Justificación</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El Estatuto de autonomía de las Illes Balears (según redacción dada por la Ley orgánica 1/2007, de 28 de febrero, que lo reformó) establece en su artículo 12 los principios rectores de la actividad pública y dispone que las instituciones propias de la comunidad autónoma deben promover, entre otras, la cohesión social y el derecho a la protección social. Asimismo, en su artículo 16.4 dispone que las administraciones públicas, en el marco de sus respectivas competencias, deben promover las condiciones necesarias para que los derechos sociales de los ciudadanos de las Illes Balears y de los grupos y colectivos en los que se integran sean objeto de una aplicación real y efectiva.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Ley 4/2009, de 11 de junio, de servicios sociales en las Islas Baleares, tiene como finalidad principal conseguir el mayor bienestar social posible en el territorio de las Islas Baleares, de forma progresiva y en todos sus aspectos, mediante un sistema de acción social integrado por servicios sociales y medidas de asistencia social que favorezcan el pleno desarrollo de la persona dentro de la sociedad para superar y prevenir las causas determinantes de su marginación y promover su plena integración social.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Y en el artículo 6 de la citada norma se establecen como personas destinatarias de los servicios sociales, con carácter prioritario, las que se encuentren, entre otras, en situación de discapacidad física, psíquica o sensorial.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Por otra parte, el artículo 20 de la referida Ley 4/2009, de 11 de junio, establece que las prestaciones del sistema público de servicios sociales pueden ser técnicas, económicas o tecnológicas. Y en el artículo 22 define las prestaciones económicas estableciendo:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">“1. Son prestaciones económicas las aportaciones dinerarias que tienen como finalidad atender determinadas situaciones de necesidad en las que se encuentran las personas que no disponen de recursos económicos suficientes para hacerle frente y no están en condiciones de conseguir o recibirlos de otras fuentes.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">2. Las prestaciones económicas pueden otorgarse con carácter de derecho subjetivo, derecho de concurrencia, urgencia social y de apoyo familiar y de soporte a los procesos de inserción social.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">3. Las prestaciones económicas que se deriven del desarrollo de este artículo quedan excluidas del ámbito de aplicación de la normativa general de subvenciones.”</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La Ley 4/2023, de 27 de febrero, de prestaciones sociales de carácter económico de las Islas Baleares, regula los diferentes tipos de prestaciones económicas establecidas en la Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares, y dedica su título III a la regulación de las prestaciones económicas de derecho de concurrencia. Estas prestaciones sociales de carácter económico de concurrencia competitiva permiten desarrollar al margen de la normativa de subvenciones convocatorias de ayudas económicas que tengan una disponibilidad económica limitada.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El Consejo Insular de Eivissa ha asumido competencias en materia de servicios sociales y asistencia social en virtud de la Ley 12/1993, de 20 de diciembre, de atribución de competencias a los consejos insulares en materia de servicios sociales y asistencia social, y de la Ley 14/2001, de 29 de octubre, de atribución de competencias a los consejos insulares en materia de servicios sociales y seguridad social, en los términos y el alcance que establecen estas leyes.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Por parte del Departamento de Bienestar Social, Familia e Igualdad se pretende, con la aprobación de la presente convocatoria de prestaciones, atender determinadas situaciones de necesidad en las que se encuentran las personas con discapacidad de la isla de Eivissa que no disponen de recursos económicos suficientes para afrontarlas.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Segundo. Objeto</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El objeto de la presente convocatoria es establecer el procedimiento para otorgar las prestaciones económicas de derecho de concurrencia para personas con discapacidad física, psíquica o sensorial reconocida que sean residentes en la isla de Eivissa.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Estas prestaciones económicas tienen como finalidad atender las situaciones de necesidades de las personas con discapacidad para poder hacer uso de su hogar en condiciones adecuadas y por su integración en la comunidad cuando estas personas beneficiarias no disponen de recursos económicos suficientes para hacerle frente.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Tercero. Consignación presupuestaria habilitada para atender las prestaciones</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El importe global de las ayudas que se distribuyen en esta convocatoria es de 180.000 euros (ciento ochenta mil euros) para el ejercicio presupuestario 2023, a cargo de las aplicaciones presupuestarias 23104890000 y 231078900 del presupuesto del Consejo Insular de Eivissa.