El 3 de julio de 2021 se publicó la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES&nbsp;III)<strong><em> </em></strong>mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021</span>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La Dirección General de Energía y Cambio Climático concedió una subvención a las personas o entidades que figuran en el anexo de esta Propuesta en el marco de la convocatoria <span style="color:black">para actuaciones de apoyo a la movilidad eléctrica.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las personas o entidades que figuran en el anexo han aportado la documentación requerida para la justificación de la realización de las actuaciones subvencionadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Los técnicos de la Dirección General de Energía y Cambio Climático han examinado la documentación aportada y han emitido un informe desfavorable a la justificación de los expedientes descritos en el anexo con la motivación que figura en este anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El consejero de Transición Energética, Sectores Productivos y Memoria Democrática es el órgano competente para resolver este procedimiento, dada la estructura orgánica de Gobierno de las Illes Balears y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Decreto Legislativo&nbsp;2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones (BOIB n.º&nbsp;196, de 31 de diciembre de 2005).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB n.º&nbsp;72, de 24 de mayo de 2008).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES&nbsp;III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOIB n.º&nbsp;88, de 3 de julio de 2021).</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Propuesta de resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Propongo al consejero de Transición Energética, Sectores Productivos y Memoria Democrática que dicte una resolución en los siguientes términos:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Revocar la concesión de las&nbsp; subvenciones detalladas en el anexo y por los importes que en él se indican.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autorizar y disponer negativamente el gasto a favor de los beneficiarios por los importes detallados en el anexo,&nbsp; con cargo a la partida presupuestaria también indicada en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Declarar concluido el procedimiento y, por tanto, archivar los expedientes indicados en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Publicar esta Propuesta en el <em>Boletín Oficial de las Illes Balears</em>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta Propuesta se dicta dentro del ejercicio de la gestión ordinaria de la consejería y bajo una convocatoria que fue aprobada antes de la celebración del proceso electoral.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Propuesta de resolución puede alegar lo que considere conveniente en el plazo máximo de diez días hábiles, contadores desde el día siguiente de su publicación en el <em>Boletín Oficial de las Illes Balears</em>.
