    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con lo dispuesto en el artículo 45 de la Ley 39/2015 de 1 de octubre, del Procedimiento Administrativo Común de las administraciones públicas, se publica que por decreto de Alcaldía de día 25 de octubre de 2023 se aprobó la modificación y ampliación del plazo establecido en las Bases de la segunda convocatoria del proceso de asignación de licencias para el uso privativo de las parcelas y/o los bloques con mesas de cultivo del huerto urbano de la área de servicios sociales del Ayuntamiento de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;BASES REGULADORAS DE LA MODIFICACIÓN Y AMPLIACIÓN DE LA SEGUNDA CONVOCATORIA DEL PROCESO DE ASIGNACIÓN DE LICENCIAS PARA EL USO PRIVATIVO DE PARCELAS Y/O BLOQUES CON MESAS DE CULTIVOS DEL HUERTO URBANO DEL ÁREA DE SERVICIOS SOCIALES DEL AYUNTAMIENTO DE MARRATXÍ&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Desde el Ayuntamiento de Marratxí se pretende dar una continuidad al programa de participación ciudadana habilitado por el Área de Servicios Sociales del Ayuntamiento de Marratxí “Huertos Urbanos”.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Este programa se puso en funcionamiento por primera vez en el año 2019. Como consecuencia del tiempo transcurrido, ya ha finalizado el primer período de licencias y, por tanto, se procede a abrir una segunda convocatoria, además de establecer unas nuevas Bases Reguladoras que introducen los cambios que se han considerado necesarios a raíz de la primera experiencia vivida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1. OBJETO DE LA CONVOCATORIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El objeto de estas bases es regular la cesión, mediante autorización temporal y después de convocatoria pública, del uso privativo de bienes de dominio público municipal y, en concreto, de pequeñas parcelas de cultivo y de un espacio con mesas de cultivos (reservado por personas con diversidad funcional) con el fin de crear espacios de participación ciudadana.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las personas o entidades beneficiarias tendrán que desarrollar las actividades propias de cultivos ecológicos de un huerto en la parcela otorgada por el Ayuntamiento de Marratxí, en concreto:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1) Las siembras, el mantenimiento, el orden y la limpieza de la parcela asignada y de los espacios comunes; así como del material propio y comunitario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2) El seguimiento de los principios de la agricultura ecológica y las recomendaciones que pueda establecer el Área de Servicios Sociales del Ayuntamiento de Marratxí al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A cargo del Ayuntamiento irá:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1) Los gastos de agua.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2) La supervisión por parte de las personas profesionales agrarias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3) El seguimiento del personal técnico del Área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4) Equipo básico de herramientas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5) Abonos y compuestos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6) Mantenimiento de las áreas comunes y el sistema de riego.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. CARACTERÍSTICAS DE LOS HUERTOS URBANOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El huerto urbano se localiza en el núcleo de Sa Cabana, Marratxí. Consta de 20 parcelas (se adjunta plano de situación y de las parcelas), cuya adjudicación se hará en dos lotes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Lote 1: personas físicas&lt;/strong&gt;. Se destinarán a este lote 17 parcelas (Anexo IV).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El huerto urbano dispone de 3 mesas de cultivo (equivalente a una parcela) adaptadas por aquellas personas que se desplazan en silla de ruedas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Lote 2: asociaciones o entidades sin ánimo de lucro&lt;/strong&gt; Se destinarán tres (3) parcelas para el uso de asociaciones o entidades sin ánimo de lucro (Anexo IV).&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de que las parcelas de este lote se quedaran sin uso (ya sea en el momento de resolver la convocatoria, ya sea durante la vigencia de la licencia) se adjudicarán a quien corresponda del Lote 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3. PERSONAS BENEFICIARIAS Y REQUISITOS DE ESTOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cuanto al uso privativo de dominio público de las parcelas de cultivo, las personas beneficiarias del Huerto Urbano de Marratxí tendrán que cumplir, en el momento del plazo de presentación de solicitudes, los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) LOTE 1: personas físicas&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tener al menos 18 años cumplidos.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar empadronado o empadronada y residir en el municipio de Marratxí y tener las capacidades y aptitudes, tanto físicas como psíquicas, que sean necesarias para desempeñar las funciones atribuidas al huerto urbano.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No haber sido privado del uso privativo por el cultivo de los huertos urbanos en el municipio de Marratxí u otras localidades, mediante expediente con resolución firme.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No disponer del uso de otro huerto municipal.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Formular declaración expresa, en el escrito de formalización de la licencia, que se encuentra al corriente en cuanto al cumplimiento de las obligaciones tributarias.