    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por Acuerdo del Pleno de fecha 25 de abril de 2023, se aprobó inicialmente la Ordenanza reguladora de las prestaciones económicas y materiales de caràcter social del Ayuntamiento de Marratxí&amp;nbsp; que sigue con el procedimiento que establece la tramitación del artículo 102 de la Ley 20/2006, de 15 de diciembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La propuesta de Acuerdo de aprobación inicial se publicó en el BOIB 66 de fecha 18 de mayo de 2023, y en cumplimiento de lo que se establece en el artículo 102 de la Ley 20/2006, de 15 de diciembre ha estado en exposición pública por un período de treinta días con el objeto de dar audiencia a los ciudadanos afectados y recoger las aportaciones adicionales que puedan presentar otras personas o entidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se ha emitido certificado por parte de la secretaria de fecha&amp;nbsp; 27 de junio de 2023, donde se certifica la elevación a definitiva de la aprobación inicial.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Reglamento de regulación de las prestaciones económicas y materiales de carácter social del Ayuntamiento de Marratxí&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PREÁMBULO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El artículo 25.1, apartado e) de la Ley 771985, de 2 de abril, reguladora de las Bases de Régimen Local, a la redacción dada por la Ley 27/2013, de 27 de diciembre, de racionalización y sostenibilidad de la Administración Local (BOE n.º 312, de 30 de diciembre de 2013) prevé como competencia municipal la evaluación e información de situaciones de necesidad social y la atención inmediata a personas en situación o riesgo de exclusión social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Ley 4/2009, de 11 de junio, de Servicios Sociales de las Islas Baleares, en el artículo 38 señala como competencias de los ayuntamientos, entre otros: “crear, organizar y gestionar los servicios sociales que consideren necesarios dentro de su municipio, tanto propios como delegados por otras administraciones, de acuerdo con la cartera de servicios sociales y el plan estratégico correspondiente, y los planes estratégicos autonómicos e insular”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En consecuencia, el Ayuntamiento de Marratxí establece un procedimiento interno para la asignación de las prestaciones económicas a la ciudadanía de Marratxí, en relación a las asignaciones presupuestarias que anualmente se destinan a tal efecto, y a aquellas que puedan ser transferidas por otras administraciones en virtud de Convenios u otros procedimientos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas se concederán en función de los créditos disponibles en el Ayuntamiento para esta finalidad. Por todo ello, no bastará para recibir la ayuda que la persona solicitante reúna todos los requisitos y condiciones que consten en este Reglamento, sino que será necesario que su solicitud pueda ser atendida teniendo en cuenta las dotaciones presupuestarias existentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A partir de aquí, se plantea la necesidad de formalizar el conjunto de ayudas y prestaciones económicas de carácter no periódico que siempre tendrán un carácter subsidiario y/o complementario respecto a las que ofrecen otras instituciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así mismo el presente reglamento da cumplimiento a los principios que, en función de la Ley 40/2015 de Régimen Jurídico del Sector Público, tienen que guiar la actuación pública en materia de objetividad, transparencia, proporcionalidad, confianza legítima, buena fe, eficacia y eficiencia de los servicios públicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las prestaciones reguladas en el presente reglamento se vinculan, en la mayoría de casos, a un plan de trabajo individual y/o familiar de la persona perceptora de la prestación. Se trata no tan solo de dar una ayuda económica, sino de articular recursos en función de las necesidades de la familia (educativos, sanitarios, ocupacionales, relacionales, etc.), así como de incidir en las causas originarias de la situación y conseguir cambios estructurales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En términos de criterios de otorgamiento el presente reglamento combina dos causas que generan la concesión de prestaciones. Por una parte, el cumplimiento de los indicadores de baremación social y económicos de las personas usuarias, siguiendo los principios de objetividad, transparencia e imparcialidad. Y, por otra, la concesión a criterio del o de la profesional social de forma excepcional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las necesidades sociales en un marco socioeconómico cambiante y con una población potencialmente vulnerable justifican esta necesaria flexibilización en la atención de los casos que llevan los y las profesionales de servicios sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1- OBJETO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El objeto del presente reglamento es regular las prestaciones, tanto económicas como materiales, que atienden necesidades sociales y su procedimiento de concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2- DEFINICIÓN Y CARACTERÍSTICAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;prestaciones económicas&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt; son un instrumento del catálogo de prestaciones de los Servicios Sociales Municipales que posibilitan la cobertura de necesidades básicas y complementarias para desarrollar las actividades de la vida cotidiana. Junto con las prestaciones técnicas, hacen una función de prevención de procesos de exclusión social, potenciando la autonomía personal y la mejora de la calidad de vida de la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Van dirigidas a aquellas personas y familias con situación de dificultad socioeconómica surgida tanto por causas coyunturales como por la configuración de la propia estructura socio familiar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las características de las prestaciones