PREÀMBULO</strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="background-color:white"><span style="color:#212121">Una parte importante de la actividad financiera del sector público se canaliza a través de subvenciones, para dar respuesta, con medidas de apoyo financiero, a demandas sociales y económicas de personas y entidades públicas o privadas.</span></span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Desde la perspectiva económica, las subvenciones son una modalidad importante de gasto público y, por tanto, deben ajustarse a las directrices de la política presupuestaria. La política presupuestaria actual está orientada por los criterios de estabilidad y crecimiento económico pactados por los países de la Unión Europea, que, además, en España han encontrado la expresión normativa en las leyes de estabilidad presupuestaria. Esta orientación de la política presupuestaria ha seguido un proceso de consolidación de las cuentas públicas hasta la eliminación del déficit público y se propone mantener, en lo sucesivo, el equilibrio presupuestario. En su exposición de motivos, la Ley General de Subvenciones (38/2003, de 17 de noviembre) establece para las administraciones públicas la necesidad de elaborar planes estratégicos de subvenciones, que relacionen los objetivos y efectos que se pretenden conseguir, con los costes previsibles y sus fuentes de financiación, con el fin de adecuar las necesidades públicas a cubrir a través de las subvenciones con las previsiones de recursos disponibles, con carácter previo a su nacimiento y de forma plurianual.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">Desde la perspectiva administrativa, las subvenciones son una técnica de fomento de determinados comportamientos considerados de interés general e incluso un procedimiento de colaboración entre la Administración pública y los particulares para la gestión de actividades de interés público.</span>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">Hay una gran diversidad de subvenciones de diferente naturaleza, que se conceden mediante procedimientos complejos y, por tanto, deben ser objeto de un seguimiento y un control eficaces.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">La mejora de la gestión y el seguimiento de las subvenciones, la corrección de las insuficiencias normativas y el control de las conductas fraudulentas que se pueden dar en este ámbito son esenciales para conseguir asignaciones eficaces y eficientes desde esta modalidad de gasto y hacer compatible la creciente importancia de las políticas de subvenciones con la actual orientación de la política presupuestaria.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">A su vez, el Tribunal de Cuentas y un creciente sector de la doctrina han propugnado la elaboración de una ley general de subvenciones que resuelva definitivamente la situación de inseguridad jurídica y las lagunas que aún subsisten.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">Por lo tanto, hay una clara conciencia de la necesidad de dotar a este importante ámbito de actividad administrativa de un régimen jurídico propio y específico que permita superar las insuficiencias del que sustituye y prevea instrumentos y procedimientos que aseguren una gestión adecuada y un control eficaz de las subvenciones. En este sentido, la Ley general de subvenciones se dirige a regular con carácter general los elementos del régimen jurídico de las subvenciones y contiene los aspectos nucleares, generales y fundamentales de este sector del ordenamiento.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">En la actualidad, esta materia, cuyo régimen jurídico fue modificado ampliamente por la Ley 31/1990, de 27 de diciembre, de presupuestos generales del Estado para 1991, y otras modificaciones posteriores, está regulada por los artículos 81 y 82 del texto refundido de la Ley general presupuestaria, aprobado por Real decreto legislativo 1091/1988, de 23 de septiembre. Con estas modificaciones se intentó paliar, al menos en parte, la dispersión y la existencia de lagunas en aspectos muy relevantes que tradicionalmente han caracterizado la legislación española sobre subvenciones.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Esta norma también establece los principios que deben regir en la gestión de las subvenciones, y que son:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">a) Publicidad, transparencia, concurrencia, objetividad, igualdad y no discriminación.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">b) Eficacia en el cumplimiento de los objetivos fijados por la Administración otorgante.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">c) Eficiencia en la asignación y utilización de los recursos públicos.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">El Ayuntamiento de Marratxí establece, entre otras, las siguientes prioridades:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">a) Dinamización económica: En el actual contexto de crisis, debemos estar atentos a todas las oportunidades. No partiremos desde cero, sino que aprovecharemos los puntos fuertes del municipio, tales como ...