    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 9&amp;nbsp;de junio&amp;nbsp;de 2021 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para las Inversiones en la Transformación,&amp;nbsp;Comercialización y/o desarrollo de &amp;nbsp;productos agrícolas, correspondientes al año 2021, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;&lt;em&gt;Boletín Oficial de las&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;Islas Baleares&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El vicepresidente&amp;nbsp;en Materia Agraria&amp;nbsp;del FOGAIBA, con fecha 18&amp;nbsp;de septiembre&amp;nbsp;de 2023, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes terminó el dí&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;15/&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;0&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;7&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;/20&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;54&amp;nbsp;solicitudes de ayuda.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han llevado a cabo el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda.&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;4. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados señalados en el Anexo I adjunto no cumplen con alguno de los requisitos previstos en la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados en el citado anexo. &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;5. Con fecha 24/08/2023 se firma la propuesta provisional de denegación, y se notifica a los interesados en las fechas detalladas en el Anexo I adjunto, concediéndoles un plazo de 10 días para presentar las alegaciones oportunas. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;6. Después del plazo establecido, los interesados relacionados en el Anexo I adjunto o bien no han presentado alegaciones o bien se han desestimado, tal y como se detalla en el Anexo I.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Propuesta&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Por todo ello, se informa &lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;des&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;favorablemente y se &lt;/span&gt;&lt;/em&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;propone&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

No se presenta documentación válida que acredite que la empresa no está en crisis de acuerdo con la definición establecida por la Unión Europea en el apartado 2.2. de las Directrices sobre las ayudas estatales de salvamento y reestructuración de empresas no financieras en crisis.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;- Incumplimiento del apartado 4 c. del artículo 6 de la convocatoria, de solicitudes. Se presenta una memoria agronómica incoherente y deficiente, donde no se justifica la capacidad productiva y de transformación de la empresa, la repercusión de las actuaciones, ni se cumple con la declaración realizada en el punto 9. de la solicitud de ayuda que el proyecto es viable técnicamente.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

			&lt;p style="text-align:left"&gt;&lt;em&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:10px"&gt;- Incumplimiento del apartado 4 f. del artículo 6 de la convocatoria, de solicitudes. Se presenta un plano/croquis deficiente que no se ajusta a lo requerido en la convocatoria y requerido en la notificación de deficiencias, ya que no ubica las inversiones previstas.&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;
