    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Junta de Gobierno del Consejo Insular de Formentera, en sesión de carácter Ordinario de 11 de agosto de 2023, celebrada en forma presencial, adoptó, entre otros, el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero. - APROBAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; el otorgamiento de subvención nominativa directa por el importe de 12.000€, al Grupo Deportivo Espalmador con CIF G57664542, para promocionar, organizar y ejecutar eventos de larga trayectoria el cual se adjunta en el Anexo I.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La gestión de la subvención se llevará a cabo de acuerdo con la firma del convenio anexo a la propuesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero. - AUTORIZAR Y DISPONER EL GASTO&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; con cargo a la partida presupuestaria 2023.1.341.48000 de los presupuestos para el año 2023&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto. - RECONOCER&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; la obligación del importe concedido, ordenar el pago y pagar el importe del 50% de 12.000€ de la subvención y registrar la operación como pendiente de justificar hasta que el beneficiario no proceda a la justificación de la misma de acuerdo con las normas de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto. -FACULTAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; al señor presidente del Consejo Insular de Formentera, para que una vez esté aprobada esta subvención de concesión nominativa directa, pueda firmar el convenio anexo, según lo estipulado en el artículo 21 de la Ley 4/2022, de 28 de junio, de consejo insulares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexto. - GUARDAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; copia de este convenio en el Registro de Convenios que se encuentra ubicado en la secretaría de la Corporación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Séptimo. - NOTIFICAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; este acuerdo al Grupo Deportivo Espalmador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Octavo. - PUBLICAR&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; el Convenio en BOIB y en la página web del Consejo Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ANEXO I&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Convenio de colaboración entre el Consejo Insular de Formentera y el Grupo Deportivo Espalmador para promocionar, organizar y ejecutar eventos de larga trayectoria para el año 2023&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Reunidos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por un lado, el Sr.&amp;nbsp;Lorenzo Córdoba Marí, mayor de edad, vecino de Formentera, domiciliado en la plaza de la constitución núm. 1 en Formentera, con Documento Nacional de Identidad núm. ***5363**.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Sr. Juan Jose Escandell Mayans, mayor de edad, con DNI ***5981**, y domicilio a efectos de notificaciones en c/ Mallorca 29, 1º, 3ª San Fernando, Formentera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Intervienen&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Sr. Lorenzo Córdoba Marí, como presidente del Consejo Insular de Formentera, actuando en nombre y representación de esta Corporación, con CIF P0702400C y con domicilio en la plaza de la Constitución núm. 1, de San Francisco Javier (Formentera), en virtud del Decreto de Presidencia de 26 de junio de 2023, de atribuciones competenciales a los miembros del equipo de Gobierno, de acuerdo con el artículo 136 del Reglamento Orgánico del Consell Insular de Formentera (ROC) y en virtud del artículo 21.1.b) de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, de la Ley Orgánica 5/1985, de 19 de junio, de régimen electoral general y de la Ley 4/2022, de 28 de junio, de consejos insulares, asistido por el Secretario de la Corporación, sr. Ángel C. Navarro Sánchez, de conformidad con el artículo 161 del ROC.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El sr. Juan Jose Escandell Mayans, presidente del Grupo Deportivo Espalmador de Formentera, quien actúa en representación del citado Club, quien dispone de CIF G57664542, según el Acta de la Asamblea General ordinaria del Grupo Deportivo Espalmador, de fecha 02 de octubre de 2019.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ambas partes actúan en representación de sus respectivas entidades, se reconocen mutuamente plena capacidad jurídica para obrar, y&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Manifiestan&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Que, a efectos de dar uso a las instalaciones deportivas del Consejo Insular de Formentera para este año 2023, con el fin de ejercer los intereses del Consejo Insular de Formentera, éste se encuentra habilitado para promover el deporte y dar servicios públicos que contribuyan a satisfacer las necesidades y aspiraciones del municipio de Formentera, dada la competencia establecida por el artículo 70.9 de la Ley orgánica 1/2007, de 28 de febrero, que modifica el Estatuto de Autonomía de las Illes Balears. Además, de forma específica, la Ley 2/2023, de 7 de febrero, de la actividad física y el deporte en las Illes Balears, establece en su artículo 9, entre otros, la competencia del Consell Insular de Formentera para colaborar, en su ámbito territorial, con las entidades en el desarrollo del deporte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Dado que el Grupo Deportivo Espalmador está interesado en realizar la promoción, la planificación, la organización y ejecución de los diferentes eventos deportivos de Larga Trayectoria para 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Que es voluntad del Consejo Insular de Formentera colaborar con el Grupo Deportivo Espalmador para que se lleve a cabo las siguientes pruebas deportivas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;XIII Trofeo Ciclismo en Ruta Isla de Formentera&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En virtud de lo expuesto anteriormente, ambas partes acuerdan formalizar este convenio, de acuerdo con las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cláusulas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1) Obligaciones del Grupo Deportivo Espalmador en cuanto a la promoción organización y ejecución de eventos deportivos.