CAIB 41232 CAIB 400 676173 ![CDATA[Resolución del consejero de Empresa, Empleo y Energía por la que se deniegan las subvenciones para el fomento de vehículos de movilidad personal para personas físicas, en el marco del impuesto sobre estancias turísticas en las Islas Baleares y de medidas de impulso del turismo sostenible]] ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El 15 de abril de 2023, en el BOIB número 48, se publicó la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 4 de abril de 2023 por la que se aprueba la convocatoria pública de subvenciones para en 2023 para el fomento de vehículos de movilidad personal para personas físicas, en el marco del impuesto sobre estancias turísticas en las Islas Baleares y de medidas de impulso del turismo sostenible.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Las personas que figuran en el anexo de esta Resolución presentaron una solicitud de subvención en el marco de la convocatoria.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Los técnicos de la Dirección General de Energía y Cambio Climático, en aplicación del procedimiento de concesión que establece el apartado séptimo de la Resolución mencionada, informaron desfavorablemente sobre la concesión de las subvenciones descritas en el anexo, con la motivación que también figura en el mismo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El 29 de junio de 2023 se emitió una propuesta de resolución denegatoria del director general de Energía y Cambia Climático (BOIB núm. 90, de 4 de julio de 2023 ).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. En fecha 15 de julio de 2023, SR. Calvo Calabuig presentó un escrito de alegaciones contra la propuesta de resolución del director general de Energía y Cambio Climático en la que se denegaba la subvención a SR . Calvo Calabuig (exp. VMP23-81/2023) por el siguiente motivo: “ <em>El pago del VMP se ha realizado en efectivo, incumpliéndose el apartado 5.3.h) de las bases de la convocatoria”.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:black"><span style="line-height:115%">Junto con el citado escrito presentó la siguiente documentación:</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:black"><span style="line-height:115%">- Contrato financiero</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:black"><span style="line-height:115%">- Recibo 1ª cuota</span></span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="color:black"><span style="line-height:115%">- Recibo 2ª cuota</span></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. En fecha 19 de julio de 2023 se emitió informe favorable a la estimación de las alegaciones presentadas por el sr. Roderic Calvo Calabuig contra la propuesta de resolución del director general de Energía y Cambio Climático por la que se deniegan las subvenciones para el fomento de vehículos de movilidad personal para personas físicas, en el marco del impuesto sobre estancias turísticas en las Islas Baleares y de medidas de impulso del turismo sostenible (BOIB núm. 90, de julio de 2023) (expediente VMP23-81/2023), dado que de la documentación presentada se deduce que el sr. Calvo Calabuig no ha realizado pago en efectivo, sino que ha financiado la adquisición de la bicicleta objeto de la solicitud de subvención.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. Se ha agotado el plazo de diez días hábiles que se concedía para presentar alegaciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. El Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones (BOIB núm. 196, de 31 de diciembre de 2005).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Decreto 75/2004, de 27 de agosto, por el que se despliegan determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 122, de 2 de septiembre de 2004 ).</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía en las Islas Baleares, modificada por la Orden del consejero de Transición Energética y Sectores Productivos de 18 de junio de 2020 (BOIB núm. 116, de 30 de junio de 2020).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 4 de abril de 2023 por la que se aprueba la convocatoria pública de subvenciones para el año 2023 para el fomento de vehículos de movilidad personal para personas físicas, en el marco del impuesto sobre estancias turísticas en las Islas Baleares y de medidas de impulso del turismo sostenible (BOIB núm. 48, de 15 de abril de 2023).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Denegar la concesión de una subvención a los beneficiarios que figuran en el anexo, de acuerdo con la motivación que también figura en la misma.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Eliminar el expediente VMP23-81 /2023 de la lista de beneficiarios a los que se les deniega la subvención y continuar con la tramitación de este expediente.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Publicar esta Resolución en el <em>Boletín Oficial de las Iles Balears.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero <span style="color:black">de Empresa, Empleo y Energía </span>en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico del Administración de la Comunidad Autónoma de las Islas Baleares.</span></p> <p><span style="font-family:Times New Roman,Times,serif;
