    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 8.4&amp;nbsp;de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 30&amp;nbsp;de enero de 2018, por la cual se convocan subvenciones para el Fomento de la Agricultura Ecológica, especifica que la Resolución se notificará a las persones interesadas mediante su publicación al Boletín Oficial de las Illes Balears de acuerdo con los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones publicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El expediente ha sido tramitado por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) en cumplimiento del que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia Agraria del FOGAIBA, con fecha 10&amp;nbsp;de julio&amp;nbsp;de 2023, firmó la siguiente resolución:&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 26 de febrero de 2015, se publicó en el BOIB núm. 29 la Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014- 2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Con fecha de 27 de febrero de 2021 se publicó, en el BOIB núm. 27, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para los años 2021 y 2022 de las ayudas destinadas al fomento de la agricultura ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 24 de febrero de 2022 se publicó, en el BOIB núm. 29, una modificación de la Resolución citada anteriormente por la que se incrementa el crédito y se modifica la financiación de la convocatoria, para los años 2021 y 2022. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 27 de abril de 2023 se publicó en el BOIB núm. 54 la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se modifica el anexo III de la convocatoria de las ayudas destinadas al fomento de la agricultura ecológica para los años 2021 y 2022, referente a la tipificación del incumplimiento del compromiso evaluable de formación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6.Los interesados señalados en el Anexo I adjunto han presentado, en tiempo y forma, toda la documentación necesaria prevista en la convocatoria, pero se ha comprobado a fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;20&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;6/2023 que no cumplen con algún requisito de la convocatoria, con las incidencias y motivos correspondientes que se señalan, según los motivos de reducción del Anexo II. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7.Con fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;26&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;junio de 2023 se notifica, mediante publicación en la página web del FOGAIBA, el informe y la propuesta provisional de revocación parcial de la subvención, emitida por el Servicio de ayudas al Desarrollo Rural a los interesados, concediendo un plazo de 10 días para presentar las alegaciones oportunas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Se ha considerado el Informe/Propuesta provisional de resolución, de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;26&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;junio&amp;nbsp;de 2023, de revocación parcial de la resolución de concesión de los expedientes señalados en el anexo I, ya que no cumplen con alguno de los requisitos de la convocatoria, con las incidencias y motivos correspondientes que se señalan.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17.Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución de revocación parcial de la Resolución de concesión&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;Por todo ello, se informa y se propone al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Revocar parcialmente la resolución de concesión de la ayuda de la Medida 11.2. 1. Ayudas para el fomento de la agricultura ecológica para los años 2021 y 2022 del PDR, por el importe y con los datos detallados en el Anexo I de esta resolución, que son un total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;15&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;expedientes y que comienza con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;SMART LOCAL ENTERPRISE, SL&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;SMART LOCAL ENTERPRISE, SL&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;&lt;span style="line-height:120%"&gt;&lt;em&gt;2.Notificar la resolución a los interesados en el Boletín Oficial de las Illes Balears.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
