&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Ejecutivo del Consejo de Mallorca, en sesión de día 18 de octubre de 2023, ha aprobado el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“La Borrasca Juliette impactó, entre los días 26 y 28 de febrero de 2023, en la sierra de Tramuntana y otros lugares de la isla de Mallorca, afectando especialmente las comarcas agrarias de Tramuntana, Raiguer, el Pla, Llevant y Migjorn, que sufrieron los efectos del fenómeno meteorológico adverso de acumulación de nieve, temperaturas mínimas, lluvia, viento y fenómenos costeros, que ocasionaron graves daños materiales. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El episodio dejó sin suministro eléctrico a más de 25.000 personas cerca de 48 horas en la isla de Mallorca. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Numerosas carreteras cortadas por la nieve dejaron aisladas personas y animales durante unos cuatro días. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La afectación en la vegetación se estima en unas 14.167,64 hectáreas forestales la mayoría concentradas en la Sierra de Tramuntana pero también en otros lugares de la isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ante esta situación gravísima y excepcional, el Gobierno de las Islas Baleares ha decidido establecer ayudas y otras medidas de carácter urgente con el fin de reparar y paliar, en aquello que sea posible, las pérdidas sufridas, contribuyendo así a recuperar con la máxima celeridad la normalidad de las zonas afectadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así pues, el Gobierno de las Islas Baleares ha dictado el Decreto ley 3/2023 de 13 de marzo, por el cual se establecen ayudas y otras medidas urgentes para reparar las pérdidas y los daños producidos por la borrasca Juliette en la sierra de Tramuntana y otros lugares de la isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Concretamente, la Disposición adicional primera punto 3 establece: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“De acuerdo con los dos apartados anteriores, los municipios de la isla de Mallorca y el Consejo Insular, y también los entes instrumentales o dependientes respectivos, sin perjuicio del ejercicio, en cualquier momento, de las competencias mencionadas y del resto de competencias que les son propias de acuerdo con la normativa local, pueden otorgar ayudas o subvenciones a las personas o entidades afectadas y, en general, acordar todas las acciones de fomento que estimen pertinentes con la finalidad de coadyuvar a la recuperación económica en los territorios municipales e insulares afectados”.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Asimismo, de acuerdo con el artículo 36.2 letra b de la Ley 7/1985 de 2 de abril reguladora de las Bases de Régimen Local, es competencia del Consejo Insular asegurar el acceso de la población al conjunto de los servicios mínimos de competencia municipal y a la mayor eficacia y economía en la prestación de éstos mediante cualesquiera fórmulas de asistencia y cooperación municipal, y con esta finalidad se permite al Consejo Insular otorgar subvenciones y ayudas con cargo a sus recursos propios para la realización y el mantenimiento de obras y servicios municipales, que se instrumentaran a través de planes especiales u otros instrumentos específicos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Decreto por el cual se establecen las competencias de los departamentos del Consejo de Mallorca, de fecha 10 de julio de 2023 (BOIB 106, 29 de julio de 2023), establece entre las competencias atribuidas al Departamento de Promoción Económica y Desarrollo Local, la elaboración, además del Plan Insular de Obras y Servicios, de los planes especiales y otros instrumentos específicos de colaboración con los municipios. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por acuerdo del Pleno del Consejo Insular de Mallorca, de fecha 9 de marzo de 2023 se aprobó la correspondiente modificación presupuestaria por la cual se atribuye a este departamento una partida presupuestaria por importe de 5.000.000,00 euros en concepto "A ayuntamientos subvenciones por tormentas”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Ejecutivo del Consejo Insular de Mallorca, en sesión celebrada día 26 de abril de 2023 acordó, a propuesta del consejero ejecutivo de Hacienda y Función Pública, la modificación del Plan Estratégico de Subvenciones y se incluyó en la línea de subvención/programa Cooperación y Administración Local (904310) del Departamento de Promoción Económica y Desarrollo Local las ayudas/subvenciones destinadas a reparar o restituir los daños producidos por la Borrasca Juliette durante los días 26 a 28 de febrero de 2023 en los bienes, infraestructuras, equipamientos, instalaciones y servicios de los Ayuntamientos de Mallorca por importe de 5.000.000 €, de los cuales se decidió destinar el importe de 2.500.000 € directamente a los Ayuntamientos como beneficiarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Es urgente y está justificado que el Consejo de Mallorca, al amparo del Decreto Ley 3/2023 mencionado, actúe ante esta catástrofe para ayudar a reparar estos daños dentro de los municipios de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con la aprobación de esta convocatoria se inicia el procedimiento de concesión de subvenciones urgentes y excepcionales&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;para llevar a cabo la reparación o restitución de los daños producidos en los bienes, elementos etnológicos, infraestructuras, equipamientos, instalaciones y servicios de titularidad municipal de los municipios afectados en Mallorca, así