    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el Pleno de 29 de julio de 2021 se acordó la aprobación al primer punto de la Ordenanza reguladora de la promoción, venta y consumo de bebidas&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ORDENANZA DE MEDIDAS PARA REGULAR LA PROMOCIÓN, VENTA Y CONSUMO DE BEBIDAS ALCOHÓLICAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;EXPOSICIÓN DE MOTIVOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El consumo abusivo del alcohol es, según la OMS (Organización Mundial de la Salud), un grave problema de salud pública, está directamente relacionado con el desarrollo de muchas enfermedades. En los países desarrollados, se estima que el consumo abusivo de alcohol es el tercer factor de riesgo para la salud, es por eso que las instituciones trabajan para unificar esfuerzos en la promoción de la salud comunitaria y en estrategias para promover actitudes saludables y regular la comercialización de productos que pueden afectar la salud de las personas y en particular la de los niños y jóvenes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Según los datos de las últimas encuestas (ESTUDES 2014) de la población de las Islas Baleares, la edad mediana de inicio al consumo de alcohol es de 13'8 años, la prevalencia de consumo de bebidas alcohólicas entre los estudiantes de enseñanza secundaria de 14 a 18 años, alguna vez en la vida es de 78'8%, en cuanto a la prevalencia en los últimos 30 días el porcentaje se sitúa en 68'8%.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Desde hace un tiempo, se están generalizando pautas de consumo donde predomina el consumo intensivo, sobre todo durante los fines de semana y en las fiestas. Dentro de este patrón de consumo, el de más de cinco copas en periodos breves de tiempos (“bingedrinking”) según los datos del estudio un 26'3% de los jóvenes practican esta modalidad de consumo. Este “consumo”, se asocia también a un mayor uso de drogas ilegales (policonsumo).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Hay que destacar especialmente el que se ha popularizado con el nombre de “*botellón”, tanto por lo que supone una conducta de riesgo en un amplio sector de jóvenes, como por el impacto medioambiental que produce. La prevalencia, respecto a esta actividad en las Islas Baleares los últimos 30 días, es del 18'9% .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las reuniones masivas de jóvenes en plazas, parques públicos, con el alcohol ‘como vehiculitzador', constituyen en sí mismas un fenómeno de moda. Entre los factores que contribuyen a esta situación hay la facilidad que encuentra la gente para conseguir bebidas alcohólicas y la baja percepción que su consumo, incluso abusivo, comporte riesgo para el consumidor o su entorno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cuanto a la accesibilidad al alcohol, los datos de la encuesta señalan que los establecimientos donde mayoritariamente han comprado o han conseguido el alcohol, en los últimos 30 días, son los bares un 26'9% y los supermercados con un 23'6%, en el supuesto de que lo hayan comprado ellos mismos, siendo menores de edades, (14 a 17 años) llega hasta un 80% en los bares y a un 60% en los supermercados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La situación se caracteriza, por lo tanto, por un elevado consumo de bebidas alcohólicas, con tendencia a hacer un consumo muy concentrado en un tiempo corto y que afecta todas las edades, pero de manera más preocupante a los jóvenes, que empiezan a edades muy tempranas. Además, hay que añadir la existencia de una percepción de riesgo reducida por part de la población, lo cual favorece un incremento progresivo del consumo y a menudo ocasiona problemas diversos en el ámbito del hogar, la convivencia vecinal y al aumento del riesgo de accidentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Constitución española dentro de los principios rectores de la política social y económica contiene los principios y directrices que inspiran la acción administrativa art. 43.2 con relación a la protección de la salud a través de medidas preventivas y de las prestaciones y servicios necesarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Ayuntamiento, como órgano de administración y gobierno del municipio, ejerce su actividad para garantizar y fomentar los derechos individuales y colectivos de los vecinos, reconocidos por la Constitución y las leyes, así como hacer respetar y cumplir los deberes y obligaciones, legítimamente establecidos, en beneficio del interés general.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para cumplir esta misión, tiene la potestad de dictar ordenanzas para velar por la convivencia, proteger la salud pública, racionalizar el uso de los espacios públicos municipales y garantizar el aprovechamiento, por parte de todos los ciudadanos y ciudadanas, de las vías y los espacios públicos, para que las actividades de un sector de la ciudadanía no supongan un perjuicio grave para la tranquilidad y el descanso de los otros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con las finalidades mencionadas en los apartados anteriores, esta ordenanza regula una serie de medidas, encaminadas específicamente a fomentar y promover la convivencia y el civismo en el espacio público, identifica cuáles son los bienes jurídicos tutelados, prevé cuáles son las normas de conducta en cada caso, sanciona las que pueden perturbar, lesionar o deteriorar tanto la misma convivencia ciudadana como los bienes que se encuentran en el espacio público, que le tienen que servir de apoyo y tipifica, si procede, medidas específicas de intervención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En este marco constitucional y dentro de las competencias atribuidas por la legislación vigente en los ayuntamientos, se dicta la presente ordenanza, que prioriza la política preventiva en relación a niños y jóvenes, introduce medidas para regular los mecanismos de control, así como las prohibiciones y limitaciones de las actividades promocionales, publicitarias, de suministro, venta y consumo de estas sustancias. También pretende dotar de un marco estratégico con capacidad de detectar e intervenir con los adolescentes y jóvenes consumidores de alcohol con el objetivo de reducir los riesgos y daños secundarios al consumo y/o reducir al mínimo el consumo, así como de prevenir el consumo a los menores de edad con el fin de permitir el desarrollo íntegro de la persona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TÍTULO I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;DISPOSICIONES GENERALES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 1. Objeto y finalidad de la ordenanza&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La presente ordenanza tiene como objeto el desarrollo de las normas que regulan las limitaciones a la publicidad, venta, y consumo de bebidas alcohólicas, en el ámbito de las competencias que corresponden en el ayuntamiento de Deià, de acuerdo con la legislación estatal y de las Islas Baleares. Es también finalidad de esta ordenanza, fomentar la educación por la salud y la prevención del consumo abusivo de alcohol y otras drogas, especialmente en el caso de los menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 2. Fundamentos legales&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Esta ordenanza se ha elaborado de acuerdo con las competencias establecidas a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el artículo 25.2 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, y el artículo 29 de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley Orgánica 3/1986, de 14 de abril de medidas especiales en materia de salud pública, y la Ley 14/1986, de 25 de abril, general de sanidad;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley 34/1988, de 11 de noviembre general de publicidad.;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;el Real decreto legislativo 1/2007, de 16 de noviembre, por el cual se aprueba el texto refundido de la Ley general para la defensa de los consumidores y usuarios y otras leyes complementarias;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley 7/2013, de 26 de noviembre, de régimen jurídico de instalación, acceso y ejercicio de actividades en las Islas Baleares;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;la Ley 11/2014, de 15 de octubre, de comercio de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;2. La potestad de tipificar infracciones y sanciones que, con el fin de ordenar las relaciones de convivencia ciudadana, se establece en los artículos 139 y siguientes de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, y en el artículo 32.3 de la Ley Orgánica 4/2015, de 30 de marzo, de protección de la seguridad ciudadana.