&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;1. El 3 de julio de 2021 se publicó la convocatoria pública de subvenciones para actuaciones de apoyo en la movilidad eléctrica (Programa MOVES III) mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021, modificada por la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 3 de agosto de 2022 (BOIB núm. 103, de 6 de agosto de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;2. Las personas o entidades que figuran en el anexo de esta Resolución presentaron a la consejería de Transición Energética, Sectores Productivos y Memoria Democrática una solicitud de subvención en el marco de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;3. Los titulares de los expedientes que aparecen en el anexo han presentado un escrito en el que indican que desisten de la solicitud de subvención mencionada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. El consejero de Empresa, Empleo y Energía es el órgano competente para resolver este procedimiento atendida la estructura orgánica del Gobierno de las Islas Baleares y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la cual se establecen las bases reguladoras para la concesión de subvenciones en materia de energía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. La Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. El Decreto Legislativo&amp;nbsp;2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones (BOIB núm.&amp;nbsp;196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El artículo 94, de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, prevé que la Administración, en el supuesto de renuncia de la persona interesada a sus derechos, aceptará la renuncia completamente y resolverá el procedimiento declarando esta circunstancia, con indicación de los hechos producidos y las normas aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la cual se aprueba la convocatoria pública de subvenciones para&amp;nbsp; actuaciones de soporte a la movilidad eléctrica (Programa MOVES&amp;nbsp;III) en el marco del Plan de Recuperación, Transformación y Resiliència Europeo (BOIB núm.&amp;nbsp;88, de 3 de julio de 2021), &lt;span style="color:black"&gt;modificada por la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 3 de agosto de 2022 (BOIB núm. 103, de 6 de agosto de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aceptar el desistimiento de la solicitud de subvención presentada por los beneficiarios de los expedientes que aparecen en el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Declarar concluido el procedimiento y por tanto, archivar los expedientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Publicar esta Resolución en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="color:black"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el &lt;span style="color:black"&gt;consejero de Empresa, Empleo y Energía&lt;/span&gt; en el plazo de un mes a contar desde el día siguiente de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También se puede interponer directamente un recursocontencioso‑administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-Administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
