    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Efectuada depuración y revisión de expedientes en el Servicio de Tramitación de Licencias de Actividades de la solicitud de licencia de actividades relacionadas en el anexo 1, el Consejo de la Gerencia de Urbanismo en sesión de fecha 25/07/2023 ha adoptado el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;“Informe con propuesta de resolución por la que se declara la caducidad y el archivo de los expedientes presentados por las personas que constan en el anexo 1.”&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Antecedentes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Efectuada depuración y revisión de expedientes en el Servicio de Tramitación de Actividades de las solicitudes de licencia de actividades relacionadas en el Anexo 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Efectuadas las notificaciones de requerimiento de documentación a los peticionarios con la advertencia de que la falta de presentación de la documentación y que una vez agotado el plazo de tres meses, se dictaría resolución de caducidad y archivo del procedimiento.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Dado que el plazo de tres meses, antes citado, ha finalizado sin que los interesados que constan en el anexo 1 hayan presentado la documentación requerida para reparar los inconvenientes e irregularidades detectadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de Derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El artículo 73 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece que “Los trámites que deban ejecutar los interesados deben realizarse en el plazo de diez días a partir del día siguiente de la notificación del acto correspondiente, salvo en el caso en que la norma correspondiente fije un plazo diferente, (...) las personas interesadas que no cumplan lo dispuesto en los apartados anteriores, se les puede declarar que han perdido su derecho al trámite correspondiente. Sin embargo, debe admitirse la actuación del interesado, que produce sus efectos legales si se produce antes o dentro del día en que se notifique la resolución en la que se considere que el plazo ha transcurrido”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El artículo 95.1 de la Ley 39/2015, de 1 de octubre, dispone que en los procedimientos iniciados a solicitud de la persona interesada, cuando el procedimiento se paraliza por causa que sea imputable a ésta, la Administración le debe advertir que, transcurridos tres meses, se producirá su caducidad. &lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Consumido este plazo sin que el particular requerido realice las actividades necesarias para reanudar la tramitación, la Administración debe acordar el archivo de las actuaciones y debe notificarlo a la persona interesada. Contra la resolución que declare su caducidad, procederán los recursos pertinentes. No podrá acordarse la caducidad por la simple inactividad de la persona interesada en la formalización de trámites, siempre que no sean indispensables para dictar la resolución. Esta inactividad no surtirá más efecto que la pérdida del derecho a este trámite.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El artículo 45.1 de la Ley 39/2015, de 1 de octubre, establece que los actos administrativos serán objeto de publicación cuando así lo establezcan las normas reguladoras de cada procedimiento o cuando lo aconsejen razones de interés público apreciadas por el órgano competente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Conclusión&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por lo expuesto, se informa favorablemente la declaración de la pérdida del derecho al trámite y la caducidad del procedimiento de referencia, así como el archivo de los expedientes, al haber transcurrido el plazo de tres meses desde que la Administración requirió los interesados para que aportaran la documentación necesaria, sin que la hayan aportado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En cumplimiento de lo que prevé el artículo 95 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, el artículo 124 de la Ley 7/85, de 2 de abril , Reguladora de las bases del régimen local, y los artículos 4 y 12 del Reglamento de la Gerencia de Urbanismo, la TAG jefe del Servicio Jurídico Administrativo que suscribe considera que por el Consejo de Gerencia de Urbanismo podría adoptar la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;RESOLUCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Declarar la pérdida del derecho al trámite y la caducidad de los expedientes de licencia de actividad relacionados en el anexo 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Ordenar el archivo de los expedientes relativos a las solicitudes presentadas por las personas que constan en el anexo 1.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Informar que la carencia de título habilitante determinar la imposibilidad de iniciar o continuar con el ejercicio del derecho o actividad afectada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Notificar la presente resolución a las personas interesadas con indicación de los recursos que contra la misma pueden interponerse.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Publicar esta Resolución en el Boletín Oficial de las Illes Balears.”&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Lo que le comunico para su conocimiento y efectos oportunos. Contra esta resolución, que agota la vía administrativa, se puede presentar recurso de reposición potestativo, ante el mismo órgano que la ha dictado, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre , del procedimiento administrativo común de las administraciones públicas. El plazo para interponerlo es de un mes contado desde el día siguiente al de recibir esta notificación. En este caso no podrá interponerse recurso contencioso administrativo hasta que no se haya resuelto el de reposición. El recurso de reposición potestativo se entenderá desestimado cuando no se haya resuelto y notificado la resolución, en el plazo de un mes, contado desde el día siguiente de su interposición, en cuyo caso quedará expedita la vía contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Si no se utiliza el recurso potestativo de reposición, se puede interponer directamente recurso contencioso administrativo, de acuerdo con los artículos 123 y 124 antes mencionados y el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa, ante el Juzgado Contencioso Administrativo, en el plazo de dos meses contados desde el día siguiente de recibir esta notificación; todo esto sin perjuicio de cualquier otro recurso o acción que se considere conveniente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El recurso de reposición potestativo debe presentarse, si se trata de una persona jurídica, a través de la Sede Electrónica del Ayuntamiento de Palma, indicando expresamente de forma clara de qué se trata y haciendo constar el número de expediente. Si se trata de una persona física se puede utilizar dicha Sede Electrónica o presentar la documentación en cualquiera de las oficinas de atención a la ciudadanía que se detallan a continuación o en las dependencias a que se refiere el artículo 16.4 de la Ley 39 /2015, mediante solicitud dirigida al Ayuntamiento de Palma y haciendo constar el número de expediente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
