    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En los últimos años se han dado casos relativamente frecuentes de capturas por parte de embarcaciones de arrastre de balas de paja que se encuentran alojadas en el fondo del mar. A pesar de las tareas realizadas para averiguar el origen de estas, ha resultado del todo imposible identificar la procedencia de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La captura accidental de estos elementos por parte de las embarcaciones tiene como consecuencia principal la rotura del aparejo, hecho que imposibilita la continuidad de la actividad pesquera, a la vez que arruina las capturas, sean cuales sean, que ya se encontraban dentro de la red. Este hecho provoca la pérdida del jornal y el obligado regreso de la embarcación al puerto para separar el material enredado en la red y la reparación de esta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Como si eso no fuera suficiente, la captura de una bala de paja comporta un peligro adicional para la embarcación dado el gran peso que se acumula en el bou, poniendo en riesgo la integridad de las tripulaciones cuando se levanta y se abre la red.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así, vista la imposibilidad de encontrar a un responsable y a fin de poder compensar las pérdidas ocasionadas por estas pescas accidentales, se propone crear una línea de ayudas para poder disminuir las pérdidas ocasionadas por estas pescas accidentales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Reglamento (UE) núm. 717/2014 de la Comisión, de 27 de junio de 2014, relativo a la aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea a las ayudas &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;minimis&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;en los sectores de la pesca y de la acuicultura, establece las condiciones que deben cumplir las ayudas para ser consideradas exentas de la obligación de notificación establecida en el artículo 108, apartado 3, de este tratado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En fecha 17 de marzo del 2005 se publicó en el &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Balears&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;núm. 43 la Orden de la consejera de Agricultura y Pesca de 10 de marzo de 2005, por la que se establecen las bases reguladoras de las subvenciones en los sectores agrario y pesquero. El artículo 1.2, letra &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;m&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;, de esta orden señala que son objeto de ayudas todas aquellas actividades de utilidad pública o de interés social o la consecución de una finalidad pública, relacionadas con los sectores agrario y pesquero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Decreto 64/2005, de 10 de junio, de creación del Fondo de Garantía Agraria y Pesquera de las Illes Balears, establece en su artículo 2.&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;que el FOGAIBA tiene por objeto ejecutar la política de la consejería competente en materia de agricultura y pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero (IFOP), incluidas las derivadas de la política agrícola común y de los fondos procedentes del Instrumento Financiero de Orientación de la Pesca, de las medidas de desarrollo rural y de otros regímenes de ayudas previstos en la normativa de la Unión Europea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mediante el Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears. En concreto, en el anexo 1 se acuerda la adscripción del FOGAIBA a la Consejería de Agricultura, Pesca y Medio Natural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con lo dispuesto en el artículo 15 del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, 28 de diciembre, y en el artículo 3 de la Orden de la consejera de Agricultura y Pesca de 10 de marzo de 2005, por la que se establecen las bases reguladoras de las subvenciones en los sectores agrario y pesquero, corresponde aprobar la convocatoria de estas ayudas mediante resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, en virtud de lo establecido en el artículo 6.1.&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;g&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;del Decreto 64/2005, de 10 de junio, de creación del Fondo de Garantía Agraria y Pesquera de las Illes Balears, y a propuesta del director gerente del FOGAIBA, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Objeto de las ayudas y ámbito de aplicación&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Se aprueba, para el año 2023, la convocatoria de ayudas para compensar los daños provocados a las redes de pesca por balas de paja que se encuentran depositadas en las pesqueras, de acuerdo con lo establecido en la Orden de la consejera de Agricultura y Pesca de 10 de marzo de 2005, por la que se establecen las bases reguladoras de las subvenciones en los sectores agrario y pesquero, publicada en el &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;núm. 43, de 17 de marzo de 2005.