&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Pleno del Ayuntamiento de Alaior, en sesión ordinaria de día 2 de mayo de 2023 acordó, entre otros, aprobar inicialmente la modificación del Reglamento municipal de horarios de los establecimientos públicos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Dado que no se han presentado alegaciones, se entiende aprobada definitivamente y se procede a la publicación del texto íntegro:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;“&lt;strong&gt;REGLAMENTO MUNICIPAL SOBRE HORARIO DE ESTABLECIMIENTOS PÚBLICOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La ley 9/97 de Medidas Tributarias y Administrativas de la Comunidad Autónoma de las Islas Baleares en su artículo 19 establece la potestad municipal de regular los horarios de los espectáculos públicos y de las actividades recreativas mediante reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La disposición adicional séptima de la Ley 16/06 deja fuera de aplicación las circulares 3/90 y 5/92, que determinaban los horarios de los establecimientos públicos y actividades recreativas en las Islas Baleares, produciendo un vacío legal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;A efectos de completar este vacío, y de conformidad con la normativa citada, se establecen las siguientes normas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ÍNDICE&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Artículo 1. Objeto y ámbito de aplicación Artículo 2. Horario general.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Artículo 3. Apertura e inicio. Artículo 4. Cierre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Artículo 5. Sesiones adscritas a menores de edad. Artículo 6. Actividades realizadas al aire libre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Artículo 7. Locales con ambientación y amenización musical. Artículo 8. Establecimientos anexos a otras instalaciones principales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Artículo 9. Ampliación del horario general por el Ayuntamiento durante la época estival.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Artículo 10. Horario de actividades extraordinarias y actividades singulares o excepcionales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El presente Reglamento tiene por objeto establecer el horario general de apertura y de cierre de los espectáculos, establecimientos públicos y actividades recreativas del municipio de Alaior.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 2&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Horario general&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Sin perjuicio de las disposiciones legales existentes en materia de contaminación ambiental y acústica, los espectáculos públicos, actividades recreativas&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;y establecimientos públicos podrán ejercer su actividad únicamente dentro de los horarios establecidos en el artículo 3 y de cierre para cada uno de ellos en los apartados siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;–Cierre después de la terminación de la última sesión, que como máximo empezará a las 00.05 horas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Espectáculos cinematográficos Teatros&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Auditorios&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;–Cierre a la 01.00 horas: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Instalaciones deportivas &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Pistas de patinaje&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;-Cierre a las 3.00 horas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Restaurantes&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. El horario de los establecimientos que se ubiquen en la zona marítimo-terrestre de acuerdo con la normativa reguladora de Costas, en función de sus condiciones de autorización y según lo previsto en la regulación de espectáculos públicos, actividades recreativas y establecimientos públicos, será desde las diez de la mañana (10.00 h) hasta las tres de la madrugada (03.00 h).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Los espectáculos, establecimientos públicos y actividades recreativas incluidos en el ámbito de aplicación de esta orden podrán prolongar el horario de cierre en Nochevieja en 90 minutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Durante las fiestas patronales de Sant Llorenç, si así se dispone por la Alcaldía, no será de aplicación la previsión horaria del punto primero, pudiendo el Ayuntamiento autorizar horarios especiales durante la celebración de las fiestas populares, con las limitaciones que se establezcan en la resolución administrativa correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;5. Aquellos establecimientos en los que concurran varias y distintas licencies de actividad y siempre y cuando las citadas actividades no puedan ser separadas físicamente las unas de las otras y, por tanto, ser objeto de apertura y cierre de forma individualizada, en función de la actividad adoptaran como horario de apertura el más restrictivo de los establecidos para las diferentes actividades y como horario de cierre, el más restrictivo de los establecidos para las diferentes actividades, salvo autorización expresa en contrario.