    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El Consejo Ejecutivo del Consejo Insular de Eivissa, en sesión ordinaria el día 30 de octubre de 2023, aprobó la siguiente propuesta de la consejera ejecutiva del Departamento de Promoción Económica, Cooperación Municipal y Recursos Humanos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;“(...)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;PRIMERO.-&lt;/strong&gt; APROBAR y suscribir el Convenio entre el Consejo Insular de Eivissa y el Ayuntamiento de Santa Eulària des Riu para impulsar el fomento del espíritu emprendedor en Eivissa para la promoción de políticas activas de empleo, la promoción económica y el desarrollo local – INGENION 2023 con CSV 14615534762100032355.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;SEGUNDO.-&lt;/strong&gt; APROBAR la dotación económica de la subvención al Ayuntamiento de Santa Eulària con CIF P0705400J por un importe total máximo de diez mil euros (10.000,00 €), con cargo a la aplicación presupuestaria 4220.46206 del vigente presupuesto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;TERCERO.-&lt;/strong&gt; PUBLICAR el presente convenio en el Boletín oficial de las Illes Balears (BOIB) y en la Base Nacional de Datos de Subvenciones (BNDS), una vez aprobado, de conformidad con lo establecido en el artículo 18 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, en el Boletín Oficial de las Islas Baleares y en el Portal de transparencia del Consejo Insular de Eivissa (http://transparencia.conselldeivissa.info), de conformidad con lo establecido en artículos 5.4 y 8.1 de la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno."&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;REUNIDOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;María Fajarnés Costa, consejera ejecutiva de Promoción Económica, Cooperación Municipal y Recursos Humanos del Consejo Insular de Ibiza, nombrada por Decreto de Presidencia n.º 2023000472 (publicado en el BOIB n.º 88, de 29-06-2023), actuando en nombre y representación del Consejo Insular de Ibiza, de conformidad con lo que disponen el artículo 33.2 y) de la Ley 4/2022, de 28 de junio, de consejos insulares, y el artículo 72 del Reglamento orgánico del Consejo Insular de Ibiza, y el apartado tercero, punto 3 b) del Decreto de Presidencia n.º 2023000467, de determinación de las atribuciones correspondientes a los diferentes órganos del Consejo Insular de Ibiza (BOIB n.º 88, de 28-06-2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Carmen Ferrer Torres, alcaldesa del Ayuntamiento de Santa Eulària des Riu, por nombramiento del Pleno de fecha 17 de junio de 2023, en nombre y representación del consistorio de la mencionada ciudad, de conformidad con lo que dispone el artículo 21.1.b de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local (LBRL), asistida por el secretario de esta Corporación en ejercicio de sus funciones de fe pública que le atribuye el artículo 92 bis de la LBRL.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Las partes se reconocen mutuamente la capacidad necesaria para formalizar este Convenio y&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;MANIFIESTAN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;I. &lt;/strong&gt;Que el Consejo Insular de Ibiza (en lo sucesivo, Consejo) y el Ayuntamiento de Santa Eulària des Riu (Ayuntamiento) tienen entre sus finalidades la promoción de la ocupación estable y de calidad de los ciudadanos y ciudadanas de toda la isla de Ibiza, a través, entre otros, del desarrollo de estrategias de promoción económica y desarrollo local y de fomento del espíritu emprendedor, el autoempleo y la creación de empresas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;II&lt;/strong&gt;. Así mismo, el Consejo es competente en materia de cooperación en el fomento del desarrollo económico y social y en la planificación en el territorio insular, de acuerdo con las competencias de las otras administraciones públicas en este ámbito, según la letra d) del artículo 36.1 de la LBRL.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;III&lt;/strong&gt;. Por otro lado, el Ayuntamiento disfruta de la naturaleza de ente local y tiene plena capacidad y personalidad jurídica independiente para el cumplimiento de sus finalidades propias y se rige por los principios de cooperación y colaboración; y en su actuación, por los criterios de eficiencia y servicio a la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Así mismo, en cuanto a la competencia de los municipios en materia de desarrollo económico local, el artículo 29 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, prevé: «1. Además de las competencias derivadas de la legislación básica del Estado y del ejercicio de las que puedan ser delegadas por el Estado, por la comunidad autónoma, por los consejos y por otras administraciones, esta ley garantiza en los municipios un núcleo de competencias propias que tienen que ser ejercidas por estas entidades con plena autonomía, sujeta solo al control de constitucionalidad y legalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Los municipios de las Islas Baleares, en el marco de las leyes, tienen en todo caso competencias propias en las materias siguientes, de entre otras: s) Regulación del establecimiento de autorizaciones y promociones de todo tipos de actividades económicas, especialmente las de carácter comercial, artesanal y turístico, en su territorio; t) Desarrollo económico local y promoción turística de su territorio».&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;IV&lt;/strong&gt;. El Ayuntamiento de Santa Eulària des Riu, a través del IX Foro de Emprendedores Ingenion 2023, da apoyo directo a las personas emprendedoras y pretende ser un punto de encuentro de proyectos, recursos y personas de la isla de Eivissa, en torno a la innovación, en el ámbito profesional y empresarial.