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El 75% de la referida consignación (135.000€) irán a la aplicación presupuestaria 23104890000 correspondiente al capítulo IV, y el 25% (45.000€) a la aplicación presupuestaria 231078900 correspondiente al capítulo VII.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En ningún caso, el importe máximo de la prestación concedida a una misma persona al amparo de esta convocatoria podrá superar los 4.500€ (cuatro mil quinientos), con los límites que se detallan en el punto quinto de la presente convocatoria.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Cuarto. Personas beneficiarias y condiciones para acceder</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Pueden ser personas beneficiarias de las prestaciones económicas de derecho de concurrencia que se regulan en esta convocatoria aquellas que cumplan con los siguientes requisitos:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Tener menos de 65 años en la fecha de presentación de la solicitud.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Tener reconocido un grado de discapacidad igual o superior al 33% y vigente en la fecha de presentación de la solicitud, o ser beneficiario de una pensión de la Seguridad Social por incapacidad permanente en grado de total, absoluta o gran invalidez, o ser pensionista de clases pasivas de jubilación o retiro por incapacidad permanente para el servicio o inutilidad.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Acreditar que se está residiendo en la isla de Eivissa y que lo ha estado haciendo durante los últimos doce meses antes de la solicitud de la prestación.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Tener una renta per cápita de la unidad económica de convivencia igual o inferior a 21.000€ (renta calculada en base a 2,5 veces el indicador público de renta de efectos múltiples, el IPREM, anual y teniendo en cuenta 14 pagas). El valor oficial del IPREM para 2023 está establecido en 8.400,00€.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las necesidades de las personas beneficiarias deben estar relacionadas con alguno de los siguientes supuestos:</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><strong>I. Rehabilitación</strong>: tratamientos de psicoterapia, fisioterapia, tratamientos psicopedagógicos, psicomotricidad, logopedia, atención temprana y otras actividades terapéuticas de las personas beneficiarias de esta prestación.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las referidas actuaciones deben estar realizadas por profesionales con titulación oficialmente reconocida.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><strong>II. Movilidad</strong>, cuando se tengan problemas de movilidad y se necesiten para conseguir un aumento de la capacidad de desplazamiento.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><strong>III. Adaptación del hogar</strong>, para la supresión de barreras arquitectónicas para el hogar y/o la adaptación del mismo para dar accesibilidad a las personas beneficiarias de estas prestaciones.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La adaptación funcional corresponderá al domicilio habitual en el que conste empadronada la persona solicitante.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el caso de obras, deberá adjuntarse la correspondiente licencia municipal con fecha anterior a la de la factura aportada, cuando sea preceptiva; o certificado del Ayuntamiento de no exigir tal licencia.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Los gastos realizados, deberán constar detallados en la factura presentada por la empresa constructora.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><strong>IV. Ayudas técnicas y otros:</strong> aquellos instrumentos que, actuando como intermediarios entre la persona y el entorno, ya sea con medios mecánicos o estáticos, faciliten su relación y permitan una mayor movilidad.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las referidas necesidades se justificarán mediante la realización de un gasto y el abono del referido gasto relativo a la referida necesidad en concordancia a la discapacidad que se tiene reconocida, de la persona beneficiaria de la prestación, durante el período comprendido entre el <strong>1 de septiembre de 2022 y 31 de agosto de 2023,</strong> ambos incluidos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En cuanto a las necesidades presentadas debe tenerse presente que deben ser concordantes con la discapacidad de la persona solicitante, lo que significa que deben estar relacionadas con su particular discapacidad.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En aquellos casos en los que no quede acreditada estrictamente la concordancia entre la discapacidad y la necesidad a cubrir, se valorará la idoneidad de dicha solicitud siempre que esté acompañada de un informe técnico profesional de los servicios públicos donde se especifique esta relación.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Por otra parte, la justificación del pago de los referidos gastos se realizará aportando la acreditación de su abono; según el medio de pago que se haya utilizado, deberá aportarse la documentación que a continuación se indica:</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">a) Pago mediante transferencia bancaria o ingreso en cuenta bancaria:</span></span></span></span></p> <ul style="margin-left:40px"> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Documento bancario acreditativo del pago en el que figuren el concepto de la transferencia o el ingreso, la fecha del documento, el importe y los datos del ordenante y del destinatario, que deben coincidir con el beneficiario y con el emisor de la factura, respectivamente. No se aceptarán capturas de móvil, ni resguardo del cajero.