&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. &lt;/strong&gt;Mediante Resolución de la Presidencia del IMAS, nº. 1324 de 26 de enero de 2023, se aprueba la previsión de los servicios a concertar durante el año 2023 para&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt; la Dirección Insular de Personas con Discapacidad e Innovación Social (BOIB nº 16, de 4 de febrero de 2023), entre los cuales se encuentra el servicio de residencia para personas con discapacidad intelectual y/o trastorno del desarrollo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Además, en&amp;nbsp;la mencionada resolución se aprueban la Guía de aplicación en el&amp;nbsp;modelo de atención a los servicios sociales para personas con discapacidad de Mallorca y el Modelo de Evaluación de seguimiento de la acción concertada, aplicables a todos el servicios a concertar para&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt; la Dirección Insular de Personas con Discapacidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. &lt;/strong&gt;Mediante Resolución 17 de mayo de 2023, la Presidencia del IMAS aprobó&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;e&lt;/span&gt;&lt;span style="color:#000000"&gt;l &lt;/span&gt;&lt;span style="color:#000000"&gt;expediente&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;convocatoria de &lt;/span&gt;&lt;span style="color:#000000"&gt;la concertación social del servicio de residencia para personas con discapacidad intelectual y/o trastorno del desarrollo&lt;span style="background-color:#ffffff"&gt;,&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;incluido en la red pública de servicios para personas con discapacidad de Mallorca&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;(&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;BOIB nº. 67, de 20 de mayo de 2023), por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; un total de 323 plazas del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;3. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;Una vez realizada la instrucción del procedimiento, se adjudicó un total de 145 plazas de los 323 convocados mediante la Resolución de la Presidencia del IMAS de día 29 de junio de 2023 (BOIB nº. 97 de 13 de julio de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;4. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;Por este motivo, en fecha 17 de julio de 2023 desde la Dirección Insular de Personas con Discapacidad se emitió informe justificativo, relativo a la necesidad de concertar por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el procedimiento de urgencia previsto en&amp;nbsp;la Disposición final primera de la Ley 12/2018 de 15 de noviembre de servicios a las personas en el ámbito social en&amp;nbsp;la Comunidad Autónoma de las Islas Baleares (BOIB nº. 146, de 22 de noviembre de 2018), de 178 plazas y 47 complementos de apoyo&lt;span style="display:none"&gt;&amp;lt;A[apoyo|soporte]&amp;gt;&lt;/span&gt; extraordinario al servicio, del servicio de residencia para personas con discapacidad intelectual y/o trastorno del desarrollo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;5. &lt;/span&gt;&lt;/strong&gt;En la misma fecha la Presidencia del IMAS, ordenó el inicio del expediente relativo a esta concertación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. &lt;/strong&gt;Constan en el expediente los Pliegos&lt;span style="display:none"&gt;&amp;lt;A[Pliegues|Pliegos]&amp;gt;&lt;/span&gt; de prescripciones técnicas que tienen que regir la concertación, así como la propuesta de convocatoria y los anexos correspondientes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7.&lt;/strong&gt; El gasto previsto por este expediente es de &lt;strong&gt;7.547.262,82€&lt;/strong&gt; y el Servicio de Contabilidad y Presupuestos ha emitido Informe de autorización al gasto plurienal en fecha de 26 de julio de 2023. Asimismo, constan en el expediente los documentos contables a cargo de la aplicación presupuestaria 40.23128.26000.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8. &lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;El Servicio Juridicoadministrativo y la Intervención delegada del IMAS han emitido sendos informes favorables en&amp;nbsp;la convocatoria de la concertación objeto de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos&lt;span style="display:none"&gt;&amp;lt;A[Fundamentos|Cimientos]&amp;gt;&lt;/span&gt; de Derecho &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Respecto a la competencia,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.&lt;/strong&gt; La Ley orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares (BOIB nº. 32 ext., de 1 de marzo de 2007; corrección de errores BOIB nº. 29, de 28 de febrero de 2008), &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.&lt;/strong&gt; La Ley 14/2001, de 29 de octubre, de atribución de competencias en los consejos insulares en materia de servicios sociales y seguridad social (BOIB nº. 135, de 10 de noviembre de 2001 y BOE nº. 284, de 27 de noviembre de 2001).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares (BOIB nº. 89 de 18 de junio de 2009 y BOE nº. 163 de 7 de julio de 2009).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.&lt;/strong&gt; Los&lt;/span&gt;&lt;span style="color:#000000"&gt; Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB nº. 67, de 18 de mayo de 2019) aprobados por acuerdo del Pleno del Consejo de Mallorca de fecha 11 de abril de 2019, en especial lo&amp;nbsp;establecido en el artículo 2 de acuerdo con el cual &lt;/span&gt;&lt;span style="color:#000000"&gt;el Instituto Mallorquín de Asuntos Sociales, como organismo autónomo creado por el Consejo de Mallorca, adscrito al Departamento de Derechos Sociales del Consejo de Mallorca, es el organismo que ejerce las competencias atribuidas para&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt; cualquier título en el Consejo de Mallorca en materia de servicios sociales y protección de menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;5.&amp;nbsp;&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;Decreto de la Presidencia del Consejo de Mallorca, de 10 de julio de 2023, por el cual se crean los departamentos que tienen que estructurar el gobierno (&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:#ffffff"&gt; nº. 95, de 11 de julio de 2023), entre los cuales se encuentra el Departamento de Bienestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;6. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;Decreto de la Presidencia del Consejo de Mallorca por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; el cual se nombran los miembros del Consejo Ejecutivo de 10 de julio de 2023 (&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;BOIB&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; nº. 95, de 11 de julio de 2023) por&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; el cual se nombra el Sr. Guillermo Sánchez Cifre consejero&lt;span style="display:none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; ejecutivo de Bienestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.3 de los Estatutos del IMAS (BOIB nº. 67, de 18 de mayo de 2019).&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;No obstante, y de acuerdo con el artículo 8.2.1 las Vicepresidencias del IMAS suplirán a la Presidencia y asumirán sus atribuciones en caso de vacante, ausencia, enfermedad, imposibilidad física o una otro causa legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Respecto al fondo,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.&lt;/strong&gt; La Cartera Insular de Servicios Sociales y de los Servicios a Menores y Familia de Mallorca aprobada definitivamente en pleno del Consejo de Mallorca de 13 de julio de 2017 (BOIB nº. 97, de 18 de julio de 2017 y corrección de errores materiales publicada BOIB nº. 161, de 30 de diciembre de 2017) y prorrogada su vigencia hasta el 31 de diciembre de 2023 por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; Acuerdos del Pleno en sesiones de 8 de julio de 2021 (BOIB nº. 95, de 17 de julio de 2021) y de 15 de diciembre de 2022 (BOIB nº. 168, de 27 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Reglamento del Consejo de Mallorca por el cual se regula el funcionamiento de los servicios sociales para personas con discapacidad incluidos en la cartera de Servicios sociales, y se establecen los requisitos de autorización y acreditación (BOIB nº. 83, de 20 de junio de 2023)&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; La Directiva 2014/24/UE del Parlamento Europeo y del Consejo, de 26 de febrero de 2014, sobre contratación pública (DOUE nº. 94, de 28 de marzo de 2014)&lt;/span&gt;&lt;span style="color:#000000"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; La Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares (BOIB nº. 89 de 18 de junio de 2009).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en&amp;nbsp;la comunidad autónoma de las Islas Baleares (BOIB nº. 146 de 22 de noviembre de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13.&lt;/strong&gt; El Decreto 48/2017, de 27 de octubre, (BOIB número 132 de 28 de octubre de 2017) por el cual se establecen los principios generales a los cuales se tienen que someter los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; La Ley 3/2018, de 29 de mayo, del tercer sector de acción social (BOIB nº. 67, de 31 de mayo de 2018), regula en sus artículos 3 y 4 las entidades que tienen la consideración de entidades del tercer sector de acción social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Resolución de la Presidencia del Instituto Mallorquín de Asuntos Sociales por&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; la cual establece los servicios sociales para personas con discapacidad y para personas mayores, incluidos en la cartera insular de servicios sociales, que pueden ser objeto de concertación social (BOIB nº. 36, de 22 de marzo de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; Resolución de la Presidencia del IMAS, nº. 21525 de 2 de diciembre de 2022, de actualización y fijación de precios de los servicios para personas con discapacidad, incluidos en la cartera insular de servicios sociales, que pueden ser objeto de concertación social (BOIB nº. 158, de 6 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;17.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Resolución de la Presidencia del Instituto Mallorquín de Asuntos Sociales, núm.1324 de 26 de enero de 2023, de aprobación de la previsión de los servicios a concertar durante el año 2023 para&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; la Dirección Insular de Personas con Discapacidad e Innovación Social (BOIB nº. 16, de 4 de febrero de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Respecto al procedimiento,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;18.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; La Directiva 2014/24/UE prevé en el artículo 75 la publicación de los anuncios en el DOUE, en cumplimiento del principio de transparencia, asegurando un grado de publicidad adecuado, aunque la dimensión transfronteriza de los servicios sociales a concertar es limitada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;19.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;La Ley 12/2018 dispone en el artículo 5 los «Requisitos exigibles a las entidades gestoras de los servicios concertados y al artículo 6 los «Procedimientos de concertación y criterios de preferencia a favor de entidades del tercer sector social», junto con la Disposición final primera que excepciona el requisito de acreditación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;20.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; El Decreto 48/2017 al Título III, prevé los «&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Procedimientos de concertación&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;21.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (BOE nº. 236, de 2 de octubre de 2015). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;22.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;El artículo 214 del Real Decreto Legislativo 2/2004, de 5 de marzo, por el cual se aprueba el Texto refundido de la Ley reguladora de las Haciendas Locales, y visto el&lt;span style="background-color:#ffffff"&gt; acuerdo de aprobación del régimen de fiscalización e intervención limitada previa de requisitos básicos y toma de razón en ingresos del Consejo Insular de Mallorca y de las entidades de su sector público sujetos a función interventora de fecha 12 de diciembre de 2019, el expediente ha &lt;/span&gt;sido sometido a la Intervención delegada del IMAS para la emisión del preceptivo informe de fiscalización previa ( BOE nº. 59, de 9 de marzo de 2004).