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;V&lt;/strong&gt;. Que desde sus inicios, hace ocho años, el Foro de Emprendedores Ingenion ha trabajado para impulsar el crecimiento de las pequeñas y medianas empresas, así como de los autónomos con el fin de mejorar su profesionalización. Alrededor de 2.056 asistentes entre las ocho ediciones, donde se han presentado 86 proyectos empresariales innovadores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;VI&lt;/strong&gt;. Que el coste total subvencionable previsto para la realización de este acontecimiento es de 20.544,71 € (ANEXO I).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;VII&lt;/strong&gt;. Que es voluntad de ambas instituciones que todos los ciudadanos y ciudadanas de la Isla de Ibiza puedan beneficiarse del IX Foro de Emprendedores Ingenion 2023 para fomentar el espíritu emprendedor, la innovación, generar conocimiento, atraer talento empresarial y crear una comunidad entorno al emprendimiento para favorecer la creación y consolidación de las empresas de la isla de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público (LRJSP), establece en su artículo 47.1 que son convenios los acuerdos con efectos jurídicos adoptados por las administraciones públicas, los organismos públicos y las entidades de derecho público vinculados o dependientes o las universidades públicas entre sí o con sujetos de derecho privado para una finalidad común.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por otro lado, en el marco de los principios generales que tienen que regir las relaciones entre las diferentes administraciones públicas de la citada LRJSP, se dispone en el artículo 3 que las administraciones públicas, en sus relaciones, se rigen por los principios de cooperación, colaboración y coordinación; y en su actuación, por los criterios de eficacia y servicio efectivo a los ciudadanos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Y por todo lo expuesto, ambas partes subscriben este Convenio que se rige por las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;ESTIPULACIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Primera.- Objeto del convenio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Es objeto del presente convenio establecer los términos y las condiciones de colaboración entre el Consejo Insular de Ibiza y el Ayuntamiento de Santa Eulària des Riu.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Así mismo, este convenio instrumenta la subvención nominativa prevista en los Presupuestos del Consejo Insular de Ibiza al Ayuntamiento de Santa Eulària des Riu del año 2023, de conformidad con lo establecido en el artículo 48 de la LRJSP; en el artículo 22 2 a) de la Ley 38/2003, de 17 de noviembre, General de Subvenciones (LGS); y en el artículo 65 del RD 887/2006, de 21 de julio, mediante el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones (RLGS).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Segunda.- &lt;span style="color:black"&gt;Obligaciones de las partes&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Ambas partes nos comprometemos con carácter general a ejecutar las actividades objeto de este Convenio de conformidad con los principios de buena administración, buena fe y presunción de legalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Además, el Ayuntamiento se compromete a:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;a) Organizar, gestionar, difundir y realizar el IX Foro de emprendedores Ingenion 2023, los días 9 y 10 de noviembre de 2023, en el Centro cultural de Jesús, con el siguiente contenido:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;TALLERES “FÓRMATE CON INGENION” 2023&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;c) &amp;nbsp;Acreditar ante el Consejo la realización de la actividad objeto del Convenio y presentar la documentación justificativa correspondiente de acuerdo con los requisitos y las condiciones que determinan la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;d) Comunicar al Consejo la obtención, si procede, de cualquier ayuda económica para la misma finalidad durante la vigencia de este Convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;e) &amp;nbsp;Encontrarse al corriente de sus obligaciones con la Hacienda estatal y autonómica, la Seguridad Social y ante la Tesorería del Consejo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;f)&lt;/span&gt; No incurrir en ninguna de las prohibiciones para ser beneficiario de la subvención &amp;nbsp;establecidas en el artículo 13 de la LGS, y en el artículo 10 de texto refundido de la Ley de subvenciones (de las Illes Balears), aprobado por el Decreto Legislativo 2/2005, de 28 de diciembre (TRLGS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;g) Y, en cualquier caso, cumplir con las obligaciones de los beneficiarios previstas en el artículo 11 del TRLGS, en relación con el artículo 14 de la LGS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;El Consejo, por su parte, se compromete a:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;a) Destinar la cantidad de diez mil euros (10.000 €) a cargo de la aplicación presupuestaria 4220.46206, según se prevé en el Plan Estratégico de Subvenciones del Consejo Insular de Ibiza 2023-2025 (*BOIB número 12, de 26 de enero de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;b) Comprobar el cumplimiento de la adecuada justificación de la subvención, así como de la realización de la actividad y el cumplimiento de la finalidad que determinan la concesión o el disfrute de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;Tercera.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; &lt;strong&gt;&lt;span style="color:black"&gt;Compatibilidad con otras ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Esta aportación es compatible con la concesión de otras ayudas por el mismo concepto por parte de otras entidades públicas o privadas, sin perjuicio de la obligación del Ayuntamiento de Santa Eulària des Riu de comunicarlo al Consejo Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En ningún caso el importe de las aportaciones y las ayudas recibidas puede superar el coste de la actividad, según el presupuesto que obra en el anexo del presente convenio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Cuarta.