![CDATA[<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Antecedentes</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. Mediante la Resolución de la consejera de Presidencia, Función Pública e Igualdad de 16 de septiembre de 2022 (BOIB núm. 122, de 17 de septiembre de 2022), se aprobaron las bases generales que deben regir el proceso excepcional de estabilización por concurso extraordinario de méritos para cubrir las plazas de personal funcionario de la Administración general y especial de la Comunidad Autónoma de las Islas Baleares.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. En fecha 13 de junio de 2023 se publicó la Resolución de la consejera de Presidencia, Función Pública e Igualdad por la que se ofrecen los puestos de trabajo y se requiere a los aspirantes para que presenten la documentación acreditativa del cumplimiento de los requisitos del proceso excepcional de estabilización por concurso extraordinario de méritos para cubrir las plazas de personal funcionario de la Administración general de la Comunidad Autónoma de las Islas Baleares.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. El 5 de octubre de 2023 se publicaron las listas definitivas de valoración de méritos del cuerpo subalterno del proceso excepcional de estabilización por concurso extraordinario de méritos para cubrir las plazas de personal funcionario de la Administración general de la Comunidad Autónoma de las Islas Baleares, incluida la reserva de personas con discapacidad.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Una vez comprobado el cumplimiento de los requisitos para ser nombrados funcionarios de carrera, siguiendo el orden obtenido en las puntuaciones de la lista definitiva de valoración de méritos y aplicados los desempates, el tribunal ha acordado elevar a la consejera de Presidencia y Administraciones Públicas la propuesta de aspirantes que han superado el proceso selectivo del concurso y que han presentado la documentación pertinente, las cuales deben ser nombradas personal funcionario de carrera del cuerpo subalterno de la Administración general de la Comunidad Autónoma de las Illes Balears. </span></span></span></span></p>

<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">1. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p>

El Decreto 16/2023, de 20 de julio, de la presidenta de las Illes Balears, por el que se modifica el Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></span></span></p>

Adjudicar los puestos de trabajo, de acuerdo con lo que se indica en el anexo de esta Resolución, a los aspirantes que han superado el concurso extraordinario de méritos del cuerpo subalterno de la Administración general de la Comunidad Autónoma de las Illes Balears, después de haber presentado la documentación pertinente, de acuerdo con su petición efectuada y la puntuación obtenida en el proceso selectivo.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las adjudicaciones se realizan de acuerdo con la estructura orgánica que consta en la resolución de ofrecimiento de puestos de 12 de junio. Antes de la toma de posesión, se informará de la unidad orgánica a la que está adscrita cada puesto resultante de la reestructuración orgánica establecida por el Acuerdo del Consejo de Gobierno de 29 de septiembre de 2023, por el que se aprueba la modificación de puestos de trabajo correspondiente a personal funcionario y laboral de la Administración de la Comunidad Autónoma de las Illes Balears (BOIB núm. 134, de 30 de septiembre de 2023). </span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. La toma de posesión debe efectuarse en la consejería correspondiente, en el plazo de tres días hábiles a contar a partir del día siguiente de la publicación de esta Resolución en el Boletín Oficial de las Illes Balears.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Antes de tomar posesión del puesto adjudicado, la persona interesada debe hacer constar que si ocupa algún puesto de trabajo o realiza alguna actividad en el sector público de las que figuran en el artículo 1 de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas. Si lleva a cabo alguna actividad privada, incluidas las de carácter profesional, debe declararlo en el plazo de diez días hábiles a contar a partir del día siguiente de la toma de posesión, para que el órgano competente acuerde la declaración de compatibilidad o incompatibilidad .</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">4. Una vez publicado el nombramiento, para adquirir la condición de funcionario de carrera debe efectuarse el juramento o la promesa de acatar la Constitución, el Estatuto de Autonomía de la Comunidad Autónoma de las Illes Balears y el ordenamiento vigente y tomar posesión en el plazo reglamentario.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">5. Declarar desistidas de su solicitud por caducidad y excluidas del procedimiento, a las personas que no hayan presentado el escrito de elección de los puestos de trabajo ofrecidos, por orden de preferencia, y la documentación acreditativa del cumplimiento de los requisitos, de acuerdo con la base 12 de la convocatoria. </span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="background-color:null">Interposición de recursos</span></strong></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Contra esta Resolución, que pone fin a la vía administrativa, se puede interponer un recurso potestativo de reposición ante la consejera de Presidencia y Administraciones Públicas en el plazo de un mes, a contar a partir del siguiente a su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común, y el artículo 57 de la Ley 3/2003, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></span></span></p>
<p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">También se puede interponer un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears, en el plazo de dos meses a contar a partir del siguiente a la publicación de la resolución, de acuerdo con los artículos 8.2 y 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.</span></span></span></span></p>
