&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1.En fecha 21 de agosto de 2023, el director general de Atención a la Dependencia emitió un informe justificativo relativo a la necesidad de convocar la acción concertada de la prestación de vivienda supervisada para personas con diagnóstico de salud mental, en Inca, para los años 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;2. En fecha 23 de agosto de 2023, la consejera de Familias y Asuntos Sociales resolvió iniciar el expediente de concertación de la prestación de vivienda supervisada para personas con diagnóstico de salud mental, en Inca, para los años 2023-2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1. La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;2. La Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3. El Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;4. El Decreto 32/2023, de 26 de mayo, por el que se aprueba la Cartera básica de servicios sociales de las Illes Balears 2023-2027 y se establecen principios generales para las carteras insulares y locales y se modifican varias normativas del ámbito social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5. El Decreto 86/2010, de 25 de junio, por el que se establecen los principios generales y las directrices de coordinación para la autorización y la acreditación de los servicios sociales de atención a personas mayores y personas con discapacidades, y se regulan los requisitos de autorización y acreditación de los servicios residenciales de carácter suprainsular para estos sectores de población.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;6. El Decreto 8/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se determina la composición del Gobierno y se establece la estructura de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;7. El Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, modificado por el Decreto 16/2023, de 20 de julio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;8. El Acuerdo del Consejo de Gobierno de 6 de marzo de 2023 por el que se aprueba la previsión de las prestaciones y los servicios que la Consejería de Asuntos Sociales y Deportes tiene que concertar durante el año 2023 y se declaran los servicios de interés económico general (BOIB núm. 29, de 7 de marzo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1. Convocar la acción concertada y establecer el procedimiento de la convocatoria de la prestación de vivienda supervisada para personas con diagnóstico de salud mental, en Inca, para los años 2023-2027, de acuerdo con el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;2. Aprobar el Pliego general de condiciones técnicas para la concertación, entre la Consejería de Familias y Asuntos Sociales y entidades que gestionan la prestación de vivienda supervisada para personas con diagnóstico de salud mental, que puede consultarse en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3. Publicar esta Resolución en el &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, puede interponerse un recurso potestativo de reposición ante la consejera de Familias y Asuntos Sociales en el plazo de un mes contador desde el día siguiente a la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;También se puede interponer un recurso contencioso administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contadores desde el día siguiente de la publicación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objeto y ámbito de aplicación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1.1. Se establece el procedimiento de convocatoria del concierto de la prestación de vivienda supervisada para personas con diagnóstico de salud mental, en Inca, para los años 2023-2027, al amparo de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears, y del Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1.2. Se sujeta a este procedimiento el concierto de plazas de la prestación de vivienda supervisada para personas con diagnóstico de salud mental en Inca. Este servicio está recogido en el punto 7.5 del anexo del Decreto 32/2023, de 26 de mayo, por el que se aprueba la Cartera básica de servicios sociales de las Illes Balears 2023-2027, se establecen principios generales para las carteras insulares y locales y se modifican varias normativas del ámbito social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;1.3. De acuerdo con el artículo 3.&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;h)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; de la Ley 12/2018, también es objeto del concierto lograr los objetivos de igualdad de género y de innovación en la gestión de las entidades y los servicios públicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Órgano instructor&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;El órgano instructor del procedimiento es la Dirección general de Atención a la Dependencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Lugar y plazo de presentación de solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3.1. El plazo para presentar las solicitudes es de siete días hábiles contadores desde el día siguiente que se haya publicado esta convocatoria en &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;el Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;A los efectos de lo que disponen la cláusula 7.3 y la cláusula 9.1, las entidades interesadas pueden hacer la solicitud considerando que renuncian al concierto anterior a partir de el día siguiente de la formalización del nuevo concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;3.2. Las solicitudes se han de presentar electrónicamente mediante el trámite telemático disponible en la Sede Electrónica de esta Administración, al cual, en conformidad con el artículo 66.6 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, se tiene que adjuntar la solicitud específica del procedimiento, disponible en la misma Sede Electrónica, firmada electrónicamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Requisitos de las entidades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;4.1. Los requisitos que tienen que cumplir las entidades que se presenten a la convocatoria de este concierto social son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Estar debidamente inscritas en el Registro Unificado de Servicios Sociales (RUSS).