El 27 de mayo de 2023, se publicó la Resolución del consejero de Fondos Europeos, Universidad y Cultura de 24 de mayo de 2023 por la que se convocan subvenciones para apoyar la movilidad en la proyección exterior de las actividades y de los proyectos que promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears en 2023 (BOIB núm. 70).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. El objeto de esta convocatoria es contribuir a la proyección exterior y apoyar económicamente la movilidad de las entidades sin ánimo de lucro de las Illes Balears que lleven a cabo actividades y proyectos que den a conocer, fomenten, difundan y promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears, que se concretan, en particular, en los ámbitos expuestos en el artículo 3 de la Ley 18/2019, de 8 de abril, de salvaguardia del patrimonio cultural inmaterial de las Illes Balears.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Las entidades que figuran en el anexo 1 y el anexo 2 de la presente resolución presentaron en la Consejería de Fondos Europeos, Universidad y Cultura (actual Consejería de Turismo, Cultura y Deportes) una solicitud de subvención para apoyar la movilidad en la proyección exterior de las actividades y de los proyectos que promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears en 2023.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. El personal técnico de la Dirección general de Cultura examinó las solicitudes presentadas y, sobre aquellas que figuran en el anexo 1, está conforme en los siguientes puntos:&nbsp;</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las entidades solicitantes, por su naturaleza, pueden ser beneficiarias de las subvenciones objeto de la convocatoria.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las entidades solicitantes han presentado las solicitudes en tiempo y forma y han adjuntado la documentación exigida en la convocatoria.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las entidades solicitantes han declarado que están al corriente de las obligaciones con la Seguridad Social y de las obligaciones tributarias con la Administración del Estado y la Administración de la Comunidad Autónoma de las Illes Balears. Este hecho ha sido comprobado por el personal técnico de la Dirección General de Cultura.</span></span></span></span></li> </ul> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. El 18 de septiembre de 2023, se publicó en la página web de la Dirección General de Cultura la propuesta de resolución del director general de Cultura de 15 de septiembre de 2023 sobre la concesión y denegación de subvenciones para apoyar la movilidad en la proyección exterior de las actividades y de los proyectos que promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears en 2023, en la que se concedían diez días a contar desde el día siguiente al de su publicación para presentar alegaciones y renuncias.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">6. No se presentó ninguna alegación ni renuncia en relación con la propuesta de resolución mencionada en el apartado anterior.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">7. El 26 de octubre de 2023, se publicó la Resolución del consejero de Turismo, Cultura y Deportes de 20 de octubre de 2023 sobre la concesión y denegación de subvenciones para apoyar la movilidad en la proyección exterior de las actividades y de los proyectos que promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears en 2023 (BOIB núm. 145).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8. Se ha advertido un error en el anexo 1 de la Resolución mencionada en el apartado anterior, puesto que la suma de las dos subvenciones concedidas a la entidad Sa Colla de l'Horta, que son 6.302,40 euros (3.002,40 euros por el expediente PCI-07/2023 i 3.300,00 euros por el expediente PCI-09/2023), supera el máximo establecido en el punto 8.1 de la convocatoria, según el cual el importe máximo total que puede concederse por entidad solicitante es de 6.000 euros.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">9. Por ello, es preciso aminorar de 3.300,00 euros a 2.997,60 euros el importe concedido a la entidad Sa Colla de l'Horta por el proyecto Encuentro Nacional de Danzas Villa de Gallur en Zaragoza (expediente PCI-09/2023), que corresponde a la segunda solicitud presentada.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">10. Con dicha aminoración se produce un remanente de fondos de 302,40 euros que debe redistribuirse entre las entidades que han presentado correctamente las solicitudes, respetando el orden de prelación, por lo que la Resolución de concesión y denegación del día 20 de octubre de 2023 y, especialmente, sus anexos 1 y 2 se tienen que modificar. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">11. Por un lado, a la entidad Asociación para el Fomento de la Conservación y Producción de Vegetales Autóctonos y Tradicionales de las Illes Balears, a la que no se le concedió el total solicitado por el proyecto Feria Estatal de la Biodiversidad Agrícola en Murcia (expediente PCI-16/2023) a causa de la insuficiencia de crédito presupuestario, se le debe aumentar el importe concedido de 603,51 euros hasta llegar a los 639,36 euros. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">12. Por otro lado, a la entidad Escuela de Música y Danzas de Mallorca Bartomeu Enseñat i Estrany, a la que en la Resolución mencionada se le había denegado la subvención por el proyecto Festival Internacional de Folclore de Zamora (expediente PCI-17/2023) también por falta de crédito presupuestario, ahora se le pueden conceder 266,55 euros hasta el agotamiento del crédito. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">13. En la presente resolución las subvenciones se distribuyen en las cuantías especificadas en el anexo 1, por beneficiario, y hay crédito adecuado y suficiente en la partida 21401.455A01.48000 00 de los presupuestos generales de la Administración de la Comunidad Autónoma de las Illes Balears para el año 2023. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">14. Las entidades especificadas en el anexo 2 de la presente resolución no pueden ser beneficiarios de la subvención por los motivos que se indican en este. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">15. Las ayudas concedidas en el marco de esta convocatoria constituyen ayudas de estado de las previstas en los artículos 107 y 108 del Tratado de Funcionamiento de la Unión Europea, sometidos a la norma </span><em><span style="background-color:null">de minimis, </span></em><span style="background-color:null">que determina que el importe total de estas ayudas<em><span style="background-color:null"> </span></em>a una única empresa no puede ser superior a 200.000 euros durante cualquier periodo de tres ejercicios fiscales, de acuerdo con lo establecido en el artículo 3 del Reglamento (UE) núm. 1407/2013 de la Comisión, de 18 de diciembre de 2013, modificado por el Reglamento (UE) núm. 2020/972, de 2 de julio de 2020, en cuanto a su prórroga. Asimismo, estas ayudas no están sometidas al marco nacional temporal.