Con fecha de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resoluciones de fecha 17 de diciembre de 2015 (BOIB núm. 185), en fecha 22 de junio de 2016, (BOIB núm. 81), con fecha 26 de junio de 2018 (BOIB núm. 80), en fecha 2 de marzo de 2020 y 6 de mayo de 2020. </span></em></em></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em><span style="background-color:null">2. El 4 de febrero de 2022, el vicepresidente del FOGAIBA, dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 23, de 12 de febrero de 2022, en la que figuraba una concesión a favor de los beneficiarios especificados en el anexo adjunto. </span></em></em></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em><span style="background-color:null">3. El artículo 70.3 del Reglamento de la Ley de subvenciones, aprobado por Real Decreto 887/2006, de 21 de julio, establece que transcurrido el plazo establecido de justificación sin que ésta se haya presentado ante el órgano competente, éste ha de requerir al beneficiario para que en el plazo improrrogable de 15 días la presente. </span></em></em></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em><span style="background-color:null">4. El 12 de septiembre de 2022, se firmó el requerimiento de la solicitud de pago y se publicó en la página web del FOGAIBA. </span></em></em></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em><span style="background-color:null">5. Una vez transcurrido el plazo para subsanar las deficiencias los beneficiarios que se especifican en el anexo adjunto, que son un total de 5 y que comienza con Miguel Ángel Carreras Malondra y que termina con Llorenç Arrom Crespí, no han presentado la documentación requerida y se da por desistida la ayuda, lo que supone llevar a cabo la revocación total de la ayuda concedida. </span></em></em></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em><span style="background-color:null">6. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa ya notificarla. En su párrafo segundo especifica que “En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y normas aplicables». </span></em></em></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em><span style="background-color:null">7. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas». </span></em></em></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em><span style="background-color:null">8.
