&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El día 9 de marzo de 2023 se publicó en el portal corporativo del Servicio de Salud de las Illes Balears y en el Boletín Oficial de las Illes Balears núm. 30 la Resolución del Director Gerente de Atención Primaria de Mallorca de 27 de febrero de 2023 por la que se convoca la provisión, por el sistema de concurso específico de méritos, del puesto de trabajo de Jefe/a de Grupo de Selección y Provisión de personal sanitario A2, B, C1 y C2 de la plantilla orgánica autorizada de la Gerencia de Atención Primaria de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El día 23 de mayo de 2023 se publicó en el portal corporativo del Servicio de Salud de las Illes Balears la Resolución del Director Gerente de Atención Primaria de Mallorca por la que se aprueba la lista provisional de personas admitidas y excluidas, con la causa de exclusión, de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. El día 8 de junio de 2023 se publicó en el portal corporativo del Servicio de Salud de las Illes Balears la Resolución del Director Gerente de Atención Primaria de Mallorca por la que se aprueba la lista definitiva de personas admitidas y excluidas, con la causa de exclusión, y la lista provisional de puntuaciones obtenidas por las personas admitidas de la convocatoria, y se abrió un plazo de siete días hábiles a contar desde el siguiente al de la fecha de publicación para presentar alegaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Dentro de este plazo de siete días hábiles a contar desde el siguiente al de la fecha de publicación de la resolución citada en el punto anterior para presentar alegaciones, presentó alegaciones la señora Maria Juana Amengual Serra.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. El día 27 de junio de 2023 se reunió la Comisión de Valoración de la convocatoria a los efectos de analizar, estudiar y valorar las alegaciones presentadas por la señora María Juana Amengual Serra y adoptó, entre otros, los siguientes acuerdos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“1) Proponer al órgano convocante que estime parcialmente las alegaciones presentadas por la señora María Juana Amengual Serra en el sentido de valorarle su título de Técnica Superior en Secretariado con 3 puntos, de conformidad con el punto 4.1.d y 4.2 del baremo de méritos de la convocatoria, por los motivos antes mencionados (especialmente por la relación entre este título y la rama de conocimiento de enseñanzas universitarias de grado de ciencias sociales y jurídicas establecida en el Real Decreto 1618/2011, de 14 de noviembre, sobre reconocimiento de estudios en el ámbito de la educación superior).&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;La valoración de este título supone que se deje de valorar su título de bachiller en la modalidad de Humanidades y Ciencias Sociales, ya que, de conformidad con el punto 4.2.d del baremo de méritos de la convocatoria, solo se valora la titulación de nivel más alto que se acredita, cuya puntuación no se acumula a la de otras titulaciones que se posean.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2) Proponer al órgano convocante que desestime el resto de alegaciones presentadas por la señora María Juana Amengual Serra respecto a la valoración de diversos cursos&amp;nbsp; de formación per no estar relacionados directamente con las funciones propias del puesto convocado y no pertenecer a las áreas que, de conformidad con el punto 4.4.d del baremo de méritos de la convocatoria, se consideraba que lo estaban (Recursos Humanos, Gestión de Personal, Selección y Provisión, SAP RRHH Ib-Salut, Seguridad Social y Tributación, i Jurídico-administrativa) y, respecto de dos cursos de formación concretos, por estar repetidos y ya haber sido valorados los de mayor duración.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;3) Proponer al órgano convocante, consecuentemente con lo anterior, que modifique la lista provisional de puntuaciones obtenidas por las personas admitidas de la convocatoria, publicada en el portal corporativo del Servicio de Salud de las Illes Balears el día 8 de junio de 2023, en el sentido siguiente:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Disposición transitoria segunda de la Ley 4/2016, de 6 de abril, de medidas de capacitación para la recuperación del uso del catalán en el ámbito de la función pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Resolución del Director General del Servicio de Salud de las Illes Balears de 29 de marzo de 2023 de modificación de la plantilla orgánica de personal estatutario de la Gerencia de Atención Primaria de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Dar conformidad a las diversas propuestas de la Comisión de Valoración de la convocatoria, acordadas en la sesión de 27 de junio de 2023, referidas en el hecho quinto anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Adjudicar la provisión, por el sistema de concurso específico de méritos, del puesto de trabajo de Jefe/a de Grupo de Selección y Provisión de personal sanitario A2, B, C1 y C2 de la plantilla orgánica autorizada de la Gerencia de Atención Primaria de Mallorca a la señora María Juana Amengual Serra, con D.N.I. ***2751*M.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La persona designada debe tomar posesión del puesto adjudicado dentro del plazo máximo de un mes a partir del día siguiente de la publicación de la resolución definitiva del concurso en el BOIB. En aquellos casos en que la persona adjudicataria lo solicite y siempre que se justifique debidamente, el órgano convocante puede conceder una prórroga del citado plazo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Si, por cualquier motivo, la persona designada no toma posesión del puesto adjudicado, el órgano competente para resolver podrá, si procede, designar la persona candidata que, después de la valoración de méritos, la siguiera por orden de puntuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La persona nombrada no podrá participar en los concursos de provisión de puestos durante un plazo mínimo de dos años a contar desde el día en que toma posesión del puesto, excepto en los supuestos de remoción o supresión del puesto de trabajo, de redistribución de efectivos u otros supuestos de movilidad forzosa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Los efectos económicos y administrativos del nombramiento solo se producirán una vez se haya efectuado la toma de posesión del puesto adjudicado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Publicar esta resolución en el portal corporativo del Servicio de Salud de las Illes Balears y en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta resolución, que no agota la vía administrativa, se puede interponer un recurso de alzada ante el Director General del Servicio de Salud de las Illes Balears en el plazo de un mes a contar desde el día siguiente a la publicación, de acuerdo con el artículo 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 58 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