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En virtud de la competencia atribuida legalmente; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;RESUELVO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.&lt;/strong&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;DECLARAR que de acuerdo con los antecedentes de esta resolución, queda acreditada la concurrencia de las circunstancias en que hacen necesario recurrir&lt;span style="display:none"&gt;&amp;lt;A[recurrir|recorrer]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; en la acción concertada para la gestión de la prestación del &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;servicio &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;de residencia&lt;/span&gt;&lt;span style="color:#000000"&gt; para personas &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;con &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;discapacidad intelectual y/o trastorno del desarrollo&lt;/span&gt;, incluido en la red pública de servicios para personas con discapacidad de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; DECLARAR la urgencia de la concertación del &lt;span style="background-color:#ffffff"&gt;servicio &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;de residencia&lt;/span&gt;&lt;span style="color:#000000"&gt; para personas &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;con &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;discapacidad intelectual y/o trastorno del desarrollo&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;,&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; a los efectos de lo&amp;nbsp;establecido en&amp;nbsp;la disposición final primera de la Ley 12/2018, de 15 de noviembre, &lt;/span&gt;de servicios a las personas en el ámbito social en&amp;nbsp;la comunidad autónoma de las Islas Baleares (BOIB nº. 146 de 22 de noviembre de 2018)&lt;span style="background-color:#ffffff"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero. &lt;/strong&gt;CONVOCAR por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el procedimiento de urgencia&lt;span style="background-color:#ffffff"&gt; la concertación de 178 plazas del&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;servicio de residencia para personas con discapacidad intelectual y/o trastorno del desarrollo y 47 complementos de apoyo&lt;span style="display:none"&gt;&amp;lt;A[apoyo|soporte]&amp;gt;&lt;/span&gt; extraordinario nocturno,&lt;/span&gt; &lt;span style="background-color:#ffffff"&gt;por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; una anualidad, de acuerdo con los términos siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;«Convocatoria &lt;span style="background-color:#ffffff"&gt;de la concertación social por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el procedimiento de urgencia del servicio de residencia &lt;/span&gt;para personas con discapacidad intelectual y/o trastorno del desarrollo, incluidos en la red pública de servicios para personas con discapacidad de Mallorca&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;1. Objeto&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El objeto de esta convocatoria es fijar el procedimiento, los criterios de preferencia, los requisitos y las condiciones de la concertación del Servicio de residencia para personas con discapacidad intelectual y/o trastorno del desarrollo incluido en la red pública de servicios para personas con discapacidad de Mallorca de acuerdo con el pliego de prescripciones técnicas. Se dicta conforme a la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en&amp;nbsp;la comunidad autónoma de las Islas Baleares, en adelante ley 12/2018 (BOIB nº. 146 de 22 de noviembre de 2018); y del Decreto 48/2017 de 27 de octubre, por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el cual se establecen los principios generales a los cuales se tienen que someter los conciertos sociales, en adelante Decreto 48/2017 (BOIB Nº. 132, de 28 de octubre de 2017). &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;2. Ámbito territorial&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;El ámbito territorial de esta concertación es la Isla de Mallorca. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;3. Plazas a concertar&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;4.Vigencia del concierto &lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La vigencia de esta concertación será de un año, desde la formalización o desde la fecha que expresamente se determine al acuerdo de acción concertada suscrito entre el IMAS y las entidades que resulten adjudicatarias. El concierto será susceptible de renovación por igual plazo, como máximo. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;5. Revisión de los servicios y apoyos&lt;span style="display:none"&gt;&amp;lt;A[apoyos|soportes]&amp;gt;&lt;/span&gt; complementarios&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Los servicios y apoyos&lt;span style="display:none"&gt;&amp;lt;A[apoyos|soportes]&amp;gt;&lt;/span&gt; complementarios concertados en el marco de esta convocatoria serán objeto de revisión de acuerdo con lo que se detalla a continuación: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Servicio complementario de apoyo&lt;span style="display:none"&gt;&amp;lt;A[apoyo|soporte]&amp;gt;&lt;/span&gt; extraordinario nocturno:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt; &lt;/strong&gt;el servicio complementario de apoyo&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="display:none"&gt;&amp;lt;A[apoyo|soporte]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; extraordinario será objeto de revisión de oficio cada 6 meses por parte del IMAS, de forma individual con cada persona usuaria. De acuerdo con la revisión de oficio efectuada, semestralmente se acorda&lt;/span&gt;rá&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;, si procede&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="display:none"&gt;&amp;lt;A[pega|ocurre]&amp;gt;&lt;/span&gt;, la resolución de las bajas y/o de las altas que se produzcan de este tipo de servicio complementario. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Las bajas que se produzcan durante la vigencia del concierto, de este complemento por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; necesidades excepcionales de apoyo&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="display:none"&gt;&amp;lt;A[apoyo|soporte]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;, podrán ser concertadas, en cualquier momento, por parte del IMAS de acuerdo con la orden de prelación de la lista de espera de las solicitudes que no se hayan podido atender de este tipo de apoyo&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="display:none"&gt;&amp;lt;A[apoyo|soporte]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;. Se procederá a hacer una modificación del concie&lt;/span&gt;rto,&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; si&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; procede, &lt;span style="background-color:#ffffff"&gt;por este motivo, cada seis meses. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;6. Presupuesto y precio máximo del servicio &lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;6.1 Presupuesto&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El importe máximo estimado para asignar al concierto es de &lt;/span&gt;7.547.262,82€&lt;span style="color:#000000"&gt;&lt;em&gt; &lt;/em&gt;&lt;/span&gt;&lt;span style="background-color:#ffffff"&gt;(IVA exento), &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;6.2. Precio&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Los precios de referencia máximo por plaza y complementos concertados por anualidad, de conformidad a los aprobados por&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; la Resolución de actualización y fijación de precios de los servicios de personas con discapacidad, incluidos en la cartera de servicios sociales, que pueden ser objeto de concertación social (BOIB nº. 158, de 6 de diciembre de 2022),és: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;7. Requisitos de las entidades&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Las entidades que quieran optar a esta concertación social tendrán que cumplir los requisitos siguientes: &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;a) Inscripción en el&amp;nbsp;Censo de Organizaciones del Tercer Sector Social de las Islas Baleares, de acuerdo con el establecido a la Ley 3/2018, de 29 de mayo, del tercer sector social. (BOIB núm, 67, de 31 de mayo de 2018)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;b) Cumplir los requisitos mínimos que se establecen en el título VII de la Ley 4/2009, de 11 de junio, de servicios sociales de las Islas Baleares, en adelante Ley 4/2009. (BOIB nº. 89, de 18 de junio de 2009)&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;c)Tener el servicio objeto de esta convocatoria legalmente constituido y autorizado por el IMAS en el momento de la adjudicación, según lo&amp;nbsp;establecido en&amp;nbsp;la disposición transitoria primera del Decreto 48/2007, así como tener el servicio inscrito en el Registro Unificado de Servicios Sociales. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;d) Acreditar una experiencia mínima de un año en la prestación del servicio y perfil de las personas usuarias objeto de este concierto. La experiencia tiene que ser acreditada de acuerdo con el punto 8.2 de esta convocatoria.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;e) Acreditar solvencia financiera y técnica para prestar el servicio objeto de la concertación social de acuerdo con el punto 8.2 de esta convocatoria. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;f) Estar al corriente en el cumplimiento&lt;span style="display:none"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt; de las obligaciones económicas con el Consejo de Mallorca y con el IMAS y de las otras obligaciones tributarias y con la Seguridad Social que vendan impuestas para&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt; la normativa vigente. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;g) Que la entidad no haya sido objeto, respecto del servicio a concertar, de una resolución de expediente sancionador en materia de servicios sociales, causas que constan en los artículos 127 a 129 de la Ley 4/2009 durante los 24 meses anteriores al concierto, a excepción que, con carácter previo a la presentación de la solicitud, la entidad haya satisfecho el pago íntegro de la totalidad del importe de la sanción y haya acreditado delante del órgano sancionador que se han corregido las causas que motivaron la sanción. Estos hechos se acreditarán necesariamente mediante la verificación y el correspondiente informe por parte del órgano administrativo competente. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;h) No estar afectadas por ninguna prohibición de contratar con la Administración, de acuerdo con el artículo 71 de la Ley 9/2007, de 8 de noviembre, de contratos del sector público, ni estar incluida en ninguno de los supuestos previstos en el artículo 13 de la Ley 38/2003, de 17 de noviembre, general de subvenciones, ni la Ley 58/2003, de 17 de diciembre, general tributaria. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;i) No haber sido sancionado en los últimos cuatro años mediante resolución firme por la comisión de infracciones graves o muy graves en materia de relaciones laborales, empleo&lt;span style="display:none"&gt;&amp;lt;A[empleo|ocupación]&amp;gt;&lt;/span&gt;, empresas usuarias de empresas de trabajo temporal, seguridad social, emigración, movimientos migratorios y trabajo de extranjeros.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;j) Cuando el objeto de la concertación social consiste en servicios que, de acuerdo con la normativa vigente, se tiene que prestar en un espacio físico determinado, se tiene que acreditar la titularidad del centro o la disponibilidad por cualquier título jurídico válido por un periodo no inferior al de la vigencia de esta concertación social. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;k) Acreditar el cumplimiento&lt;span style="display:none"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt; de la normativa que, con carácter general o específico, les sea aplicable, tanto por&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; la naturaleza jurídica de la entidad como por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el tipo de servicio objeto de concertación. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;8. Presentación de solicitudes&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;8.1. Lugar&lt;span style="display:none"&gt;&amp;lt;A[Lugar|Sitio]&amp;gt;&lt;/span&gt; y plazo de presentación de solicitudes&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El plazo para presentar las solicitudes es de 5 días hábiles contadores desde el día siguiente que se haya publicado esta convocatoria en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Documentación que se tiene que presentar&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Las entidades interesadas tienen que presentar la solicitud de acuerdo con el modelo normalizado que figura en la sede electrónica del Consejo de Mallorca y en el Tablón de Anuncios del IMAS, y que se aprueba con esta convocatoria. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El modelo de solicitud (MOD-1), tiene que ir firmado por la persona representante legal de la entidad, indicando expresamente el número de plazas que solicita concertar con el IMAS en el marco de esta convocatoria. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Esta solicitud se tiene que acompañar de los documentos que se detallan a continuación:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;a) Una fotocopia del documento nacional de identidad, para acreditar la identidad de la persona que legalmente represente a la entidad, así como la acreditación de su representación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;b) Certificado de la inscripción en el&amp;nbsp;Censo Público de Organizaciones del Tercer Sector Social de las Islas Baleares, con menos de 6 meses de vigencia.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;c) Certificado de la inscripción en el&amp;nbsp;Registro de Servicios Sociales, con menos de 6 meses de vigencia.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;d) Copia de la resolución de autorización vigente, en caso de disponer, del servicio a concertar o copia de la solicitud &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;e) Documentación acreditativa de la solvencia técnica. En el caso de que la solvencia técnica se acredite mediante Resolución de servicios previamente contratados o concertada con el IMAS, no es preceptivo presentar la documentación acreditativa. Si bien, en todo caso, se tiene que indicar en el&amp;nbsp;MOD-1.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;f) Documentación acreditativa relativa a la solvencia financiera señalada en el MOD- 1 de solicitud.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;g) Justificante&amp;nbsp;de disposición de póliza de seguro de responsabilidad civil que cubra la indemnización por riesgos (profesionales, de atención a las personas o de otros) para todo el periodo de duración del concierto, por un importe igual o superior al exigido en los pliegos&lt;span style="display:none"&gt;&amp;lt;A[pliegues|pliegos]&amp;gt;&lt;/span&gt; de prescripciones técnicas de esta concertación social, en función del número de plazas solicitadas. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;h) Documentación acreditativa de la titularidad o de disponibilidad del espacio físico en el&amp;nbsp;que se desarrollará el servicio, para&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt; cualquier título jurídico válido, por un periodo no inferior al de la vigencia del concierto. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;En relación a la documentación referenciada en&amp;nbsp;las letras a), b), c), d) y e) del punto 1, de conformidad con&amp;nbsp;lo&amp;nbsp;establecido en el artículo 28 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (en adelante Ley 39/2015), no será necesaria la presentación de aquella documentación que ya haya estado previamente aportada, teniendo que indicarlo a la entidad, cumplimentando a este efecto la información contenida, siempre que esté en vigor y no haya sufrido modificaciones. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;En caso de que la entidad solicitante esté interesada en&amp;nbsp;solicitar plazas complementarias de apoyo&lt;span style="display:none"&gt;&amp;lt;A[apoyo|soporte]&amp;gt;&lt;/span&gt; extraordinario previstas en esta convocatoria, lo podrán hacer mediante la presentación de la solicitud específica de plazas complementarias (MOD 2), disponible en la sede electrónica del Consejo de Mallorca.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Esta solicitud tendrá que ir firmada por el representante legal de la entidad, y se tendrá que indicar cada una de las personas usuarias respecto de las cuales se solicitan los complementos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;La presentación de la solicitud implica que la entidad autoriza al&amp;nbsp;IMAS para que&amp;nbsp;pueda consultar o pedir a cualquier administración la documentación, los datos y los informes que consideren necesarios para tramitar el expediente, y que la entidad se obliga a cumplir con el pliego de prescripciones técnicas de esta convocatoria. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;8.3. Enmienda de deficiencias&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Si la solicitud no reúne los requisitos legales y los que se derivan de esta convocatoria se tiene que requerir la entidad solicitante, de acuerdo con lo que establece el artículo 68 de la Ley 39/2015, para que, en un plazo no superior a cinco días hábiles, enmiende la falta o acompañe los documentos preceptivos, con la indicación que, si no lo hace, se tendrá por&amp;nbsp;desistida de su petición, previa resolución expresa en los términos que establece el artículo 21 de la Ley mencionada. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9. Instrucción del procedimiento&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.1. Órgano competente para la instrucción&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El órgano competente para instruir el procedimiento es la Dirección Insular de Personas con Discapacidad del Instituto Mallorquín de Asuntos Sociales, que tendrá la prerrogativa de interpretarlo y resolver las dudas que surjan durante el cumplimiento&lt;span style="display:none"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt;. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Los servicios técnicos de la Dirección Insular de Personas con Discapacidad del Instituto Mallorquín de Asuntos Sociales tienen que examinar las solicitudes y si procede&amp;nbsp;tramitar los requerimientos de enmienda que sean necesarios, emitiéndose informe al respecto.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.2. El procedimiento de concertación se resolverá de acuerdo con los siguientes criterios:&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- Si el cómputo total de plazas que ofrecen las entidades que cumplan con los requisitos establecidos en el punto 7 de esta convocatoria no supera el número total de plazas previstas en la convocatoria, el informe propondrá que se adjudiquen directamente a las entidades solicitantes.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- Si el cómputo total de plazas que ofrecen las entidades que cumplan con los requisitos establecidos en el punto 7 de esta convocatoria supera el número total de plazas previstas en la convocatoria, se actuará según los criterios de preferencia establecidos en el punto 9.4 de esta convocatoria.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- A &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;petición del órgano instructor, e&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;n caso que haya dificultades&amp;nbsp;en la interpretación de las ofertas presentadas o dudas en el procedimiento de adjudicación, o así lo considere el órgano instructor se convocará una comisión evaluadora, con la composición y funciones que se establecen en el punto 9.3 de esta convocatoria. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.3. De la Comisión Evaluadora&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;La Comisión Evaluadora actuará de conformidad con el artículo 15 relativo al «Comité técnico de asesoramiento» del Decreto 48/2017 y, consecuentemente tendrá los mismos efectos que el mencionado Comité Técnico de Asesoramiento. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;i. Composición La Comisión Evaluadora estará integrada por los miembros siguientes:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Presidente: La directora insular del Área de Personas con Discapacidad, o persona que la sustituya.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Vocales: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- La jefa del Servicio de Personas con Discapacidad, o persona que la sustituya.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- La jefa del Servicio de Gestión Económica, o persona que la sustituya, y;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:120px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;- La gerente del IMAS o persona que la sustituya.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;ii. Régimen de funcionamiento:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Esta comisión tiene que analizar e interpretar las incidencias o dificultades detectadas y tiene que emitir informe al&amp;nbsp;respeto, el qual se tiene que tener en cuenta por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el órgano instructor a la hora de elaborar la propuesta de resolución. Sólo será convocado por el órgano instructor en caso que, por&amp;nbsp;existir dificultades o dudas este órgano lo considere necesario. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;La Comisión Evaluadora queda válidamente constituida con la asistencia, como mínimo, de los miembros siguientes: la presidencia o persona suplente, la secretaria o persona suplente y dos vocales.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.4. Criterios de preferencia&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;De acuerdo con el artículo 6 de la Ley 12/2018, los criterios para resolver esta concertación social objeto de la presente convocatoria son: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;a) El arraigo&lt;span style="display:none"&gt;&amp;lt;A[arraigo|enraizamiento]&amp;gt;&lt;/span&gt; de la persona en el entorno de atención y las condiciones de atención que requiere la persona. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;b) La implantación de la entidad en la localidad donde se tenga que prestar el servicio. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;c) La libre elección y la lista de espera pública de acceso a los servicios.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;En caso de que se pueda producir la renuncia a solicitar el concierto o bien queden plazas para cubrir debido a un posible incumplimiento de los requisitos señalados en el apartado 7, la comisión evaluadora establecerá la fórmula para garantizar los derechos y la adecuada atención a las personas usuarias. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Una vez aplicados estos criterios, la comisión evaluadora instará al&amp;nbsp;órgano instructor para que proponga la adjudicación del servicio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;9.5 Continuación del procedimiento&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Una vez comprobados todos los requisitos, el órgano instructor emitirá informe propuesta de adjudicación de las plazas a concertar del servicio objeto de esta convocatoria y si es el caso, la exclusión motivada de las entidades que no cumplan con los requisitos establecidos, así como cualquier otra información que resulte necesaria para la resolución del expediente. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;10. Resolución y notificación&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;10.1. Órgano competente para la resolución&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.2.28 de los Estatutos del IMAS (BOIB nº. 67, de 18 de mayo de 2019).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;10.2. Plazo&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El plazo máximo para dictar y notificar la resolución de la presente concertación es de tres meses contadores desde el&amp;nbsp;día siguiente que acabe el plazo de presentación de solicitudes. Se tienen que considerar desestimadas las solicitudes no resueltas en el plazo indicado anteriormente. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;10.3. De la notificación&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;La resolución de la concertación social objeto de esta convocatoria, se tiene que notificar individualmente a las entidades interesadas, de acuerdo con lo&amp;nbsp;previsto en el artículo 42 de la Ley 39/2015, tienen que ser expresas, motivadas y tienen que fijar la cuantía individual del concierto. Además esta resolución se publicará en el Tablón de Anuncios del IMAS (https://imas.sedipualba.es/tablondeanuncios/) y a la Sede Electrónica del Consejo de Mallorca. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;10.4. Modificación resolución&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Cualquier alteración de las condiciones exigidas para conceder la concertación social, puede dar lugar a la modificación de la resolución. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;10.5. De los Recursos&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Contra las resoluciones que adopta la Presidencia se puede interponer recurso de alzada ante el Consejo Ejecutivo del Consejo de Mallorca en el plazo y con los efectos del artículo 112 de la Ley 39/2015, del 1 de octubre, de procedimiento común de las administraciones públicas. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;11. Formalización de los conciertos&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;La concertación social que se establece al amparo de esta convocatoria se tiene que formalizar mediante un documento administrativo denominado «acuerdo de acción concertada», cuyo modelo se tendrá que aprobar por resolución de la Presidencia del IMAS. En este acuerdo de acción concertada se tiene que hacer constar los contenidos mínimos previstos en el artículo 8 de la Ley 12/2018 así como&lt;span style="display:none"&gt;&amp;lt;A[como|cómo]&amp;gt;&lt;/span&gt;, según lo&amp;nbsp;establecido en el artículo 7 del decreto 48/2017, los derechos y las obligaciones recíprocos, las características concretas del servicio, otras circunstancias derivadas de la Ley 4/2009 y de los &lt;/span&gt;decretos de desarrollo&lt;span style="background-color:#ffffff"&gt;, y del pliego de condiciones técnicas de la presente concertación. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;12. Cesión&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;De acuerdo con lo&amp;nbsp;previsto en el artículo 7.4 de la Ley 12/2018 queda prohibida la cesión, total o parcial, del servicio objeto del acuerdo de acción concertada. No obstante, cuando la entidad concertada sea declarada en concurso de acreedores, la administración pública competente podrá autorizar la cesión con la adopción de las medidas necesarias para garantizar la continuidad y la calidad del servicio. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;13. Condiciones técnicas de ejecución&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Las condiciones técnicas de ejecución se tienen que ajustar al Decreto 10/2013, de 28 de febrero, por&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt; el cual se fijan los principios generales del Registro Unificado de Servicios Sociales de las Islas Baleares y de los procedimientos para la autorización y la acreditación de servicios sociales, y se regulan la sección suprainsular del Registro y los procedimientos para autorizar y acreditar servicios sociales de ámbito suprainsular, y los reglamentos de despliegue vigentes en su ámbito territorial de actuación; así como también se tienen que ajustar a la Ley 12/2018 y al Decreto 48/2017.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Asimismo, la ejecución de la concertación social objeto de la presente convocatoria se ha regir por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el contenido del pliego de prescripciones técnicas aplicable en esta tipología de servicios y que se aprueba conjuntamente con esta convocatoria. Concretamente, este pliego, de conformidad con lo&amp;nbsp;previsto en el artículo 8 del Decreto 48/2017, de 27 de octubre, detalla: el objeto, la definición del servicio, el calendario y horario, los servicios que se tienen que prestar, los requisitos de los servicios a concertar, el modelo de atención, los criterios de intervención con las personas usuarias, el régimen de utilización de plazas y el régimen económico, los seguros, el número de plazas, los medios materiales y humanos que tiene que aportar la entidad concertada, las obligaciones de la entidad concertada, la financiación de la concertación social, la justificación, la coordinación, control y supervisión, la protección de datos de carácter personal y la regulación de los incumplimientos por parte de las entidades y las penalizaciones, así como el plazo de la concertación. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Al respecto, el artículo 9.3 del Decreto 48/2017, de 27 de octubre establece las obligaciones de las entidades y determina que mediante la concertación social, la entidad de iniciativa privada titular del servicio se obliga a cumplir los pliegos&lt;span style="display:none"&gt;&amp;lt;A[pliegues|pliegos]&amp;gt;&lt;/span&gt; técnicos, así como las normas establecidas en el título VII de la Ley 4/2009 y en los correspondientes decretos de despliegue y de aplicación de esta Ley. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;14. Seguimiento y criterios de acceso de las personas usuarias&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;La jefa del Servicio de Personas con Discapacidad&amp;nbsp;será la responsable de los conciertos formalizados y por sí misma o la persona en quien delegue, hará el seguimiento técnico del servicio concertado objeto de esta convocatoria, de conformidad con lo&amp;nbsp;mencionado en el artículo 10 de la Ley 12/2018 y en el&amp;nbsp;artículo 27 del Decreto 48/2017 y con los pliegos&lt;span style="display:none"&gt;&amp;lt;A[pliegues|pliegos]&amp;gt;&lt;/span&gt; técnicos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;La entidad concertada tiene que facilitar las actuaciones de seguimiento y comprobación que lleve a cabo la Dirección Insular de Personas con Discapacidad.