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Estas ayudas se concederán de acuerdo con el Reglamento (UE) núm. 717/2014 de la Comisión, de 27 de junio de 2014, relativo a la aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea a las ayudas &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;minimis&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;en los sectores de la pesca y de la acuicultura, establece las condiciones que deben cumplir las ayudas para ser consideradas exentas de la obligación de notificación establecida en el artículo 108, apartado 3, de este tratado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El ámbito territorial de aplicación de estas ayudas es la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Importe máximo de la convocatoria y financiación&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Para esta convocatoria se destina un importe máximo de quince mil euros (15.000,00&amp;nbsp;€), con cargo a los presupuestos del Fondo de Garantía Agraria y Pesquera de las Illes Balears del año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Los créditos que se destinan a esta convocatoria pueden incrementarse con cargo a los presupuestos del Fondo de Garantía Agraria y Pesquera de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Pueden ser beneficiarios de las ayudas previstas en esta resolución los armadores de embarcaciones que cumplan los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;. Deben estar en posesión de la licencia de pesca y de las autorizaciones para la modalidad de pesca de arrastre de fondo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A efectos de esta ayuda, la modalidad censal del barco será la que figure en el Registro general de la flota pesquera en la fecha de solicitud de la ayuda, que deberá ser la misma que figuraba cuando se produjo el accidente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;. Deben haber notificado y documentado gráficamente el accidente ante la Dirección General de Pesca. Dicha notificación se debe hacer inmediatamente cuando se produzca el accidente y siempre antes de la llegada a puerto de la embarcación afectada para poder, si se considera oportuno, hacer el control correspondiente. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;. Su barco, en el momento del accidente, debe cumplir los siguientes requisitos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Debe estar inscrito en la lista tercera del Registro oficial de matrícula de buques y debe estar dado de alta, provisional o definitivamente, en el Registro general de la flota pesquera como activo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Debe tener su puerto base en las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estos requisitos deben mantenerse, como mínimo, hasta la resolución de concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La comprobación de los requisitos anteriores se realizará de oficio, excepto manifestación contraria del peticionario, ya que con la presentación de la solicitud de ayuda se entiende otorgada esta autorización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Cuando se trate de personas físicas o jurídicas sin personalidad jurídica propia, se deben hacer constar expresamente, tanto en la solicitud como en la resolución de concesión, los compromisos de ejecución que asume cada uno de los miembros, así como el importe de la subvención que se debe aplicar a cada uno de ellos, los cuales tienen igualmente la consideración de beneficiarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En cualquier caso, se debe nombrar a un representante o apoderado único de la agrupación, con poder suficiente para cumplir las obligaciones que, como beneficiaria, corresponden a la agrupación. Esta no podrá disolverse hasta que no haya transcurrido el plazo de prescripción previsto en el artículo 24 de la Ley 14/2014, de 29 de diciembre, de finanzas de la Comunidad Autónoma de las Illes Balears, y en el artículo 57 del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Además de los requisitos establecidos en el punto 1 anterior, se deben cumplir los requisitos previstos en la Orden de la consejera de Agricultura y Pesca de 10 de marzo de 2005, por la que se establecen las bases reguladoras de las subvenciones en los sectores agrario y pesquero, así como los establecidos en el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. No podrán ser beneficiarias de las subvenciones previstas en esta resolución las personas, entidades o asociaciones que incurran en alguna de las prohibiciones establecidas en los apartados 1 y 2 del artículo 10 del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre. La justificación de no incurrir en estas prohibiciones debe efectuarse de la manera prevista en el apartado 6 del artículo 10 mencionado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. De acuerdo con lo dispuesto en el artículo 10.1.&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;e&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, se considerará que los beneficiarios están al corriente de las obligaciones tributarias y con la Seguridad Social cuando quede verificado lo dispuesto en el artículo 38 del Decreto 75/2004, de 27 de agosto, de desarrollo de determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears, así como en los artículos 18 y 19 del Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones. La circunstancia de estar al corriente de las obligaciones tributarias —estatales y autonómicas— y con la Seguridad Social deberá quedar acreditada antes de que se dicte la propuesta de resolución de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La acreditación del cumplimiento de este requisito debe realizarse mediante la presentación de las certificaciones previstas en el artículo 22 del Real decreto 887/2006. No obstante, la persona interesada puede autorizar al FOGAIBA y/o a la Consejería de Agricultura, Pesca y Medio Natural&amp;nbsp;para que compruebe de oficio el cumplimiento del requisito mencionado y, en este caso, no es necesario presentar los certificados correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En todo caso, y de acuerdo con lo dispuesto en el artículo 11.