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Tener el servicio acreditado de conformidad con el Decreto 86/2010, de 25 de junio, por el que se establecen los principios generales y las directrices de coordinación para la autorización y la acreditación de los servicios sociales de atención a personas mayores y personas con discapacidades, y se regulan los requisitos de autorización y acreditación de los servicios residenciales de carácter suprainsular para estos sectores de población, y la normativa complementaria insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Tener una experiencia mínima de un año en materia de servicios para personas con diagnóstico de salud mental en el ámbito de los servicios sociales de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Tener el carácter de entidad del tercer sector social, en conformidad con el que establece el artículo 5.1 de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;4.2. Así mismo, las entidades han de cumplir los requisitos mínimos establecidos en despliegue del título VII de la Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears, como también los requisitos que fijan el artículo 5 de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears, y el artículo 4.2 del Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Documentación que se tiene que presentar&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5.1. Las entidades interesadas que cumplan los requisitos que establece el punto 4 de esta convocatoria tienen que formular una solicitud &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;para&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;la prestación &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;d&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;e &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;vivienda&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;supervisada &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;firmada&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; la persona representan&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;te&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; legal de la entidad. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;El&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; modelo de solicitud se encuentra disponible &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#0000ff"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;en la Sede Electrónica de la CAIB (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;https://www.caib.es/seucaib/ca/201/empreses/&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5.2. En esta a solicitud se tiene que indicar el número de plazas que se ofrecen para concertar con la Administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5.3. A la solicitud se tiene que adjuntar la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol class="lower-alpha" start="1"&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Certificado de acreditación del servicio para concertar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Acreditación de la experiencia mínima de un año en materia de servicios para personas con diagnóstico de salud mental en el ámbito de los servicios sociales de las Illes Balears, mediante una resolución de autorización o acreditación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Declaración responsable que la entidad no está sometida a las prohibiciones de contratar con la Administración, de acuerdo con el artículo 71 de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, ni a ninguno de los supuestos de prohibición para ser beneficiaria de subvenciones, establecidos en los apartados 1 y 2 del artículo 10 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones, o de la Ley 58/2003, de 17 de diciembre, general tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de no incurrir en ninguna de las prohibiciones que establece el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres, y de no haber sido sancionada por resolución firme en los últimos cuatro años por la comisión de infracciones graves o muy graves en materia de relaciones laborales, ocupación, empresas usuarias de empresas de trabajo temporal, seguridad social, emigración, movimientos migratorios y trabajo de extranjeros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Acreditación de solvencia financiera, según el documento disponible en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Acreditación de solvencia técnica, según el documento disponible en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Certificado de estar al corriente de las obligaciones tributarias y de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Declaración del número total de plazas acreditadas, firmada por la dirección del servicio, con la diferenciación entre disponibles y no disponibles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Acreditación de la titularidad de las viviendas o de la disponibilidad por cualquier título jurídico válido por un periodo no inferior &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;a la vigencia del concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Acreditación del carácter de entidad del tercer sector social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Declaración, firmada per la persona responsable de la entidad, que el servicio cumple la normativa general o específica aplicable, tanto por la naturaleza jurídica de la entidad como por el tipo de servicio objeto de concertación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Acreditación de la disposición de los medios y los recursos suficientes para garantizar el cumplimiento de las condiciones previstas en el acuerdo de acción concertada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Comunicación, a efectos de la acreditación preceptiva, de los cambios de accionariado o de titularidad, para preservar la identidad institucional que haya justificado el acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;5.4. La presentación de la solicitud supone que la entidad autoriza a los técnicos de la Dirección general de Atención a la Dependencia para que puedan pedir a otras administraciones cualquier documentación, los datos y los informes que consideren necesarios para tramitar el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tramitación de los conciertos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;6.1. Los servicios técnicos de la Dirección general de Atención a la Dependencia tienen que examinar las solicitudes y la documentación adjunta para determinar si cumplen los requisitos que establece la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;6.2. En el supuesto de que las solicitudes no cumplan los requisitos legales o los que exige esta convocatoria o no incorporen la documentación mencionada en el apartado anterior, se requerirá la entidad interesada para que, en el plazo de diez días hábiles, enmiende el defecto o aporte la documentación que falta, con la indicación que, si no lo hace, se considerará que desiste de su petición, con la resolución previa que se tiene que dictar en los términos que dispone el artículo 21 de la Ley 39/2015.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;6.3. Se tiene que resolver el procedimiento de concertación de acuerdo con los criterios siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;a) Si el cómputo total de plazas que ofrecen las entidades no supera el número máximo de plazas previstas en el servicio y, por lo tanto, hay disponibilidad presupuestaria suficiente para atender toda la oferta, las plazas se adjudicarán directamente a las entidades solicitantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;b) Si el cómputo total de plazas que ofrecen las entidades supera la disponibilidad presupuestaria, se actuará según los criterios de preferencia que prevé la Ley&amp;nbsp;12/2018 en el artículo 6.3:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;— El arraigo de la persona en el entorno de atención y las condiciones de atención que requiere.