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el supuesto de que el beneficiario sea mayor de edad, pero justifique que no cuenta con ingresos propios provenientes de un trabajo, pensiones o rentas, se aceptará que los datos del ordenante correspondan con la persona o personas de las que depende su manutención.</span></span></span></span></li> </ul> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">b) Pago en metálico:</span></span></span></span></p> <ul style="margin-left:40px"> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Una factura firmada y sellada por el proveedor, con la expresión «recibido en metálico» o similar. Se admitirán los justificantes de pago en efectivo siempre que no superen los 999,99€ conforme se establece en la ley 11/2021, de medidas de prevención y lucha contra el fraude fiscal.</span></span></span></span></li> </ul> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">c) Pago mediante cheque/ pagaré nominativo:</span></span></span></span></p> <ul style="margin-left:40px"> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Copia del cheque nominativo o pagaré nominativo emitido a nombre del proveedor que emite la factura o documento equivalente, siempre que esté vencido.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Extracto de la cuenta corriente del beneficiario de la ayuda en la que figure el cargo de este cheque o pagaré.</span></span></span></span></li> </ul> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">d) Pago mediante tarjeta de crédito o débito:</span></span></span></span></p> <ul style="margin-left:40px"> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Extracto de la cuenta en la que figure el cargo del pago con tarjeta. La prestación irá destinada a sufragar los gastos derivados de la eliminación de las barreras arquitectónicas, a fin de facilitar la estancia de las personas con limitación funcional; como pueden ser el cambio de bañera por plato de ducha, la instalación de pavimento antideslizante en el cuarto de baño, instalación de rampa de acceso, colocación de pasamanos y barandillas en el pasillo, adecuación del ancho de las puertas...etc. En ningún caso serán objeto de la prestación las obras de reforma generales ni aquellas que afecten a elementos decorativos y ornamentales.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">⁽²⁾ En el caso de los audífonos, los implantes cocleares y otros dispositivos similares o análogos no se considerarán valorables de la necesidad el gasto de las pilas que no sean las iniciales.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">⁽³⁾En referencia a la obtención del carnet de conducir, habrá que acreditar tener dificultades de movilidad de conformidad con lo previsto en el Real Decreto 888/2022, de 18 de octubre, de procedimiento para el reconocimiento, declaración y calificación del grado de discapacidad.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Dentro de esta necesidad se contemplan los gastos de traslado y manutención que supone realizar las prácticas en coche adaptado fuera de la isla, cuando en Eivissa no sea posible. Para justificar este extremo será necesario aportar factura de la autoescuela a nombre del beneficiario y escrito de la misma conforme no es posible realizar las prácticas en Eivissa.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">(4) En cuanto a los gastos de desplazamientos, todas las facturas de billetes de avión y de barco deberán especificar el trayecto de ida o de vuelta, la fecha y el precio total. No estarán permitidos para la valoración de la necesidad los billetes abiertos ni de primera clase, business o análogos. En estos billetes se tendrá en cuenta que la fecha en la que se efectúe el trayecto sea dentro del período comprendido en la convocatoria.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">⁽⁵⁾ En cuanto a los gastos de adquisición y adaptación de vehículo a motor, es necesario que la persona beneficiaria esté en posesión del permiso de conducir y acredite tener dificultades de movilidad de conformidad con lo previsto en el Real Decreto 888/2022, de 18 de octubre, de procedimiento para el reconocimiento, declaración y calificación del grado de discapacidad.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En caso de que la persona beneficiaria no pueda obtener el permiso de conducir por motivos de su discapacidad o edad, podrán solicitar la ayuda para la adquisición de vehículo los familiares que lo cuiden y estén en posesión del carné de conducir, siempre que las personas beneficiarias tengan dificultades de movilidad de conformidad con el referido Real Decreto 888/2022, de 18 de octubre, de procedimiento para el reconocimiento, declaración y calificación del grado de discapacidad.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Para poder recibir estas ayudas será necesario que se acredite que han transcurrido cinco (5) años desde la fecha de adquisición del último vehículo por el que se recibió esta prestación (Anexo V), y presentar copia de la tarjeta de la inspección técnica del vehículo donde conste la adaptación.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">⁽⁶⁾ Previa valoración del Departamento de Bienestar Social, Familia e Igualdad.