&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;f&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, la acreditación prevista en el párrafo anterior puede sustituirse por una declaración responsable de la persona solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. De acuerdo con lo dispuesto en el artículo 11 de la Ley 11/2016, de 28 de julio, de igualdad de mujeres y hombres, tampoco pueden ser beneficiarias de las subvenciones previstas en esta resolución las empresas y las entidades solicitantes sancionadas o condenadas, en los últimos tres años, por resolución administrativa o sentencia judicial firmes, por haber ejercido o tolerado prácticas laborales consideradas discriminatorias por razón de sexo o de género.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Actuaciones subvencionables&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Constituye la acción subvencionable una compensación por los días de pesca perdidos en el año 2023, como consecuencia de los daños provocados a las redes de pesca por balas de paja que se encuentran depositadas en las pesqueras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Cuantía de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La cuantía de la ayuda es calculará como la media del valor de comercialización de las capturas de los cinco días anteriores al día del accidente menos el valor de comercialización de las capturas del día del accidente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El valor de las capturas comercializadas se comprobará de oficio por el FOGAIBA ante la Dirección General de Pesca, excepto manifestación contraria del peticionario; en este caso deberá presentar los certificados correspondientes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El importe máximo de la ayuda será de 1.500,00&amp;nbsp;€ por accidente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Asimismo y de conformidad con lo establecido en el punto 2 del artículo tercero del Reglamento (UE) núm. 717/2014 de la Comisión, de 27 de junio de 2014, relativo a la aplicación de los artículos 107 y 108 del Tratado de funcionamiento de la Unión Europea a las ayudas &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;minimis&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;en los sectores de la pesca y de la acuicultura, la cuantía total de ayudas &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;minimis&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;no puede superar los 30.000,00&amp;nbsp;€ por beneficiario en un periodo de tres ejercicios fiscales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexto&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Solicitudes y documentación&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El plazo para presentar solicitudes será desde el día siguiente a la publicación de esta Resolución en el BOIB hasta el 15 de diciembre de 2023.&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Las personas interesadas que cumplan los requisitos previstos en esta convocatoria pueden presentar las solicitudes de ayuda, de acuerdo con el modelo de formulario que figura en la página web del FOGAIBA (A04026954). Las solicitudes deben presentarse correctamente cumplimentadas en los registros de entrada del FOGAIBA, de la Consejería de Agricultura, Pesca y Medio Natural&amp;nbsp;o en cualquier otro registro previsto en el apartado 4 del artículo 16 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y en el artículo 37 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las personas obligadas a relacionarse electrónicamente de acuerdo con lo dispuesto en el artículo 14.2 de la Ley 39/2015, de 1 de octubre, y las que opten por la presentación electrónica, deben presentar la solicitud mediante el trámite telemático que estará disponible en el procedimiento publicado en la Sede electrónica de la Administración de la Comunidad Autónoma de las Illes Balears. &amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se deberán suministrar todos los datos indicados en el formulario, así como asumir los compromisos, otorgar las autorizaciones y realizar las declaraciones que contiene dicho formulario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Estas solicitudes deben incluir la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;a&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;. Fotocopia del NIF del solicitante, en caso de personas jurídicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;b&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;. En su caso, documento acreditativo de la representación con la que se firma la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;c&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;. En el caso de agrupaciones sin personalidad jurídica, debe aportarse:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Documento en el que se reflejen las normas o la reglamentación de funcionamiento que hayan suscrito todos los miembros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Fotocopia del NIF de la agrupación, si lo tiene. En caso de que alguno de los asociados sea una persona jurídica, debe