como actuaciones de limpieza de arbolado y de fincas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Hay crédito adecuado y suficiente para cubrir la cantidad de dos millones quinientos mil euros (2.500.000,00 €) con cargo a la aplicación presupuestaria 65.94310.76208 del presupuesto de gastos del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El director insular de Desarrollo Local ha emitido la memoria justificativa de esta Convocatoria de subvenciones urgentes y excepcionales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En fecha 10 de octubre de 2023, la jefa del Servicio de Desarrollo Local ha emitido informe jurídico de esta convocatoria de subvenciones urgentes y excepcionales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;La Intervención Delegada de la Misericordia del Consejo de Mallorca ha emitido, en fecha 16 de octubre de 2023, el informe favorable de fiscalización previa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dado que, en posterioridad en el informe de fiscalización previa, se ha procedido a modificar el régimen de concesión de las subvenciones de esta convocatoria, la jefa del Servicio de Desarrollo Local, ha emitido nuevo informe jurídico en fecha 19 de octubre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Intervención Delegada de la Misericordia del Consejo de Mallorca ha emitido el informe de fiscalización previa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se constata que la convocatoria de subvenciones gestionada por el Consorcio Sierra de Tramuntana Patrimonio Mundial está destinada únicamente a personas físicas, agrupaciones de personas físicas, entidades sin ánimo de lucro, Comunidades de bienes, Comunidades de regantes y explotaciones agrarias que sean propietarios o arrendatarios de terrenos ubicados dentro del ámbito territorial de la Sierra de Tramuntana declarado como Patrimonio Mundial, quedando excluidos los ayuntamientos de dicha convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Intervención Delegada de la Misericordia del Consejo de Mallorca ha emitido el informe de fiscalización previa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Executivo es el órgano competente para aprobar y resolver esta convocatoria de conformidad con el artículo 28 letras f) y m) de la Ley 4/2022, de 28 de junio, de consejos insulares en relación con la base 24.4 de las Bases de ejecución del presupuesto para el 2023 y con el artículo 36.f) del Reglamento orgánico del Consejo de Mallorca vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo eso, la consejera executiva de Promoción Económica y Desarrollo Local eleva al Consejo Ejecutivo la siguiente propuesta de &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ACUERDO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobar la convocatoria que se adjunta de subvenciones urgentes y excepcionales para cooperar en la reparación y restitución de los daños producidos por la Borrasca Juliette durante los días 26 a 28 de febrero de 2023 en los bienes, elementos etnológicos, infraestructuras, equipamientos, instalaciones y servicios de titularidad municipal de los Ayuntamientos de Mallorca, así como en actuaciones de limpieza de arbolado y de fincas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Autorizar un gasto por un importe total de dos millones quinientos mil de euros (2.500.000,00 €) con cargo a la aplicación presupuestaria 65.94310.76208 del presupuesto de gastos del Consejo de Mallorca con el documento contable RC validado nº. 2202300006323. La concesión de las subvenciones está condicionada a la existencia de crédito adecuado y suficiente en el momento de la resolución de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobar los modelos normalizados siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Solicitud de la subvención (Anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de no incurrir en prohibiciones para ser beneficiario de subvenciones (Anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de encontrarse al corriente en el cumplimiento de obligaciones tributarias y con la Seguridad Social (Anexo III)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Autorización para la obtención de datos de estar al corriente en el cumplimiento de las obligaciones tributarias con el Estado, con la Tesorería General de la Seguridad Social y con el Consejo de Mallorca (Anexo IV).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de no encontrarse en la situación prevista en el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres (Anexo V).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Modelo de certificado de la posesión y disposición real y plena de los terrenos o bienes necesarios para la ejecución de la obra o servicio (Anexo VI)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un certificado del secretario/secretaria de la entidad local de estar al corriente en el cumplimiento de las obligaciones tributarias con el Estado, la Seguridad Social y el Consejo de Mallorca y sus organismos autónomos dependientes, de acuerdo con lo establecido en el artículo 48.4 de la vigente Ordenanza general de subvenciones del Consejo de Mallorca (Anexo IX)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Publicar esta convocatoria en el Boletín Oficial de las Islas Baleares (BOIB) y en la Bases de Datos nacional de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;De conformidad con el artículo 44 en relación con el 46.6 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contenciosa Administrativa, contra este acuerdo no se podrá interponer recurso en vía administrativa, si bien se podrá formular potestativamente REQUERIMIENTO para su anulación o revocación en el plazo de dos meses contadores desde el día que se publique en el Boletín Oficial de las Islas Baleares con carácter previo a la interposición de recurso contencioso administrativo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;El requerimiento se entenderá desestimado si en el plazo de un mes desde su presentación no se notifica resolución expresa. El plazo para interponer el recurso contencioso administrativo será de dos meses contadores desde el día siguiente en aquel en el cual se reciba comunicación de la resolución expresa sobre el requerimiento previo o este se entienda desestimado de forma presunta. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Si no se formula requerimiento previo, se podrá interponer directamente recurso contencioso administrativo en el plazo de dos meses contadores desde el día de la publicación del acuerdo en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Convocatoria de Subvenciones urgentes y excepcionales para cooperar en la reparación y restitución de los daños producidos por la Borrasca Juliette durante los días 26 a 28 de febrero de 2023 en los bienes, elementos etnológicos, infraestructuras, equipamientos, instalaciones y servicios de los Ayuntamientos de Mallorca, así como actuaciones de limpieza de arbolado y de fincas públicas.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.- Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto de esta convocatoria es cooperar con los Ayuntamientos de Mallorca en la reparación o restitución de los daños producidos en Mallorca por la Borrasca Juliette durante los días 26 a 28 de febrero de 2023 en los bienes, elementos etnológicos, infraestructuras, equipamientos, instalaciones y servicios de titularidad municipal de los Ayuntamientos de Mallorca, así como en las actuaciones de limpieza de arbolado, fincas, parques y jardines públicos, al amparo del Decreto ley 3/2023 de 13 de marzo, por el cual se establecen ayudas y otras medidas urgentes por reparar las pérdidas y los daños producidos por la borrasca Juliette en la sierra de Tramuntana y otros lugares de la isla de Mallorca (BOIB nº. 33 de 15 de marzo de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Concretamente, la Disposición adicional primera punto 3 establece: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“De acuerdo con los dos apartados anteriores, los municipios de la isla de Mallorca y el Consejo Insular, y también los entes instrumentales o dependientes respectivos, sin perjuicio del ejercicio, en cualquier momento, de las competencias mencionadas y del resto de competencias que les son propias de acuerdo con la normativa local, pueden otorgar ayudas o subvenciones a las personas o entidades afectadas y, en general, acordar todas las acciones de fomento que estimen pertinentes con la finalidad de coadyuvar a la recuperación económica en los territorios municipales e insulares afectados”.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones de esta convocatoria se podrán destinar a sufragar gastos comprendidos desde el día 26 de febrero de 2023 hasta la fecha de publicación de la presente convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.- Beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pueden acogerse a esta convocatoria los ayuntamientos de Mallorca que han sufrido daños producidos por la Borrasca Juliette durante los días 26 a 28 de febrero de 2023 en sus bienes, elementos etnológicos, infraestructuras, equipamientos, instalaciones y servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para acogerse a esta convocatoria los ayuntamientos no tendrán que incurrir en alguna de las prohibiciones establecidas en el artículo 8 de la Ordenanza general de subvenciones del Consejo de Mallorca (BOIB nº. 21, de 18 de febrero de 2017 y BOIB nº. 96, de 4 de agosto de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Queda excluido de esta Convocatoria el municipio de Palma y su Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.- Actuaciones subvencionables&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Serán actuaciones subvencionables aquellas que se lleven a cabo sobre cualquier bien, elemento etnológico, infraestructura, equipamiento, instalación o servicio de titularidad municipal que haya resultado afectado por la borrasca Juliette de los días 26 a 28 de febrero de 2023, así como aquellas actuaciones destinadas a la limpieza de arbolado y de fincas públicas a causa afectadas por dicho fenómeno meteorológico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Concretamente podrán ser subvencionables las siguientes actuaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuaciones de limpieza de arbolado, fincas, parques y jardines públicos. Se incluye poda, tala y replantación, siempre que sea posible de la misma especie.