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Fundamentos de derecho</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. La Ley 38/2003, de 17 de noviembre, General de Subvenciones (BOE núm. 276, de 18 de noviembre).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. El Acuerdo del Consejo de Gobierno de 20 de diciembre de 2021 por el que se aprueba el Plan Estratégico de Subvenciones de la Comunidad Autónoma de las Illes Balears para los ejercicios 2021-2023 (BOIB núm. 175, de 23 de diciembre).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. El Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB núm. 122, de 2 de septiembre).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">6. La Orden de la consejera de Educación y Cultura de 1 de julio de 2009 por la cual se establecen las bases reguladoras de las subvenciones en materia de educación y cultura (BOIB núm. 100, de 11 de julio).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">7. La Resolución del consejero de Turismo, Cultura y Deportes de 27 de julio de 2023 por la cual se establece la delegación de competencias y de firma en los órganos directivos de la Consejería y se determina el régimen de suplencia (BOIB núm. 107, de 1 de agosto).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8. La Resolución del consejero de Fondos Europeos, Universidad y Cultura de 24 de mayo de 2023 por la que se convocan subvenciones para apoyar la movilidad en la proyección exterior de las actividades y de los proyectos que promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears en 2023 (BOIB núm. 70, de 27 de mayo). </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">9. La Resolución del consejero de Fondos Europeos, Universidad y Cultura de 2 de junio de 2023 de corrección de errores relativa a la Resolución del consejero de Fondos Europeos, Universidad y Cultura de 24 de mayo de 2023 por la que se convocan subvenciones para apoyar la movilidad en la proyección exterior de las actividades y de los proyectos que promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears en 2023 (BOIB núm. 75, de 6 de junio).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">10. La propuesta de resolución del director general de Cultura de 15 de septiembre de 2023 sobre la concesión y denegación de subvenciones para apoyar la movilidad en la proyección exterior de las actividades y de los proyectos que promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears en 2023.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Por todo ello, dicto la siguiente </span></span></span></span></p> <p style="text-align:center"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Resolución</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Dejar sin efecto la Resolución del consejero de Turismo, Cultura y Deportes de 20 de octubre de 2023 sobre la concesión y denegación de subvenciones para apoyar la movilidad en la proyección exterior de las actividades y de los proyectos que promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears en 2023, publicada en el BOIB núm. 145, de 26 de octubre. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Aprobar la concesión de las subvenciones para apoyar la movilidad en la proyección exterior de las actividades y de los proyectos que promuevan las diferentes manifestaciones del patrimonio cultural inmaterial de las Illes Balears en 2023 a las entidades beneficiarias que figuran en el anexo 1 por el importe individual que se señala en este.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Denegar la subvención a las entidades que han presentado las solicitudes incluidas en el anexo 2 por los motivos que se indican en este.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Autorizar y disponer el gasto por un importe de 35.000,00 euros, a favor de las entidades beneficiarias que figuran en el anexo 1 por el importe individual que se señala en este, con cargo a la partida 21401.455A01.48000 00 de los presupuestos generales de la Administración de la Comunidad Autónoma de las Illes Balears para el año 2023.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. Conceder un nuevo plazo de diez días hábiles a contar desde el día siguiente al de la publicación de esta resolución en el </span><em><span style="background-color:null">Boletín Oficial de las Illes Balears </span></em><span style="background-color:null">o, si la finalización de la actividad fuera posterior a esta publicación, en un máximo de diez días hábiles después de haber llevado a cabo la actividad, para que las entidades beneficiarias presenten la cuenta justificativa.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">6. Informar de que la subvención se justificará mediante la presentación de una cuenta justificativa en el Registro, en los términos indicados en el punto 10.5 de la convocatoria, subscrita por la entidad beneficiaria o por quien la represente, a la que se adjuntará la documentación prevista en el punto 14.2 de la convocatoria. Transcurrido el plazo de presentación de la cuenta justificativa sin que se haya presentado, se requerirá a la persona beneficiaria para que en el plazo improrrogable de quince días la presente.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">7. Hacer saber que el pago de la subvención únicamente podrá hacerse efectivo una vez dictada la resolución correspondiente y justificada la realización de la actividad subvencionable.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">8. Informar de que las actividades objeto de esta subvención se deberán ejecutar en el periodo comprendido entre los días 16 de noviembre de 2022 y 31 de octubre de 2023, de acuerdo con el punto 4 de la convocatoria.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">9. Informar de que la falta de presentación de la justificación en el plazo establecido podrá dar lugar al inicio de un procedimiento de revocación y el eventual reintegro de la subvención, de acuerdo con los artículos 43 y 44 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto Refundido de la Ley de Subvenciones; y se podrán exigir el resto de responsabilidades establecidas en la normativa reguladora de las subvenciones.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Interposición de recursos</span></strong></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra esta resolución, que agota la vía administrativa, podrá interponerse un recurso potestativo de reposición ante el consejero de Turismo, Cultura y Deportes en el plazo de un mes a contar a partir del día siguiente al de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, del Procedimiento Administrativo Común de las Administraciones Públicas.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