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Sexto. Régimen de incompatibilidad con otras prestaciones y ayudas, si procede</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las prestaciones de concurrencia competitiva no son incompatibles, por su naturaleza, con ninguna pensión ni prestación pública.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En ningún caso, el importe de la prestación que se conceda puede superar, aisladamente o en concurrencia con subvenciones de entidades públicas o privadas, el coste de los gastos presentados para valorar la necesidad, en cuanto a la finalidad y el período objeto de la prestación objeto de la presente convocatoria.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Séptimo. Publicidad</span></span></span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">Esta convocatoria se publicará en el Boletín Oficial de las Illes Balears y en la Sede Electrónica del Consell Insular de Eivissa </span></span></span></span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">(https://seu.conselldeivissa.es).</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">La publicación de los actos y trámites del procedimiento y la resolución de concesión se harán mediante su inserción en el tablón de anuncios y edictos electrónicos de la Sede Electrónica del Consell Insular de Eivissa (https://seu.conselldeivissa.es) de conformidad con lo previsto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y de conformidad con los requisitos contenidos en la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos de carácter personal y garantía de los derechos digitales; y las indicaciones de la Agencia Española de Protección de Datos.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El Departamento competente, sin perjuicio de la publicidad preceptiva, tiene que dar la máxima difusión a la convocatoria para conceder prestaciones sociales de carácter económico.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Octavo. Presentación de solicitudes de la prestación, plazos y documentación a adjuntar</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El plazo para presentar las solicitudes será de quince días hábiles, a partir del día siguiente de la fecha de publicación de la presente convocatoria en el Boletín Oficial de las Islas Baleares.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las solicitudes de la prestación se formalizaran mediante instancia, según el modelo normalizado que figura como Anexo I de esta convocatoria.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Estas solicitudes se presentarán en el Registro General del Consejo Insular de Eivissa (avenida de España, 49, 07800 Eivissa). Así como también habrá la posibilidad de registrar las solicitudes telemáticamente en la propia Sede Electrónica habilitada a tal fin, de conformidad con el artículo 14.2 de la Ley 39/2015 o en cualquiera de las formas establecidas en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Si la solicitud se envía por correo, la documentación correspondiente debe presentarse en un sobre abierto para que el ejemplar destinado al Consell Insular de Eivissa se feche y se selle antes de que se certifique. En caso de que la oficina de correos correspondiente no feche y selle la solicitud, se entenderá como fecha válida de presentación la de entrada en el Registro General del Consell Insular de Eivissa.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">Si la solicitud se entrega en un sitio que no es el Registro del Consejo Insular de Eivissa, se recomienda enviar al correo electrónico dep.benestar@conselldeivissa.es la hoja con el sello de entrada dentro de plazo al Departamento de Bienestar Social, Familia e Igualdad durante las 24 horas siguientes a la entrega. En los mismos términos, si se envía por correo certificado, se recomienda enviar por fax la hoja de la solicitud con el sello de Correos en el que conste el envío dentro de plazo.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las solicitudes irán acompañadas de la siguiente documentación:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- DNI/NIE de la persona solicitante. En el supuesto de que la solicitud se presente en representación de otra persona, también se deberá presentar el DNI/NIE de la persona representante debidamente autorizada.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- En caso de presentación de NIE, este debe ir acompañado de la documentación que acredite la identidad de la persona beneficiaria.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- En caso de que el beneficiario sea mayor de 18 años y tenga capacidad legal modificada, se deberá adjuntar la sentencia legal.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Libro de familia o documentación análoga oficial que lo sustituya en caso de que la persona beneficiaria no viva sola en la vivienda, o certificado de estar inscrita en el correspondiente registro de parejas estables.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Certificado de convivencia emitido por el ayuntamiento del municipio de residencia.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Certificado histórico de empadronamiento a nombre de la persona beneficiaria, donde conste la fecha de alta en cualquiera de los municipios de la isla de Eivissa </span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Documentación en vigor, acreditativa del reconocimiento de la situación de discapacidad mediante resolución o tarjeta acreditativa; resolución que acredite la condición de pensionista de la Seguridad Social por incapacidad permanente total, absoluta o gran invalidez, pensionista de clases pasivas de jubilación o retiro por incapacidad permanente para el servicio o inutilidad, emitido por el órgano competente.