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Lote 2: asociaciones o entidades sin ánimo de lucro&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El objeto social debe incluir actividades sociales, divulgativas, formativas o de sensibilización.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Tener domicilio social o sede social en el municipio de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar registrada en el Registro Municipal de entidades del municipio de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;No haber sido privada del uso privativo de parte de un huerto urbano, del municipio o de otro.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Formular declaración expresa, en el escrito de formalización de la licencia, que se encuentra al corriente en cuanto al cumplimiento de las obligaciones tributarias.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los anteriores requisitos, por ambos lotes, deberán mantenerse durante la vigencia de la licencia. El Ayuntamiento, podrá, en todo momento, realizar controles sobre la concurrencia de dichos requisitos, pudiendo proceder, en su caso, a la revocación de las licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4. SOLICITUD, LUGAR Y PLAZO DE PRESENTACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dentro del plazo de 15 días hábiles, desde el día siguiente a la fecha de publicación de las presentes Bases en el tablón de edictos de la Sede Electrónica del Ayuntamiento de Marratxí, las personas interesadas podrán presentar una solicitud de licencia de uso privativo de los huertos urbanos del Ayuntamiento de Marratxí según modelo normalizado (que se acompaña como Anexo I para las personas físicas, y Anexo II para las asociaciones o entidades sin ánimo de lucro), junto con toda la documentación requerida según el tipo de lote a que se opte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las &lt;strong&gt;asociaciones o entidades sin ánimo de lucro&lt;/strong&gt; están obligadas a relacionarse a través de medios electrónicos con las Administraciones Públicas, por lo que presentarán su solicitud preferentemente de forma telemática en la Sede Electrónica del Ayuntamiento de Marratxí (https:/ /seuelectronica.marratxi.es), sin perjuicio de utilizar cualquier otro medio electrónico a su alcance.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las solicitudes de las &lt;strong&gt;personas físicas&lt;/strong&gt;, además de lo anterior, pueden presentarse en cualquiera de los siguientes registros municipales, &lt;strong&gt;previa solicitud de cita&lt;/strong&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Igualmente podrá utilizarse para su registro cualquiera de los medios establecidos en el artículo 16.4 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Sólo se admite una solicitud por cada solicitante, y por tanto, sólo podrán resultar beneficiarios de una única parcela.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Se entiende que la presentación de una solicitud implica la íntegra aceptación de las presentes bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;5. DOCUMENTACIÓN A APORTAR&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todas las personas interesadas en la adjudicación de un huerto, tanto físicas como jurídicas, deben presentar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Lote 1 - Personas físicas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Solicitud según anexo I, adecuadamente cumplimentada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Fotocopia del documento de identidad (DNI, NIE, pasaporte o tarjeta de residencia).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Documentación acreditativa de ingresos (todos los miembros de la unidad familiar):&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. Trabajadores/as por cuenta de otro/a: nómina o nóminas del más anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. Trabajadores/as por cuenta propia: modelo 130 autoliquidación del pago fraccionado del IRPF o el modelo 131 de autoliquidación trimestral del pago fraccionado del IRPF.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c. Personas perceptoras de RESOGA o IMV, resolución con el importe concedido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d. Persona pensionista que no desarrolle ninguna actividad que le aporte rendimientos de trabajo, certificado de la pensión&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e. Personas perceptoras de prestaciones SEPE: Resolución con el importe de la prestación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f. Otra documentación que la persona solicitante considere necesaria para la acreditación de su situación socioeconómica. Declaración responsable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Certificado de discapacidad, en caso de:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a. Tener algún miembro de la unidad familiar con discapacidad&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b. Optar a las mesas de cultivo adaptadas&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. En caso de haber sufrido violencia de género, aportar el documento que acredite la situación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. Compromiso de cumplimiento de las obligaciones estipuladas por el uso de los huertos urbanos (anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Lote 2 - Asociaciones o entidades sin ánimo de lucro&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;a) Solicitud según anexo II.