    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El punto 3 del apartado Octavo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12&amp;nbsp;de abril&amp;nbsp;de 2023, por la cual se convocan ayudas destinadas al pago compensatorio en zonas de montaña para el año 2023, así como el punto 3 del apartado Octavo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12&amp;nbsp;de abril&amp;nbsp;de 2023, por la cual se convocan ayudas destinadas al pago compensatorio pera zonas con limitaciones específicas pera el año 2023, especifican que la resolución expresa se notificará a las personas interesadas mediante su publicación en&amp;nbsp;el Boletín Oficial de las Islas Baleares, y se hará de acuerdo a los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El vicepresidente&amp;nbsp;en Materia de Pesca&amp;nbsp;del FOGAIBA, con fecha 7&amp;nbsp;de septiembre&amp;nbsp;de 2023, firmó la siguiente resolución:&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Con fecha 15 de abril de 2023 se publicó, en el BOIB núm. 48, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril de 2023, por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas al pago compensatorio para zonas con limitaciones específicas en las Islas Baleares. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Con fecha 15 de abril de 2023 se publicó, en el BOIB núm. 48, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril de 2023, por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas al pago compensatorio para zonas de montaña en las Islas Baleares. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. De conformidad con los apartados sexto de ambas resoluciones, y de la Resolución de modificación de la Presidenta del FOGAIBA, para el año 2023, de determinadas ayudas comunitarias directas y al desarrollo rural en la Agricultura y en la Ganadería, de fecha 25 de mayo de 2023, publicada en el BOIB&amp;nbsp;núm.&amp;nbsp;71 de 30 de mayo de 2023, el plazo de presentación de solicitudes de las convocatorias terminó el 30/6/23, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 1357 solicitudes de ayuda de limitaciones específicas y 274 de ayuda de montaña. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de estas ayudas. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5. Con fecha 7 de agosto de 2023 se notifica, mediante publicación en la página web http://www.caib.es, un requerimiento de documentación concediendo un plazo de 10 días para aportar la documentación solicitada, informando que transcurrido este plazo se darán por desistidas las solicitudes de ayuda si no se ha recibido la documentación. Los interesados del ANEXO I adjunto, no han aportado ningún documento o los aportados no han sido suficientes.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;15. Orden 10/2023 de la consellera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;16. La ley 3/2019, de 31 de enero, agraria de las Islas Baleares. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;El resto de normativa de desarrollo y aplicación.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Propuesta de resolución de desistimiento&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Por todo esto, se informa desfavorablemente y propongo al vicepresidente en Materia Agraria del FOGAIBA que dicte una resolución en los términos siguientes:&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Considerar desistidas&amp;nbsp;las solicitudes presentadas por los interesados relacionados en el Anexo I, de las líneas de ayudas Pago &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;compensatorio para zonas con limitaciones específicas 2023 y Pago compensatorio en zonas de montaña, por no presentar la documentación requerida, o presentarla incompleta.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Declarar concluido el procedimiento y &amp;nbsp;archivar los expedientes detallados en el Anexo I.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Notificar la resolución a los interesados del Anexo I, mediante la publicación en el BOIB .&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Contra esta resolución –que no agota la vía administrativa- se puede interponer recurso de alzada ante el conseller de Agricultura , Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