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;— La implantación en la localidad donde se tenga que prestar el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;— La libre elección y la lista de espera de acceso a los servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;c) En caso de que alguna entidad renuncie a la concertación, las plazas que haya ofrecido se distribuirán de la misma manera entre el resto de entidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Formalización de los conciertos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;7.1. Los concierto&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;s &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;que se establece&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;n&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;l amparo de esta convocatoria se ha&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;n&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; de formalizar mediante un documento administrativo &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;denominado &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;acuerdo de acción concertada&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;en el cual se haga constar &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;el contenido mínimo previsto en el artículo 8 de la Ley 12/2018, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;como también&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;las características concretas del servicio y otras circunstancias derivadas de la Ley 4/2009, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;de la &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Ley 12/2018, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;de la &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;normativa de despliegue y del Pliego general de condiciones técnicas del concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;7.2. En el momento de formalizar el concierto, se tiene que presentar una declaración responsable que se continúan cumpliendo los requisitos para poder concertar el servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;7.3. &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;Si alguna de las entidades solicitantes dispone de un concierto en vigor que finaliza el año 2023, se considera que la entidad renuncia al concierto anterior a partir de el día siguiente de la firma del nuevo concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Plazas del servicio y distribución territorial&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;8.1. La previsión del número máximo de plazas para concertar en Inca es de 10.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;8.2. &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;Estas plazas se pueden ampliar de acuerdo con lo que prevén la Ley&amp;nbsp;12/2018 y el Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los cuales se tienen que someter los conciertos sociales, y teniendo en cuenta el procedimiento previsto en el artículo 23.3 del Decreto 48/2017.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Vigencia del concierto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;9.1. El concierto será vigente desde el 1 de diciembre de 2023, o la fecha en que se formalice, y finalizará el 30 de noviembre de 2027.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;9.2. El concierto&lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt; se podrá renovar de acuerdo con lo que prevén la Ley 12/2018 y el Decreto 48/2017.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Presupuesto y precio máximo del servicio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;10.1. El importe máximo estimado para asignar es de 1.140.374,10 € (exento de IVA), que se distribuirá entre las anualidades de 2023, 2024, 2025, 2026 y 2027. En todo caso, este valor estimado tiene carácter orientativo y no vinculante. El gasto real quedará limitada por el número de plazas que ofrezca la entidad y por los servicios que la Administración requiera efectivamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;10.2. Este importe se indica únicamente a efectos de publicidad y no supone ningún compromiso de gasto. Por eso, no consta ninguna consignación presupuestaria, que se tiene que acreditar en el momento en que se materialice el servicio de concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;10.3. El coste estipulado es de 76,41 € por plaza &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;y día &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;para el año 2023 y de 78,09 € &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;por &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;plaza &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;y día &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;para el año 2024 y siguientes, de acuerdo con la Resolución de la consejera de Asuntos Sociales y Deportes por la cual se actualizan los precios de los servicios concertados, derivada del acuerdo sectorial en materia salarial para centros especiales de ocupación y centros de atención especializada de las Illes Balears, incluidos en el Convenio colectivo estatal de centros y servicios de atención a personas con discapaci&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;dad&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;, por el que se amparan los servicios concertados (BOIB núm. 135, de 18 de octubre de 2022). &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;En esta Resolución se aprueba la actualización de precios de los servicios concertados de tutela judicial, atención temprana, apoyo tecnológico para la autonomía personal, acompañamiento &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;de sord&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;o&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;cegue&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;r&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;a,&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;acompañamiento de personas con discapacidad física, vivienda supervisada salud mental, apoyo a la vivienda en las diferentes intensidades y servicio ocupacional para salud mental durante los años 2022, 2023 y 2024. Por otro lado, en el apartado segundo de esta Resolución se indica que estos precios se tienen que aplicar desde el 1 de enero de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11. Condiciones técnicas de ejecución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;11.1. Las condiciones técnicas de ejecución se tienen que ajustar al Decreto 86/2010, de 25 de junio, por el que se establecen los principios generales y las directrices de coordinación para la autorización y la acreditación de los servicios sociales de atención a personas mayores y personas con