    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 8.4&amp;nbsp;de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 30&amp;nbsp;de enero de 2018, por la cual se convocan subvenciones para el Fomento de la Agricultura Ecológica, especifica que la Resolución se notificará a las persones interesadas mediante su publicación al Boletín Oficial de las Illes Balears de acuerdo con los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones publicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El expediente ha sido tramitado por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) en cumplimiento del que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia de pesca del FOGAIBA, con fecha 9&amp;nbsp;de agosto&amp;nbsp;de 2023, firmó la siguiente resolución:&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 26 de febrero de 2015, se publicó en el BOIB núm. 29 la Orden del conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014- 2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha de 27 de febrero de 2021 se publicó, en el BOIB núm. 27, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para los años 2021 y 2022 de las ayudas destinadas al fomento de la agricultura ecológica. Esta Resolución ha sufrido dos modificaciones, la primera publicada en el BOIB nº.29, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 24 de febrero de 2022, por la que se incrementa el crédito y se modifica la financiación de la convocatoria, para los años 2021 y 2022. Y la segunda, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con fecha 27 de abril de 2023, publicada en el BOIB nº. 54, por la que se modifica el anexo III de la convocatoria de las ayudas destinadas al fomento de la agricultura ecológica para los años 2021 y 2022, en lo referente a la tipificación del incumplimiento del compromiso evaluable de formación. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Los interesados señalados en el Anexo I adjunto han presentado, en tiempo y forma, toda la documentación necesaria prevista en la convocatoria, tal y como explica el apartado sexto de la convocatoria; pero se ha comprobado a fecha 13/07/2023 que no cumplen con alguno de los requisitos de la misma, concretamente con el punto duodécimo, apartado 1, en lo referente a la solicitud anual de pago. Los expedientes señalados en el anexo I, a pesar de tener una concesión de ayuda, no han presentado la solicitud anual de pago correspondiente a la campaña 2022 y por tanto debe revocarse esta anualidad.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 27 de febrero de 2021 por la que se aprueba la convocatoria para los años 2021 y 2022 de las ayudas destinadas al fomento de la agricultura ecológica . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha 24 de febrero de 2022 se publicó, en el BOIB núm. 29, una modificación de la Resolución citada anteriormente por la que se incrementa el crédito y se modifica la financiación de la convocatoria, para los años 2021 y 2022. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Por todo ello, se informa y se propone al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Revocar parcialmente la resolución de concesión de la ayuda de la Medida 11.2.1. Ayudas para el &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;F&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;omento de la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;gricultura &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;cológica para los años 2021 y 2022 del PDR, por el importe y con los datos detallados en el Anexo I de esta resolución, que es un total de 3 expedientes y que comienza con Tierra de Foravila, SL (B02685956) y termina con Patrick Merie Jean de la Chesnais (&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;***&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1160&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;**).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;2.Notificar la resolución a los interesados en el Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