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Apertura e inicio&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Se entenderá por hora de apertura de los espectáculos públicos, actividades recreativas y establecimientos públicos el momento a partir del cual se permite el acceso de los espectadores o usuarios a los mismos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1.1 Entre el cierre y la apertura de los locales y establecimientos públicos deberá mediar un período de tiempo no inferior a cuatro horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Se considerará por hora de inicio aquella en la que, a partir de la hora de apertura, da comienzo el espectáculo o actividad. En los establecimientos públicos citados en el artículo anterior la hora de apertura podrá coincidir con la hora de inicio de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. La antelación con que los locales y establecimientos deberán estar abiertos antes de que den comienzo los espectáculos públicos incluidos en el primer grupo del artículo 2.1 de esta orden será como mínimo de 15 minutos y como máximo de 30 minutos. Esta circunstancia se dará a conocer por la organización del espectáculo mediante los carteles anunciadores del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los locales destinados a los espectáculos de café-teatro, café-concierto y café- cantante, cuando realicen actuaciones en directo abrirán las puertas al público con una antelación respecto al inicio de la actuación de 15 minutos, como mínimo, y de 30 minutos, como máximo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. No obstante, en los espectáculos y actividades que tengan la consideración de extraordinarios, singulares o excepcionales, de acuerdo con lo previsto en la normativa vigente, dicha antelación se ampliará, como mínimo, en una hora más en cada uno de los supuestos anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Asimismo, en aquellos espectáculos o actividades que por razones de orden público se requiera, el tiempo que medie entre la hora de apertura de las instalaciones o recintos y el inicio del espectáculo o actividad se podrá ampliar en función de las necesidades concurrentes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 4&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Cierre&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. A partir de la hora de cierre, señalada en el artículo 2 de esta norma para los establecimientos públicos, no se permitirá el acceso de clientela al local o establecimiento, no se expenderá consumición alguna y deberá, en su caso, quedar fuera de funcionamiento tanto la música ambiental como las máquinas recreativas, vídeos o cualquier aparato o máquina similar, así como las señales luminosas ubicadas en el exterior de los mismos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Asimismo, a la hora de cierre se encenderán las luces generales del local, quedando las puertas de entrada y de emergencia expeditas y abiertas para que se produzca el total desalojo en el plazo máximo de 30 minutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Con independencia de que hayan finalizado las tareas propias de recogida y limpieza del local o establecimiento, las personas usuarias no podrán permanecer en su interior a partir de la hora de cierre, siendo responsabilidad de quien es titular de la actividad la efectividad del desalojo y cierre del local en la forma y tiempo establecido.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. Entre el cierre y la apertura de los locales y establecimientos públicos deberá mediar un período de tiempo no inferior a cuatro horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 5 &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Sesiones adscritas a menores de edad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los locales que hayan obtenido autorización para la celebración de sesiones especiales dirigidas a menores de edad podrán iniciar la actividad o espectáculo a partir de las 17.00 horas. En todo caso, deberán finalizar antes de las 22.00 horas del mismo día. Estos locales permanecerán cerrados al menos durante media hora desde la finalización de la sesión y el comienzo de las sesiones ordinarias, si las tuvieren.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 6&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Actividades realizadas al aire libre&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Las actividades y espectáculos comprendidos en el artículo 2.1 de este Reglamento –salvo los autocines y cines de verano– que se realicen al aire libre o en instalaciones portátiles o eventuales en la vía pública, ya sean autorizadas con carácter temporal o cuenten con licencia o autorización definitiva municipal, tendrán el horario que se establezca en la correspondiente autorización administrativa, que deberá ser expresa, debiendo terminar en todo caso su actividad, como máximo, a la hora de cierre señalada con carácter general en este Reglamento para cada grupo, sin perjuicio del cumplimiento de las disposiciones sobre contaminación acústica.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Por las fiestas populares o patronales, como Sant Llorenç en el casco urbano de Alaior y las fiestas de Cala en Porter en Cala en Porter, así como Navidad y Carnaval en todos los núcleos, el Ayuntamiento podrá autorizar horarios especiales con las limitaciones que se establezcan en la resolución administrativa correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3. La autorización del horario de las actividades al aire libre podrá ser revocada, previo trámite de audiencia de la persona interesada, por un período no superior a 10 días por la autoridad municipal.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 7&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Locales con ambientación y amenización musical&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El horario de la ambientación musical de los espectáculos públicos, actividades recreativas o establecimientos públicos que de acuerdo con su licencia municipal de apertura dispongan de la misma, comenzará en todo caso a partir de las 10.00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 8&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Establecimientos anexos a otras instalaciones principales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los establecimientos ubicados en instalaciones en las que se desarrolle otra actividad considerada como principal y de las que sean accesorias, podrán tener el mismo horario que aquellas. No obstante, quedan excluidos los establecimientos o locales situados en centros comerciales o grandes superficies comerciales o de ocio, en cuyo caso serán regidos por el horario general establecido en este Reglamento, siempre y cuando estén comprendidos dentro del horario de apertura y cierre del centro comercial o de ocio donde se ubiquen.