son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Son finalistas. Se aplican exclusivamente a la cobertura de la necesidad por la cual se han otorgado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Son prestaciones no periódicas. A pesar de que pueden ser concedidas durante determinados periodos del ciclo anual, varían en función de los cambios que se producen en la situación inicial del núcleo familiar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Son complementarias a las prestaciones técnicas del trabajo social, en cuanto que forman parte – en la mayoría de los casos - de un plan de intervención socio familiar dirigido a conseguir un mayor nivel de autonomía personal y social de las personas perceptoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Son complementarias a las prestaciones que se otorgan desde otras instituciones y/o entidades para la misma necesidad, entendiéndose que la parte que atenderá el Ayuntamiento será aquella que no es cubierta por otra institución y/o entidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Son ayudas con consignación presupuestaria anual no permanente, es decir, que dependen en cada ejercicio de las previsiones que se puedan establecer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se entiende por prestaciones materiales- a diferencia de las económicas- aquellas en el que su contenido técnico o material es sustituido por su equivalente en prestación directa de coste de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3- MODALIDADES DE LAS PRESTACIONES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En virtud del acuerdo del Pleno de esta corporación las prestaciones económicas que se regulan en el presente reglamento tienen como objeto paliar las necesidades siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;a. Necesidades básicas de alimentación, higiene y ropa y calzado:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para alimentación y necesidades básicas de subsistencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para productos de higiene y limpieza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para alimentación infantil e higiene/lactancia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ropa y calzado. Cobertura también en los casos en que se necesite ropa especial laboral según valoración y situación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;b. Carencia o insuficiencia de recursos económicos para el acceso o mantenimiento de la vivienda habitual y/o de los gastos derivados del mismo:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Garantizar los suministros básicos de agua, gas, electricidad y otros. Incluye gastos de contratación de contadores.- Alquileres atrasados y ayudas para alquiler de vivienda habitual, cuando existan garantías de continuidad en la misma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para hacer frente a gastos de hipotecas atrasadas o pagos puntuales de cuotas de hipotecas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas a los gastos para hacer frente a la pérdida temporal o permanente de la vivienda por desahucio, ruina, higiene, catástrofe u otras causas de fuerza mayor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas a alojamientos temporales (puntuales y/o transitorios) en casos de extrema necesidad y situaciones de emergencia social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas a los gastos puntuales para facilitar el acceso a la vivienda de alquiler como: adelanto de fianzas, avales, etc.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para reparaciones o adaptación de la vivienda habitual para proporcionar niveles mínimos de habitabilidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para la adquisición de equipamiento básico.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para el pago de los gastos de comunidad atrasadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para el pago de impuestos (generados por la vivienda) o tasas atrasadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;c. Prevención y mantenimiento de la salud y atención sanitaria:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para medicamentos vitales y de urgencia: siempre que sea por prescripción médica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas para ortopedias y prótesis no cubiertos por la sanidad pública o cubiertos parcialmente, por prescripción facultativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Desplazamientos habituales por necesidades formativas o de atención sanitaria:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ayudas al transporte siempre que los desplazamientos estén motivados por actividades de formación o de activación en el mercado de trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Desplazamientos para atención sanitaria siempre y cuando no esté cubierto por el sistema sanitario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;e. Prestaciones económicas dirigidas a la utilización de servicios educativos:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Prestaciones por la realización de actividades socioculturales y deportivas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ayudas para la atención de situaciones de urgente y grave necesidad que no puedan ser atendidas por ninguno de los conceptos previstos en los epígrafes anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4- ÁMBITO DE APLICACIÓN&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El presente reglamento será de aplicación a las personas físicas y núcleos familiares empadronados en el municipio, que estén en una situación de dificultad socioeconómica y para los cuales las ayudas establecidas sean necesarias para contener o evitar el empeoramiento de su situación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se considera núcleo familiar, a efectos de las prestaciones que regula el Reglamento, el núcleo constituido por dos personas con vínculo de pareja, o una persona sola,&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;y las personas con parentesco hasta el primer grado de consanguinidad en línea ascendiente y descendiente o adopción. También se considera núcleo familiar aquel núcleo de parentesco en el cual existe una situación de tutela.