    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Pleno del Ayuntamiento de Sant Antoni de Portmany, en sesión celebrada el día 28 de julio de 2022 , ha acordado rectificar el error material contenido en la transcripción del artículo 228 en su redacción dada en la Modificación del Plan General de Ordenación Urbana de Sant Antoni de Portmany todo ello en los términos establecidos en el Anexo I del presente anuncio y de conformidad con los artículos 54, 55 y 59 de la Ley 12/2017, de 29 de diciembre, de urbanismo de las Illes Balears, se procede a la publicación del acuerdo en el Boletín Oficial de las Islas Baleares. La documentación que contiene la modificación del Plan General de Ordenación Urbana de Sant Antoni de Portmany y su rectificación puede encontrarse en el Portal de Transparencia alojado en la web municipal &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;https://transparencia.santantoni.net/t/planeamiento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Visto que el Pleno del Ayuntamiento de Sant Antoni de Portmany, en sesión celebrada el día 28 de octubre de 2021 (BOIB n. 153, de 06.11.21) y 31 de marzo de 2022 (BOIB n. 50 de 14.04.22) acordó la aprobación inicial de la Modificación del Plan General de Ordenación Urbana de Sant Antoni de Portmany y que tras la tramitación legalmente prevenida, en fecha 30 de junio de 2022, el referido órgano aprueba definitivamente la Modificación del Plan General de Ordenación Urbana de Sant Antoni de Portmany (BOIB n. 92, de 16.07.22 y BOIB n. 98, de 28.07.22).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Visto que el objeto de esta modificación afectaba a los artículos 71, 78, 84, 85, 95, 227, 228, 229, 230, 231, 232, 234, 258, 260, así como cuadro resumen de normas y disposición transitoria de las normas urbanísticas del PGOU.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Visto que en la transcripción de los usos permitidos del artículo 228 (Régimen de usos permitidos. Zona de casco antiguo CA1 y CA2) se omitieron 2 líneas que no eran objeto de modificación y que afecta a los usos permitidos de tal forma que los usos permitidos de industria sólo aparecen para la zona CA1 y no los relativos a la zona CA2 y, en el caso de los talleres, aparecen los correspondientes a la zona CA2 y no los de la zona CA1. Así pues, esta corrección de error material consiste en la modificación del cuadro de usos con la finalidad de incorporar la regulación de dichos usos que de otra forma se podría entender que están unificados en una calificación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Vista la competencia de este Ayuntamiento para la aprobación definitiva de la presente modificación puntual de conformidad con lo establecido en el artículo 54.1 b de la Ley 12/2017, de 29 de diciembre, de urbanismo de las Illes Balears, por consistir la modificación en cuestiones de ordenación detallada previstas en el artículo 42 de la misma norma.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;A la vista de la tramitación legalmente establecida conforme a lo dispuesto en el artículo 54, 55 y 59 de la Ley 12/2017, de 29 de diciembre, de urbanismo de las Illes Balears, y vista la competencia del Pleno, en virtud de los artículos &lt;/span&gt;&lt;span style="color:#000000"&gt;22.2 c) y 47.2 ll) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, y artículo 94 m) de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vista la memoria de corrección material de la Modificación del Plan General de Ordenación Urbana de Sant Antoni de Portmany de fecha 14 de junio de 2023 &lt;/span&gt;&lt;span style="color:#000000"&gt;suscrita por el arquitecto Antonio Ramis Ramos con la siguiente url de verficación &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;https://santantoni.sedelectronica.es/doc/6E6ZH6CRLDNJ22X75ZQJ2F247 y donde se pone de manifiesto la necesidad corrección del error material de transcripción detectado en el artículo 228 del &lt;/span&gt;&lt;span style="color:#000000"&gt;Plan General de Ordenación Urbana de Sant Antoni de Portmany&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Considerando que la corrección del error material del instrumento de planeamiento que nos ocupa viene amparada en lo dispuesto en el artículo 55 de la Ley 12/2017, de 29 de diciembre, de urbanismo de las Illes Balears (LUIB).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Visto que, de conformidad con lo establecido en el artículo 54 LUIB la competencia para la corrección del error referido reside en el Ayuntamiento con motivo en haber sido éste órgano el competente para la aprobación definitiva de &lt;/span&gt;&lt;span style="color:#000000"&gt;la Modificación del Plan General de Ordenación Urbana de Sant Antoni de Portmany cuya corrección aquí se indica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Visto que el objeto de la presente es la corrección material de errores detectados en la transcripción de uno de los artículos objeto de la &lt;/span&gt;&lt;span style="color:#000000"&gt;Modificación del Plan General de Ordenación Urbana de Sant Antoni de Portmany aprobada definitivamente por el Pleno de esta Corporación en fecha 30 de junio de 2022 y no constituye alteración respecto del contenido de la modificación del PGOU ni de su documentación gráfica antes referida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Visto lo dispuesto en los artículos 22.2 c) y 47.2 ll) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local, y artículo 94 m) de la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares, la corrección de errores materiales de la &lt;/span&gt;&lt;span style="color:#000000"&gt;Modificación del Plan General de Ordenación Urbana de Sant Antoni de Portmany &lt;/span&gt;&lt;span style="color:#000000"&gt;es competencia del Pleno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Vista la propuesta de resolución que emite la Técnico de la Administración General del departamento de Urbanismo y Actividades de fecha 3 de julio de 2023 con la &lt;/span&gt;&lt;span style="color:#000000"&gt;nota de conformidad&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;que suscribe el Secretario de la Corporación, de acuerdo con lo dispuesto con el artículo 3.3 d) 7º del Real Decreto 128/2018, de 16 de marzo, por el que se regula el régimen jurídico de los funcionarios de Administración Local con habilitación de carácter nacional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;ACUERDO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
