    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para Inversiones en las explotaciones agrarias, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1 de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de &amp;nbsp;1 de octubre, y&amp;nbsp;del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria&amp;nbsp;del FOGAIBA, con fecha 5&amp;nbsp;de julio&amp;nbsp;de 2023, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha&amp;nbsp;de 16 de julio de 2015 se publicó, en el Boletín Oficial de las Islas Baleares núm. 106, la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias, modificada mediante las resoluciones de 17 de diciembre de 2015 (BOIB núm. 185), 22 de junio de 2016 (BOIB núm. 81)&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y con fecha 26 de junio de 2018 (BOIB núm. 80). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.El 17 de abril de 2023, el vicepresidente en materia agraria del FOGAIBA dictó una Resolución de concesión de ayudas para inversiones en las explotaciones agrarias, que se publicó en el Boletín Oficial de las Islas Baleares número 50, del 20 de abril de 2023, en la que figuraba una concesión a favor del interesado señalado en el anexo adjunto. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.El 01 de junio de 2023, el interesado JAIME COLL BENNASSAR, con NIF ***3237**, con registro de entrada núm. 364527/2023, ha presentado un escrito en el que expresa su desistimiento de la inversión de la nave y los honorarios profesionales, por un importe de 145.808,08 €. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.La ayuda inicialmente aprobada era de 168.869,63€, por tanto hay una diferencia de 87.484,85€ que debe revocarse. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5.Dado todo esto, se propone aceptar el desistimiento de inversiones y realizar la revocación parcial de la ayuda concedida al beneficiario como se indica en el anexo adjunto de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Consideraciones jurídicas&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Resolución &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;de 10 de julio de 2015&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;el&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA)&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;&amp;nbsp;por la que se convocan, para los años 2015 a 2019, subvenciones para inversiones en las explotaciones agrarias.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. &lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Propuesta de Resolución&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Por todo ello, se informa &amp;nbsp;favorablemente &lt;/em&gt;&lt;em&gt;del cambio de inversión &lt;/em&gt;&lt;em&gt;y se propone al vicepresidente &lt;/em&gt;&lt;em&gt;en Materia Agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Aceptar el desistimiento propuesta y revocar parcialmente la resolución de ayuda concedida al beneficiario detallado en el anexo adjunto, que es un total de 1 expediente, que comienza y termina por JAIME COLL BENNASSAR, con NIF ***3237** (exp. INEA2020_1/177 ), por un importe de 87.484,85 €, y que corresponde a la cofinanciación TOP UP (100% CAIB). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Notificar esta resolución a l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;persona &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;interesada&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;mediante la publicación en el&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;B&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;oletín &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;O&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ficial de les &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;lles &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Balears.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante la&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ll&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;er&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;a&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de Agricultura&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;,&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Pesca&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;y Alimentación&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Islas Baleares, y l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;os&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;artículo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s 121 y 122&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de la Ley 39/2015, de 1 de octubre, del &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;Régimen Jurídico de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