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;b) Original o copia compulsada de los estatutos de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;c) Fotocopia del CIF de la entidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;d) Una memoria en la que se justificará documentalmente la realización de actividades sociales, divulgativas, formativas o de sensibilización durante el año anterior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;e) DNI de la persona representante legal&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;f) Lista de las personas que han desarrollado el proyecto en nombre de la asociación o entidad, con declaración de que cumplen con todos los requisitos del apartado 3 de estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;g) Compromiso de cumplimiento de las obligaciones estipuladas por el uso de huertos urbanos (anexo III)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento podrá solicitar cualquier otra documentación complementaria a la prevista en las presentes bases, para completar o esclarecer el derecho a licencia o la documentación presentada. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de que no se aporte la documentación establecida, o la solicitada posteriormente, se dará a las personas solicitantes por desistidas del procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;6. CRITERIOS DE VALORACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Lote 1 - Personas físicas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La proporción de huerto estará dada en función de la puntuación obtenida según los siguientes apartados. En caso de empate se tendrá en cuenta el orden de entrada de las solicitudes en el registro general municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La adjudicación de las mesas de cultivo a las personas con diversidad funcional, por el contrario, se realizará por riguroso orden de registro de entrada de las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Más de 4.500 € - 0 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;A los efectos de esta convocatoria y para el cómputo de ingresos, es unidad familiar conviviente la integrada para los padres/madres o tutores/as legales y los hijos/as, así como los menores a cargo en acogimiento familiar, debidamente acreditado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En los siguientes casos se sumará la siguiente puntuación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ser beneficiario de la renta mínima de inserción 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar parado sin prestación por desempleo 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estar parado con prestación por desempleo 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ser mayor de 65 años o pensionista 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;2. Diversidad funcional&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por diversidad funcional; física, psíquica o sensorial en la unidad familiar con calificación de discapacidad ≥ a un 33% 2 puntos por cada miembro con diversidad funcional con un máximo de 6 puntos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;3. Situación familiar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Familia numerosa 3 hijos/ hijas 2 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Más de 3 hijos/ hijas 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Embarazos múltiples (gemelos o gemelas) 1 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Familia monoparental (Un solo progenitor, viudedad o separación y depender económicamente de un progenitor). 3 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Situación de violencia de género 2 puntos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Lote 2 - asociaciones o entidades sin ánimo de lucro&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La adjudicación de estas parcelas se llevará a cabo por riguroso orden de registro de entrada de solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;7. ÓRGANO INSTRUCTOR Y COMISIÓN TÉCNICA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El órgano instructor será el Área de Servicios Sociales, que se encargará de elevar a la comisión técnica las valoraciones y propuestas provisionales que correspondan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Comisión Técnica estará integrada por la persona que ostente la concejalía delegada de los Servicios Sociales, una persona técnica del Área, la persona que ocupe el puesto de Secretaría y un Técnico de la Administración General (o las personas en quien deleguen).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Comisión, levantará un acta detallada de cada una de las intervenciones que realice y trasladará las actas y propuestas de resolución que resulten necesarias de acuerdo con las presentes bases para llevar a cabo el proceso de admisión y adjudicación de las licencias.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Podrá resolver cualquier punto o incidencia que se plantee.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las funciones de esta comisión serán las siguientes, a propuesta del órgano instructor:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Admitir o excluir las solicitudes que corresponda, en relación con los requisitos que se enmarcan en estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Evaluar y baremar cada una de las solicitudes válidamente presentadas según los criterios de valoración.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;8. PROCEDIMIENTO PARA LA CONCESIÓN DE LAS LICENCIAS.