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;3. Para la correcta aplicación de la ordenanza, se tiene que tener en cuenta la Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Todo esto sin perjuicio del que puedan disponer las leyes autonómicas, que en su día se dicten, sobre promoción, venta y consumo de bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 3. Ámbito de aplicación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Ámbito de aplicación objetiva:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Esta ordenanza se aplica a todo el término municipal de Deià.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Particularmente, la ordenanza es de aplicación en todos los espacios y edificios públicos, en los espacios destinados al uso o al servicio público de titularidad municipal, y también a construcciones, instalaciones, mobiliario urbano y el resto de bienes y elementos de dominio público municipal que están situados en el mismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Así mismo, la ordenanza se aplica en aquellos otros espacios, construcciones, instalaciones, vehículos o elementos que estén destinados a un uso o a un servicio público de titularidad diferente a la municipal. Cuando corresponda, el Ayuntamiento tiene que impulsar la suscripción de convenios específicos con los titulares de tales espacios, construcciones, instalaciones, vehículos o elementos a fin de dotar de la cobertura jurídica necesaria a la intervención municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. La ordenanza se aplica también en espacios, construcciones, instalaciones y bienes de titularidad privada cuando se llevan a cabo las conductas o actividades reguladas en esta ordenanza: establecimientos comerciales, hosteleros y no hosteleros, establecimientos de actividades de espectáculos y de actividades recreativas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Ámbito de aplicación subjetiva&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Esta ordenanza se aplica a todas las personas que se encuentran en el municipio de Deià, sea cual sea su concreta situación jurídica administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. También es aplicable a las conductas realizadas por los menores de edad, en los términos y con las consecuencias que se prevén en esta ordenanza y en el resto del ordenamiento jurídico. En los supuestos en que esté previsto expresamente, los padres, tutores, o guardadores, también pueden ser considerados responsables de las infracciones cometidas por los menores cuando concurra, por parte de aquellos, luto, culpa o negligencia, incluida la simple inobservancia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. También es aplicable a las personas que tengan responsabilidad en las conductas sancionadas en la presente ordenanza y según los términos que se establecen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 4. Competencia municipal&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Constituye competencia de la Administración municipal:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. La conservación y la tutela de los bienes municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. La regulación de las condiciones de seguridad en las actividades organizadas en espacios públicos y en los locales de concurrencia pública, que incluye la vigilancia de los espacios públicos y la protección de personas y bienes, en coordinación con los cuerpos y las fuerzas de seguridad del Estado de acuerdo con el que establece la Ley Orgánica 2/1986, de 13 de marzo, de fuerzas y cuerpos de seguridad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Es obligación del Ayuntamiento de Deià, elaborar un plan de control y prevención del consumo abusivo del alcohol y otras sustancias enmarcado en el Plan municipal de actuaciones sobre drogodependencias y conductas adictivas, que tiene que ser revisado cada año por una comisión de seguimiento y tiene que incorporar los siguientes objetivos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aprobar un plan de medios personales y materiales para la aplicación efectiva de la presente Ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Promover e impulsar programas para fomentar el civismo y la convivencia ciudadana dirigidos a diferentes colectivos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Elaborar un plan socioeducativo con el objetivo de prevenir el abuso del alcohol y otras drogas y los efectos negativos que provoca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Realizar regularmente campañas informativas y publicitarias sobre los efectos nocivos del consumo abusivo de bebidas alcohólicas y otras drogas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Promover programas de ocio alternativo para los jóvenes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Potenciar y promover el uso del transporte público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Promover e impulsar programas y campañas específicas en el sector del comercio y el hotelería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Impulsar una mayor implicación e intervención de los profesionales sanitarios en la hora de reducir los problemas relacionados con el consumo del alcohol y otras drogas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Facilitar las herramientas necesarias a las APYMA para intensificar la formación de educación para la salud, para procurar una mayor implicación de la familia en la formación integral de los menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Crear y promover equipos de mediación para la educación en salud y la intervención en resolución de conflictos in situ.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Elaborar un protocolo para la intervención concreta en menores de edad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Las medidas de protección de competencia municipal previstas en esta ordenanza se entienden sin perjuicio de los derechos, las facultades y los deberes que corresponden a las personas titulares de los bienes afectados y de las competencias otras administraciones públicas y de los juzgados y tribunales de justicia reguladas por las leyes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La aplicación de las medidas establecidas en esta ordenanza tiene como objetivo principal la preservación de la salud, el restablecimiento del orden cívico, la reprensión de las conductas antisociales y la reparación de los daños causados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TÍTULO II&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;MEDIDAS PREVENTIVAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 5. Medidas de información, orientación y educación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Administración municipal facilita a los residentes en el término municipal, mediante los servicios de bienestar