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El IMAS, a través del Servicio de Personas con Discapacidad, tiene que gestionar directamente el acceso a los servicios.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;15. Penalidades&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El incumplimiento de las condiciones previstas para la prestación del servicio se tiene que penalizar, de acuerdo con el Pliego de prescripciones técnicas de este concertación social, y con la normativa de aplicación.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;16. Causas de resolución&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Los acuerdos de acción concertada se extinguen, de acuerdo con lo&amp;nbsp;previsto en el artículo 9 de la Ley 12/2018, por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el cumplimiento&lt;span style="display:none"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt; y vencimiento del plazo, siempre que no se hayan renovado, o por resolución. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;Son causas de resolución de los acuerdos de acción concertada las siguientes: &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;a) Acuerdo mutuo de las partes, manifestado con la antelación de dos meses. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;b) Renuncia de la entidad concertada, manifestada con una antelación mínima de dos meses para garantizar la continuidad del servicio. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;c) Incumplimiento de las normas de carácter obligatorio a que se tienen que someter el servicio objeto de la presente concertación y de las obligaciones en materia de seguridad e instalaciones.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;d) Incumplimiento de los objetivos cualitativos y cuantitativos establecidos, siempre que el incumplimiento sea imputable a la entidad concertada, así como de las estipulaciones esenciales del acuerdo y de los pliegos&lt;span style="display:none"&gt;&amp;lt;A[pliegues|pliegos]&amp;gt;&lt;/span&gt; de prescripciones técnicas aplicables.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;e) Prestación defectuosa de las obligaciones acordadas. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;f) La negación a atender a las personas usuarias derivadas por el IMAS. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;g) Infracción con carácter grave de la legislación fiscal, laboral, de la Seguridad Social, de integración social de personas con discapacidad y de prevención de riesgo. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;h) Pérdida sobrevenida de los requisitos de participación en la presente convocatoria o de las condiciones técnicas, económicas y financieras que hayan habilitado el acuerdo de acción concertada, así como la revocación o la caducidad de la autorización de apertura&lt;span style="display:none"&gt;&amp;lt;A[apertura|abertura]&amp;gt;&lt;/span&gt; y funcionamiento y/o de la acreditación del servicio. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;i) Muerte&amp;nbsp;de la persona física titular del servicio o la extinción de la persona jurídica a la cual corresponde la titularidad, excepto lo que prevé el artículo 29 del Decreto 48/2017.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;j) Declaración de concurso de acreedores de la entidad titular del servicio, a excepción de lo&amp;nbsp;previsto en el artículo 7.4 de la Ley 12/2018. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;k) Modificación de las condiciones técnicas o de las condiciones económicas por parte de la Administración, siempre que la entidad de iniciativa privada no haya dado la conformidad. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;l) No disponibilidad sobrevenida del título jurídico que acredita la titularidad del servicio durante la vigencia del acuerdo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;m) Las cláusulas de revocación previstas en los pliegos&lt;span style="display:none"&gt;&amp;lt;A[pliegues|pliegos]&amp;gt;&lt;/span&gt; técnicos objeto del presente servicio.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;17. Modificación y/o ampliación del acuerdo de acción concertada.&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;El procedimiento de ampliación de plazas concertadas del servicio objeto de la presente convocatoria, así como de modificación de la concertación social mencionada, se tiene que llevar a cabo de conformidad con el establecido en los pliegos&lt;span style="display:none"&gt;&amp;lt;A[pliegues|pliegos]&amp;gt;&lt;/span&gt; de prescripciones técnicas. &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;18. Jurisdicción competente&lt;/span&gt;&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="background-color:#ffffff"&gt;La jurisdicción contenciosa administrativa es la competente para resolver las cuestiones litigiosas relativas a la formalización de esta concertación social y también las surgidas entre las partes sobre la interpretación, la modificación, el cumplimiento&lt;span style="display:none"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt;, los efectos y la extinción de la concertación social.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Esta resolución no pone fin a la vía administrativa y contra ella se puede interponer, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consejo de Mallorca de 11 de abril de 2019 (BOIB nº. 67, de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Consejo de Mallorca, dentro del plazo de un mes, contados&amp;nbsp;a partir del día siguiente al&amp;nbsp;de la notificación de la presente resolución. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;administrativo ante el Juzgado Contencioso Administrativo, en el plazo de dos meses, contadores a partir del día siguiente al&amp;nbsp;de la notificación de la desestimación del mencionado recurso. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso&amp;nbsp;administrativo ante el Juzgado Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;No obstante el anterior, se puede ejercitar, si es el caso, cualquier otro recurso que se estime pertinente. Todo esto de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contenciosa Administrativa, y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
