    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 21 de diciembre de 2018, por la cual se convocan, para el año 2018, subvenciones para inversiones en la prevención de los daños causados en los bosques por incendios forestales, desastres naturales y catástrofes, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;Boletín Oficial de las Illes Balears&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;&amp;nbsp;de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0,0000pt; text-align:justify"&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="line-height:120%"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;"&gt;&lt;span style="font-size:11,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;span style="color:#212121"&gt;&lt;span&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 30/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Presenta una memoria de actuación en la que indica que dispondrá de una licencia de tala o aprovechamiento de recursos silvestres autorizada por la Administración forestal. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Tms Rmn&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;5. Dada la Resolución de concesión de la ayuda mencionada, y de acuerdo con lo que establece el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido y en justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Tms Rmn&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;6. Dentro del plazo legalmente establecido para la justificación de las inversiones aprobadas, la persona interesada presenta la solicitud de pago así como la documentación exigida, pero, una vez examinada esta solicitud de pago, se comprueba que no dispone de plan de gestión o de aprovechamiento forestal y según el quinto apartado de la convocatoria, Intensidad y límite de las subvenciones, donde dice que La intensidad de la ayuda es del 80% de los gastos elegibles. En el caso de disponer de planes de gestión o aprovechamiento forestal, la intensidad será del 85% de la ayuda, sólo le corresponde un 80% de ayuda por importe de 16.000,00€ y se tendrán que revocar 1.000,00 €. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Tms Rmn&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;7.&amp;nbsp;El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Procede la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas”. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span&gt;&lt;span&gt;&lt;span&gt;&lt;span style="font-family:&amp;quot;Tms Rmn&amp;quot;"&gt;&lt;em&gt;&lt;span style="font-size:12,0000pt"&gt;&lt;span style="font-family:'Times New Roman'"&gt;&lt;em&gt;8. En fecha 11 de octubre de 2021 se notifica a la persona interesada, mediante la publicación en la web, el informe propuesta provisional de revocación parcial de 7 de octubre de 2021 en la que se determina que una vez revisado de oficio dicho expediente no dispone de plan de gestión o de aprovechamiento forestal. Transcurrido el plazo de 10 días hábiles para presentar las correspondientes alegaciones y no habiendo presentado alegación alguna y/o las presentadas no han sido estimadas por el servicio gestor, se procede a dictar resolución. &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
