financieramente Sostenible (en adelante IFS) de conformidad con lo dispuesto en la disposición adicional decimosexta del texto refundido del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales, en concordancia con lo que establece la disposición adicional sexta de la Ley Orgánica 2/2012, de 27 de abril, de estabilidad presupuestaria y sostenibilidad financiera. Asimismo, se podrán subvencionar obras y/o inversiones que, aunque no sean consideradas IFS, se realicen como consecuencia de la obra proyectada y que estén directamente vinculadas a la misma para lograr su objeto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Todo esto, en el marco de un Plan estratégico de inversiones municipales (PLAN 5), con la voluntad de impulsar un modelo de inversión con los municipios de la isla de Ibiza y entidades locales que profundice en los aspectos locales , a fin de articular nuevas formas de trabajar en el territorio, basadas en un concepto moderno de administración dialogante, negociadora, flexible y &lt;span style="color:#000000"&gt;concertadora,&lt;/span&gt; que permita alcanzar, con la máxima calidad y eficiencia, los objetivos de cohesión social y solidaridad territorial; propiciando un desarrollo social y económico, compatible con la adecuada conservación del entorno, que contribuya a la fijación de la población en el territorio; reforzando la dimensión cívica y democrática de los pueblos de la isla e integrando la perspectiva de género y el desarrollo sostenible de forma sistemática, en los distintos ámbitos de las políticas locales, y con el objetivo de mejorar las políticas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segunda.- OBRAS E INVERSIONES SUBVENCIONABLES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Las obras objeto y/o inversiones del presente convenio ejecutivo serán las que se adjuntan al mismo, como anexo, previa solicitud del Ayuntamiento, y tendrán que ser consideradas Inversiones Financieramente Sostenibles de acuerdo con los requisitos establecidos a la disposición adicional decimosexta del texto refundido del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el texto refundido de la Ley Reguladora de las Haciendas Locales, tales como mejoras en instalaciones deportivas de entre otros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;No obstante lo anterior, también se podrán incluir otras inversiones que no sean IFS pero que respondan a los objetivos establecidos en el presente convenio y se considere de interés por parte del Consejo participar en la financiación de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Se podrán incluir en el convenio obras y/o inversiones que ya hayan sido ejecutadas o estén en ejecución, siempre que cumplan con los requisitos antes establecidos, y siempre que la ejecución finalice antes de la fecha máxima de justificación establecida en el presente convenio, el 31 de marzo de 2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Asimismo, se podrán subvencionar los gastos derivados de la contratación de la redacción de proyectos básicos y/o de ejecución de las obras y/o inversiones que se hayan incluido en el convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercera.- PERIODO DE VIGENCIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La vigencia de este convenio es de cuatro años a partir de su firma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarta.- OBLIGACIONES DEL AYUNTAMENTO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Ayuntamiento deberá realizar las obras que se incluyan en el presente convenio, para las que recibirá una ayuda máxima del 75% del coste individual de cada una de las obras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Serán obligaciones del Ayuntamiento las establecidas para los beneficiarios de subvenciones en la Ley 38/2003, de 17 de noviembre, General de Subvenciones así como en el Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y el Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones aplicable a las Illes Balears que, entre otros son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a&lt;/em&gt;) Cumplir con el objetivo, ejecutar el proyecto, ejercer la actividad o adoptar el comportamiento que fundamenta la concesión de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b&lt;/em&gt;) Justificar ante el órgano &lt;span style="color:#000000"&gt;concedente&lt;/span&gt; o la entidad colaboradora, en su caso, el cumplimiento de los requisitos y las condiciones, así como la realización de la actividad y el cumplimiento de la finalidad que determinen la concesión o disfrute de la misma subvención. La justificación de la ejecución de las obras e inversiones municipales deberá realizarse de acuerdo con las condiciones que se determinen en este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c&lt;/em&gt;) Someterse a las actuaciones de comprobación, que debe efectuar el órgano &lt;span style="color:#000000"&gt;concedente&lt;/span&gt; o la entidad colaboradora, en su caso, y cualquier otra de comprobación y control financiero que puedan llevar a cabo los órganos de control competentes, tanto nacionales como comunitarios, aportando toda la información que le sea requerida en el ejercicio de las actuaciones anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d&lt;/em&gt;) Someterse a las actuaciones de comprobación, que debe efectuar el órgano concedente o la entidad colaboradora, en su caso, y cualquier otra de comprobación y control financiero que puedan llevar a cabo los órganos de control competentes, tanto nacionales como comunitarios, aportando toda la información que le sea requerida en el ejercicio de las actuaciones anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt;) Acreditar que está al corriente en el cumplimiento de sus obligaciones tributarias y frente a la Seguridad Social, en la forma que se determine por reglamento, y sin perjuicio de lo establecido en