social, juventud, cultura, deportes, policía y otros del municipio, asesoramiento y orientación sobre la prevención del consumo abusivo de alcohol y, si es el caso, del tratamiento de las situaciones de adicción y de los problemas derivados del consumo de bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con tal fin tiene que promover e impulsar campañas informativas que conciencien de los efectos del consumo abusivo de alcohol a fin de modificar hábitos y actitudes en relación a su consumo. Estas campañas divulgativas se tienen que dirigir al conjunto de la población y visitantes, enfatizando los aspectos positivos de la no ingestión abusiva de alcohol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Se tiene que dispensar una protección especial en este campo a los niños y jóvenes, y población general. Para tal fin, los servicios municipales de manera coordinada con los servicios de las otras administraciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tienen que promover acciones en el ámbito de la información, formación, educación para el ocio, etc., que tiendan a conseguir los indicados fines preventivos en este colectivo, en colaboración con los centros escolares, culturales, deportivos y todas aquellas instituciones que dispongan de infraestructuras destinadas a un público compuesto principalmente por menores de 18 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tienen que promover actuaciones de sensibilización, educativas y formativas que potencian entre los niños y los jóvenes, y la población en general, el valor de la salud en el ámbito individual y social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- El Ayuntamiento tiene que promover de manera especial las actuaciones dirigidas a niños y jóvenes por parte de los profesionales de la propia administración: policía local (en especial, policía tutor), educadora o educador, profesional de la psicología y de trabajo social de los servicios sociales municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El ayuntamiento tiene que dotarse de los dispositivos y medios necesarios de intervención sobre las conductas desarrolladas por los jóvenes menores de dieciocho años relacionadas con el consumo de alcohol en la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En el campo del asociacionismo tiene que promover, con la misma finalidad, las asociaciones y entidades que trabajen en drogodependencias y les tiene que facilitar la participación e integración en los programas de prevención que se llevan a cabo en el municipio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 6. Participación ciudadana&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el ámbito de sus competencias el Ayuntamiento de Deià tiene que adoptar las medidas adecuadas de fomento de la participación social y el apoyo a las instituciones sin ánimo de lucro que colaboran con el municipio en la ejecución de los programas de prevención que contribuyen a la consecución de los objetivos de esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las acciones informativas y educativas, y cuántas otras medidas adopte en este campo el ayuntamiento, se tienen que dirigir a familias, mediadores sociales, sector de hostelería y ocio, etc., a fin de favorecer su colaboración en el cumplimiento del fin pretenso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TÍTULO III&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;MEDIDAS DE INTERVENCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 7. Título habilitante&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La venta y el suministro de bebidas alcohólicas solo se puede hacer en los establecimientos que dispongan del correspondiente título habilitante en materia de actividades que contemple la venta y, si es el caso, el consumo de bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. No se permite la venta ni el suministro de bebidas alcohólicas en la vía pública, excepto terrazas, veladores, o en días de feria o fiestas patronales o similares autorizados al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 8. Prohibición de mostradores en la vía pública&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se prohíbe, bajo la responsabilidad de los titulares de los establecimientos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. La venta o suministro de bebidas alcohólicas en los establecimientos de hostelería y establecimientos comerciales, para ser consumidas en el exterior o en la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. La existencia de mostradores, ventanas o huecos que hagan posible el despacho de bebidas alcohólicas a personas situadas en la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. La venta de alcohol en descampados, playas, merenderos, sin la solicitud y obtención previa de la correspondiente autorización municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 9. Fiestas Populares&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las actividades relacionadas con la venta y consumo de alcohol en la vía pública en días de fiesta patronal o fiestas populares, así como cualquiera otra fecha que se determine por resolución de Alcaldía, tienen que contar con la correspondiente autorización. Su concesión o denegación se tiene que ajustar a su normativa específica, así como a los requisitos y condiciones establecidos en la presente ordenanza, y de manera específica, tienen que observar las siguientes obligaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Los titulares tienen que justificar haber participado en un curso sobre la dispensación responsable de bebidas alcohólicas, y tienen que asegurar que durante todo el tiempo que tengan abierto al público siempre habrá un mínimo de la mitad del personal con esta formación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. No servir bebidas alcohólicas a menores de edad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Ofrecer agua a un precio más asequible que cualquier otro tipo de consumición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Por razones de seguridad, en aquellos espectáculos multitudinarios como conciertos u otros acontecimientos similares que se celebren con autorización municipal que incluyan la posibilidad de dispensar bebidas y otras consumiciones, estas se tienen que servir en envases de plástico, y no se permite en ningún caso vidrio, latas o similares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Los titulares de la concesión de la instalación de un bar u otra actividad clasificada similar, como por ejemplo una concesión temporal durante las fiestas, tienen que colocar en lugar visible al público que tienen licencia de actividad para suministrar y/o consumir bebidas alcohólicas, así como el cartel de prohibición de venta a menores de 18 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 10. De la actuación inspectora&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La policía municipal y los servicios técnicos municipales competentes, conforme a las disposiciones vigentes en la materia, están facultadas para investigar, inspeccionar, reconocer y controlar todo tipo de locales e instalaciones a efectos de verificar el cumplimiento por sus titulares de las limitaciones y prohibiciones establecidas en la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Cuando se aprecie algún hecho que se estime pueda constituir infracción a los preceptos de la presente ordenanza, se tiene que extender el correspondiente parte de denuncia o acta si es procedente, o se tienen que consignar los datos personales del presunto infractor y los hechos o circunstancias que puedan servir de base para la incoación del correspondiente procedimiento sancionador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Los titulares, gerentes, encargados o responsables de la actividad sometida a control municipal están obligados a prestar la ayuda y colaboración necesaria para la realización de la labor inspectora referida a la comprobación del cumplimiento de los preceptos de esta ordenanza. Es una infracción e incurre en infracción de esta quien por medio de oposición activa o por simple omisión entorpezca, dificulte o impida el desarrollo de la mencionada labor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TÍTULO IV&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;PROHIBICIONES Y LIMITACIONES A LA PUBLICIDAD, VENTA Y CONSUMO DE BEBIDAS ALCOHÓLICAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A. Medidas en cuanto a la publicidad y promoción de las bebidas alcohólicas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 11. A todos los efectos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Todos aquellos establecimientos que suministren y vendan bebidas alcohólicas tienen que tener fijado un cartel señalizador con el siguiente texto ‘Prohibida la venta de cualquier tipo de bebidas alcohólicas a menores de 18 años'.