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5- DOTACIÓN PRESUPUESTARIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.1 El Ayuntamiento de Marratxí establece en una única partida presupuestaria el conjunto de prestaciones económicas de signo social destinadas a personas o familias en situación de vulnerabilidad social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.2 La mencionada partida podrá ser incrementada en función de las modificaciones de crédito que eventualmente pueda aprobar la corporación ante la circunstancia de agotar la dotación y la conveniencia de la disponibilidad presupuestaria del ente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.3 Las prestaciones económicas vinculadas, en su fuente de financiación, a la actividad de fomento o subvenciones, no tendrán efecto de consolidación en el presupuesto municipal del siguiente ejercicio, quedando condicionadas a la disponibilidad de liquidez si se aprueba la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.4 A la ejecución del gasto le será de aplicación el presente reglamento independientemente de la fuente de financiación, ya sea dotación específica de convenios que el Instituto Mallorquín de Asuntos Sociales del Consell de Mallorca subscriba con el Ayuntamiento o cualquier otra línea de apoyo del Gobierno Balear u otra administración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6- CRITERIOS DE ACCESO A LAS PRESTACIONES ECONÓMICAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para poder tener acceso a las ayudas, las personas o unidades familiares no tienen que disponer de ingresos (descontando los gastos de pago de la vivienda : alquiler (hasta un máximo de 750€ mes) o hipoteca (hasta un máximo de 600€ en el mes)) superiores a los siguientes porcentatges del SMI ponderados en función de los miembros de la unidad familiar y calculando de forma mensual:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7- REQUISITOS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Ser mayor de 18 años o estar emancipado/da legalmente o, en su defecto, haber iniciado el trámite legal de emancipación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Ser residente (residencia efectiva) en el municipio y estar empadronado/da en el Ayuntamiento de Marratxí. De manera excepcional podrán ser beneficiarias de las prestaciones aquellas personas que, sin estar empadronadas, se encuentran en una situación de dificultad que precisa ser resuelta de forma urgente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Tener dificultades para cubrir de forma autónoma la cobertura de las necesidades propias y las de las personas a cargo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;-Presentar la documentación requerida, colaborar en la valoración social y firmar el plan de trabajo individual/familiar consensuado en los casos que se requiera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8- OBLIGACIONES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Acreditar los requisitos exigidos para tener acceso a las prestaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Comunicar a los servicios sociales municipales las variaciones o cambios existentes en la situación social y económica de la persona o de la unidad de convivencia que puedan modificar las circunstancias que dieron lugar a la solicitud y resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Destinar la prestación a la finalidad que la motivó.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- A todos los efectos el otorgamiento de la prestación queda condicionado a la aceptación de seguir un plan de trabajo individual y/o familiar por parte de la persona usuaria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- En caso de prestaciones económicas con modalidad de pago a la persona o empresa proveedora del servicio y, en el supuesto de que esta cubra solo una parte de coste del mismo, la persona beneficiaria tendrá la obligación de hacerse cargo de la parte restante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Justificar la ayuda mediante la presentación de facturas. Los SS.SS tendrán en cuenta el grado de cumplimiento del acuerdo económico establecido, en caso de solicitud de nuevas ayudas económicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Comunicar a los servicios sociales del Ayuntamiento la obtención otras ayudas para la misma finalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Someterse a las actuaciones de comprobación y control financiero que efectúe el Ayuntamiento de Marratxí y facilitar cuanta información y documentación le sea requerida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Reintegrar los importes concedidos cuando no se apliquen para las finalidades para las cuales se concedieron.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Mantener el empadronamiento y la residencia efectiva en el municipio de Marratxí durante el tiempo de percepción de la prestación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Cualquier otra obligación relacionada directamente con el objeto de la prestación y que específicamente se establezca en el acuerdo de concesión de esta, y que será propuesta según el criterio profesional de los servicios sociales municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Obligaciones específicas según tipologías de prestación&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cada tipología de prestación tendrá unas obligaciones concretas y específicas que se detallarán a la resolución que conceda la prestación o, en su caso, en la convocatoria que publique el Ayuntamiento para su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9- DERECHOS DE LAS PERSONAS BENEFICIARIAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Derecho a recibir información de las posibles modificaciones que se puedan producir en el régimen de la prestación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Derecho a la intimidad y tratamiento confidencial de la documentación de carácter personal incluida al expediente. El personal técnico y administrativo que tramita las ayudas está obligado a mantener el secreto de la información de los expedientes, puesto que la intimidad de las personas está afectada y sujeta a reserva y tratamiento confidencial de acuerdo con el artículo 18 de la Constitución española y con el dispuesto a la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Derecho a ejercer el derecho de queja según las disposiciones vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Derecho al abandono efectivo de la ayuda o prestación una vez resuelta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10- CRITERIOS POR El OTORGAMIENTO DE LAS PRESTACIONES ECONÓMICAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Criterios generales:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Se dará prioridad a las familias mono parentales y a los núcleos familiares con problemática social grave.