la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;f) Conservar los documentos justificativos de la aplicación de los fondos recibidos, incluidos los documentos electrónicos, en tanto puedan ser objeto de las actuaciones de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;g) Adoptar las medidas de difusión contenidas en el apartado 4 del artículo 18 de la Ley General de Subvenciones, en los términos establecidos en el presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;h) Proceder al reintegro de los fondos percibidos en los casos previstos en el artículo 37 de la Ley General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- El Ayuntamiento deberá realizar la ejecución de las obras e inversiones municipales incluidas en el presente convenio de acuerdo a la normativa vigente en materia de contratación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Asimismo, el Ayuntamiento queda también sometido a todas aquellas obligaciones que se deriven de la Ley 38/2003, de 17 de noviembre, General de Subvenciones y su Reglamento, aprobado por Real Decreto 887/2006, de 21 de julio, y del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones, en todo lo que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quinta.- OBLIGACIONES DEL CONSEJO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El Consejo Insular de Ibiza aportará un importe máximo de un millón cuatrocientos veintiún mil seiscientos veintiún euros con cincuenta y dos céntimos (1.421.621,52 €) al Ayuntamiento por financiar las obras y/o inversiones incluidas en el Plan estratégico de inversiones municipales de &lt;span style="color:#000000"&gt;Ibiza&lt;/span&gt; (PLAN 5) del año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La ayuda económica del Consejo Insular de Ibiza no podrá ser superior a la cuantía debidamente justificada por el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Asimismo, la aportación del Consejo Insular de Ibiza para cada inversión y/u obra individual no podrá superar, en ningún caso, el 75% de su importe total.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La aportación máxima del Consejo a la totalidad de las obras en 2023 será de 1.421.621,52 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Sexta.- COMPATIBILIDAD DE LAS AYUDAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Esta aportación es compatible con cualquier otra ayuda por el mismo concepto que se conceda por parte de otras entidades públicas o privadas, sin perjuicio de la obligación del Ayuntamiento de comunicar este hecho al Consejo Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En ningún caso el importe de las aportaciones y ayudas recibidas por el mismo concepto, aisladamente o en concurrencia, podrá superar el coste total de la obra o inversión, de conformidad con lo dispuesto en el artículo 19 de la Ley 38/ 2003, de 17 de noviembre, General de Subvenciones, y con el artículo 20 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Séptima.- PAGO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Consejo Insular de Ibiza abonará al Ayuntamiento el 100% de la cuantía solicitada para la ejecución del Plan estratégico de inversiones municipales una vez firmado el presente Convenio, en forma de pago adelantado, siempre por un importe máximo de un millón cuatrocientos veintiún mil seiscientos veintiún euros con cincuenta y dos céntimos (1.421.621,52 €). El Ayuntamiento deberá justificar la ejecución de la obra y/o inversión municipal, hasta el importe correspondiente, en la forma establecida en el presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La ayuda económica recibida en virtud de este convenio no podrá ser superior a la cuantía debidamente justificada por el Ayuntamiento. Asimismo, la aportación del Consejo Insular de Ibiza para cada inversión y/u obra individual no podrá superar, en ningún caso, el 75% de su importe total.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;En cualquier caso, atendiendo a la condición de administración local del Ayuntamiento queda exonerado de la constitución de garantía, de conformidad con lo establecido en el artículo 42.2 del Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de desarrollo de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Octava.- JUSTIFICACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Ayuntamiento tendrá que justificar las obras e inversiones totalmente ejecutadas antes de la finalización del convenio. La justificación de los gastos de las obras e inversiones se tendrán que constatar, de conformidad con la disposición adicional novena de la Ley 4/2022, de 28 de junio, de Consejos Insulares, mediante:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;-ANEXO I&lt;/strong&gt; Relación proyecto incluidos en el convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;-ANEXO II&lt;/strong&gt; Relación ordenada de documentación aportada que se incluye en la cuenta justificativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;-ANEXO III &lt;/strong&gt;Memoria técnica del órgano gestor de la subvención con una breve descripción de los proyectos ejecutados e imágenes de los mismos, que acredite la realización de la actividad y el cumplimiento de la finalidad por la que ha recibido la aportación económica (texto redacción libre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;-ANEXO IV&lt;/strong&gt; Certificado emitido por el órgano gestor de la subvención que acredite la realización de la actividad y el cumplimiento de la finalidad para la que han recibido la aportación económica, segundo modelo anexo. (ANEXO IV).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;-ANEXO V&lt;/strong&gt; Certificado/Informe de la Intervención del Ayuntamiento que acredite de forma detallada los gastos realizados en relación con cada obra y la fecha de pago, así como la veracidad y la regularidad de la documentación justificativa aportada, según modelo anexo (ANEXO V).