</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">b) Cohesión social: Trabajaremos por un municipio socialmente equilibrado, capaz de atender más que nunca las necesidades de las personas más vulnerables. Apostamos por la redistribución de los recursos, por la convivencia y por la justicia social como valores irrenunciables.</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">c) Calidad democrática: fundamentaremos nuestras políticas en la transparencia y el rigor, en la complicidad con todos los ciudadanos, en el ejercicio honesto de los valores esenciales de la democracia y en hacerlos protagonistas activos de los asuntos públicos.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Más allá del cumplimiento de las obligaciones normativas que tiene el Ayuntamiento en esta materia, el presente plan de subvenciones quiere ser un instrumento estratégico que establezca las bases para la renovación del procedimiento de concesión de subvenciones, entre los que destacaríamos, principalmente:</span></span></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Garantizar la transparencia de las actuaciones y decisiones del Ayuntamiento y respetar el derecho de la ciudadanía a una información clara y suficiente sobre todos aquellos asuntos que le afecten.</span></span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Establecer criterios objetivos en la concesión de subvenciones y ayudas, así como su posterior control en la ejecución, disponibilidad y justificación de las aportaciones municipales.</span></span></span></span></li> </ul> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><strong>2. ARTÍCULO 1: NATURALEZA JURÍDICA Y REQUISITOS BÁSICOS</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">El Plan Estratégico de Subvenciones del Ayuntamiento de Marratxí es un instrumento de planificación. Su carácter es programático, no normativo.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">La aprobación del Plan Estratégico de subvenciones no supondrá la generación de derechos a favor de los potenciales beneficiarios, que no podrán exigir indemnización o compensación en caso de que el Plan no se lleve a cabo en los propios términos.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Para el establecimiento efectivo de las subvenciones previstas en este Plan, será requisito básico la inclusión de las consignaciones presupuestarias correspondientes en los presupuestos anuales, así como la aprobación de las bases reguladoras de su concesión, en el de las bases de ejecución del presupuesto.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3. ARTÍCULO&nbsp; 2:&nbsp; ÁMBITO&nbsp; DE APLICACIÓN</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Se entiende por subvención, a efectos de este Plan, toda disposición dineraria realizada por el Ayuntamiento de Marratxí a favor de personas públicas o privadas, y que cumplan los siguientes requisitos:</span></span></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Que la entrega se realice sin contraprestación directa de los beneficiarios.</span></span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Que la entrega esté sujeta al cumplimiento de un determinado objetivo, la ejecución de un proyecto, la realización de una actividad, la adopción de un comportamiento singular, ya desarrollados o a desarrollar, o la concurrencia de una situación, debiendo cumplir el beneficiario con las obligaciones materiales y formales que se hayan establecido.</span></span></span></span></li> <li>Que el proyecto, la acción, conducta o situación financiada tenga por objeto el fomento de una actividad de utilidad pública o de interés social o de promoción de una finalidad pública.</li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.&nbsp;ARTÍCULO&nbsp; 3:&nbsp; PERÍODO DE VIGENCIA DEL PLAN ESTRATÉGICO DE SUBVENCIONES.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">El otorgamiento de subvenciones por parte del Ayuntamiento de Marratxí durante el periodo 2023-2026 se ajustará a lo establecido en el presente Plan.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">A los efectos del establecimiento de subvenciones, el procedimiento de concesión y su justificación y control estará sujeto a lo previsto en la Ley General de Subvenciones y su Reglamento, así como se prevé en la Ordenanza General de Subvenciones del Ayuntamiento de Marratxí.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5. ARTÍCULO&nbsp; 4:&nbsp; LIMITACIONES EN EL ESTABLECIMIENTO DE SUBVENCIONES</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">El establecimiento de subvenciones queda sometido al cumplimiento de los objetivos de estabilidad presupuestaria, por lo tanto las consignaciones presupuestarias que se aprueben y las bases reguladoras de su concesión se acomodarán en cada momento a estos objetivos.</span></span></span></span></p> <p><strong>6. ARTÍCULO&nbsp; 5:&nbsp; PRINCIPIOS ORIENTADORES</strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">La gestión de las subvenciones se regirá por los principios de:</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">(Art. 8.3 LGS)</span></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">Legalidad presupuestaria, existencia de crédito suficiente y sometimiento a la normativa de disposición de fondos.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">Sostenibilidad económica y financiera, que la disposición conlleve la cantidad necesaria exclusivamente.