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 9&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Ampliación del horario general por el Ayuntamiento durante la época estival&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Durante el período comprendido entre el 17 de junio y el 30 de septiembre, los establecimientos podrán prolongar el horario general de finalización/cierre establecido en el artículo 2.1 de este Reglamento los viernes, sábados y vísperas de festivos en media hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 10&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Horario de actividades extraordinarias y actividades singulares o excepcionales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Los espectáculos y actividades recreativas que tengan carácter extraordinario deberán terminar, como máximo, a la hora de cierre del establecimiento de acuerdo con lo indicado en este Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Los espectáculos y actividades recreativas que tengan carácter singular o excepcional deberán terminar, como máximo, a la hora indicada por el órgano competente para su autorización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La indicación de dicho horario de finalización estará determinado por la tipología y/o características del recinto donde vayan a realizarse así como por la clase de espectáculo o actividad que se solicite.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 11&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Cartel horario&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Los locales afectados por este Reglamento deberán colocar un cartel en lugar legible y visible desde el exterior en el que se expresará el horario de apertura y cierre que realicen. Dicho horario deberá estar comprendido, en todo caso, dentro de lo establecido con carácter general en el artículo 2 de este Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Igualmente, en el referido cartel se hará constar el horario en que dejen de prestarse algunos de los servicios en el caso de que éste sea diferente al de apertura o cierre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 12&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Restricciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El Ayuntamiento podrá avanzar el horario de cierre o retrasar el horario de apertura de aquellos locales a los que, por infracción en la normativa de actividades clasificadas, se les haya señalado la obligación de adoptar medidas correctoras. La citada restricción de horarios de funcionamiento se prolongará hasta que se hayan adaptado las citadas medidas y obtenido informe favorable del órgano competente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 13&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Actividad inspectora y de control&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las actividades inspectores y de control sobre el cumplimiento de lo previsto en el presente Reglamento serán efectuadas por la Policía Local o por funcionariado debidamente acreditado del Ayuntamiento de Alaior. Este personal tendrá, en el ejercicio de sus funciones, el carácter de agentes de la autoridad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los titulares o prestadores de los establecimientos públicos y los organizadores de espectáculos públicos y actividades recreativas, o sus representantes y encargados, estarán obligados a permitir, en cualquier momento, el libre acceso a los inspectores cuando se realicen las inspecciones sobre el cumplimiento de este Reglamento. Asimismo, deberán prestar la colaboración necesaria que les sea solicitada en relación con las inspecciones de que sean objeto.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Régimen sancionador&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 14&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Principios generales&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El ejercicio de la potestad sancionadora en el ámbito del presente Reglamento se regirá por lo dispuesto en el título IX de la Ley de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común, modificada por la Ley 4/1999, de 13 de enero, y por la Ley 25/2009, de 22 de diciembre, que regula la potestad sancionadora de la CAIB mediante Decreto 14/1994.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 15&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Responsabilidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;De las infracciones del presente Reglamento serán responsables solidariamente los titulares de las licencias de actividad de los locales, los organizadores o promotores de espectáculos o actuaciones que tengan lugar o que se beneficien directa o indirectamente de su realización.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 16&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Infracciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Constituyen infracciones administrativas las acciones u omisiones que contravengan las disposiciones del presente Reglamento, sin perjuicio de las responsabilidades civiles, penales o de otro orden que puedan derivarse.