    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;El Decreto 62/2011, de 20 de mayo, por el que se regulan las modalidades de colaboración en las actividades formativas y en los procesos selectivos y de provisión organizados por la Escuela Balear de Administración Pública, y se aprueba el baremo de las indemnizaciones que se derivan, en su artículo 39 establece que las personas representantes de las organizaciones sindicales pueden asistir, ejerciendo las funciones de vigilancia para velar por el buen desarrollo de los procesos selectivos, previstas en el artículo 51 de la Ley 3/2007.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;La Directora General de Personal Docente de acuerdo con el apartado 1. a) de la Resolución del Consejero de Educación y Formación Profesional de 19 de marzo de 2021 de delegación de determinadas competencias en materia de gestión de personal en la Directora General de Personal Docente (BOIB núm. 41, de 25 de marzo), es competente para dictar la presente Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Primero&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;. Nombrar como personal colaborador, en la vigilancia del buen funcionamiento del proceso selectivo necesario para el desarrollo de las pruebas, a los miembros de las organizaciones sindicales que lo han solicitado y se relacionan a continuación: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Segundo&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;. Indicar que tal como establece el artículo 39 del Decreto mencionado este personal colaborador puede asistir, sin voz ni voto, a la constitución del tribunal, a la realización de las diferentes pruebas selectivas, a las sesiones de revisión de las puntuaciones de ejercicios y méritos, con citación previa de las personas que lo hayan solicitado, como también a las de publicación de las listas de puntuaciones de ejercicios y méritos y, en general, a las que no sean de deliberación del tribunal, sin perjuicio de sus facultades de solicitar información sobre diferentes aspectos del procesos selectivo y de ejercer su derecho a presentar quejas, denuncias y alegaciones que consideren oportunas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Por otra parte, los tribunales deben facilitar la labor de las personas representantes sindicales en el desarrollo de sus funciones, sin que ello afecte la agilidad del proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="line-height:115%"&gt;Tercero. &lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif; line-height:115%"&gt;Informar que el personal colaborador debe percibir la indemnización diaria por sesión y día que se indica en el anexo 10 del&amp;nbsp; Decreto 62/2011, siempre que la persona que ejerza la presidencia del tribunal certifique que han asistido a la sesión completa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Cuarto. &lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt;Publicar esta Resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Contra esta Resolución, que agota la vía administrativa, las personas interesadas pueden interponer un recurso potestativo de reposición ante la Directora General de Personal Docente en el plazo de un mes contador desde el día siguiente de haberse publicado en el &lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y los artículos 25.5 y 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;También pueden interponer un recurso contencioso administrativo ante la Sala Contenciosa Administrativa del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contadores desde el día siguiente de haberse publicado en el &lt;/span&gt;&lt;em style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;, de acuerdo con los artículos 10 y 46 de la Ley 29/1998, de 13 de julio, Reguladora de la Jurisdicción Contenciosa Administrativa.&lt;/span&gt;&lt;/p&gt;
