    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por Decreto de alcaldía número 2023-1241 de fecha 13 de julio de 2023, se ha dictado el siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«DECRETO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En conformidad con el artículo 51 del Código Civil, en la redacción dada por la Ley 35/1994, de 23 de septiembre, de modificación en materia de autorización de los matrimonios civiles por los alcaldes, el cual establece que son competentes para autorizar el matrimonio civil el alcalde del municipio donde se tenga que celebrar el matrimonio o regidor/a en que este delegue.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Con el fin de dotar de una mayor celeridad y eficacia a la actuación municipal, en uso de las facultades que me confieren los artículos 21.3 y 23.4 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local (LRBRL), artículos 43 y 44 del RD 2568/1986, de 28 de noviembre, Reglamento de organización y funcionamiento de las entidades locales, artículo 3 del Reglamento orgánico Municipal (ROM) y artículo 9 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público, donde se regulan las competencias de la alcaldía que no son susceptibles de delegación y su régimen jurídico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En uso de las atribuciones que me confiere la legislación vigente,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;RESUELVO&lt;/strong&gt;&lt;span style="display:block; margin-bottom:0px; margin-top:0px"&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Delegar de forma indistinta, en todos los regidores y regidoras de esta corporación, la competencia que el artículo 51.1 del Código Civil otorga a la alcaldía para autorizar los matrimonios civiles que se celebran en este término municipal, cuando los contrayentes solicitan que sea autorizado el matrimonio por alguno de los miembros electos de la corporación o cuando la alcaldía no pueda asistir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta delegación faculta a todos los regidores y regidoras que se indican para autorizar matrimonios civiles, sin que en una misma ceremonia pueda intervenir más de uno de ellos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Maria Antonia Pons Mascaró&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Juan Fernando Orfila Timonero&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A estos efectos, la coordinación para la designación del regidor o regidora actuando se establecerá por el Departamento de alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Las competencias delegadas se ejercerán en los términos y dentro de los límites de esta delegación, no son susceptibles de ser delegadas por sus titulares en ningún otro órgano o miembro de la corporación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Las resoluciones que se adopten por delegación, que serán inmediatamente ejecutivas y presuntamente legítimas, se entenderán dictadas por esta alcaldía como titular de la competencia originaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el texto del acta matrimonial adoptada por los miembros de la corporación en virtud de esta delegación se tendrá que hacer constar esta circunstancia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En conformidad con el artículo 44.2 del Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales, aprobado por Real Decreto 2568/1986, de 28 de noviembre, estas delegaciones tendrán efectos desde el día siguiente a la fecha de esta resolución y serán de carácter indefinido, sin perjuicio de la potestad de avocación de esta alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Dar cuenta de la presente resolución al Pleno en la primera sesión que se convoque en conformidad con el artículo 38.d) y 44.4 ROF; notificarla personalmente a los regidores y regidoras y publicarla en el Boletín Oficial de las Islas Baleares y en el tablón de anuncios del Ayuntamiento, en cumplimiento del que dispone el artículo 44.2 del Real Decreto 2568/1986, de 28 de noviembre, por el cual se aprueba el Reglamento de Organización, Funcionamiento y Régimen Jurídico de las Entidades Locales, y difundirla, de acuerdo con el principio de transparencia, mediante su publicación actualizada y permanente a la sede electrónica municipal, en cumplimiento del que disponen los artículos 5 y siguientes de la Ley 19/2013, de 9 de diciembre, de Transparencia, Acceso a la Información y Buen Gobierno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Comunicar esta resolución a todos los regidores y regidoras afectados y a los servicios administrativos del Departamento de alcaldía para su conocimiento y efectos, entendiéndose aceptada esta delegación de competencias de forma tácita, si dentro del plazo de tres días hábiles contados desde la notificación de la resolución, los destinatarios no hacen manifestación expresa ante el órgano delegado de que no acepta la delegación, según el que establece el artículo 114 del ROF.»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