aportar, además, fotocopia del NIF y del documento acreditativo de su representación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Documento suscrito por todos los miembros de la agrupación en el que haya constancia expresa de los compromisos de ejecución que asume cada uno, así como del número de DNI y de la cuenta bancaria (IBAN de 24 dígitos) de cada uno de ellos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Nombramiento de un representante o apoderado único de la agrupación con poder suficiente para cumplir las obligaciones que corresponden a la agrupación como beneficiaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Documento suscrito por todos los miembros de la agrupación en el que se haga constar el compromiso de no disolver la agrupación hasta que haya transcurrido el plazo de prescripción previsto en el artículo 24 de la Ley 14/2014, de 29 de diciembre, de finanzas de la Comunidad Autónoma de las Illes Balears, y en los artículos 57 y 60 del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Además, antes de la concesión de la ayuda, FOGAIBA debe obtener de&amp;nbsp;la persona beneficiaria una declaración relativa al resto de las ayudas &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;minimis &lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;recibidas durante el ejercicio fiscal en curso y los ejercicios precedentes, y debe comprobar que la nueva ayuda no supere los límites aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. &amp;nbsp;El FOGAIBA comprobará de oficio el DNI de la persona beneficiaria, de su representante o de los miembros de la agrupación, en caso de entidades sin personalidad jurídica, la presentación de la notificación y de la documentación gráfica del accidente ante la Dirección General de Pesca, así como los datos del Registro general de la flota pesquera y del Registro oficial de matrícula de barcos. En caso de que la persona interesada no autorice expresamente al FOGAIBA y/o a la Consejería de Agricultura, Pesca y Medio Natural&amp;nbsp;para obtener el DNI y los certificados de estar al corriente de las obligaciones tributarias, estatales y autonómicas, y con la Seguridad Social, así como los certificados del Registro general de la flota pesquera y del Registro oficial de matrícula de barcos, debe aportar los certificados o documentos correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. De acuerdo con lo previsto en el artículo 28 de la Ley&amp;nbsp;39/2015, de 1 de octubre, de Procedimento&amp;nbsp;administrativo&amp;nbsp;común&amp;nbsp;de las administraciones públicas, no será necesario presentar la documentación&amp;nbsp;o los datos elaborados por cualquier administración&amp;nbsp;que se&amp;nbsp;puedan&amp;nbsp;obtener por medios telemáticos o que se&amp;nbsp;encuentren en poder del FOGAIBA. En el caso&amp;nbsp;de denegación&amp;nbsp;expresa para esa&amp;nbsp;comprobación, deberá aportar el documento&amp;nbsp;correspondiente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las personas interesadas tampoco&amp;nbsp;están obligadas a presentar datos&amp;nbsp;o documentos que se hayan aportado&amp;nbsp;por&amp;nbsp;ellas mismas &amp;nbsp;ante&amp;nbsp;cualquier administración. A dicho&amp;nbsp;efecto, las personas mencionadas deberán&amp;nbsp;comunicar en qué momento y&amp;nbsp;ante&amp;nbsp;qué órgano&amp;nbsp;administrativo&amp;nbsp;presentaron los &amp;nbsp;documentos,&amp;nbsp;y el FOGAIBA será el que los deba obtener electrónicamente. Excepcionalmente, si el FOGAIBA no pudiera obtener los&amp;nbsp;documentos citados, podrá solicitar nuevamente &amp;nbsp;la aportación&amp;nbsp;a las personas interesadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de imposibilidad&amp;nbsp;material de obtener el documento, antes de la propuesta de resolución, el&amp;nbsp;órgano&amp;nbsp;competente&amp;nbsp;podrá requerir a la persona solicitante&amp;nbsp;para que lo presente&amp;nbsp;o, por defecto, que acredite&amp;nbsp;por otros medios&amp;nbsp;los requisitos a los que se refiere el el documento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Si la solicitud tienen algún defecto&amp;nbsp;o no adjunta toda&amp;nbsp;la documentación&amp;nbsp;mencionada&amp;nbsp;en los puntos anteriores, o bien si los documentos que se deban presentar durante&amp;nbsp;la tramitación&amp;nbsp;del&amp;nbsp;expediente&amp;nbsp;presentan enmiendas o tachaduras, se&amp;nbsp;requerirá&amp;nbsp;a la persona solicitante&amp;nbsp;para que, en el plazo&amp;nbsp;de diez&amp;nbsp;días, enmiende el defecto&amp;nbsp;o aporte&amp;nbsp;la documentación, con&amp;nbsp;la indicación de que, si no lo hace, se entenderá que desiste&amp;nbsp;de la solicitud y, con la resolución previa, se archivará el&amp;nbsp;expediente sin ningún otro trámite. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. La presentación de la solicitud supone la aceptación, por parte de la persona interesada, del contenido de esta convocatoria, de las bases reguladoras establecidas en la Orden de la consejera de Agricultura y Pesca de 10 de marzo de 2005 y del resto de normativa de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Séptimo&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Selección de las&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;personas&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;beneficiarias&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La selección de las personas beneficiarias se realizará mediante el procedimiento individual de selección de beneficiarios; en este caso, las solicitudes podrán resolverse individualmente, a medida que entren en el registro del órgano competente, aunque no haya finalizado el plazo para presentar solicitudes de subvención, siempre que se haya presentado toda la documentación requerida, de acuerdo con esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Si se agotan los créditos destinados a la convocatoria antes de que finalice el plazo de presentación de solicitudes, deberá suspenderse la concesión de nuevas ayudas mediante una resolución del presidente del FOGAIBA, que deberá publicarse en el &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Butlletí Oficial de les Illes Balears&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Octavo&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Instrucción del procedimiento&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El órgano competente para la instrucción del procedimiento de concesión de las ayudas es el Área de Gestión de Ayudas del FOGAIBA. Este órgano lleva a cabo, de oficio, las actuaciones necesarias para determinar, conocer y comprobar los datos en virtud de los cuales debe dictarse la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La resolución de los expedientes la dicta el vicepresidente en materia pesquera del FOGAIBA, a propuesta del jefe del Servicio de Ayudas OCM, del Estado y de Pesca, sobre la base del informe previo de la unidad gestora correspondiente de este servicio, en el que se acreditarán, en caso de ser favorable, la legalidad de la ayuda y su importe.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El plazo máximo para dictar y notificar la resolución expresa es de seis meses, a contar desde la finalización del plazo de presentación de solicitudes, y esta resolución debe notificarse individualmente a las personas interesadas. Una vez transcurrido este plazo sin que se haya notificado ninguna resolución expresa, se entenderá desestimada la solicitud. En la resolución de concesión de la ayuda debe hacerse constar expresamente el carácter &lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;de&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;&lt;/span&gt;&lt;em&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;minimis&lt;/span&gt;&lt;/em&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;&amp;nbsp;de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Contra esta resolución puede interponerse recurso de alzada ante la consejera de Agricultura, Pesca y Medio Natural&amp;nbsp;en el plazo de un mes, a contar desde el día siguiente al de su notificación, de acuerdo con lo establecido en el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y en los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Noveno&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Pago de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El pago de la ayuda se realizará mediante transferencia bancaria, una vez que se haya dictado la resolución de concesión, con la autorización previa del director gerente del FOGAIBA, ya que la justificación se ha realizado y acreditado con carácter previo a la concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Décimo&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Obligaciones de los beneficiarios&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Son obligaciones de los beneficiarios las establecidas en el artículo 11 del texto refundido de la Ley de subvenciones, aprobado por el Decreto legislativo 2/2005, de 28 de diciembre, y el artículo 15 de la Orden de la consejera de Agricultura y Pesca de 10 de marzo de 2005, por la que se establecen las bases reguladoras de las subvenciones en los sectores agrario y pesquero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El régimen jurídico aplicable en caso de incumplimiento de las obligaciones señaladas es el previsto en el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones, y comprende desde el reintegro de la ayuda y el pago del interés de demora hasta la imposición de las sanciones correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Undécimo&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Incompatibilidades&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas objeto de esta convocatoria son incompatibles con las ayudas que, para las mismas actuaciones concretas, pueda recibir el beneficiario de cualquier administración pública o de otra entidad pública o privada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Duodécimo&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Régimen jurídico aplicable&lt;/span&gt;&lt;/strong&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El régimen jurídico aplicable a la presente convocatoria es el establecido en la Orden de la consejera de Agricultura y Pesca de 10 de marzo de 2005, por la que se establecen las bases reguladoras de las subvenciones en los sectores agrario y pesquero; en el Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones en el ámbito de la Illes Balears; los preceptos que sean de aplicación de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y del Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones, y otra normativa de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por parte del FOGAIBA se realizarán los controles administrativos y sobre el terreno que se consideren necesarios para verificar que se cumplen las condiciones reglamentarias para conceder y pagar la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
