![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Considerando las bases que rigen la concesión de ayudas a acciones para mejorar el conocimiento, la salvaguarda y la difusión del patrimonio histórico de Menorca, incluido el patrimonio cultural inmaterial, y la convocatoria correspondiente al año 2023, aprobadas por el Consell Executiu día 20 de marzo de 2023 y publicadas en el BOIB núm. 41 de 1 de abril de 2023.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Dado que en las bases y en la convocatoria de estas ayudas se diferencian hasta 6 líneas de subvención, las cuales deben cumplir los requisitos y las condiciones específicas y las comunes sobre las acciones subvencionadas.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Dado que la Comisión Evaluadora prevista en el punto 10 de las bases que rigen la convocatoria se reunió el día 27 de junio de 2023.</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Dado que una vez revisadas las solicitudes presentadas y valorados los proyectos por parte de los instructores, en las líneas 1, 3, 5 quedó sin repartir el importe de 33.290,83 € (correspondientes a capítulo 7) y en la línea 6 quedó sin repartir el importe de 23.979,30 € (correspondientes a capítulo 4).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Dado que la convocatoria de las ayudas establece que: «En caso de que para una línea no se agote la consignación presupuestaria, la cantidad sobrante se asignará, dentro de la misma línea presupuestaria, a proyectos de otras líneas siguiendo el orden de puntuación otorgada, y teniendo en cuenta todas las líneas, sin que pueda superar la cantidad solicitada ni el importe máximo por solicitud establecido para la línea correspondiente.».</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Dado que el importe del remanente de la línea 6 (financiado con una partida del capítulo 4 – gasto corriente) no puede repartirse entre los proyectos del resto de líneas (financiadas con una partida del capítulo 7 – inversiones).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Dado que el remanente de las líneas financiadas con el capítulo 7 por importe de 33.290,83 € debe repartirse entre todas las solicitudes que no han recibido el importe máximo por solicitud establecido en la convocatoria (incluyendo las que ya tienen una ayuda por parte del importe solicitado).</span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%">Dado que al aplicar este criterio los remanentes se distribuyen entre los proyectos que tienen mayor puntuación e incrementan el importe de varias líneas de acuerdo con el siguiente cuadro:</span></span></span></p>

<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000"><strong>UNDÉCIMO. </strong>Dar por desistida de las siguientes solicitudes de ayuda a acciones de salvaguarda, conocimiento y difusión del patrimonio cultural inmaterial (línea 6) para el año 2023 a la Asociación Soca de Mots (registro de entrada núm. GE/ 015823/2023 y GE/015829/2023) por haber renunciado a las mismas.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000"><strong>DUODÉCIMO. </strong>Aprobar las Consideraciones generales de la convocatoria de ayudas a acciones para mejorar el conocimiento, la salvaguarda y la difusión del patrimonio histórico de Menorca, incluido el patrimonio inmaterial, correspondiente al año 2023:</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000">a) El importe total concedido de las seis líneas será de 276.020,70 €.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000">b) Todas las ayudas concedidas de las diferentes líneas quedan sujetas a las siguientes condiciones y requisitos:</span></span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000"><strong>Primero</strong>. Para las líneas 1 a 5, el plazo máximo para realizar la actividad subvencionada es de un año a contar desde la publicación del acuerdo de concesión de la ayuda en el Boletín Oficial de las Illes Balears, y para la línea 6 la actividad subvencionada debe realizarse dentro de la primera anualidad de la convocatoria. Salvo causas excepcionales que lo impidan y que el beneficiario deberá alegar por escrito. A la vista de lo anterior, el CIM podrá ampliar el plazo de realización de la actividad por un período de un mes, improrrogable, a contar a partir de la fecha de finalización del plazo para llevar a cabo la actividad.</span></span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000"><strong>Segundo</strong>. El importe de las ayudas de las líneas 1 a 5 se aplicará de la siguiente manera: un 50% al capítulo 7 del programa de Patrimonio Histórico del presupuesto de 2023 y el restante 50% en una partida del capítulo 7 del programa de Patrimonio histórico del presupuesto del año 2024. El importe de las ayudas de la línea 6 se aplicará al capítulo 4 del programa de Política Lingüística y Patrimonio Cultural Inmaterial del presupuesto de 2023.</span></span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000"><strong>Tercero</strong>. En caso de que la subvención concedida sea sustancialmente inferior al importe solicitado o en caso de que no se disponga de financiación para realizar el proyecto presentado, se conceden quince días hábiles desde que el beneficiario haya recibido la notificación de la concesión para aceptar o renunciar a la ayuda concedida. Si no se comunica la renuncia en este plazo, se entenderá aceptado tácitamente el importe de la subvención y deberá justificarse la totalidad del presupuesto de la actividad que se presentó en la convocatoria, y no sólo el importe de la ayuda concedida.</span></span></span></span></p>
<p style="margin-left:80px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000"><strong>Cuarto</strong>. Si el gasto justificado excede del importe del presupuesto solicitado, la posible desviación presupuestaria irá a cargo del beneficiario de la ayuda. Si por el contrario el gasto justificado es inferior al importe del presupuesto solicitado y subvencionado se reducirá de forma proporcional la subvención concedida.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000"><strong>DECIMOTERCERO.</strong> Remitir a la Base de Datos Nacional de Subvenciones el acuerdo de resolución del expediente de concesión o denegación de las ayudas en cumplimiento del arte. 20.8 de la LGS y publicarlo en el Boletín Oficial de las Islas Baleares, haciendo constar los cuadros con las valoraciones de los criterios objetivos que se han tenido en cuenta para su concesión y que figuran como anexo.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000">Contra este acuerdo – que no agota la vía administrativa – puede interponerse recurso de alzada ante el Consejo Ejecutivo en el plazo de un mes a contar desde el día siguiente de su publicación, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></span></span></p>
<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="line-height:100%"><span style="color:#000000">Dicho recurso se entenderá desestimado, si no se notifica la correspondiente resolución, cuando hayan transcurrido tres meses desde su interposición. Contra la desestimación del recurso de alzada por silencio administrativo podrá interponer recurso contencioso administrativo ante el Juzgado Contencioso Administrativo de Palma.</span></span></span></span></p>