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuaciones de reparación i reconstrucción en edificios, como por ejemplo tejados, porches, paredes, cerramientos, puertas y ventanas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuaciones de reparación, restauración, o rehabilitación de inmuebles de titularidad municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuaciones de carácter etnológico: elementos construidos con materiales y técnicas tradicionales, principalmente, los vinculados a la captación, conducción, aprovechamiento, y almacenamiento del agua, y otros elementos que se detallan a continuación: canales, fuentes, pozos, norias, albañales, acequias, canaladura, aljibes, balsas, charcos y lavaderos, molinos de extracción de agua y molinos de agua, cuellos de cisterna, abrevaderos, torrentes, puentes, piedras , piedras pasadores, vados empedrados, eras de batir, los miradores, hornos de cal, casas de nieve, hornos de carbonero, barracas de carbonero (elementos de piedra), márgenes y paredes de piedra en seco, márgenes y paredes de piedra en seco de caminos, barracas de piedra en seco, molinos de viento, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Actuaciones de reparación y reconstrucción de la infraestructura viaria y otros equipamientos de titularidad municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Gastos de honorarios por redacción de proyectos y por dirección de obras, siempre que quien redacte el proyecto o dirija la obra sea un técnico externo a la Corporación Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Adquisición de equipos, maquinaría, herramientas y utensilios como bienes necesarios para poder reparar y restituir daños dentro de los bienes de propiedad municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por razones de urgencia en su ejecución, se presentarán actuaciones ya finalizadas siempre que tengan la causa en la borrasca Juliette de días 26 a 28 de febrero de 2023. Para lo cual el solicitante debe aportar al mismo momento y con la solicitud toda la documentación requerida en la base octava&amp;nbsp;de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Limitaciones o condiciones de las actuaciones subvencionables:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En ningún caso se admitirán actuaciones u obras que tenga un resultado diferente a lo que tenía el elemento antes de la catástrofe meteorológica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No son subvencionables las actuaciones llevadas a cabo en terrenos de carácter forestal ni a arbolado de tipología forestal (encinas, pinos, etc.) ya que se tiene previsto que desde la Consejería de Medio Ambiente del Gobierno Balear se tramite una línea de ayudas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se excluyen los gastos de personal de las entidades locales, y las obras que hayan obtenido el 100% de financiación de otras administraciones públicas o entidades privadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En ningún caso el importe del gasto subvencionable puede ser superior al valor de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los bienes, infraestructuras, equipamientos, instalaciones y servicios cubiertos por sistemas privados de cobertura de daños de los cuales puedan ser beneficiarias las entidades afectadas quedan excluidos de esta Convocatoria de subvenciones &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4.- Crédito presupuestario&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se destina la cantidad dos millones quinientos mil euros (2.500.000,00 €) a cargo de la aplicación presupuestaria 65.94310.76208, a las subvenciones objeto de esta convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concesión de las subvenciones está condicionada a la existencia de crédito adecuado y suficiente en el momento de la resolución de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5.- Naturaleza de la subvención y límites&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones de esta convocatoria son de carácter voluntario y eventual, y anulables, revocables y reintegrables en todo momento por las causas previstas a la Ordenanza general de subvenciones y el resto de normativa aplicable. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Además, no generan ningún derecho a obtener otras subvenciones en años posteriores y no se pueden alegar como precedente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstante, son compatibles con otras ayudas y subvenciones que pueda recibir el beneficiario para el mismo proyecto subvencionado siempre que el cómputo total de las ayudas o subvenciones recibidas no supere el coste de las actuaciones que la entidad beneficiaria haya llevado a cabo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6.- Régimen de concesión&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vista la situación grave y excepcional a causa de la borrasca Juliette, la concesión de las subvenciones reguladas por la presente convocatoria pública se llevará a cabo mediante régimen de concurrencia NO competitiva de acuerdo con el artículo 17.2 de la Ordenanza General de Subvenciones, una vez los ayuntamientos hayan presentado la solicitud y el resto de documentación del punto 8 en el registro general del Consejo de Mallorca. De esta manera serán subvencionadas hasta agotar el total del crédito asignado por la convocatoria todas aquellas solicitudes completas que cumplan los requisitos que se establecen y, por lo tanto, no es necesaria la comparación entre las solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el número de actuaciones solicitadas, una vez finalizado el plazo de presentación de las solicitudes, el Consejo de Mallorca concederá una subvención hasta el 100% del coste de las obras y honorarios con un máximo global de hasta dos millones quinientos mil de euros (2.500.000,00 €).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto que el crédito presupuestario no llegue para la satisfacción del 100% del gasto justificado miedo parte de las entidades solicitantes, se realizará el sumatorio de la totalidad de dichos gastos justificados y se otorgará en cada municipio la parte proporcional correspondiente del crédito presupuestario aprobado (2.500.000,00 €). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto que el sumatorio de la totalidad de los gastos justificados no agote el crédito asignado revertirá en la aplicación presupuestaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dado que la presentación de la solicitud implica la justificación de los gastos de la actuación objeto de subvención, ésta derivará en el reconocimiento de la obligación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7.