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- No se valorarán aquellas solicitudes de prestaciones de familias que no presentan la documentación requerida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.1 Órgano competente para resolver y órgano gestor&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano competente para resolver la concesión o denegación de las ayudas&amp;nbsp; solicitadas es la Alcaldía Presidencia, que puede delegar esta facultad en la Junta de Gobierno Local o en el/la regidor/a o Teniente de Alcalde/esa del Área de Servicios Sociales del Ayuntamiento de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano competente para llevar a cabo toda la gestión administrativa de la concesión o denegación de las prestaciones solicitada es el regidor/a del Área de Servicios Sociales del Ayuntamiento de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.2 Procedimiento normalizado de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los/las ciudadanos/se tendrán que solicitar las prestaciones por propia iniciativa, o bien serán remitidos a propuesta del/ de la profesional de referencia cuando se trate de personas con las cuales se está haciendo una intervención profesional por parte del equipo de Servicios Sociales o en los casos de emergencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las ayudas serán tramitadas por el trabajador/a social de los Servicios Sociales del Ayuntamiento de Marratxí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La solicitud (anexo 1) se presentará en el registro General de Entrada del Ayuntamiento de Marratxí e irá dirigida a la Área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez recibida la solicitud, en el supuesto de que no se haya aportado toda la documentación necesaria, se requerirá a la persona solicitante que lo aporte en un plazo de 15 días hábiles. En todo caso, el incumplimiento de este requerimiento supondrá el archivo del expediente sin más trámites.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En un plazo de 20 días hábiles desde la recepción de la documentación acreditativa, el/la trabajador/a social realizará un informe en el cual propondrá o no la concesión de la ayuda solicitada (anexo 3) que puede ir o no acompañado de un Plan de trabajo (anexo 2)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.3 Procedimiento de urgencia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En las situaciones de urgencia, el personal técnico, con el visto bueno del técnico/a responsable, tienen que resolver aquello que estime pertinente mediante el procedimiento ordinario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.4 Documentación que se tiene que adjuntar a la solicitud&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los documentos básicos, aparte de los específicos según el tipo de prestación, que tendrá que presentar la persona solicitante, tanto propios como de todos los miembros de la unidad familiar, son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;DNI, NIE o pasaporte de las personas mayores de 16 años. Fotocopia compulsada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Libro de familia y, en su caso, sentencia de separación o divorcio, o convenio&amp;nbsp; regulador donde conste pensión alimenticia y custodia de los hijos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Nóminas (las tres últimas)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Justificantes de prestaciones del SEPE&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Tarjeta de desempleo o mejora de ocupación del SOIB&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Justificantes de prestaciones del INSS&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Declaración jurada de ingresos del núcleo familiar( anexo 4)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li style="margin-bottom: 0px; margin-right: 0px; margin-top: 0px;"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Cualquier otra documentación que por la correcta valoración de la solicitud pueda ser requerida durante la tramitación, que podrá ser solicitada por el personal técnico de referencia de los equipos básicos de atención social o aportada por el interesado/da si lo considera conveniente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;No se reclamará documentación que ya conste en el expediente de la persona solicitante o de la unidad de convivencia, ni aquella que se pueda conseguir de oficio en otros servicios municipales u otras administraciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se garantiza la confidencialidad de los datos y su procesamiento adecuado, respetando la legislación vigente. La persona solicitante tiene que firmar una autorización expresa de tratamiento de datos de carácter personal (anexo 5)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.5- Valoración técnica&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El/la trabajador/a social llevará a cabo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Una valoración económica de la solicitud en base a los cálculos de ingresos y gastos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Una valoración social que se tendrá que hacer atendiendo a la existencia de indicadores de exclusión y vulnerabilidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se planifica un espacio de interconsulta del equipo de Trabajo Social, para las situaciones familiares socioeconómicas más complejas, así como de ayuda cronificadas, para definir la intervención socioeconómica a realizar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.6- Gestión técnica de la prestación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para resolver las necesidades detectadas en la unidad familiar, se podrá establecer el plan de trabajo global que implicará unos compromisos por parte de las personas usuarias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para elaborar este plan se tendrá que tener en cuenta el máximo de cuantía anual que la familia puede percibir.