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En establecimientos con mostrador, el cartel se tiene que situar detrás de este, en lugar perfectamente visible, a razón de un cartel por cada mostrador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En el resto de establecimientos las señalizaciones se tienen que colocar en un lugar visible, a razón de un cartel por cada mostrador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En los establecimientos de autoservicio, la venta de bebidas alcohólicas se tiene que realizar en una sección concreta, con letreros anunciadores de la prohibición de venta a menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Está prohibida la venta, distribución, suministro desde automóviles, caravanas, carretas o paradas, tanto a título oneroso como gratuito, excepto en las fiestas, ferias y fiestas patronales cuando esté debidamente autorizado con anterioridad. En los casos de autorización por las fiestas, también es obligatorio colocar el mencionado cartel señalizador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 12. De las limitaciones a la publicidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La promoción y publicidad, tanto directa como indirecta, de bebidas alcohólicas, tiene que respetar las limitaciones y prohibiciones establecidas en la Ley 34/1988 general de publicidad, RDL 1/2007 de 16 de noviembre por el cual se aprueba el texto refundido de la Ley General para la defensa de consumidores y usuarios y otras leyes complementarias, y en las respectivas normativas de prevención, asistencia e integración social de las personas con problemas derivados del abuso de drogas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sin perjuicio de lo que establecen las normas anteriores, la publicidad, tanto directa como indirecta, de bebidas alcohólicas tiene que observar, en todo caso, las siguientes limitaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Queda prohibida cualquier campaña, sea como actividad publicitaria o no publicitaria, dirigida a menores de dieciocho años que induzca directamente o indirecta al consumo de bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. En ningún caso pueden utilizarse voces o imágenes de menores de dieciocho años, o de jóvenes que puedan suscitar dudas sobre su mayoría de edad, para ser utilizados como soportes publicitarios de bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. No tiene que asociarse el consumo de alcohol a una mejora del rendimiento físico y psíquico, a la conducción de vehículos o al manejo de armas, ni dar la impresión que este consumo contribuye al éxito social o sexual. Tampoco puede asociarse este consumo a prácticas educativas, sanitarias o deportivas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 13. De las prohibiciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Se prohíbe expresamente la publicidad directa o indirecta de bebidas alcohólicas en:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Locales e instalaciones destinados predominantemente a jóvenes menores de 18 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Centros y dependencias de la Administración municipal, y en especial centros de acción social y centros culturales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el interior y exterior de los medios de transporte público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los vehículos del servicio de taxi con licencia municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En los centros docentes, tanto los dedicados a enseñanzas no regladas como cualquier tipo de enseñanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Instalaciones móviles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mobiliario urbano municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Empresas de transporte público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Lugares donde está prohibida su venta y consumo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Se prohíbe cualquier publicidad dirigida a menores de 18 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En los periódicos, revistas y el resto de publicaciones, así como cualquier medio de registro y reproducción gráfica o sonora dirigidas a menores de dieciocho años está prohibido todo tipo de publicidad directa o indirecta de bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 14. Promoción de bebidas alcohólicas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La promoción de bebidas alcohólicas en ferias, certámenes, exposiciones y actividades similares, se tiene que situar en espacios diferenciados cuando tengan lugar dentro de otras manifestaciones públicas. En estas actividades no está permitido el ofrecimiento, ni la degustación gratuita a menores de 18 años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. No se pueden distribuir a menores invitaciones, carteles u objetos (bolígrafos, camisetas, etc.) alusivos a bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Está prohibida la promoción de bebidas alcohólicas por medio de la distribución de información por buzones, correo, teléfono o redes informáticas, salvo que esta vaya dirigida nominalmente a mayores de dieciocho años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Queda prohibida la promoción de bebidas alcohólicas en los establecimientos y locales de venta o suministro que supongan una incitación directa a un mayor consumo, mediante ofertas promocionales, premios, sorteos, concursos, fiestas o rebajas de los precios estipulados segundos tarifas autorizadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. No se pueden utilizar las bebidas alcohólicas como premio o incentivo en la promoción de artículos, bienes, servicios o actividades de ninguna clase si pueden participar menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La Administración municipal no puede utilizar como apoyos informativos o publicitarios objetos relacionados con el consumo de bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A. Medidas en cuanto al suministro, venta y consumo de bebidas alcohólicas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 15. Prohibiciones de carácter general&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. No se permite la venta, suministro o distribución de bebidas alcohólicas con carácter ambulante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. No se permite la venta ni el consumo de bebidas alcohólicas en:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Centros sanitarios, sociosanitarios, sociales y culturales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Establecimientos destinados en el despacho de pan y leche, churrerías, así como todos los que no tengan autorización exprés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Recintos con carácter deportivo-recreativo, salvo que sean en lugares especialmente habilitados para lo cual.