    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La directora gerente de la Escuela Balear de Administración Pública (EBAP) ha formulado la siguiente propuesta de resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El artículo 18 del Decreto 191/1996, de 25 de octubre, por el que se regulan las condiciones generales de las actividades formativas dirigidas al personal al servicio de la Administración de la Comunidad Autónoma que organiza la Consejería de la Función Pública e Interior, prevé la constitución de una Comisión de Homologaciones y Convalidaciones, que decidirá sobre las características y condiciones (generales y específicas) de homologación de cursos realizados por instituciones docentes ajenas al IBAP y que quieran ser considerados por las valoraciones propias del IBAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En virtud del artículo 4 de la Orden del consejero de Interior, de 20 de julio de 2001, por la que se establece el proceso de homologación, a través del IBAP, de las acciones formativas llevadas a cabo por el personal de la CAIB, el estudio de las peticiones de homologación y la emisión del informe correspondiente será emitida por la comisión que a tal fin tiene creada el IBAP en la Resolución del consejero de Interior, de 12 de junio de 2000. En caso de petición de homologación de una acción formativa organizada por la Universidad de las Illes Balears, se incorporará a la Comisión un funcionario de la Dirección General de Universidad, quien será nombrado por el director general de ésta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la EBAP, recoge como función de la EBAP, en el artículo 5.17, la homologación de la formación realizada en todas las materias de competencia propia por cualquier institución pública o privada externas a la EBAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Ante la evolución normativa, mediante la Resolución de 13 de marzo de 2023, se determina la necesidad de establecer una nueva composición de la Comisión de Homologaciones y Convalidaciones de la Escuela Balear de Administración Pública (BOIB núm. 36, de 21 de marzo de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La resolución citada en el punto anterior quedó sin efectos en virtud de la Resolución de la Conselleria de Presidencia, Función Pública e Igualdad, mediante la cual se modifica la composicón de la Comisión de Homologaciones y Convalidaciones de la Escuela Balear de Administración Pública (BOIB núm. 58, de 6 de mayo de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Los miembros que constituyen la composición de la Comisión que establece el Boib citado en el punto anterior, lo son por razón del cargo que ocupan, excepto los miembros correspondientes al suplente del vocal 3, y aquellos que ocupan la secretaria (titular i suplente), que requieren de un nombramiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Dadas las modificaciones que ha sufrido la Composición con relación a dichos miembros se considera oportuno reflejar estos cambios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El Decreto 191/1996, de 25 de octubre, por el que se regulan las condiciones generales de las actividades formativas dirigidas al personal al servicio de la administración de la Comunidad Autónoma que organiza la Consejería de Función Pública e Interior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Orden del consejero de Interior, de 20 de julio de 2001, por la que se establece el&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;proceso de homologación, a través del IBAP, de las acciones formativas llevadas a cabo por el personal de la CAIB (BOIB núm. 90, de 28 de julio).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El Decreto 31/2012, de 13 de abril, por el que se aprueban los Estatutos de la EBAP.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Resolución de la consejera de Presidencia, Función Pública e Igualdad, por la que se determina una nueva composición de la Comisión de Homologaciones y Convalidaciones de la Escuela Balear de Administración Pública (BOIB núm. 58, de 6 de mayo de 2023) .&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Propuesta de resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Propongo a la consejera de Presidencia y Administraciones Públicas que dicte una resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Designar como miembros de la Comisión de Homologaciones y Convalidaciones de la Escuela Balear de Administración Pública a las siguientes personas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En representación del Servicio de Régimen Jurídico de la EBAP:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;

Dejar sin efectos la Resolución de la Consellera de Presidencia, Función Públia e Igualdad, a propuesta de la directora gerente de la Escuela Balear de Administración Pública, mediante la cual se designan los miembros de la Comisión de Homologaciones y Convalidaciones de la Escuela Balear de Administración Pública (BOIB núm. 66, de 18 de mayo de 2023) .3. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Publicar esta Resolución en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