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Durante la vigencia de las prestaciones, el/la trabajador/a social hará el seguimiento de la prestación y reflejará en el registro del HSI la valoración del proceso y la valoración final.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si hay incumplimiento del plan acordado o se produce un cambio en la situación que determine la innecesaria prestación, el/la trabajador/a social podrá decidir finalizar la concesión antes del plazo acordado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.7- Devolución de la resolución adoptada&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una vez hecha la valoración que da lugar a la demanda de ayuda, la persona solicitante será informada de la resolución adoptada y de sus condiciones: concepto, cuantía, modalidad de adquisición del producto (si es el caso) o de utilización de la prestación, duración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de que la solicitud sea denegada, se entregará siempre el documento de denegación de ayuda económica municipal, con la correspondiente motivación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12.8- Pago de las ayudas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El abono de la ayuda se puede realizar directamente a la persona destinataria, o en los casos donde se proponga en el informe técnico, la persona destinataria tendrá que consentir la cesión de crédito a favor de la persona que tenga que ser retribuida con la ayuda o, en su defecto, a la entidad prestamista del servicio o motivo de ayuda. El Ayuntamiento de Marratxí quedará facultado para realizar el pago directo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13.- JUSTIFICACIÓN DEL GASTO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La justificación del gasto se acreditará por las facturas de los pagos y gastos realizados, las cuales tendrán que cumplir los requisitos reglamentariamente establecidos o mediante otros documentos, de valor probatorio equivalente, con validez en el tráfico jurídico mercantil o con eficacia administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El plazo para la justificación es de dos meses a partir de la fecha de la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La falta de justificación o la justificación incorrecta de la ayuda puede ser motivo de penalización.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una copia de la justificación de las ayudas obtenidas se archivará en el expediente personal/familiar del beneficiario o la beneficiaria de la ayuda, que se encuentra en el Área de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14.- DENEGACIÓN, MODIFICACIÓN, SUSPENSIÓN Y RENUNCIA&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14.1 Denegació de la subvención&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Podrán ser denegadas aquellas solicitudes en las que pueda concurrir alguna de las siguientes circunstancias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- La falta de todos o algunos de los requisitos necesarios para su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que la persona solicitante no resida, efectivamente, en el municipio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- El impedimento de la labor técnica de valoración de la solicitud recibida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que exista persona legalmente obligada y con posibilidad de prestar ayuda a la persona solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que no exista crédito suficiente por la atención de la solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- El falseamiento u ocultamiento de cualquiera de los datos declarados por las personas solicitantes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que se demuestre que la persona solicitante puede satisfacer adecuadamente las necesidades por sí misma y/o con el soporte de sus familiares, representantes legales o guardadores de hecho.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Que corresponda la atención de la persona solicitante por razón de la naturaleza de la prestación o por razón de residencia a otra administración pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Cualquier otro motivo que atendiendo a las circunstancias y previa valoración de las Unidades de Trabajo Social, estimen su denegación de forma motivada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14.2. Modificación de la prestación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se puede producir una modificación en la prestación cuando las circunstancias que motivaron la solicitud varíen. Se podrá modificar la finalidad y la cantidad de la prestación a propuesta de la persona beneficiaria o del/la profesional.