discapacidades, y se regulan los requisitos de autorización y acreditación de los servicios residenciales de carácter suprainsular para estos sectores de población; en el Decreto 32/2023, de 26 de mayo, por el que se aprueba la Cartera básica de servicios sociales de las Illes Balears 2023-2027 y se establecen principios generales para las carteras insulares y locales y se modifican varias normativas del ámbito social, y en la normativa insular complementaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;11.2. &lt;/span&gt;&lt;/span&gt;&lt;span style="background-color:null"&gt;El Pliego general de condiciones técnicas detalla la acción concertada, las características concretas de la población para atender, el sistema de facturación, el régimen de realización con medios ajenos, las penalizaciones que se tienen que aplicar en caso de incumplimiento de la entidad, los requisitos de calidad de la actividad, los aspectos técnicos y económicos que se pueden modificar a lo largo de la ejecución del concierto y el sistema de seguimiento y control del concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;11.3. Las aplicaciones informáticas del Servicio de Atención a la Discapacidad son las únicas válidas para gestionar las plazas del servicio y para cualquier uso aplicable que se derive de la ejecución de este concierto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Seguimiento&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;12.1. Los técnicos de la vivienda supervisada para personas con diagnóstico de salud mental grave son los responsables del seguimiento de los casos atendidos y se tienen que coordinar con el Servicio de Atención a la Discapacidad y los servicios sociales comunitarios básicos, de salud, educativos o de otros que se requieran.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;12.2. Los técnicos del Servicio de Atención a la Discapacidad pueden hacer visitas de comprobación del funcionamiento del servicio y requerir documentación cuando lo consideren necesario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;12.3. La entidad concertada tiene que facilitar las actuaciones de seguimiento y comprobación que lleve a cabo la Dirección general de Atención a la Dependencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;12.4. Así mismo, la entidad concertada facilitará toda la información que le requieran el órgano instructor, la Intervención General de la Comunidad Autónoma de las Illes Balears, la Sindicatura de Cuentas u otros órganos de control externo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Obligaciones de las entidades concertadas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Mediante el concierto social, las entidades que presten el servicio se obligan a cumplir el Pliego general de condiciones técnicas, que establece las obligaciones de las entidades concertadas, y las normas establecidas en el título VII de la Ley 4/2009, en el capítulo I de la Ley 12/2018 y en los decretos de desarrollo y de aplicación correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Penalidades&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de las condiciones previstas para prestar el servicio puede dar lugar a la imposición de penalizaciones, de acuerdo con el Pliego general de condiciones técnicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Criterios de acceso de los usuarios y lista de espera&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;15.1. El criterio de acceso de los usuarios y la lista de espera del servicio de vivienda supervisada se rigen de acuerdo con los capítulos II y III del Decreto 7/2016, de 12 de febrero, por el que se regulan el acceso al servicio ocupacional para personas con discapacidad por trastorno mental grave y la gestión de la lista de espera de las plazas de este servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;15.2. Las personas que hayan solicitado el acceso a la prestación de vivienda supervisada y que forman parte de la lista de espera para iniciar el nuevo servicio serán valoradas por los profesionales del Servicio de Atención a la Discapacidad y derivadas a la entidad prestadora del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Publicidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;16.1. Las entidades de iniciativa privada acogidas al concierto social, junto con su denominación, tienen que hacer constar en la documentación, en todas las comunicaciones (informes, hojas, documentos, trípticos de difusión, mensajes electrónicos, webs, inserciones en prensa, artículos a diarios y a revistas especializadas) y en la publicidad la adscripción funcional del servicio a la red pública de servicios sociales, según las indicaciones del &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Manual de identidad corporativa&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; que les facilitará la Administración, siempre con el visto bueno de la Consejería de Familias y Asuntos Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;16.2. Las entidades de iniciativa privada acogidas al régimen de concierto social tienen que colocar en un lugar visible de sus instalaciones la indicación «Servicio de vivienda supervisada concertada con el Gobierno de las Illes Balears» con el logotipo correspondiente, que les proporcionará la Consejería de Familias y Asuntos Sociales. Así mismo, se tiene que hacer referencia a esta circunstancia en las comunicaciones y en las relaciones que establezcan por escrito con las personas usuarias del servicio concertado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;16.3. Los acuerdos de acción concertada se publicarán en el&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, en conformidad con lo que establece la letra &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; del artículo 3 de la Ley&amp;nbsp;12/2018, y en el Portal de Transparencia, de acuerdo con el apartado &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g)&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; del mismo artículo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Prerrogativas de la Administración&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;17.1. El órgano instructor del procedimiento de concertación tiene la prerrogativa de interpretarlo y resolver las dudas que surjan durante su cumplimiento. Por otro lado, el órgano competente para resolver el procedimiento tiene, además, la prerrogativa de modificarlo por razones de interés público, acordar su resolución y determinar sus efectos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;17.2. Los acuerdos que adopte el órgano resolutorio a partir de las prerrogativas mencionadas ponen fin a la vía administrativa y son inmediatamente ejecutivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;18. Causas de extinción&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Son causas de extinción del acuerdo de acción concertada las que establece el artículo 9 de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;19. Jurisdicción competente&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