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los centros de asistencia a menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Centros educativos de enseñanza primaria, secundaria y especial, y centros destinados a la enseñanza deportivos o culturales para menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Centros y dependencias de la Administración, excepto en los lugares expresamente habilitados a tal efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Locales de trabajo de las empresas de transportes públicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Queda prohibida la venta de bebidas alcohólicas en quioscos, paradas de helados, tiendas de artículos diversos y cualquier otra de instalación permanente, ocasional o de temporada en la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Queda prohibido el suministro de bebidas alcohólicas a través de máquinas automáticas, salvo que se encuentran en el interior de establecimientos cerrados y a la vista de una persona encargada que se cumplan las condiciones anteriores, y bajo la directa responsabilidad del titular de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En los establecimientos en régimen de autoservicio la exhibición de bebidas alcohólicas se tiene que realizar en una sección concreta con carteles anunciadores de la prohibición de su venta a menores. Se responsabiliza de dicha venta de bebidas alcohólicas a menores el titular del establecimiento, o terceras personas mayores de edad que, a fin de eludir el control de los responsables de los comercios, adquieran personalmente las bebidas alcohólicas y posteriormente las faciliten a los menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. No se permite la venta, suministro y consumo de bebidas alcohólicas en los establecimientos que no tengan el título habilitante correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En los establecimientos autorizados para la venta y consumo de bebidas alcohólicas, como por ejemplo bares, restaurantes, cafeterías, clubes nocturnos, etc. está prohibido vender bebidas de ninguna clase cuando falte media hora para la hora autorizada de cierre, ya sea por la propia licencia de actividad como por la normativa vigente. Se puede establecer una excepción durante las fiestas populares y tradicionales, cuando se autorice expresamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. En los establecimientos autorizados para la venta y consumo de bebidas alcohólicas, como por ejemplo bares, restaurantes, cafeterías, clubes nocturnos, etc., está prohibido sacar vasos, botellas de vidrio, de plástico, o cualquier otro recipiente de los establecimientos fuera del local. Así mismo está prohibido que incluyan la venta de bebidas alcohólicas en los servicios para llevar y a domicilio. Del incumplimiento de esta prohibición son responsables tanto los autores como los titulares de los establecimientos, por lo cual, tienen que adoptar las medidas correspondientes, a fin de evitarlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Los establecimientos que tengan la terraza sobre la vía pública o sin ninguna delimitación que la separe, tienen prohibido servir alcohol.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Los establecimientos comerciales no hosteleros no pueden vender bebidas alcohólicas de ninguna clase entre las 22:00 horas y las 8:00 horas del día siguiente, con independencia del régimen de apertura que los sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Los establecimientos de actividades permanentes de espectáculos públicos, actividades recreativas y establecimientos públicos, a partir de la hora de cierre que les sea aplicable según la normativa vigente, tienen que&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Dejar de servir bebidas y otros servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Parar la música.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Impedir la entrada de usuarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. Dejar de ejecutar cualquier espectáculo, juego o similar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e. Encender la iluminación para facilitar la salida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 16. Protección de los menores&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. No se pueden vender ni suministrar bebidas alcohólicas ni tabaco, ni tampoco permitir el consumo a menores de 18 años, tanto en los lugares de expedición, como en los de consumo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En todos los establecimientos públicos donde se venda o facilite de cualquier manera o forma bebidas alcohólicas, se tiene que informar con carácter obligatorio que está prohibida su adquisición y consumo por los menores de dieciocho años, así como la venta, suministro o dispensación a los menores. Esta información se tiene que realizar por medio de anuncios o carteles de carácter permanente, fijados en forma visible en el mismo punto de expedición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En todos los establecimientos comerciales se tienen que adoptar medidas especiales de control para evitar la venta de bebidas alcohólicas a menores de dieciocho años.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Está prohibido que los menores de 18 años puedan vender o dispensar bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La autoridad, en cumplimiento de su papel de agente de prevención y con el objetivo de protección de los menores, puede confiscar las bebidas alcohólicas que lleven las personas menores de edad cuando pueda prever que es para su consumo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 17. Acceso de menores y acreditación de la edad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El acceso de menores a establecimientos se rige por lo que dispone la normativa estatal y autonómica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. A los efectos establecidos en los artículos precedentes, los titulares, encargados, empleados o responsables de los establecimientos pueden solicitar de sus clientes, respecto a la Constitución y el resto del ordenamiento jurídico, los documentos acreditativos de su edad cuando esta le ofrezca dudas razonables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 18. Del consumo de bebidas alcohólicas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Está prohibida la venta automática de bebidas alcohólicas a menores de 18 años. El titular del establecimiento es el responsable del cumplimiento de esta prescripción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Está prohibida, bajo responsabilidad del titular, gerente, responsable o representante legal de la actividad, que los consumidores saquen bebidas alcohólicas del establecimiento a la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. No se puede suministrar ni consumir bebidas alcohólicas en centros de trabajo dependientes del ayuntamiento, excepto en las dependencias habilitadas para ello.