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Título de familia monoparental, si es el caso.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Para los supuestos de solicitud de prestación para institucionalización, informe acreditativo del centro en el que se encuentra institucionalizada la persona beneficiaria de la ayuda, donde conste que se trata de una plaza privada.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Declaración de la renta de los miembros mayores de edad de la unidad de convivencia, correspondiente al ejercicio 2022. En caso de no estar obligado a hacerla, se deberá aportar el certificado de renta expedido por la Agencia Tributaria. En su caso, se puede autorizar al Consell Insular de Eivissa para que pueda conseguir esta documentación, según los modelos que figuran como anexos II y III.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- En caso de ciudadanos de la Unión Europea o personas extranjeras residentes en Eivissa, cuando no consten datos sobre sus ingresos tendrán que presentar documentación suficiente acreditativa en la que conste en qué país tributan y los ingresos que perciben del país correspondiente.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Las facturas originales a nombre de la persona beneficiaria, o su representante legal, justificativas de los gastos, emitidas y pagadas del día<strong> 1 de septiembre de 2022 hasta el 31 de agosto de 2023</strong>, ambos inclusive, exceptuando las facturas emitidas la última semana del mes de agosto, que podrán ser pagadas hasta el día 10 de septiembre de 2023, y la documentación justificativa del pago de las facturas de conformidad con lo previsto en el punto cuarto de la presente convocatoria.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- En el supuesto de que la persona beneficiaria sea menor de edad o esté incapacitada judicialmente, la factura podrá ir a nombre de su representante legal.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- En el supuesto de gastos por obras, se deberá adjuntar, si procede, la documentación acreditativa del ayuntamiento y/o la normativa vigente, para poder realizarlas.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- En caso de financiaciones, será necesario aportar el contrato y los recibos correspondientes; los cuales deberán ir a nombre del beneficiario de la prestación.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Cuando se haya pedido y/o recibido una subvención para hacer frente al gasto presentado para valorar la necesidad (por el mismo concepto y dentro del mismo período de la prestación), se tendrá que acreditar el importe, la procedencia y la aplicación al objeto de la ayuda, y se tendrá que presentar una declaración responsable referente a otras ayudas para las mismas necesidades (Anexo IV).</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">- Solicitud de alta o modificación como acreedor del CIE sellado por la entidad bancaria o en su lugar la declaración responsable de titularidad de datos bancarios de personas físicas expedido necesariamente a nombre de la persona beneficiaria de la ayuda y firmado por la persona beneficiaria. En caso de que la persona beneficiaria sea menor de edad, los documentos mencionados deberán ir a nombre de la persona representante. Podrá encontrar estos documentos en la página web de la institución (www.conselldeivissa.es) y también en la Sede Electrónica.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Cualquier otro documento que se considere oportuno aportar.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"> </p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Además de la documentación antes mencionada, las solicitudes de las prestaciones irán acompañadas de la documentación especifica siguiente:</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">A) Cuando la prestación sea para la adquisición de vehículo a motor, las solicitudes de ayudas irán acompañadas de la siguiente documentación específica:</span></span></span></span></strong></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">-Declaración responsable que garantice que el vehículo se utilizará para uso personal y privado (Anexo V).</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">-Declaración responsable donde conste que han transcurrido cinco años desde la fecha de adquisición del último vehículo subvencionado (Anexo V).</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">-Acreditar tener dificultades de movilidad de conformidad con el Real Decreto 888/2022, de 18 de octubre, de procedimiento para el reconocimiento, declaración y calificación del grado de discapacidad.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">-Permiso de conducir.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">B) Cuando la prestación sea para la adaptación de vehículo a motor:</span></span></span></span></strong></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Permiso de conducir correspondiente, donde se especifique el tipo de adaptación prescrita.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Copia de la tarjeta de la inspección técnica del vehículo donde conste la adaptación.