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En los procedimientos aplicadores de sanciones que se instruyan en aplicación del presente Reglamento, los hechos constatados por los agentes de la autoridad tendrán valor probatorio, conforme a la normativa aplicable al efecto, sin perjuicio de otras pruebas que puedan aportar las personas interesadas. En los expedientes aplicadores de sanciones que se instruyan, y con los requisitos que correspondan conforme a la legislación vigente, podrán incorporarse imágenes de los hechos denunciados, ya sea en fotografía, filmación digital u otros medios, en la denuncia formulada de acuerdo con la normativa aplicable. En todo caso, el uso de videocámaras se regirá de acuerdo con el principio de proporcionalidad. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las infracciones administrativas se clasifican en:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Leves&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- El retraso en el comienzo o finalización de los espectáculos, en un exceso de tiempo de hasta 30 minutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- El adelanto en la apertura o el retraso en el cierre de los locales o establecimientos públicos, en un exceso de tiempo de hasta 30 minutos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- La falta o ubicación en lugar no visible desde el acceso principal, del cartel indicativo donde conste el horario de apertura y cierre del establecimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Cualquier infracción de las normas del presente Reglamento no calificada como falta grave o muy grave.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Graves&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- El retraso en el comienzo o finalización de los espectáculos, en un exceso de tiempo de más de 30 minutos y hasta una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- El adelanto en la apertura o el retraso en el cierre de los locales o establecimientos públicos, en un exceso de tiempo de más de 30 minutos y hasta una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- El incumplimiento por parte de los establecimientos públicos que celebren sesiones para menores de los requisitos relativos a horarios, así como la dedicación del local a actividades distintas a dichas sesiones en el mismo o en diferente horario programado para ellas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Incumplir lo dispuesto en el artículo 4.1 y 4.2 del presente Reglamento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Las infracciones leves cuando, en un periodo de hasta doce meses antes de cometerlas, su responsable haya sido objeto de sanción mediante resolución definitiva por infracción tipificada como leve.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Muy graves&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- El retraso en el comienzo o finalización de los espectáculos, en un exceso de tiempo de más de una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- El adelanto en la apertura o el retraso en el cierre de los locales o establecimientos públicos, en un exceso de tiempo de más de una hora.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Negar el acceso al establecimiento o recinto a los agentes de la autoridad o funcionarios inspectores que se encuentren en el ejercicio de su cargo, así como la negativa a colaborar con los mismos en el ejercicio de sus funciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Las infracciones leves cuando, en un periodo de hasta doce meses antes de cometerlas, su responsable haya sido objeto de sanción mediante resolución definitiva, por infracción tipificada como grave.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Les infracciones tipificadas en el presente Reglamento como leves prescribirán en el plazo de 6 meses, las tipificadas como graves en 2 años, y las tipificadas como muy graves en 3 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Interrumpirá la prescripción el inicio, con el conocimiento de la persona interesada, del procedimiento aplicador de sanciones y se retomará el plazo de prescripción si el expediente aplicador de sanciones estuviera paralizado durante más de un mes por causa no imputable al presunto o presunta responsable.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El procedimiento sancionador ordinario deberá ser resuelto y notificarse la resolución que sea procedente al interesado en el plazo máximo de un año, desde su inicio, y se producirá su caducidad en la forma y modo previstos en la Ley 30/1992, de 26 de noviembre, de régimen jurídico de las administraciones públicas y del procedimiento administrativo común.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No obstante lo anterior, el instructor o instructora del expediente podrá acordar la suspensión del plazo máximo para resolver cuando concurran algunas de las circunstancias previstas y exigidas para ello en el artículo 42.5 de la citada Ley, de acuerdo con la redacción fijada por la Ley 4/1999, de 13 de enero.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 17 &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Tipos de sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las sanciones por infracción al presente Reglamento podrán aplicarse de forma independiente o conjunta y ser de tipo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Económico: multa&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Cualitativo: cierre, suspensión o retirada de licencia, etc.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 18&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Graduación de las sanciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Al amparo de lo dispuesto en la normativa vigente reguladora de las bases de régimen local, las infracciones se clasifican en leves, graves y muy graves y se sancionarán con las siguientes cuantías:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Infracciones leves, con multa de hasta 750 €.