&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;«DECRETO DE NOMBRAMIENTO DE TENIENTES/TINENTES DE ALCALDE&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Constituida la Corporación Municipal por el período 2023-2027 en el Pleno del Ayuntamiento de fecha 17 de junio de 2023 después del proceso electoral de las elecciones municipales de día 28 de mayo de 2023, y elegido alcalde de Sa Pobla, Biel Ferragut Mir, se hace necesario proceder a la nueva organización municipal y, más concretamente, a la designación de las tenencias de alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta alcaldía por decreto ha resuelto designar a los miembros integrantes de la Junta de Gobierno Local, por eso se hace preciso la designación de tenientes de alcalde entre sus componentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Artículos 21.2 y 23.3 de Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local (LBRL) que disponen que la designación de tenencias de alcaldía es competencia de esta alcaldía, quien deberá proceder a su nombramiento, mediante decreto, de entre los miembros de la Junta de Gobierno Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Artículo. 20.1 a) de la LBRL y artículos 22 y 25 de la Ley 20/2006 (LMRLIB) que establecen que las tenencias de alcaldía son de existencia obligatoria en todos los municipios. Éstos serán entrega nombrados y cesados por el alcalde de entre los miembros de la Junta de Gobierno Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Artículos 46 a 48 del RD 2568/86, de 28 de noviembre (ROF) que establece que los nombramientos y ceses se harán mediante resolución del alcalde, de la que se dará cuenta al Pleno en la primera sesión que se celebre, y se notificará a los designados y se publicará en el BOIB sin perjuicio de su efectividad desde el día siguiente de la resolución, si a ésta no se establece otra cosa. El número de tenencias de alcaldía no podrá exceder del número de miembros de la Junta de Gobierno Local,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESUELVO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1r. Nombrar tenientes y tenientes de alcalde de este Ayuntamiento, con efectos del día de hoy, a los concejales-concejalas miembros de la Junta de Gobierno Local que a continuación se relacionan, los cuales sustituirán a esta alcaldía en los casos de vacante, ausencia o enfermedad y por el orden que se indica:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ol&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1er teniente de alcalde: SR. Antoni Simó Tomàs Canyelles&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2a teniente de alcalde: Maria Magdalena De La Fuente Ferrà&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3er teniente de alcalde: Catalina Maria Serra Vidal&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4a teniente de alcalde: Guillem Gabriel Crespí Barceló&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5 a teniente de alcalde: Antoni Caldés Gost&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ol&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2º. Establecer, a los efectos indicados en el apartado anterior, que cuando tenga que ausentarse esta alcaldía del término municipal, se determinará mediante decreto la duración de su ausencia y se designará a la tenencia de alcalde que deba asumir sus competencias . De no conferirse esta delegación expresamente, esta alcaldía será sustituida por el primer teniente de alcalde, y, en su defecto, por cualquiera de las demás tenencias de alcaldía establecidas, que se encuentren presentes, las cuales tendrán que dar cuenta de ello en el resto de la Corporación, sin que durante el mismo día pueda actuar como alcalde accidental más de uno de ellos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3er. Establecer, a los efectos indicados en el apartado anterior, que las tenencias de alcaldía deberán mantener informada a esta alcaldía del ejercicio de sus atribuciones como alcalde accidental, y no podrán, durante el citado ejercicio, ni modificar las delegaciones efectuadas por esta alcaldía con anterioridad, ni otorgar otras nuevas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4º. Comunicar esta resolución a todos los concejales/as afectados ya los jefes de los diferentes servicios municipales, para su conocimiento y efectos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5º. Dar cuenta de esta resolución al pleno en la sesión extraordinaria que se convoque para dar cumplimiento a lo que prevé el artículo 38.d) ROF.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6º. Publicar, de conformidad con el artículo 46.1 ROF, esta resolución en el Boletín Oficial de las Illes Balears, sin perjuicio de su efectividad desde el día de la resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7º. Difundir el contenido de esta resolución, de conformidad con el principio de transparencia, mediante su publicación actualizada y permanente en la sede electrónica municipal, en cumplimiento de lo dispuesto en los artículos 5 y siguientes de la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información y buen gobierno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
