    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con lo que disponen los artículos 43.3 y 46.1 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales, aprobado por Real Decreto 2568/1986, de 28 de noviembre, se publica en el BOIB el siguiente acuerdo que literalmente dice:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Expediente núm.:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; 2017/2018&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Procedimento:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Alteración de Bienes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACUERDO DE PLENO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Considerando que, por Provisión de Alcaldía de fecha 18 de junio de 2018, se inició expediente relativo a la desafectación del bien «TRAMO CALLE CAMINO DE CAUBET» propiedad de este Ayuntamiento, cambiando su calificación de bien de dominio público a bien patrimonial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Considerando que, con fecha 19 de junio de 2018, se emitió informe de Secretaría en relación con el procedimiento y la Legislación aplicable para llevar a cabo la desafectación del bien de dominio público referenciado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Considerando que, con fecha 19 de noviembre de 2019, se emitió informe por los Servicios Técnicos sobre la oportunidad o necesidad de la desafectación del bien mueble, según la Legislación vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Visto que en fecha 19 de mayo de 2021, el Pleno de la Corporación tomó el acuerdo de aprobar inicialmente la desafectación del bien de dominio público tramo del camino de Caubet de una superficie de 128m2, en cumplimiento del CONVENIO PERMUTA TERRENOS POR ACONDICIONAMIENTO DE UN TRAMO DEL CAMINO DE CAUBET- BUNYOLA firmado el 24 de mayo de 2018, pasando de bien de dominio público a bien patrimonial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dado que, en fecha 05 de junio de 2021 se publicó dicho acuerdo en el BOIB núm. 74 y también se publicó dicho acuerdo en el tablón de anuncios de la sede electrónica de este ayuntamiento, sin que se presentaran Alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Y visto el Informe de Secretaría que determina que corresponde al Ayuntamiento Pleno acordar la alteración de la calificación jurídica de los bienes, previo expediente en el que se motive su oportunidad o necesidad, con el voto favorable de la mayoría absoluta del número legal de miembros de la Corporación, se propone al Pleno la adopción de lo siguiente,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACUERDO&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobar definitivamente la desafectación del bien de dominio público tramo del camino de Caubet de una superficie de 128m2, en cumplimiento del CONVENIO PERMUTA TERRENOS POR ACONDICIONAMIENTO DE UN TRAMO DEL CAMINO DE CAUBET - BUNYOLA firmado el 24 de mayo de 2018, pasando de bien de dominio público en bien patrimonial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGUNDO. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Publicar el presente acuerdo en el Boletín Oficial de las Illes Balears y en el tablón de anuncios del Ayuntamiento de la sede electrónica de este Ayuntamiento &amp;nbsp;[http://bunyola.sedelectronica.es]. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCERO.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Notificar el presente acuerdo a los interesados, firmantes del citado Convenio, por su conocimiento, y efectos pertinentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