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">C) Cuando la prestación sea para la adaptación de vehículo a motor para obtener el permiso de conducir:</span></span></span></span></strong></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">- Matrícula de la autoescuela</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las personas que hayan presentado en este Consell Insular cualquiera de estos documentos en virtud de anteriores solicitudes sólo tendrán que aportar la documentación que sea necesario actualizar o renovar, siempre que no hayan transcurrido más de cinco años desde que la documentación fuese presentada y se señalen la fecha y el número de registro de entrada del escrito con el que se aportaron.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El Consell Insular de Eivissa puede solicitar toda la documentación complementaria que considere necesaria para evaluar correctamente la solicitud de prestación presentada, como puede ser la prescripción técnica del profesional correspondiente, etc.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Si la solicitud no reúne los datos de identificación, tanto de la prestación solicitada como de la persona solicitante, o algunos de los requisitos establecidos en la presente convocatoria, debe requerirse de acuerdo con lo que establece el artículo 73 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas para que, en un plazo no superior a los diez días, se subsane la falta o se acompañen los documentos preceptivos con indicación de que, de no hacerlo, se tendrá por desistida la petición, previa resolución expresa.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Noveno. Los criterios de valoración y prelación de la situación de necesidad</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><strong>9.1.</strong> Estas prestaciones se otorgarán teniendo presentes tres criterios: la unidad económica de convivencia, la renta per cápita de la unidad económica de convivencia y la realización y el pago de los gastos correspondientes a la necesidad a valorar.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><em><strong>A)</strong> </em>La unidad económica de convivencia.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><em>A.1)</em> La unidad económica de convivencia del grupo familiar.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Se entenderá como unidad económica de convivencia del grupo familiar aquel que resida a la vivienda cuando entre los componentes del grupo haya un vínculo de matrimonio o estén inscritos en el registro de parejas estables o tengan algún hijo en común, un vínculo de consanguinidad o afinidad hasta el primer grado.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En los casos de acogida familiar permanente de menores, el/la menor tendrá la consideración de miembro de la unidad económica de convivencia cuando conste resolución administrativa, o judicial, si es el caso.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El grado de parentesco se computará según dispone el Código civil y a partir de la persona beneficiaria de la ayuda.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el supuesto de que la unidad económica de convivencia descrita anteriormente supere la renta per cápita prevista para recibir las prestaciones, se contabilizarán también las personas menores de edad o discapacitadas menores de 65 años (o mayores de 65 años que acrediten que la condición de persona con discapacidad se reconoció antes de cumplir esta edad) que viven en el mismo domicilio unidas a la persona beneficiaria de la ayuda por un grado de parentesco por consanguinidad hasta el tercer grado y de afinidad hasta el segundo grado a efectos de determinar la renta per cápita.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Cuando del certificado de convivencia municipal junto con la documentación relativa a la discapacidad o equivalente se derive que en la vivienda hay dos o más personas con discapacidad menores de 65 años (o mayores de 65 años que acrediten que la condición de persona con discapacidad se reconoció antes de cumplir esa edad) y tengan alguna relación de parentesco con el beneficiario o beneficiaria de la ayuda, no se aplicará el requisito de renta.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><em>A.2)</em> Unidad económica de convivencia de personas que viven solas.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><em>A.3)</em> La unidad económica de convivencia de familias monoparentales.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">A efectos de esta convocatoria, se entiende por familia monoparental la definida como tal en la Ley 8/2018, de 31 de julio, de apoyo a las familias de las Illes Balears. Para acreditar esta condición se requerirá la presentación de la resolución del título de familia monoparental.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En este caso, se incluirá a efectos de cómputo un miembro más en la unidad familiar a efectos de determinar la renta per cápita.</span></span></span></span></p> <p style="margin-left:40px"><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><em>A.4)</em> En el caso de personas institucionalizadas se dividirá la renta anual por 1,0 a efectos de determinar la renta per cápita.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><em><strong>B)</strong> </em>La renta per cápita de la unidad económica de convivencia.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La renta se obtendrá de la suma de la base imponible general y la base imponible del ahorro.