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Infracciones graves, con multa de hasta 1.500 €, pudiendo imponerse la sanción de suspensión de las actividades por un período máximo de 6 meses.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Infracciones muy graves, con multa de hasta 3.000 €, pudiendo imponerse la sanción de suspensión de las actividades, por un período máximo de 3 años.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Para la imposición de sanciones previstas en el presente Reglamento se tendrán en cuenta, en todo caso, los siguientes criterios de graduación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- La gravedad de la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- La existencia de intencionalidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- La naturaleza de los perjuicios causados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En la fijación de las sanciones de multa se tendrá en cuenta que, en todo caso, el cumplimiento de la sanción no resulte más beneficiosa para la persona infractora que el cumplimiento de les normas infringidas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La desobediencia o resistencia a la autoridad o a sus agentes, en los términos de los artículos 556 y 634 de la Ley Orgánica 10/1995, de 23 de noviembre,&amp;nbsp;del Código Penal, dará lugar a que el órgano actuante pase el tanto de culpa al Juzgado de Instrucción para la determinación de las responsabilidades penales en las que hubiera podido incurrir. La tramitación de las diligencias penales interrumpirá los plazos de prescripción de la infracción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El plazo de prescripción de las sanciones comenzará a contar desde el día siguiente a aquel en el que se haya agotado la vía administrativa de la resolución por la que se impone la sanción.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 19&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Competencia para sancionar&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. La competencia para incoar y resolver los procedimientos sancionadores por infracciones a este Reglamento corresponderá al Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Las sanciones impuestas por resoluciones que pongan fin a la vía administrativa serán inmediatamente ejecutivas. No obstante, por el órgano competente podrá acordarse la suspensión de su ejecución cuando se interponga recurso administrativo y se aprecie que concurra, en este sentido, lo previsto en la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 20&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Reconocimiento de la responsabilidad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las personas denunciadas podrán asumir su culpa y conformidad mediante el pago de las sanciones de multa, con una reducción del 30% del importe máximo de la sanción si el pago se hace efectivo entre la denuncia y la notificación del inicio del expediente sancionador, o con una reducción del 20% del importe de la sanción cuando el pago se haga efectivo desde la resolución de inicio y antes de la resolución final.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 21&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;Medidas provisionales durante la instrucción del procedimiento sancionador&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;1. Sin perjuicio de lo dispuesto en la normativa aplicable, iniciado el procedimiento sancionador por la presunta comisión de infracciones graves y muy graves, la autoridad competente podrá acordar mediante resolución motivada las medidas provisionales imprescindibles para el normal desarrollo del procedimiento, asegurar el cumplimiento de la sanción que pudiera imponerse y evitar la comisión de nuevas infracciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;2. Las medidas deberán ser proporcionadas a la naturaleza y gravedad de las infracciones cometidas, pudiendo consistir en alguna de las previstas seguidamente, o cualquier otra que asegure la eficacia de la resolución que pudiera recaer:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Suspensión o prohibición del espectáculo público o actividad recreativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Clausura del local o establecimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Suspensión de la licencia o autorización de la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;3.Las medidas provisionales podrán ser alzadas o modificadas durante la tramitación del procedimiento, de oficio o a instancia de parte, en virtud de circunstancias sobrevenidas o que no pudieron ser tenidas en cuenta en el momento de su adopción. En todo caso se extinguirán con la resolución que ponga fin al procedimiento sancionador correspondiente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;4. Estas medidas provisionales serán acordadas mediante resolución motivada previa audiencia de la persona interesada en un plazo de diez días. En caso de urgencia debidamente motivada el plazo de audiencia quedará reducido a dos días.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Disposición adicional&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La cuantía de las sanciones económicas previstas en el presente Reglamento podrá actualizarse reglamentariamente por el Pleno municipal en función de las variaciones del índice de precios al consumo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Disposición final&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El presente Reglamento entrará en vigor conforme a lo establecido en el artículo 103 de la Ley 20/2006, de 15 de diciembre, Municipal y de Régimen Local de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt; &lt;/p&gt;