- Pago&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El pago de la subvención nominativa del Consell al Ayuntamiento, objeto del presente convenio, se efectuará en un único pago en el plazo máximo de 30 días desde la presentación &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;por parte del Ayuntamiento de Santa Eulària des Riu de la documentación justificativa que se especifica en la estipulación quinta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Quinta.- Justificación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Para la justificación del Convenio, el Ayuntamiento deberá presentar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;1.- Certificado de la secretaría del Ayuntamiento de Santa Eulària des Riu en el que se acredite el conjunto de las obligaciones reconocidas y pagadas en cumplimiento del objeto de este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El incumplimiento de la obligación de justificación de la subvención en los términos establecidos en el presente convenio o la justificación insuficiente de la misma comportará la reducción proporcional de la parte no ejecutada del presupuesto que figura en el anexo I del convenio. En caso de total incumplimiento, su revocación en aplicación de la LGS. Las causas de reintegro y el procedimiento para su exigencia deben ser regidos por lo establecido en el artículo 44 del TRLGS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;2.- Memoria técnica de las actividades realizadas, que deberá especificar los usuarios del servicio indicando los que son residentes en el municipio y cuáles son de fuera del municipio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Esta memoria deberá indicar todas las acciones realizadas y su coste.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;La justificación de este convenio se realizará antes del 15 de diciembre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;3.- Si la documentación presentada es incompleta o incorrecta, el servicio responsable pedirá al Ayuntamiento que haga la rectificación oportuna en el plazo improrrogable de (siete) 7 días hábiles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;4.- En ningún caso serán gastos subvencionables y, por tanto, no podrán formar parte del presupuesto subvencionable ni del presupuesto del proyecto, los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Gastos que no cumplan los requisitos establecidos por la normativa específica en materia de subvenciones aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Los gastos financieros, de asesoría jurídica o financiera, notariales y registrales, y los periciales para la realización del proyecto subvencionable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Los intereses deudores de las cuentas bancarias, los recargos y sanciones administrativas y los gastos de procedimientos judiciales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Los impuestos indirectos, cuando sean susceptibles de recuperación o compensación y los impuestos sobre la renta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Los gastos relativos a comidas, tentempiés, servicios de comidas u otros parecidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- Los gastos de inversión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;- En ningún caso será gasto subvencionable el impuesto de valor añadido (IVA), excepto el IVA no recuperable cuando sea costeado de forma efectiva y definitiva por el beneficiario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si el gasto justificado supera el importe concedido, la posible desviación presupuestaria correrá a cargo de la entidad subvencionada. Si, por el contrario, el gasto justificado es inferior al &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;importe del presupuesto solicitado y subvencionado, se reducirá proporcionalmente la subvención concedida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El Consell podrá inspeccionar las actividades subvencionables, sin perjuicio de las competencias que puedan corresponder, por normativa legal o reglamentaria, a otros organismos o instituciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Sexta.- Requisitos de contratación&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Cuando el importe del gasto subvencionable supere las cantidades establecidas en la Ley 9/2017, de 8 de octubre, de contratos del sector público, por la que se transponen al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/2013/UE y 2014/24/UE, de 26 de febrero de 2014, para el contrato menor, el Ayuntamiento deberá seguir los trámites y procedimientos previstos en esta ley para su contratación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Séptima.- Mecanismos de seguimiento&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El seguimiento y evaluación del desarrollo de este Convenio, así como la resolución de las incidencias que las partes detecten, se articulará a partir de reuniones de coordinación de carácter técnico promovidas a instancia de cualquiera de las dos partes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las controversias que puedan plantearse sobre la interpretación y ejecución de este Convenio se intentarán resolver por mutuo acuerdo de las partes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Octava.- Modificación del convenio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Cualquier modificación que altere las condiciones establecidas en este Convenio se pactará por acuerdo escrito de las partes. En cualquier caso, el documento en el que se formalice la posible modificación se adjuntará a este Convenio como una adenda.