    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Después de las elecciones del pasado día 28 de mayo de 2023, de acuerdo con el previsto en el artículo 64.5 del Estatuto de autonomía de las Islas Baleares (según la redacción dada por la Ley Orgánica 1/2007, de 28 de febrero, que lo reformó; en lo sucesivo EAIB) y los artículos 16 y 20 de la Ley 4/2022, de 28 de junio, de consejos insulares (LCI), el día 23 de junio de 2023 se constituyó el Consejo Insular de Ibiza y tomó posesión de su cargo su presidente, el cual dictó el Decreto núm. 467, de estructura de Gobierno y creación de Departamentos, y el Decreto núm. 472, de nombramiento de las personas miembros del Consejo Ejecutivo y de las vicepresidencias de la Corporación, ambos de fecha 28 de junio de 2023 (BOIB núm. 88, de 29 de junio de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La Ley 9/2017, de 8 de noviembre, de contratos del sector público, por la cual se trasponen al ordenamiento jurídico español las directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014, califica la mesa de contratación como un órgano de asistencia técnica especializada en la materia hacia los órganos de contratación de las administraciones públicas y que tiene que actuar de forma obligatoria en los casos que prevé la Ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La disposición adicional segunda (Competencias en materia de contratación en las entidades locales) de la dicha Ley 9/2017, de 8 de noviembre, prevé en su apartado 7 que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;"La mesa de contratación tiene que estar presidida por un miembro de la corporación o un funcionario de esta, y tienen que formar parte, como vocales, el secretario o, en su caso, el titular del órgano que tenga atribuida la función de asesoramiento jurídico, y el interventor o, en su caso, el titular del órgano que tenga atribuidas la función de control económico presupuestario, así como los otros que designe el órgano de contratación entre el personal funcionario de carrera o personal laboral al servicio de la corporación, o miembros electos de esta, sin que su número, en total, sea inferior a tres. Los miembros electos que, si se tercia, formen parte de la mesa de contratación no pueden suponer más de un tercio del total de miembros de esta. Tiene que actuar como secretario un funcionario de la corporación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;(...)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La composición de la mesa se tiene que publicar en el perfil de contratante del órgano de contratación correspondiente. Se pueden constituir mesas de contratación permanentes".&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;De acuerdo con estas previsiones, resulta ahora oportuno nombrar las personas, titular y suplente, que tengan que presidir las mesas de contratación del Consejo Insular de Ibiza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo el anterior, en uso de las facultades que tengo conferidas,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;DECRETO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Designar como presidente titular de las mesas de contratación al Sr. Mariano Juan Colomar, vicepresidente primero y consejero ejecutivo del Departamento de Territorio, Ordenación Turística, Movilidad, Infraestructuras Viarias y Lucha contra el Intrusismo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGUNDO&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Designar como presidentes suplentes de las mesas de contratación las siguientes personas:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Suplente 1º: el Sr. Salvador Losa Marí, consejero ejecutivo del Departamento de Presidencia, Hacienda, Gestión Económica y Deportes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Suplente 2ª: Sra. Marilina Ribas Cardona, consejera ejecutiva del Departamento de Juventud, Participación Ciudadana y del Parque Insular de Servicios de “Sa Coma”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;TERCERO&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Dar cuenta del presente decreto en el primer Pleno que se celebre, y publicarlo en el Boletín Oficial de las Islas Baleares (BOIB) y en el perfil del contratante de la Corporación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CUARTO&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. Quedan derogadas todas las disposiciones de rango igual o inferior que se opongan al que establece este decreto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
