    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Pleno del Ayuntamiento de Maó, en sesión ordinaria realizada el día 26/10/2023, adoptó, entre otros, el acuerdo que se transcribe literalmente a continuación (Exp. PT0322023000002): &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Aprobar la cesión gratuita del bien patrimonial del suelo de esta entidad local que se describe a continuación, para los fines que asimismo se determinan, a favor del Instituto Balear de la Vivienda (IBAVI).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Descripción del bien: &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Parcela 15, manzana 1.2, del Polígono III del Passeig de Circumval·lació de Maó. Referencia catastral: 8256106FE0185N0001.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Límites:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Al norte, parcela 10 de esta misma manzana; al este, parcelas 13 y 15 de esta misma manzana; al sur, en 18 metros Av. Francesc Femenías; y al oeste, con las parcelas 12 y 14 de esta misma manzana.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Situación: &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Av. Francesc Femenías, con una superficie de suelo de 378 m&lt;/span&gt;&lt;sup&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/sup&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Inventario:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Epígrafe primero, número de orden 000691.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Destino del inmueble:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Patrimonio municipal del suelo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Inscripción registral:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Tomo 2.429, folio 125, finca 23.594 de Maó.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La finca objeto de cesión debe destinarse a viviendas de protección oficial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A tales efectos, si la finca cedida no se destina a la finalidad mencionada en el plazo de 5 años o si deja de destinarse a dicha finalidad dentro de los 30 años siguientes, el bien objeto de cesión revertirá, de manera automática y de pleno derecho, a favor del Ayuntamiento de Maó, en los términos que resultan del artículo 111 del Real Decreto 1372/1986, de 13 de junio, por el cual se aprueba el Reglamento de Bienes de las Entidades Locales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de reversión, lo será tanto del bien objeto de cesión como de las instalaciones y construcciones existentes sobre la finca y a favor del Ayuntamiento de Maó.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La construcción de las viviendas de protección oficial a que hace referencia este acuerdo debe ser llevada a cabo por el propio Instituto Balear de la Vivienda (IBAVI).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El terreno es apto para su destino como bien patrimonio del suelo, destinado a la construcción de viviendas de protección oficial, y contará con abastecimiento de agua, evacuación de aguas, suministro de energía eléctrica, con la potencia suficiente para la ejecución de la obra y el posterior y correcto funcionamiento, así como con la instalación de una estación transformadora de energía, en el supuesto que sea necesaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Someter el expediente a un período de información pública de 15 días hábiles, mediante anuncio en el tablón de anuncios digital del Ayuntamiento de Maó y en el Boletín Oficial de las Illes Balears, durante los cuales se pueden formular reclamaciones o alegaciones. En el supuesto de que no se formulen alegaciones ni reclamaciones en el trámite de información pública, se entenderá aprobada la cesión a favor del Instituto Balear de la Vivienda (IBAVI). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Dar cuenta de este expediente a la Consejería de Presidencia y Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexto. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Trasladar certificación del acuerdo al Instituto Balear de la Vivienda (IBAVI), para su conocimiento y a los efectos procedentes, especialmente la aceptación de la cesión, para proceder a su formalización, en su caso, en escritura pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Séptimo. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Solicitar al Registro de la Propiedad de Maó que proceda a dejar constancia de este cambio, mediante los correspondientes asentamientos u operaciones registrales adecuadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Octavo. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Facultar al alcalde para que, asistido por la secretaria de la corporación, realice todas las operaciones oportunas, redacción de documentos, firma de los mismos y otras que sean precisas para que tenga efectividad el presente acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Noveno. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Comunicar este acuerdo a la Intervención Municipal, a los efectos oportunos, y proceder a la inscripción de esta cesión en el Inventario Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Décimo. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Si se presentan reclamaciones durante el plazo de la información pública de la cesión del bien citado al Instituto Balear de la Vivienda (IBAVI), el acuerdo definitivo de cesión será aplazado todo el tiempo que sea necesario para su resolución. La Administración, una vez resueltas las reclamaciones mediante resolución motivada, optará por proseguir el procedimiento o por reabrir nuevamente el plazo de información pública, si considerara que los cambios introducidos en el expediente por la eventual estimación de las alegaciones pudiera generar cambios sustanciales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cumplimiento del artículo 110 del Real Decreto 1372/1986, de 13 de junio, por el cual se aprueba el Reglamento de Bienes de las Entidades Locales, el referido expediente podrá ser examinado durante un plazo de quince días hábiles, a partir de la fecha de su publicación en el Boletín Oficial de las Illes Balears, en las dependencias administrativas del Ayuntamiento de Maó, plaza de la Constitució, 1, Maó, durante cuyo periodo también podrán realizarse las alegaciones o reclamaciones que se consideren pertinentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