- Presentación de solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo para presentar la documentación prevista en el punto siguiente será de quince (15) días hábiles contadores a partir del día siguiente de la publicación de esta convocatoria en el Boletín Oficial de las Islas Baleares. Si el último día es inhábil, se tiene que entender prorrogado hasta el primer día hábil siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dado que los Ayuntamientos están obligados a relacionarse a través de medios electrónicos con las Administraciones Públicas para llevar a cabo cualquier trámite de procedimiento administrativo, tal como prevé, el artículo 14.2 de la Ley 39/2015, de 1 de octubre, de procedimiento administrativo común, la solicitud se tendrá que presentar y formalizar a través del registro electrónico que consta en la sede electrónica del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si la solicitud no reúne los datos de identificación, tanto de la subvención solicitada como de la persona solicitante, o algunos de los requisitos previstos a la Ley 39/2015, de 1 de octubre, del Procedimiento administrativo común de las administraciones públicas, se requerirá a la entidad solicitando, de acuerdo con lo que establece el artículo 73.2 de la ley antes mencionada, para que, en un plazo de diez días hábiles, enmiende la falta o acompañe los documentos preceptivos con indicación que, si no lo hace así, se tendrá por desistido el peticionario, con una resolución expresa previa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Junto con la solicitud se tiene que presentar la documentación detallada en el punto siguiente de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8.- Formalización de solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cada Ayuntamiento presentará una única solicitud en la cual indicará las actuaciones llevadas a cabo como la documentación exigida en la base 8 de la presente convocatória.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las solicitudes se tienen que formalizar mediante el modelo oficial (Anexo I) y se declarará que las actuaciones solicitadas no están cubiertas por sistemas privados de cobertura de daños. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con la solicitud se tiene que adjuntar la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Informe de un técnico municipal de las actuaciones solicitadas y comprendidas en la base 3 de esta convocatoria, en qué declara que los daños producidos son a consecuencia de la Borrasca Juliette, hace evaluación y valoración de los mismos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de no incurrir en prohibiciones para ser beneficiario de subvenciones (Anexo II).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de encontrarse al corriente en el cumplimiento de obligaciones tributarias con el Estado y el Consejo de Mallorca y con la Seguridad Social (Anexo III).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Autorización del interesado para que una Administración Pública pueda obtener datos de estar al corriente en el cumplimiento de sus obligaciones tributarias con el Estado, con la Tesorería General de la Seguridad Social y con el Consejo de Mallorca.&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;(Anexo IV)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración responsable de no encontrarse en la situación prevista en el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres (Anexo V).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Certificado de la posesión y disposición real y plena de los terrenos necesarios para la ejecución de la obra o servicio según el modelo del Anexo VI&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un certificado del secretario/secretaria de la entidad local con el visto bueno del alcalde/alcaldesa que acredite la realización de la actividad subvencionada, el cumplimiento de la finalidad de la subvención y la aportación de la documentación justificativa que establece la convocatoria y que la actuación subvencionada cumple con toda la normativa vigente y tiene todas las licencias y permisos necesarios, según el modelo que figura como Anexo VII de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un informe, según el modelo que figura como Anexo VIII de esta convocatoria, emitido por el interventor/interventora de la entidad local beneficiaria de la subvención en virtud del cual se haga constar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La veracidad y la regularidad de la documentación justificativa de la subvención que obra en poder de la entidad local en los términos establecidos en esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una relación de las facturas de la actuación subvencionada con los datos identificativos de cada factura. Y que el pago de las facturas se ha realizado antes de la finalización del plazo de justificación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una relación de las obligaciones reconocidas de la actuación subvencionada de acuerdo con lo que prevé el artículo 48.1, segundo apartado, de la vigente Ordenanza general de subvenciones del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Además, este informe para la justificación de las actuaciones subvencionadas hará constar:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que el Ayuntamiento no ha obtenido ninguna otra subvención de otras instituciones públicas o privadas para la actividad objeto de la subvención (o, si es el caso, relación de las concedidas, con indicación de los importes y su procedencia).