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;-ANEXO VI&lt;/strong&gt; Certificado/Informe del Secretario/a del Ayuntamiento que acredite de la recepción de obras, ayudas recibidas, según modelo anexo (ANEXO VI).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;-ANEXO VII &lt;/strong&gt;Memoria que incluya la acreditación de la publicidad de las obras subvencionadas aportando imágenes, recopilaciones de prensa, certificados de radiación o cualquier documento con el que se pueda acreditar el cumplimiento de esta obligación, de acuerdo con la cláusula novena del presente convenio (texto redacción libre).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Todo lo anterior, sin perjuicio de la obligación de conservación de los documentos justificativos de la aplicación de los fondos recibidos incluidos los documentos electrónicos, en tanto puedan ser objetos de actuaciones de comprobación y control posterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Ayuntamiento presentará la justificación correspondiente a cada obra y/o inversión municipal una vez ésta haya sido totalmente ejecutada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En cuanto al plazo máximo de justificación, en cualquier caso, la justificación de la ejecución de la totalidad de las obras y/o inversiones municipales, siempre y cuando no se haya presentado antes, deberá presentarse antes del 31 de marco 2027, todo de acuerdo con la Ley General de Subvenciones y su reglamento de desarrollo, y de acuerdo con lo que establece la base 23 de las Bases de Ejecución del presupuesto del Consejo Insular de Ibiza de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Novena.- PUBLICIDAD DE LAS OBRAS SUBVENCIONADAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Es voluntad de este Consejo dar a conocer a la sociedad ibicenca la cohesión y cooperación entre todos los municipios de la isla con esta entidad, para lo cual se quiere fomentar el uso y la aplicación del logo y el eslogan PLAN 5 para identificar de inmediato los objetivos de este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Ayuntamiento se compromete a incluir el escudo de Consejo Insular de Ibiza y la imagen del PLAN 5 de acuerdo con las especificaciones que se adjuntan como ANEXO VIII en los carteles informativos, placas, anuncios, folletos y cualquier otro soporte publicitario y/o informativo o de comunicación, sobre la obra o inversión incluida en este convenio, figurando expresamente la colaboración del Consejo Insular de Ibiza tanto en el material y soportes antes mencionados como en las memorias o informes que se puedan derivar del proyecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En cualquier caso, en el espacio físico donde se realice la inversión o la obra se colocará un cartel informativo con la imagen y las dimensiones indicadas, de acuerdo con las especificaciones que también se adjuntan en el ANEXO VIII.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En el caso de obras ejecutadas, deberá incluirse la publicidad establecida en esta cláusula en todas aquellas acciones publicitarias que se puedan realizar en relación con la inversión, así como mediante la mención de la subvención del Consejo Insular de Ibiza en notas de prensa, entrevistas, presentaciones y acciones informativas y de comunicación que se realicen sobre la obra ejecutada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Décima.- COORDINACIÓN DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Consejo de Alcaldes, como órgano de coordinación supramunicipal, realizará la coordinación de la ejecución de los convenios firmados al amparo del Plan estratégico de inversiones municipales (PLAN 5), para el que recibirá, puntualmente, las informaciones de seguimiento de lo mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Undécima.- COMISIÓN BILATERAL PARITARIA DE SEGUIMIENTO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;A partir de la firma del Convenio y con el fin de realizar el seguimiento, la vigilancia y el control de la ejecución del Convenio, así como de los compromisos adquiridos por las partes y de llevar a cabo la coordinación entre éstas, se constituirá una Comisión Bilateral Paritaria de Seguimiento (CBPS), que estará formada por:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a consejero/a ejecutivo/va del Consejo Insular de Ibiza, nombrado/a por el Consejo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a concejal/a, nombrado/a por el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a técnico/a del Ayuntamiento, nombrado/a por el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a técnico/a del Consejo Insular de Ibiza, nombrado/a por el Consejo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- un/a funcionario/a del Consejo Insular de Ibiza, asesor/a jurídico/a, que actuará como secretario/a de la comisión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La Comisión podrá convocar a sus reuniones a las personas asesoras que considere oportuno de acuerdo con los asuntos que deban evaluar en cada sesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;La Comisión resolverá los problemas de interpretación y cumplimiento que puedan plantearse respecto a la ejecución del Convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Duodécima.- REVISIÓN Y MODIFICACIÓN DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Los términos de este Convenio podrán ser revisados&lt;span style="color:#000000"&gt; ​​siem&lt;/span&gt;pre que no alteren el importe de la ayuda total concedida a la finalización o plazo de ejecución del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Cualquier otro tipo de modificación de los términos del presente convenio deberá ser aprobada por las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Las modificaciones del convenio se tramitarán en forma de adenda al mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimotercera.- ÓRGANO COMPETENTE PARA INSTRUIR Y RESOLVER EL PROCEDIMIENTO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;El Departamento de Promoción Económica, Cooperación Municipal y Recursos Humanos del Consejo Insular, es el competente para instruir el procedimiento de este Convenio, de conformidad con el Decreto de Presidencia núm.2023000467, de estructura del gobierno del Consejo Insular de Ibiza y creación de departamentos (BOIB nº 88 de 29 de junio de 2023), que atribuye al Departamento de Promoción Económica Cooperación Municipal y Recursos Humanos "La actividad competencial propia del Consejo Insular en materia de cooperación y asistencia local a los municipios de la isla, recogidas tanto en la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local como en la ley 4/2022, de 28 de junio, de Consejos Insulares .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;En cuanto a la competencia para aprobar este Convenio, de conformidad con la circular de secretaría del Consejo Insular del día 30 de junio de 2023 y según dispone el artículo 28, g de la ley 4/2022 de Consejos Insulares, corresponde al Consejo Ejecutivo “Aprobar los convenios y acuerdos de colaboración y cooperación con otras entidades públicas o sujetos privados, cuando no corresponda expresamente a otros órganos”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimocuarta.-. RESOLUCIÓN Y EXTINCIÓN DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Serán causas de resolución del convenio, además de la determinada por su vigencia:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- El cumplimiento de las actuaciones que constituyen su objeto, al haberse realizado el pago y justificación de la ayuda en su totalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Transcurso del tiempo previsto como duración cuando alguna de las partes manifieste su voluntad de no prorrogar el convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Denuncia del convenio por cualquiera de las partes hecha con un mínimo de tres meses de anticipación a la fecha prevista de extinción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Por acuerdo de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;- Por las causas generales establecidas por la legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El incumplimiento de cualquiera de las partes de las obligaciones establecidas en este convenio podrá ser causa de resolución del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En el caso de divergencia sobre la interpretación y/o ejecución de las cláusulas de este convenio marco, las partes, renunciando a su fuero propio, si las tuvieran, se someten a la competencia de los Juzgados y Tribunales de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimoquinta.- REINTEGRO Y REVOCACIÓN DE LA AYUDA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;1. El incumplimiento de la obligación de justificar la finalidad de la ayuda económica recibida en la forma y los plazos establecidos supondrá, además de la revocación, la imposibilidad de recibir ayudas del Consejo Insular de Ibiza mientras no se haga la devolución del importe reclamado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;2. En caso de reintegro total o parcial procederá aplicar los intereses de demora, de acuerdo con el artículo 44 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido d&lt;span style="color:#000000"&gt;e la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El reintegro se realizará por el procedimiento regulado por las disposiciones generales sobre procedimientos administrativos contenidas en el título IV de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, sin perjuicio de las especialidades que se establecen en la &lt;span style="color:#000000"&gt;Ley &lt;/span&gt;&lt;span style="color:#000000"&gt;General&lt;/span&gt;&lt;span style="color:#000000"&gt; de &lt;/span&gt;&lt;span style="color:#000000"&gt;S&lt;/span&gt;&lt;span style="color:#000000"&gt;ubvenciones &lt;/span&gt;y en su reglamento de desarrollo, en el que debe garantizarse la audiencia a las entidades interesadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;3. De conformidad con el artículo 17.3.n de la Ley General de Subvenciones, en relación con el artículo 37.2 de la misma ley, y con el artículo 13 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones de la comunidad autónoma de las Illes Balears, se establecen los siguientes criterios de graduación del posible incumplimiento material de la actividad objeto de esta subvención, y siempre que la entidad beneficiaria acredite una actuación inequívoca tendente a la satisfacción de sus compromisos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimosexta.- RÉGIMEN JURÍDICO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El presente convenio no tiene carácter contractual sino que articula una subvención, y debe regirse por sus cláusulas, y en todo lo no previsto en el presente Convenio, por la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público, por la Ley 38/2003, de 17 de noviembre, General de Subvenciones, por el Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de desarrollo de la Ley 38/2003, y por el Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el &lt;span style="color:#000000"&gt;texto refundido &lt;/span&gt;de la Ley de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Decimoséptima.- PUBLICIDAD DEL CONVENIO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El presente Convenio se publicará en la Base de Datos Nacional de Subvenciones en los términos expresados ​​en el artículo 18 de la Ley 38/2003, de 17 noviembre, General de Subvenciones (LGS), en el Boletín Oficial de las Illes Balears y en el Portal de Transparencia del Consejo (https://transparencia.conselldeivissa.es), de conformidad con lo establecido en los artículos 5.4 y 8.1 de la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Como muestra de conformidad, se firma este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