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por parte del Grupo Deportivo Espalmador:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Grupo Deportivo Espalmador se responsabiliza de que los eventos deportivos y todo lo referente a la promoción, planificación, organización y ejecución de los eventos antes nombrados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En los eventos deportivos objetos de este convenio, tanto los dorsales de todos los deportistas que participen como todas las pancartas, carteles de salida y llegada y página web de cada evento, debe aparecer siempre el logotipo del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Grupo Deportivo Espalmador añadirá en todos sus reglamentos deportivos de las pruebas incluidas en este convenio, una cláusula donde esté bien claro que es obligación de los participantes velar por la correcta limpieza y clasificación de los residuos que se producen durante las pruebas, pendiente el Consell Insular de Formentera sancionarles por no cumplir la normativa vigente de recogida selectiva.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por parte del Consejo Insular de Formentera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Consell Insular de Formentera se compromete a supervisar y velar por el correcto desarrollo de las actividades descritas en este convenio de colaboración y comprobar que se llevan a cabo con total normalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2) Forma de pago&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La forma de pago por parte del Consejo Insular de Formentera será la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se abonará al Grupo Deportivo Espalmador de Formentera un primer pago del 50% (6.000€) en el momento de la firma del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se abonará un segundo pago del 50% (6.000€) restante, cuando se presente una memoria justificativa del primer 50% aportando una memoria responsable con el contenido que determinen el área de deportes y la de Intervención. Se debe presentar una memoria para los gastos de la promoción, planificación, organización y ejecución de los diferentes eventos deportivos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Técnico del área de deportes emitirá un informe favorable en el que diga que la contratación conveniada se lleva a cabo con normalidad, dentro de los objetivos marcados en este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Durante el mes de enero de 2024 el Grupo Deportivo Espalmador deberá justificar el 100% de su actuación. Éste será requisito indispensable para poder firmar un nuevo convenio con el Consejo. Esto no exenta de devolver la cantidad correspondiente en caso de no poder justificar el 100% de las cantidades recibidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El beneficiario está eximido de presentar garantías atendiendo a la naturaleza de las actividades subvencionadas y sus características como beneficiario, de conformidad con el artículo 42 y siguientes del Real Decreto 88/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En Cumplimiento de lo dispuesto en el artículo 11 del decreto legislativo 2/2005, de 25 de diciembre, texto refundido de la ley de subvenciones de las Illes Balears, el Grupo Deportivo Espalmador queda sometido, entre otros, a las siguientes obligaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Realizar las actividades o la inversión o adoptar el comportamiento que fomenta la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Presentar durante el mes de enero de 2024, los documentos acreditativos de la justificación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Someterse a las actuaciones de comprobación que lleven a cabo los órganos competentes en cualquier momento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dejar constancia de la percepción y aplicación de la subvención en los libros de contabilidad o en los libros de registro que deba llevar el beneficiario de acuerdo con la legislación mercantil o fiscal que sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Conservar los documentos justificativos de la aplicación de los fondos percibidos en tanto puedan ser objeto de actuaciones de comprobación y control.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Reintegrar los fondos percibidos en los supuestos previstos en el artículo 44 de esta ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3) Justificación de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Grupo Deportivo Espalmador de Formentera presentará en el registro general de entrada del CIF, ubicado en la OAC, dirigida al Área de Deportes de este Consejo, antes del 31 de enero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una &lt;strong&gt;Memoria Justificativa Simplificada&lt;/strong&gt; (Cuenta Justificativo Simplificado) del 100% del gasto realizado donde vengan contenidas las pruebas deportivas llevadas a cabo entre el 1 de enero y el 31 de diciembre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una &lt;strong&gt;Memoria Justificativa de la Actividad&lt;/strong&gt;, con los eventos realizados entre el 1 de enero y el 31 de diciembre de 2023. Esta memoria constará de información textual del evento, y si es necesario, fotografías, carteles publicitarios, recortes de prensa y cualquier otra información que el Grupo Deportivo Espalmador considere adecuado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El técnico del área de Deportes del Consell de Formentera deberá emitir un informe que corrobore que efectivamente se ha realizado este gasto y que todo es correcto para cerrar el expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Acreditación de estar al corriente de pago de todas las obligaciones tributarias y frente a la seguridad social, o autorización en favor del CIF, para que pueda solicitar los certificados necesarios ante el Ministerio de Economía y Hacienda y el Departamento de Economía y Hacienda de la Comunidad Balear.