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Finalizado el plazo de presentación de solicitudes, el Área de Servicios Sociales (órgano instructor) comprobará que las personas interesadas cumplen los requisitos, evaluará provisionalmente las solicitudes y convocará a la Comisión Técnica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La Comisión Técnica realizará, en función de la puntuación obtenida, una propuesta de adjudicación de los huertos por cada uno de los lotes, con la lista de personas admitidas (y su valoración), las personas en lista de espera y las personas excluidas ( indicando la causa de la exclusión).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Esta propuesta será publicada, con la apertura de un plazo de cinco días hábiles para la presentación de alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez finalizado el plazo de alegaciones, en caso de que no se presenten, la propuesta será elevada para la aprobación de la adjudicación por Decreto de la Concejala de Servicios Sociales, por delegación del sr. Alcalde, que también deberá ser publicada. En el caso de presentación de alegaciones, éstas serán informadas por la comisión antes de dictar la citada resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La notificación a las personas adjudicatarias se realizará con indicación del plazo y el lugar en el que tendrán que comparecer para formalizar la licencia de acuerdo con el documento que se adjunta como anexo, con la advertencia de que si no comparecen, el ayuntamiento podrá servirse de las listas de espera para nombrar a una nueva o nuevas personas adjudicatarias siguiendo el orden establecido en las bases, formalizando adecuada licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El plazo máximo para resolver el procedimiento será de 3 meses a contar desde la finalización del plazo para presentar solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;9. DURACIÓN DE LAS LICENCIAS, PRECIO Y GARANTÍA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La adjudicación del uso privativo de las parcelas de cultivo de los huertos, por cualquiera de los lotes, se otorgará por un período inicial de un año, a contar a partir del día siguiente de la recepción de la notificación de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las licencias se prorrogarán de oficio por períodos de un año, hasta llegar a un máximo total de 3 años, salvo que antes de este plazo tenga lugar la renuncia o revocación de la licencia.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Estas prórrogas de oficio requerirán informe favorable del Área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La autorización para la utilización privativa de los huertos urbanos será gratuita, al no llevar aparejada una utilidad económica para la persona autorizada. Tampoco será necesario presentar o constituir ninguna garantía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;10. PERSONAS DE APOYO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las personas físicas beneficiarias del uso de parcelas de cultivo desarrollarán personalmente las actividades objeto de la concesión a otorgar, aunque podrán contar con el &lt;strong&gt;apoyo de una persona&lt;/strong&gt; quien podrá ayudar a sustituirla cuando sea necesario. La persona beneficiaria responderá íntegramente por los actos de esta persona de apoyo, que tendrán que ajustarse en todo momento a estas bases.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La &lt;strong&gt;persona de apoyo&lt;/strong&gt; deberá reunir los siguientes requisitos desde su inicio:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Estar empadronado y residir en el municipio de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Deberá ser mayor de 18 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. No haber sido privada del uso privativo por parte de un huerto urbano, del municipio o de otro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. No disponer, en concepto de persona adjudicatario, del uso de ningún otro huerto, municipal o privado, en el municipio de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La persona beneficiaria tendrá la obligación de comunicar a la persona técnica del Área de Servicios Sociales, el momento en que se quiera disponer de la persona de apoyo. Dando su nombre, apellidos, DNI y domicilio a efectos de notificaciones. Además, deberá aportar una declaración jurada firmada por aquella persona que cumpla con los requisitos mencionados anteriormente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El Ayuntamiento podrá acordar en cualquier momento que las personas que presten apoyo cesen en sus funciones si se comprueba que no cumplen los requisitos o por razones debidamente justificadas en el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;11. LISTAS DE ESPERA Y SU VIGENCIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las personas admitidas que no sean adjudicatarias de ningún huerto permanecerán en una lista de personas suplentes, según el lugar en el que hayan quedado según la puntuación obtenida. En caso de empate, el orden se determinará en función de la fecha de solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Cuando exista un huerto vacante, se ofrecerá de acuerdo con el orden estricto de prelación de la lista de espera correspondiente al tipo de persona solicitante. La notificación debe realizarse por correo electrónico o por vía telefónica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si la persona solicitante a quien se ofrece el cultivo de un huerto no manifiesta en el plazo de tres días la conformidad con la propuesta, se entiende que renuncia al cultivo del huerto urbano y se le excluye del adjudicación, aunque puede continuar en la lista de espera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En caso de que quede vacía alguna parcela quedará abierto, durante todo el