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el caso de las personas contribuyentes que no estén obligadas a presentar declaración de renta, se obtendrá de la suma de los rendimientos íntegros del trabajo, los rendimientos del capital mobiliario y las ganancias patrimoniales sometidas a retención, salvo los gastos deducibles de los rendimientos del trabajo .</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No tienen la consideración de rentas aquellas que estén exentas del IRPF.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">No tendrán derecho a recibir las prestaciones aquellas personas que estén obligadas a realizar la declaración de renta y no la hayan presentado.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null"><strong><em>C)</em></strong> Los gastos correspondientes a las necesidades para hacer frente a tratamientos u otros gastos para la mejora física, psíquica y sensorial, así como suplir o compensar las limitaciones y carencias funcionales de conformidad con lo establecido en el punto cuarto de la presente convocatoria de prestaciones .</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">9.2. Renta per cápita de la unidad familiar, en orden de menor a mayor.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">En el supuesto de empate, tendrán prioridad las unidades familiares en las que haya personas menores de edad y, si persiste el empate, por orden de entrada de la solicitud.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las prestaciones se resolverán según el referido orden hasta que se agote el crédito presupuestario disponible.</span></span></span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Décimo. Instrucción, resolución y notificación</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El Departamento de Bienestar Social, Familia e Igualdad del Consejo Insular de Eivissa será el competente para instruir el procedimiento de tramitación de solicitudes. </span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El órgano competente para aprobar esta convocatoria es el Consejo Ejecutivo del Consejo Insular de Eivissa, a propuesta de la consejera ejecutiva del Departamento de Bienestar Social, Familia e Igualdad. Y la resolución de esta convocatoria de prestaciones corresponde a la consejera ejecutiva del Departamento de Bienestar Social, Familia e Igualdad, de acuerdo con el artículo 33.2k de la Ley 4/2022, de 28 de junio, de consejos insulares.</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Las resoluciones de la consejera ejecutiva no agotan la vía administrativa y se podrá interponer recurso de alzada ante el Consejo Ejecutivo del Consejo Insular de Eivissa en el plazo de un mes a contar desde el día siguiente de la publicación de la resolución en el BOIB, de acuerdo con los artículos 112.1, 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, en relación con el artículo 66.4 de la Ley 4 /2022, de 28 de junio, de consejos insulares.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:null"><span style="background-color:null">Los expedientes se resolverán en un plazo máximo de tres meses a contar desde la presentación de la solicitud. Transcurrido este plazo sin que se haya dictado acto expreso, la solicitud debe entenderse desestimada. La notificación de la resolución de las ayudas se realizará mediante la publicación en el tablón de edictos de la Sede Electrónica del Consell Insular de Eivissa (https://seu.conselldeivissa.es).</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">La obtención de la prestación en virtud de esta convocatoria no genera derecho alguno a la obtención de otras prestaciones en ejercicios posteriores.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Undécimo. Pago de la prestación</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">El pago se realizará mediante un pago único por transferencia bancaria y al número de cuenta que conste en el impreso presentado junto con la solicitud de prestación, una vez dictada la resolución de la consejera ejecutiva del Departamento de Bienestar Social, Familia e Igualdad .</span></span></span></span></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Estas prestaciones no requerirán más justificación que la previa acreditación del cumplimiento de los requisitos exigidos en el apartado cuarto de la presente convocatoria. Sin embargo se podrán realizar los controles que se estimen pertinentes para verificar el cumplimiento de los requisitos y las condiciones previstas en la convocatoria.</span></span></span></span></p> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Duodécimo. Obligaciones de las personas beneficiarias</span></span></span></span></strong></p> <p><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Les persones beneficiarias de esta prestación están obligadas a:</span></span></span></span></p> <ul> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Colaborar en todo aquello que el Departamento de Bienestar Social, Familia e Igualdad les requiera.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Comunicar la solicitud y la obtención de una subvención para hacer frente al gasto presentado para valorar la necesidad de la prestación.</span></span></span></span></li> <li><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Reintegrar el importe de las prestaciones indebidamente percibidas.</span></span></span></span></li> </ul> <p><strong><span style="color:null"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:null">Decimotercero.