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Novena. Publicidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El presente Convenio se publicará en la Base de Datos Nacional de Subvenciones en los términos expresados en el artículo 18 de la LGS, en el Boletín Oficial de las Illes Balears y en el Portal de Transparencia del Consejo (http://transparencia.conselldeivissa.es), de conformidad con lo establecido en los artículos 5.4 y 8.1 de la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Además, debe enviarse la documentación sobre los convenios a la Sindicatura de Cuentas de conformidad con lo establecido en el artículo 1.2 de la Instrucción relativa al envío a la Sindicatura de Cuentas de la información sobre los convenios formalizados por las entidades del sector público local de las Islas Baleares (BOIB núm. 161, de 24-12-16), en relación con el artículo 53 de la LRJSP.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Décima.- Difusión de la colaboración del Consell Insular&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El Ayuntamiento &amp;nbsp;se compromete a que en los carteles, anuncios, folletos, stands y en todo el material relativo a las actividades objeto de este convenio figurará expresamente la colaboración del Consell, y su logotipo. También hará constar esta colaboración en su memoria anual.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Undécima.- Reintegro y revocación de la ayuda&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Si con la documentación presentada no se llega a justificar el 100% del gasto previsto para la actividad objeto del Convenio, la ayuda se reducirá proporcionalmente al gasto justificado, de modo que la ayuda cubra sólo los gastos correctamente justificados .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El incumplimiento de la obligación de justificar la finalidad de la ayuda económica recibida en la forma y los plazos establecidos supondrá, además de la revocación, la imposibilidad de recibir ayudas del Consell mientras no se realice la devolución del importe reclamado .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Si durante la instrucción del expediente o en el transcurso de los cuatro años posteriores a la concesión de la ayuda se observaran incumplimientos parciales o totales de las actividades objeto de este Convenio, el importe subvencionado podrá ser sometido a reintegro. En este sentido, de conformidad con el artículo 17.3 n de la LGS, en relación con el artículo 37.2 de la misma ley, se establecen los siguientes criterios de graduación del posible incumplimiento material de la actividad objeto de esta subvención, y siempre que los beneficiarios acrediten una actuación inequívoca tendente a la satisfacción de sus compromisos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El órgano instructor aplicará estos criterios para determinar la cantidad que finalmente tendrá que percibir la entidad beneficiaria, o en su caso, el importe a reintegrar.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;De acuerdo con lo que dispone el artículo 43 del TRLGS, se revocará la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho, el beneficiario incumpla total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. En tal caso, quedará sin efecto el acto de concesión, como consecuencia de la revocación, y procederá reintegrar total o parcialmente la ayuda recibida por la entidad beneficiaria y, en su caso, la exigencia del interés de demora, en los casos previstos en el artículo 44 del TRLGS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El reintegro se realizará por el procedimiento regulado por las disposiciones generales sobre procedimientos administrativos contenidas en el título IV de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, sin perjuicio de las especialidades que se establecen en la LGS y en el RLGS, en el que debe garantizarse la audiencia a las entidades interesadas. Las cantidades reintegrables tendrán la consideración de ingresos de derecho público y podrán ser exigidas por la vía de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El régimen de infracciones y sanciones administrativas aplicables será el establecido en el título IV de la LGS, y en el título V del TRLGS. Todo ello sin perjuicio de las responsabilidades penales o civiles en las que pueda incurrirse.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Duodécima.- Régimen jurídico y jurisdicción competente&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Este Convenio de colaboración tiene la naturaleza que prevé el artículo 6 de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, y, por tanto, está excluido del ámbito de su aplicación, y se debe regir por sus cláusulas, y en todo lo no previsto en el presente Convenio, por la LRJSP, por la LGS, por el RLGS, y por el TRLGS.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;En la realización de las actividades objeto de este Convenio deben observarse las prescripciones contenidas en la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos y garantía de los derechos digitales, en el Reglamento (UE) 2016/ 679 del Parlamento y del Consejo, de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que se refiere al tratamiento de datos personales y a la libre circulación de estos datos y por el que se deroga la Directiva 95/46/ CE (Reglamento general de protección de datos -DOUE 4-5-2016-), y en el resto de legislación vigente en materia de protección de datos personales, que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Las partes que suscribimos este Convenio nos comprometemos a intentar resolver en común las diferencias que puedan surgir en su aplicación y en su interpretación. Pero si esto no fuera posible, las cuestiones litigiosas que puedan afectar a la interpretación y ejecución del presente Convenio serán de conocimiento y competencia del orden jurisdiccional contencioso-administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;Decimotercera.- Vigencia&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;El presente Convenio de Colaboración tendrá vigencia desde la fecha de su firma hasta el día 31 de enero de 2024, y no se contempla en ningún caso su prórroga.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;Y, en prueba de conformidad, firman este documento, en dos ejemplares, en el lugar y fecha indicados en el encabezamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