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Presupuesto de ingresos y gastos realizados, en el que se deberá incluir la cuenta justificativa de gastos que de conformidad con lo establecido en el artículo 72 del Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que la documentación no se presente dentro del plazo establecido, el Consejo Insular de Formentera hará un requerimiento al grupo Deportivo Espalmador para que en el plazo de 15 días presente la documentación correspondiente a la justificación del convenio. En caso de que no se atienda a este requerimiento, el Consejo llevará a cabo los trámites necesarios para el reintegro de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4) Reintegro de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se establece la obligación por parte del Grupo Deportivo Espalmador de Formentera de reintegrar los fondos en el supuesto de incumplimiento de los requisitos y obligaciones establecidas para la concesión, y en todo caso, en los supuestos regulados en el artículo 44 del decreto legislativo 2/2005, de 28 de diciembre, texto refundido de la ley de subvenciones de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Además, el CIF se reserva el derecho a disminuir proporcionalmente su aportación, en el supuesto de incumplimiento parcial del Convenio, o en caso de que los gastos justificados no lleguen al total de los gastos presupuestados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5) Concordancia con otras subvenciones.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Grupo Deportivo Espalmador deberá informar al Consejo Insular de Formentera, a través del órgano competente en la materia, la subvención o subvenciones que reciba para la misma finalidad. En esta comunicación hará constar el dinero obtenido, así como todas las condiciones aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En ningún caso, la cuantía total de las subvenciones podrá superar el cuerpo total de la actividad, puesto que, si es así, la subvención concedida por esta Corporación se reducirá de forma proporcional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6) Vigencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Este convenio está vigente desde el día de su firma hasta el día 31 de diciembre de 2023 y tiene efectos retroactivos desde el 1 de enero de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Este convenio se podrá resolver, previa audiencia de las partes, entre otras, por las siguientes causas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El mutuo acuerdo entre las partes, que debe formalizarse por escrito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El incumplimiento de las normativas de aplicación y/o de los pactos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. No realizar la prestación de las actividades objeto del presente convenio. En caso de que la resolución del convenio fuera por incumplimiento por parte del Grupo Deportivo Espalmador éste deberá reintegrar la totalidad las cantidades económicas percibidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7) Procedimiento de otorgamiento de la subvención y naturaleza del presente convenio&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El presente convenio tiene naturaleza administrativa y constituye el instrumento a través del cual se canaliza una subvención por el procedimiento de concesión directa previsto en el artículo 7.1 c) del decreto legislativo 2/2005, de 28 de diciembre, texto refundido de la ley de subvenciones de las Islas Baleares, y en el artículo 22.2 c) de la Ley 38/2003, de 17 de noviembre, general de subvenciones, porque se acreditan razones de interés público, social, económico o humanitario que dificultan su convocatoria pública , de acuerdo con los informes que constan en el Área de Deportes del Consell Insular de Formentera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8) Normativa de aplicación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En lo no previsto en el presente convenio, habrá que ajustarse a lo que disponen las bases de ejecución del presupuesto general del Consejo Insular de Formentera para 2023, al Decreto legislativo 2/2005, de 28 de diciembre, texto refundido de la Ley de Subvenciones de las Illes Balears, en la Ley 38/2003, de 17 de noviembre, General de Subvenciones y en el Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, en el Plan Estratégico de Subvenciones para 2022 y primer semestre de 2023, aprobado inicialmente por el Pleno de 25 de febrero de 2022 y publicado en el BOIB número 36, de 12 de marzo de 2022, y de acuerdo con lo que establece el artículo 8 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, y los artículos 10 y siguientes de su Reglamento, así como, lo establecido en el artículo 6 y concordantes del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones aplicable a las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Y en prueba de conformidad, ambas partes firman este convenio de colaboración por duplicado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