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">Publicidad y transparencia, sumisión de la concesión de las subvenciones al establecimiento previo de unas bases reguladoras, que deben publicarse necesariamente en el BOE, DOGC o BOP.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">Concurrencia, objetividad, igualdad y no discriminación, establecimiento de los requisitos que deben cumplir los solicitantes, así como los criterios objetivos para la concesión de la subvención y su ponderación.</span></span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#212121">Eficacia y eficiencia, diseño adecuado a las finalidades de promoción que persigue la Administración, así como que se han de asignar y utilizar los recursos públicos para la consecución de esos fines.</span></span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><em>7. </em></strong>&nbsp;<strong>ARTÍCULO 6 : BENEFICIARIOS</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">El Ayuntamiento de Marratxí concederá subvenciones a favor de las personas o entidades privadas con el fin de fomentar la realización de actividades de utilidad pública o interés social o para promover la consecución de fines públicos atribuidos a la competencia local.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; ARTÍCULO&nbsp; 8:&nbsp; SUBVENCIONES EN RÉGIMEN DE CONCURRENCIA:</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">La concesión de las subvenciones se realiza mediante la aplicación de los criterios establecidos en las bases reguladoras y en la convocatoria. Se adjudicarán con el límite fijado en la convocatoria dentro del crédito disponible.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Conjuntamente o previamente a la convocatoria del proceso de selección, se deberán aprobar y publicar las correspondientes bases específicas. El anuncio de la convocatoria detallará los elementos esenciales de las bases específicas por las que se regirá el concurso. Se creará un órgano colegiado para examinar y valorar las solicitudes, cuya composición se determinará en las bases específicas, y su presidente formulará la propuesta de concesión. El acuerdo de otorgamiento mencionará, individualmente, los datos de cada uno de los beneficiarios, así como la actuación que se llevará a cabo, el importe del coste de la actuación a realizar y el importe de la ayuda otorgado.</span></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="background-color:white"><span style="color:#212121">Para todas las subvenciones que deban concederse por el procedimiento de concurrencia competitiva se deberán aprobar las correspondientes bases específicas, que se aprobarán conjuntamente o previamente a la convocatoria. ARTÍCULO&nbsp; 9:&nbsp;&nbsp; SUBVENCIONES EN RÉGIMEN DE ADJUDICACIÓN DIRECTA</span></span></strong></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Atendiendo al principio de corresponsabilidad de la gestión pública y dado el interés social y la singularidad de la tarea realizada por determinadas entidades de nuestro municipio, el Ayuntamiento de Marratxí establecerá, de acuerdo con el que establece la ley general de Subvenciones 38/2003, de 17 de noviembre, subvenciones en régimen de adjudicación directa, contempladas nominalmente en los presupuestos municipales.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las subvenciones podrán otorgarse directamente, no siendo preceptiva la concurrencia competitiva, en los siguientes casos: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a). Cuando estén consignadas nominativamente en los presupuestos del Ayuntamiento.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b). Aquellas otras subvenciones en las cuales se acrediten razones de interés público, social, económico o humanitario y las que su singularidad u otras debidamente justificadas que dificulten su convocatoria pública mediante concurrencia competitiva.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La concesión directa se formalizará en un convenio o un acuerdo administrativo. En el correspondiente convenio o, en su caso, en la resolución de concesión, se fijarán, además del beneficiario y cuantía de la subvención, el objeto, el plazo de ejecución de la actuación, con indicación, si se tercia, de la posibilidad de imputar gastos realizados con anterioridad a la concesión y dentro del ejercicio presupuestario y la forma de justificación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Para evaluar el valor público y el impacto generado por los beneficiarios de estas subvenciones, el Ayuntamiento establecerá comisiones de seguimiento e instrumentos de evaluación de las mismas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el anexo 1 se detallan los ámbitos y las partidas nominativas de las líneas de subvención que se otorgarán mediante procedimiento de adjudicación directa.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>11. ARTÍCULO 10: FINANCIACIÓN Y DOTACIÓN ECONÓMICA DE LAS DIFERENTES LÍNEAS DE SUBVENCIÓN</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La financiación de estas subvenciones se llevará a cabo con fondos propios y externos a esta administración con cargo al capítulo IV del presupuesto de gasto del Ayuntamiento de Marratxí (ANEXO 1).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>12.