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En las recepciones y actas sociales organizados por el ayuntamiento en que se ofrezca alguna bebida alcohólica, siempre tienen que ofrecerse bebidas alternativas. El Ayuntamiento, en estos casos, tiene que vigilar el cumplimiento del artículo 14 de la presente ordenanza de no hacer promoción de bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 19. Del consumo de bebidas alcohólicas en la vía y espacios públicos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Está prohibido el consumo de bebidas alcohólicas en la vía y espacios públicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La prohibición a la cual se refieren estos apartados anteriores sin perjuicio de cuando el mencionado consumo cuente con la oportuna autorización municipal, como las fiestas populares y patronales, conciertos u otros acontecimientos similares con autorización municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Las personas que organicen cualquier acto público de naturaleza cultural, lúdica, festiva, deportiva o de cualquiera otra índole están obligadas a velar porque no se produzcan durante el acto las conductas descritas en los apartados 1 y 2 de este artículo. Si con motivo de cualquier de estos actos se realizan las conductas mencionadas, las personas responsables de la organización lo tiene que comunicar inmediatamente a la Policía Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TÍTULO V&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Artículo &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 20. Infracciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sin perjuicio de las responsabilidades de otra índole que se puedan derivar, constituyen infracciones administrativas las acciones u omisiones tipificadas en esta ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 21. Responsabilidad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La responsabilidad administrativa por las infracciones tipificadas en esta ordenanza es de la persona física o jurídica que haga las acciones u omisiones que se tipifican. En las infracciones que hacen referencia a actividad comercial o empresa, se presume que las han hecho los titulares de la empresa o actividad comercial de que se trate.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Cuando se declare autor de los hechos una persona menor de dieciocho años no emancipada o una persona con la capacidad modificada judicialmente, tienen que responder solidariamente con ella de los daños y perjuicios ocasionados sus padres y/o tutores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. De acuerdo con el que establece la Convención de las Naciones Unidas sobre los derechos del niño todas las medidas en este caso sancionadoras de las autoridades municipales que puedan afectar a los menores tienen que atender principalmente al interés superior de estos. Se tiene que garantizar el derecho del niño y del adolescente a ser escuchado en todos aquellos asuntos que le afecten y a que sus opiniones se tengan en cuenta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En el caso de las infracciones leves referidas al consumo en la vía pública, se prevé la suspensión de la sanción si la persona infractora se somete a una intervención educativa o, en caso de necesidad, terapéutica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En todo caso, cualquier denuncia, incoación de un expediente sancionador o eventual imposición de una sanción a un menor será notificada a sus padres o tutores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En caso de que, una vez practicadas las diligencias de investigación oportunas dirigidas a individualizar la persona o las personas infractoras, no sea posible determinar el grado de participación de los varios sujetos que hayan intervenido en la comisión de la infracción, la responsabilidad será solidaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo&amp;nbsp;22. Tipificación de las infracciones y sanciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las infracciones se clasifican en leves, graves y muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las infracciones leves son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No disponer, en el lugar donde se desarrolla la actividad, de la documentación preceptiva (infracción art. 7)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La venta y suministro de bebidas alcohólicas en mostradores en la vía pública (art. 8)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dispensar bebidas en envases de vidrio, latas o similares (infracción artículo 9.2).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento del que establece el artículo 11 sobre señalización y espacios diferenciados para las bebidas alcohólicas en los lugares de venta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento del que establecen los artículos 12, 13 y 14 sobre limitaciones y prohibiciones de la publicidad y la promoción de bebidas alcohólicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Consumo de bebidas alcohólicas en la vía pública, cuando perturbe gravemente la tranquilidad ciudadana (infracción artículo 19)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Aquellas que constituyan cualquier incumplimiento de la presente ordenanza y no son consideradas infracciones graves o muy graves.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las infracciones graves son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de las prescripciones y prohibiciones recogidas en el artículo 15&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de las medidas de protección de los menores, recogidas en el artículo 16.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de las prescripciones recogidas en el artículo 17 sobre acceso de menores a los establecimientos y acreditación de la edad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de las prescripciones, restricciones y prohibiciones sobre venta y consumo de bebidas alcohólicas recogidas en el artículo 18.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La comisión de una falta leve más de tres veces en el plazo de un año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las infracciones muy graves son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La venta y el suministro de bebidas alcohólicas sin disponer del correspondiente título habilitante en materia de actividades (infracción art. 7 y art. 15.5).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- La comisión de más de una infracción grave, declarada con resolución firme, en el plazo de un año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 23. Procedimiento sancionador&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las infracciones a las disposiciones de esta ordenanza son objeto de las sanciones administrativas correspondientes, previa la instrucción del procedimiento oportuno, tramitado conforme al que establece la normativa específica en materia de abanica, promoción y consumo de bebidas alcohólicas, así como la Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El expediente sancionador se inicia siempre de oficio, por petición razonada de otro órgano o por denuncia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Las denuncias tienen que expresar la identidad de la persona o personas que las presenten, el relato de los hechos que pudieran constituir infracción, la fecha de su comisión y, cuando sea posible, la identificación de las personas presuntamente responsables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El Ayuntamiento puede compensar a las persones denunciantes por los gastos que los haya podido comportar la formulación de una denuncia, siempre que queden efectivamente acreditadas en el expediente tanto la comisión de la infracción administrativa denunciada como la necesidad del gasto efectuado y la cuantía de los gastos alegados por aquellas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Cuando el denunciante haya participado en la comisión de una infracción y existan otros infractores, el órgano competente para resolver el procedimiento se tiene que eximir al denunciante del pago de la sanción que le correspondería, u otro tipo de sanción no pecuniaria, cuando sea lo primero al aportar elementos de prueba que permitan iniciar el procedimiento o comprobar la infracción, siempre y cuando en el momento de aportarse, no se disponga de elementos suficientes para ordenarla y se repare el perjuicio causado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El instructor tiene que proteger la identidad del denunciante y la confidencialidad de sus datos personales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La incoación del expediente no se tiene que comunicar al denunciante, si no es persona interesada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Cuando la infracción cometida no sea de competencia municipal, el alcalde tiene que elevar al órgano correspondiendo el acta o denuncia con el fin de solicitar la incoación del expediente sancionador en conformidad con la legislación sectorial aplicable.