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14.3 Suspensión de la prestación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se puede proceder a la suspensión de la prestación por alguna de estas causas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A. Por voluntad o renuncia de la persona beneficiaria de la prestación económica&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B. Muerte de la persona beneficiaria. Cuando la ayuda se haya concedido a un núcleo familiar el equipo de profesionales valorarán si es pertinente o no su continuidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;C. Por la aparición de causas sobrevenidas que produzcan la imposibilidad material de continuar con la prestación de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14.4 Desistimiento y renuncia&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La persona solicitante podrá desistir de su solicitud o renunciar a su derecho a la prestación reconocida por medio de un escrito dirigido al Ayuntamiento. Este dictará una resolución donde se exprese la circunstancia en que concurre, indicando los hechos producidos y las normas aplicables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. REVOCACIÓN DE LAS AYUDAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Será procedente la revocación de las prestaciones según los motivos de las causas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A. En caso de incumplimiento de los requisitos por parte de la persona beneficiaria (cumplimiento del plan de trabajo individualizado, aceptación de ofertas de trabajo, escolarización de los niños, etc.). Serán los servicios básicos de atención social los que determinarán, en una propuesta de resolución, la valoración sobre el cumplimiento o eventual incumplimiento de estas circunstancias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B. Cuando la persona beneficiaria incumpla todas o algunas de las obligaciones adquiridas con la aceptación de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;C. Falsear, ocultar o mostrar obstrucción a las actuaciones de comprobación por parte del personal municipal de servicios sociales y servicios económicos, a pesar de reunir la persona solicitante los requisitos para la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D. Que haya transcurrido el plazo de tres meses desde el otorgamiento de la ayuda sin que el ingreso económico se haya podido hacer efectivo por causas imputables a la parte interesada. Este hecho se comunicará por correo ordinario en el domicilio que la persona solicitante declaró.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;E. La utilización de la ayuda con una finalidad diferente de aquella para la cual fue concebida, constituirá causa determinante de su revocación y el órgano competente promoverá la acción ejecutiva que corresponda, sin perjuicio de las actuaciones civiles, penales o de otro orden que en cada caso sea procedente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;F. Desaparición de todas o algunas de las circunstancias que dieron lugar a su concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;G. Por la aparición de causas sobrevenidas que produzcan la imposibilidad material de continuar con la prestación de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;H. Por ser beneficiario/a simultáneamente de otra prestación con la misma finalidad, es decir, que tenga la misma naturaleza y atienda las mismas necesidades, sin que tal circunstancia haya sido comunicada al Departamento de Servicios Sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;I. Otras causas de naturaleza análoga y carácter grave imputables a la persona beneficiaria, no previstas en los apartados anteriores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto que el Ayuntamiento detecte que concurre una posible causa de revocación de las prestaciones, lo comunicará a la persona interesada, concediendo un trámite de audiencia de diez días. Durante este plazo, la persona beneficiaria podrá alegar lo que considere conveniente y, en su caso, aportar los documentos o justificaciones pertinentes. Realizado este trámite, se adoptará, si corresponde, el acuerdo de revocación de la prestación. El acuerdo que se dicte será notificado al interesado y en este se detallará si corresponde iniciar además un expediente de imposición de penas cuando la conducta pueda constituir una infracción de las previstas en el artículo siguiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. INFRACCIONES Y PENALIDADES&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Constituyen infracciones las acciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A. El falseamiento u ocultamiento de cualquier de los datos declarados por las personas solicitantes, incluido cuando la persona solicitante reúna los requisitos por la concesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B. La no aplicación, en todo o en parte, de la cantidad recibida a las finalidades para las cuales fue concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;C. El incumplimiento reiterado y continuo, por razones imputables a la persona beneficiaria, del plan de trabajo individualizado y de los acuerdos relacionados con la prestación concedida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;D. La falta de justificación del uso dado a los fondos recibidos, la justificación incompleta o inexacta y la justificación fuera de plazo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;E. La obstrucción, excusa o negativa a las actuaciones de valoración, seguimiento y/o comprobación por parte del equipo de profesionales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;F. Incumplimiento de la obligación de comunicar al/a la profesional cualquier cambio o mejora en las circunstancias que propiciaron la concesión de la ayuda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Las personas beneficiarias de la ayuda o los/las representados de los mismos serán los responsables de estas infracciones. Las infracciones mencionadas podrán suponer las penas siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;A. Cierre temporal, entre dos y seis meses, del expediente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;B. Extinción de las prestaciones concedidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;C. La no valoración de la situación de la persona beneficiaria durante un periodo de seis meses a contar desde la imposición de la penalidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La imposición de cualquiera de las penas indicadas requerirá la tramitación previa del procedimiento en el que se concederá, en todo caso, trámite de audiencia previa al interesado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17.- VIGENCIA DEL REGLAMENTO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Este reglamento, una vez aprobado definitivamente por el Pleno de la Corporación, entrará en vigor con la publicación íntegra de su texto en el BOIB y transcurridos los plazos que marca la ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