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que los trabajos realizados y facturados objeto de la subvención se ajustan a los precios de mercado. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que los gastos corresponden sin lugar a dudas a las actuaciones objeto de subvención. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que el Ayuntamiento no recupera ni compensa o recupera y compensa el Impuesto sobre el Valor Añadido (IVA). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que, si procede, con respecto a las facturas de honorarios de personas físicas el Ayuntamiento ha ingresado las retenciones de IRPF en la Agencia Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Un certificado del secretario/secretaria de la entidad local de estar al corriente en el cumplimiento de las obligaciones tributarias con el Estado, la Seguridad Social y el Consejo de Mallorca y sus organismos autónomos dependientes, de acuerdo con lo establecido en el art. 48.4 de la vigente Ordenanza general de subvenciones del Consejo de Mallorca (Anexo IX)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9.- Órgano instructor y procedimiento de concesión de las subvenciones&lt;/span&gt;&lt;s&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/s&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano instructor es la secretaría técnica del Departamento de Promoción Económica y Desarrollo Local, que tiene que llevar a cabo las actuaciones establecidas en la Ordenanza general de subvenciones, y formular la propuesta de resolución. El órgano instructor puede requerir a las entidades solicitantes los informes o las aclaraciones que considere convenientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Departamento de Promoción Económica y Desarrollo Local es el centro gestor responsable del seguimiento de las subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cumplimiento del previsto en el artículo 19.2 de la Ordenanza general de subvenciones, se enviará a la base nacional de subvenciones información sobre esta convocatoria, y sobre las resoluciones de concesión que se deriven, y se publicará en el BOIB por conducto de la base mencionada, además de publicarse en la sede electrónica de Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo máximo para resolver y notificar la resolución del procedimiento será de 30 días. El vencimiento del plazo máximo sin haberse notificado la resolución, legitima a los interesados para entender desestimada por silencio administrativo la solicitud de concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;La concesión se realizará a través de un procedimiento de concurrencia no competitiva en el que la cuantía máxima de la subvención viene predeterminada en el apartado sexto de esta convocatoria. Los municipios deberán acreditar al presentar su solicitud la existencia de una serie de gastos relacionados con las actuaciones mencionadas en el apartado 3 de esta convocatoria, realizados entre el 26 de febrero de 2023 y la publicación de ésta, debidamente justificados a través de las facturas emitidas en legal forma.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Ejecutivo es el órgano competente para aprobar esta convocatoria de conformidad con el artículo 28 letra f) y m) de la Ley 4/2022, de 28 de junio, de consejos insulares en relación con la base 24.4 de las de ejecución del presupuesto de 2023 y con el artículo 36.f) del Reglamento orgánico del Consejo de Mallorca vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo Ejecutivo habilitará a la consejera ejecutiva de Promoción Económica y Desarrollo Local como órgano competente para resolver, conceder, modificar y llevar a cabo cualquier acto administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10.- Pago de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo máximo para ordenar lo pago de la subvención será hasta el 31 de diciembre de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para ello el beneficiario deberá haber acreditado estar en el corriente de las obligaciones tributarias como el Estado, el Consejo de Mallorca y la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;11.- Obligaciones de las entidades beneficiarias&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los ayuntamientos a los cuales se las ha concedido las subvenciones estarán obligados a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Comunicar al Departamento de Promoción Económica y Desarrollo Local del Consejo de Mallorca, en cualquier momento, la obtención de subvenciones o ayudas para la misma finalidad y no consignadas en la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cumplir el resto de obligaciones que se prevén en el artículo 9 de la vigente Ordenanza general de subvenciones del Consejo de Mallorca aprobado por acuerdo de lleno de día 23 de diciembre de 2016 (BOIB nº. 21, de día 18 de febrero de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;12.