período de licencia, el procedimiento de adjudicación. En este caso, sólo se tendrán que cumplir los requisitos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;12. PUBLICIDAD DE LA CONVOCATORIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Una vez aprobadas estas bases por el Área de los Servicios Sociales, la convocatoria se publicará en el Boletín Oficial de las Islas Baleares, en el tablón de edictos de la Sede Electrónica del Ayuntamiento de Marratxí (http://www.marratxi.es), además de los demás medios de difusión que considere el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Las propuestas y resoluciones definitivas se notificarán a las personas interesadas como mínimo mediante anuncio publicado en la página web del Ayuntamiento de Marratxí. En el caso de la adjudicación también debe notificarse por vía telefónica y/o correo electrónico.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los plazos de recurso contra las resoluciones definitivas y los actos de trámite calificado, que son los mismos que los contemplados en el apartado 15 de las presentes bases, se contarán a partir del día siguiente a aquél en que tenga lugar esta publicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;13.- LEGISLACIÓN SUPLETORIA E INTERPRETACIÓN DE LAS BASES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En todo lo no previsto en las presentes bases regirá el Reglamento regulador del régimen de uso de huertos ecológicos urbanos del municipio de Marratxí. Igualmente, le serán de aplicación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los preceptos básicos de la ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los preceptos básicos de la Ley 33/2003, de 3 de noviembre, del Patrimonio de las Administraciones Públicas&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Real Decreto 1372/1986, de 13 de junio, por el que se aprueba el Reglamento de Bienes de las Entidades Locales.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Legislación estatal no básica en materia de régimen local y bienes públicos&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Resto de disposiciones legales y reglamentarias de los ordenamientos jurídicos administrativo y civil&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Para todas aquellas cuestiones no contempladas en las presentes Bases, y la interpretación de las dudas que puedan surgir en su aplicación, será competente el órgano con facultades para tramitar las mismas, que queda autorizado para dictar aquellos actos que sean precisos por a su desarrollo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;14.- PROTECCIÓN DE DATOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;De conformidad con lo que se prevé en la Ley orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Responsable del tratamiento de sus datos&lt;/strong&gt;: Ayuntamiento de Marratxí (CIF: P0703600G, Camino de n'Olesa, 66 – 07141 Marratxí, Illes Balears), único destinatario de la información aportada voluntariamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Finalidad del tratamiento de los datos: &lt;/strong&gt;Gestionar la solicitud de licencia de uso privativo de parcelas y/o bloques con tablas de cultivos del huerto urbano del Área de Servicios Sociales del Ayuntamiento de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Tiempo de conservación de los datos: &lt;/strong&gt;Durante el plazo de vigencia de este expediente. Sin embargo, los datos serán conservados con fines de archivo de interés público o fines Estadísticos&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Legitimación para el tratamiento de los datos&lt;/strong&gt;: Ejercicio de los poderes públicos o competencias propias&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Cesión a terceras personas: &lt;/strong&gt;Los datos cedidos NO serán cedidos a terceras personas ajenas al Ayuntamiento de Marratxí, salvo que deban ser comunicados a otras entidades públicas por imperativo legal&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Derechos: &lt;/strong&gt;Derecho de acceso a sus datos, solicitar su rectificación o, en su caso, cancelación, oposición o solicitar su supresión. Podrá solicitar la limitación del tratamiento de sus datos o, en su caso, oponerse al tratamiento de éstos. Para ejercer los expresados derechos podrá hacerlo a través de los siguientes medios:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Presencialmente, mediante escrito presentado en el Registro General del Ayuntamiento de Marratxí, oa través de cualquiera de los medios establecidos en el art. 16.4 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por correo electrónico dirigido al Delegado/a de Protección de Datos: delegatpd@marratxi.es&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;15. RÉGIMEN DE RECURSOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La resolución por la que se aprueban las presentes bases y convocatoria pone fin a la vía administrativa, pudiendo interponer contra la misma, alternativamente, o recurso de reposición potestativo, en el plazo de un mes ante el mismo órgano que dictó el acto, o recurso contencioso administrativo, ante los Juzgados de lo Contencioso-Administrativo de Palma, en el plazo de dos meses, a contar desde el día siguiente a la publicación de esta resolución. Si se optara por interponer el recurso de reposición potestativo no podrá interponerse recurso contencioso administrativo hasta que aquél sea resuelto expresamente o haya producido desestimación por silencio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Todo lo anterior, sin perjuicio de que se pueda ejercitar cualquier otro recurso que se estime pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
