    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El apartado 8.4&amp;nbsp;de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 22&amp;nbsp;de febrero de 2021, por la cual se convocan subvenciones para el “Fomento de la Agricultura Ecológica”, para los años 2021 y 2022 (anualidad 2022) especifica que la Resolución se notificará a las persones interesadas mediante su publicación al Boletín Oficial de las Illes Balears de acuerdo con los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones publicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El expediente ha sido tramitado por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) en cumplimiento del que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 9 de agosto&amp;nbsp;de 2023, firmó la siguiente resolución:&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;em&gt;&lt;em&gt;1. Con fecha 26 de febrero de 2015, se publicó en el BOIB núm. 29 la Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014- 2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;em&gt;&lt;em&gt;2. Con fecha de 27 de febrero de 2021 se publicó, en el BOIB núm. 27, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para los años 2021 y 2022 de las ayudas destinadas al Fomento de la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;gricultura &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;cológica. Esta Resolución ha sufrido dos modificaciones, la primera publicada en el BOIB nº.29, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 24 de febrero de 2022, por la que se incrementa el crédito y se modifica la financiación de la convocatoria, para los años 2021 y 2022. Y la segunda, &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 27 de abril de 2023, publicada en el BOIB nº.54, por la que se modifica el anexo III de la convocatoria de las ayudas destinadas al &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;F&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;omento de la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Agricultura Ecológica para los años 2021 y 2022, en lo referente a la tipificación del incumplimiento del compromiso evaluable de formación. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;em&gt;&lt;em&gt;3. Con fecha 23 de abril de 2021 se registró la solicitud de ayuda a nombre de JUAN LLULL ESPLUGUES con DNI ***1536**, al amparo de la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 22 de febrero de 2021 por la que se aprueba la convocatoria para el año 2021 de las ayudas destinadas al Fomento de la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Agricultura Ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;em&gt;&lt;em&gt;4. El día 1 de junio de 2022 el vicepresidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) aprobó la ayuda correspondiente al expediente 04003250/21AECU de la línea de ayudas destinadas al Fomento de la Agricultura Ecológica a favor de JUAN LLULL ESPLUGUES con DNI ***1536**, un importe máximo de 2.199,12 € repartidos en dos anualidades de 1.099,56 € correspondientes a una superficie comprometida de 2,45 ha (BOIB 86, 02/ 07/22). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. Con fecha 9 de junio de 2022 se ha realizado el pago de la anualidad 2021 por un importe de 1.099,12 €. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Con fecha 4 de abril de 2022 se realiza mediante la aplicación Sistema de Gestión de Ayudas, una subrogación de los compromisos por los que se tenía derecho a la ayuda de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;gricultura Ecológica del expediente 04003250/21AECU, a favor de JORDI LLULL MASCARO, con DNI ***2164** (expediente 04002213/22AECU). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han comprobado la información necesaria para efectuar la evaluación del cumplimiento de los requisitos por parte del nuevo titular para ser beneficiario de las ayudas tal y como estipula el apartado décimo de la resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 22 de febrero de 2021 por la que se aprueba la convocatoria para los años 2021 y 2022 de las ayudas destinadas al para el Fomento de la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;gricultura Ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Durante la evaluación de los compromisos, se comprueba que ni el cedente JUAN LLULL ESPLUGUES con DNI ***1536**, ni el cesionario JORDI LLULL MASCARO, con DNI ***2164** cumplen con el requisito de la convocatoria , punto noveno, apartado d) de participación, durante el período de compromiso, en actividades de formación relacionadas con la agricultura ecológica, de un mínimo de 25 horas, o una titulación en formación agrícola reglada de nivel FP2 o superior. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. El cedente JUAN LLULL ESPLUGUES con DNI ***1536** no acredita ningún tipo de formación, y el cesionario JORDI LLULL MASCARO, con DNI ***2164** acredita una titulación que se corresponde a un grado medio de FP y no se contempla en el punto noveno, apartado d) de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para los años 2021 y 2022 de las ayudas destinadas al Fomento de la &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;gricultura Ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10. Con fecha 3 de julio de 2023 se notifica, mediante publicación en la página web del FOGAIBA, el informe y la propuesta provisional de denegación de subrogación, emitida por el Servicio de ayudas al Desarrollo Rural al interesado JORDI LLULL MASCARO, con DNI ***2164**, y se concede un plazo de 10 días para presentar las alegaciones oportunas. Dentro del plazo establecido, el interesado no ha presentado alegaciones para realizar posibles enmiendas, o bien si las ha presentado, se han desestimado. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;11. Se ha considerado el informe/propuesta provisional de Resolución, publicado en la página web del FOGAIBA, de denegación de la subrogación del expediente de JORDI LLULL MASCARO, con DNI ***2164**, puesto que no cumple con compromiso básico de formación a que se refiere el punto noveno, apartado d) de la convocatoria. El incumplimiento del compromiso básico de formación implica una exclusión del 100% de la ayuda, consiguientemente, no puede ser beneficiario de las ayudas previstas en la convocatoria, debiendo denegarse la subrogación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 22 de febrero de 2021 por la que se aprueba la convocatoria para los años 2021 y 2022 de las ayudas destinadas al F&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;omento de Agricultura Ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Con fecha 24 de febrero de 2022 se publicó en el BOIB núm. 29, una modificación de la Resolución citada anteriormente por la que se incrementa el crédito y se modifica la financiación de la convocatoria,&amp;nbsp;&amp;nbsp;para los años 2021 y 2022. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER) y por el que se deroga el Reglamento (CE) núm. 1698/2005 del Consejo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, de 17 de diciembre de 2013, sobre la financiación, gestión y seguimiento de la Política Agrícola Común, por el que se derogan los Reglamentos (CE) núm. 352/78, (CE) núm. 165/94, (CE) núm. 2799/98, (CE) núm. 814/2000, (CE) núm. 1290/2005 y (CE) núm. 485/2008 del Consejo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. Reglamento delegado (UE) núm. 640/2014 de la Comisión, de 11 de marzo de 2014, por el que se completa el Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, en lo que se refiere al sistema integrado de gestión y control ya las condiciones sobre la denegación o retirada de los pagos y sobre las sanciones administrativas aplicables a los pagos directos, a la ayuda al desarrollo rural ya la condicionalidad. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Reglamento de ejecución (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;​​​​​​​&lt;/span&gt;&lt;/p&gt;

Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, en lo que respecta al sistema integrado de gestión y control, las medidas de desarrollo rural y la condicionalidad. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Real decreto 1075/2014, de 19 de diciembre, sobre la aplicación a partir de 2015 de los pagos directos a la agricultura y la ganadería y otros regímenes de ayuda, así como sobre la gestión y control de los pagos directos y de los pagos al desarrollo rural. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. Real decreto 1078/2014, de 19 de diciembre, por el que se establecen las normas de condicionalidad que deben cumplir los beneficiarios que reciban pagos directos o determinadas primas anuales de desarrollo rural, o pagos en virtud de los programas de apoyo a la reestructuración y reconversión o de apoyo a la cosecha en verde, en el sector vitivinícola. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), a la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;17. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;18. Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución de denegación de subrogación &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo esto, se informa desfavorablemente y se propone al vicepresidente del FOGAIBA que dicte una &lt;strong&gt;resolución&lt;/strong&gt; en los términos siguientes:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Denegar la subrogación de los compromisos relativos a la línea de ayudas destinadas al fomento de la agricultura ecológica a favor de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;JORDI LLULL MASCARO&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;D&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;NI&amp;nbsp;***2164**.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Informar a los beneficiarios de que sus expedientes se encuentran a su disposición y consulta en el Servicio de Ayudas al Desarrollo Rural del FOGAIBA (calle de Reina Constança, núm. 4 de Palma). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolución a los beneficiarios mediante la publicación en el Boletín Oficial de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la consejera de Agricultura, Pesca y Alimentación, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/15, de 1 de octubre, del procedimiento administrativo común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/p&gt;