- Principios generales y criterios objetivos que tienen que regir el otorgamiento y cuantía de las subvenciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La concesión de las subvenciones de esta convocatoria se rige por los principios de publicidad, objetividad, igualdad y no discriminación, y se tiene que resolver según los siguientes criterios objetivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1) la existencia de unos gastos de reparación o restitución del mobiliario, reparación o rehabilitación de inmuebles e infraestructuras y limpieza de parques, jardines y fincas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2) que las actuaciones se hayan realizado entre&amp;nbsp;el 26 de febrero de 2023 y la fecha de publicación de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3) que se acredite documentalmente que las reparaciones coinciden con las actuaciones descritas en la convocatoria aportando una relación de gastos derivados de las mismas con los justificantes de pago correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13- Revocación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las subvenciones son de concesión voluntaria, revocables y reducibles por las causas previstas a las leyes y a la vigente Ordenanza general de subvenciones del Consejo de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14.- Normativa supletoria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En todo lo que no se haya previsto en esta convocatoria serán de aplicación la normativa siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley orgánica 2/2012, de 27 de abril, de estabilidad presupuestaria y sostenibilidad financiera;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el Real Decreto Legislativo 781/1986, de 18 de abril, que aprueba el texto refundido de las disposiciones legales vigentes en materia de régimen local;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley 38/2003, de 17 de noviembre, general de subvenciones; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el texto refundido de la Ley reguladora de las haciendas locales, aprobado por el Real Decreto Legislativo 2/2004, de 5 de marzo; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley 9/2017, de 8 de noviembre, de contratos del sector público; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley 4/2022, de 28 de junio, de consejos insulares;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el Decreto ley 3/2023 de 13 de marzo, por el cual se establecen ayudas y otras medidas urgentes para reparar las pérdidas y los daños producidos por la borrasca Juliette en la sierra de Tramuntana y otros lugares de la isla de Mallorca;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el Real Decreto 887/2006, por el cual se aprueba el reglamento que desarrolla la Ley general de subvenciones; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;las Bases de ejecución del presupuesto del Consejo de Mallorca&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el Plan estratégico de subvenciones del Consejo de Mallorca;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;y el resto de la normativa que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15.- Recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De conformidad con el artículo 44 en relación con el 46.6 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa, contra el acuerdo de aprobación de la convocatoria de subvenciones no se podrá interponer recurso en vía administrativa, si bien se podrá formular potestativamente requerimiento para su anulación o revocación en el plazo de dos meses contadores desde el día siguiente al de su publicación en el Boletín Oficial de las Islas Baleares (BOIB) con carácter previo a la interposición de recurso contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El requerimiento se entenderá desestimado si en el plazo de un mes desde su presentación no se notifica resolución expresa. El plazo para interponer el recurso contencioso administrativo será de dos meses contadores desde el día siguiente en aquel en el cual se reciba comunicación de la resolución expresa sobre el requerimiento previo o este se entienda desestimado de forma presunta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si no se formula requerimiento previo, se podrá interponer directamente recurso contencioso administrativo en el plazo de dos meses contadores desde el día siguiente en el de la publicación del acuerdo de aprobación de la convocatoria en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No obstante lo anterior, se puede interponer, si es el caso, cualquier otro recurso que se estime pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16.- Publicación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consejo de Mallorca, en cumplimiento del previsto en los artículos 17, 18 y 20 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, remitirá a la base de datos nacional de subvenciones información sobre la aprobación de la convocatoria de las subvenciones y de las resoluciones de concesión que se deriven y se publicará en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que ha tenido conocimiento de la convocatoria de subvenciones urgentes y excepcionales para cooperar en la reparación y restitución de los daños producidos por la Borrasca Juliette durante los días 26 a 28 de febrero de 2023 en los bienes, elementos etnológicos, infraestructuras, equipamientos, instalaciones y servicios de los Ayuntamientos de Mallorca, así como actuaciones de limpieza de arbolado y de fincas públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que, de acuerdo con el informe del técnico municipal, su municipio ha sufrido daños producidos por la Borrasca Juliette y que declara que la/as actuación/es solicitada/s para reparar o restituir estos daños no está cubiertos por sistemas privados de cobertura de daños.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que la Corporación que preside se quiere acoger a esta convocatoria y, por eso, acompaña la documentación prevista al punto 8.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Que, de conformidad con las normas de la convocatoria, que acepta íntegramente,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