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 24. Medidas provisionales en fase de instrucción.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Iniciado el expediente sancionador, mediante un acuerdo motivado, se pueden adoptar las medidas provisionales imprescindibles para el normal desarrollo del procedimiento, para evitar la comisión de nuevas infracciones o para asegurar el cumplimiento de la sanción que pudiera imponerse. Estas medidas pueden consistir en cualquiera de las previstas en la normativa general y sectorial aplicable en cada caso, y tienen que ser proporcionadas a la naturaleza y la gravedad de la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Los agentes de la autoridad podrán, en todo caso, decomisar los utensilios, vehículos y el género objeto de la infracción o que se usan, directa o indirectamente, para la comisión, y también el dinero, los frutos o los productos obtenidos con la actividad infractora, los cuales quedan bajo la custodia municipal mientras sea necesario para la tramitación del procedimiento sancionador o, a falta de este, mientras perduren las circunstancias que han motivado el decomiso. También se puede decretar la suspensión de la licencia de la actividad, cierre temporal del establecimiento, retirada de productos, suspensión temporal de servicios por razones de sanidad, higiene o seguridad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Los gastos ocasionados por el decomiso, transporte, depósito y destrucción son a cargo del causante de las circunstancias que lo han determinado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Si se trata de bienes fungibles, se tienen que destruir o se les tiene que dar el destino adecuado. Los objetos decomisados se tienen que depositar a disposición del órgano sancionador competente para la resolución del expediente. Una vez dictada una resolución firme y transcurridos dos meses sin que el titular haya recuperado el objeto, se tienen que destruir o entregar gratuitamente a entidades sin ánimo de lucro con fines sociales. Aun así, los objetos, materiales, vehículos o medios intervenidos, se pueden devolver si el propietario abona previamente en vía voluntaria la sanción que corresponda, justificando su propiedad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Excepcionalmente, en caso de grave riesgo o peligro inminente por personas o corderos, la policía local puede adoptar las medidas provisionales directamente con carácter previo a la incoación del expediente y se tienen que rectificar, modificar o revocar en el acuerdo de incoación en el plazo máximo de 15 días. En todo caso, estas medidas quedan sin efecto si no se incoa el procedimiento o el acuerdo de incoación no tiene un pronunciamiento explícito sobre las medidas provisionales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 25. Sanciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Modificación de las cuantías de la sanción:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las posibles reducciones, se tienen que determinar en la notificación de iniciación del procedimiento y su efectividad está condicionada a la dejación o renuncia de cualquier acción o recurso en vía administrativa contra la sanción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cuando el beneficio que resulte de una infracción sea superior a la sanción que corresponda, esta se puede incrementar en la cuantía equivalente al beneficio obtenido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El pago voluntario de la sanción resultante de la comisión de cualquier de las infracciones impuestas supone las siguientes reducciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Las personas denunciadas pueden asumir su responsabilidad mediante el pago de las sanciones previo a la resolución del expediente sancionador, con una reducción en mitad de la sanción tipo si se hace efectivo antes del inicio del procedimiento sancionador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. El pago del importe de la sanción de multa implica la finalización del procedimiento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

De las medidas alternativas al cumplimiento de la sanción.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En el caso de las infracciones leves referidas al consumo en la vía pública cometidos por menores, se prevé la suspensión de la sanción si la persona infractora o sus padres o tutores acuerdan una intervención educativa o, en caso de necesidad, terapéutica alternativa a la sanción pecuniaria. La medida alternativa se tiene que acordar entre la persona infractora y alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Si se acuerda una medida alternativa a la sanción, el expediente sancionador queda suspendido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Se establece que cada hora de medida educativa o reparadora que se establezca, incluido el trabajo comunitario o social, equivale al importe de 20 euros de multa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 27. De la prescripción de las infracciones y caducidad del procedimiento sancionador.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Las infracciones tipificadas como leves, prescriben a los seis meses, las tipificadas como graves prescriben a los dos años y las muy graves a los tres años, e inician el plazo de prescripción a partir del momento que se comete la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El procedimiento sancionador ordinario se tiene que resolver, notificando la resolución a la persona interesada en el plazo máximo de un año.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Las sanciones tipificadas como leves prescriben a los seis meses, las graves prescriben a los dos años y las muy graves a los tres años e inician el plazo de prescripción desde el momento en que la resolución es firme.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 28. Apreciación de delito o falta&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Cuando las conductas a que se refiere esta ordenanza pudieran constituir infracción penal, se tienen que remitir al Ministerio Fiscal o a la autoridad judicial que corresponda los antecedentes necesarios de las actuaciones practicadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En el caso de identidad de sujeto, hecho y fundamento de las conductas ilícitas, la incoación de un proceso penal no impide la tramitación de expedientes sancionadores por los mismos hechos, pero la resolución definitiva del expediente solo puede producirse cuando sea firme la resolución recaída en el ámbito penal, quedando hasta entonces interrumpido el plazo de prescripción. Los hechos declarados probados en vía judicial vinculan la autoridad competente para imponer la sanción administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La condena o la absolución penal de los hechos no impide la sanción administrativa, si se aprecia diversidad de fundamento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Las medidas provisionales adoptadas en el seno del procedimiento administrativo sancionador antes de la intervención judicial pueden mantenerse en vigor mientras no recaiga pronunciamiento exprés respecto de esto de las autoridades judiciales, sin perjuicio de los recursos que pueda interponer el presunto infractor sobre el establecimiento o la vigencia de las dichas medidas provisionales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 29. Decretos e instrucciones del alcalde en desarrollo y aplicación de la ordenanza&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cuando las circunstancias así lo aconsejen, el alcalde puede dictar las instrucciones correspondientes para la aplicación de la ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Sin perjuicio de la imposición de la sanción que si se tercia corresponda, el alcalde puede también requerir a las personas que resulten responsables de alguna de las conductas descritas en esta ordenanza porque se abstengan en el futuro de realizar actuaciones parecidas dentro del término municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de las órdenes o requerimientos previstos al apartado anterior puede dar lugar a procedimiento sancionador o penal a &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 30. Funciones de la Policía Local referentes al cumplimiento de esta ordenanza&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En su condición de policía administrativa, la Policía Local es la encargada de velar por el cumplimiento de esta ordenanza, de inspeccionar y denunciar, cuando corresponda, las conductas que le sean contrarias, y de adoptar, se procede, las otras medidas de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 31. Deber de colaboración ciudadana en el cumplimiento de la ordenanza&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Todas las personas que están en Deià tienen el deber de colaborar con las autoridades municipales o sus agentes para preservar las relaciones de convivencia ciudadana y civismo en el espacio público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Toda la ciudadanía tiene el deber de comunicar a las autoridades o agentes más próximos cualquier situación que detecten de presunto riesgo o desamparo de un menor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 32. Conductas obstruccionistas a las tareas de control, investigación o sanción en los ámbitos de la convivencia y el civismo&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En los ámbitos de la convivencia ciudadana y el civismo, y salvaguardando todos los derechos previstos en el ordenamiento jurídico, no se permiten las conductas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. La negativa o la resistencia a las tareas de inspección o control del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Suministrar a los funcionarios actuantes, en cumplimiento de sus labores de inspección, control o sanción, información o documentación falsa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. El incumplimiento de las órdenes o los requerimientos específicos formulados por las autoridades municipales o sus agentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Sin perjuicio de la legislación penal y sectorial, las conductas descritas en el apartado anterior son constitutivas de infracción grave.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo&amp;nbsp;33. Presunción de veracidad de los agentes de la autoridad&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En los procedimientos sancionadores que se instruyan en aplicación de esta ordenanza, los hechos constatados por agentes de la autoridad tienen presunción de veracidad, de acuerdo con la normativa aplicable a tal efecto, sin perjuicio otras pruebas que puedan aportar los interesados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En los expedientes sancionadores que se instruyan, y con los requisitos que correspondan conforme a la legislación vigente, se pueden incorporar imágenes de los hechos denunciados, ya sea con fotografía, filmación digital u otros medios tecnológicos, que permitan acreditar los hechos recogidos en la denuncia formulada de acuerdo con la normativa aplicable. En todo caso, la utilización de video-cámaras requiere, si es procedente, de las autorizaciones previstas en la legislación aplicable, y su uso de acuerdo con el principio de proporcionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 34. Medidas de carácter social&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Cuando el presunto responsable del incumplimiento de la ordenanza sea indigente o presente otras carencias o necesidades de asistencia social o de atención médica especiales o urgentes, los agentes de la autoridad que intervengan tienen que informar de la posibilidad de acudir a los servicios sociales o médicos correspondientes y del lugar concreto en que puede hacerlo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En aquellos casos especialmente graves o urgentes, y con el único objeto que la persona pueda recibir efectivamente y cuanto antes mejor la atención social o médica requerida, los agentes de la autoridad u otros servicios competentes pueden acompañarla a los mencionados servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Así mismo, siempre que sea posible, y previa la autorización de la persona mayor de edad y capaz, los servicios municipales pueden intentar contactar con la familia de la persona afectada para informarla de la situación y circunstancias en que ha sido encontrada en el espacio público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Artículo 35. Medidas de policía administrativa directa&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Los agentes de la autoridad tienen que exigir en todo momento el cumplimiento inmediato de las disposiciones previstas en esta ordenanza y, sin perjuicio de denunciar las conductas ilícitas, pueden requerir verbalmente a las personas que no respeten las normas para que cejen en su actitud o comportamiento, advirtiéndolos que en caso de resistencia pueden incurrir en desobediencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Cuando la infracción cometida provoque, además de una perturbación de la convivencia ciudadana y el civismo, un deterioro del espacio público, se tiene que requerir a su causante la reparación, restauración o limpieza inmediatas, cuando sea posible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En caso de resistencia a estos requerimientos, y sin perjuicio de lo que dispone el apartado 1 de este artículo, las personas infractoras pueden ser desalojadas, cumpliendo en todo caso con el principio de proporcionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. A los efectos de poder incoar el correspondiente procedimiento sancionador, los agentes de la autoridad tienen que requerir la persona presuntamente responsable que se identifique.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En caso de no conseguir la identificación por cualquier medio de la persona que ha cometido una infracción, los agentes de la autoridad pueden requerirla porque, a fin de iniciar el expediente sancionador de la infracción cometida, los acompañe a dependencias próximas que cuenten con medios adecuados para realizar las diligencias de identificación, a estos únicos efectos y por el tiempo imprescindible, con un máximo de seis horas informando la persona presuntamente infractora de los motivos del requerimiento de acompañamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Disposición final&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La presente ordenanza entra en vigor, una vez aprobada definitivamente por la corporación, en el plazo de quince días hábiles a partir del siguiente al de su publicación en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Disposición derogatoria&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el momento de la entrada en vigor de la presente ordenanza queda derogada la antigua Ordenanza municipal de medidas para regular la promoción, venta y consumo de bebidas alcohólicas, publicada al BOIB 129 de 18 de octubre de 2018.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
