    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Alcalde-Presidente en fecha 19 de junio de 2023, emitió el decreto n.º 219/2023, que dice lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;«Antecedentes de la resolución:&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.-&lt;/strong&gt; El artículo 21.3 de la ley 7/1985, de 2 de abril, reguladora de las bases de régimen local (LRBRL)&amp;nbsp;permite la delegación de funciones atribuidas al Alcalde por el artículo 21.1 en cualquier regidor, excepto las de convocar y presidir las sesiones del Pleno y de la Junta de Gobierno Local, decidir los empates con voto de calidad, la concertación de operaciones de crédito, la jefatura superior de todo el personal, la separación del servicio de los funcionarios y el despido del personal laboral, y las mencionadas a los párrafos a), e), j), k), l)&amp;nbsp;y&amp;nbsp;m) del mismo artículo 21.1.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.- &lt;/strong&gt;El Reglamento Orgánico Municipal del Ayuntamiento de Consell (ROM), aprobado el 16 de septiembre de 1986, establece en su artículo 22.2 la posibilidad de delegación específica en cualquier regidor de funciones de la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.-&lt;/strong&gt; El artículo 22.4 del ROM establece que las delegaciones para cometidos específicos comprenderán la dirección interna y la gestión de los servicios correspondientes. No obstante, la facultad de emitir actos administrativos que afecten a terceros estará reservada a la Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto.-&lt;/strong&gt; Por aplicación supletoria al que determine el ROM, el artículo 43.5 del Real Decreto 2568/1986, de 28 de noviembre, regula que podrán haber delegaciones específicas en cualquier regidor de tres tipos: relativas a un proyecto o asunto determinado, relativas a un determinado servicio, o relativas a un distrito o barrio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por todo esto, &lt;strong&gt;RESUELVO:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.- &lt;/strong&gt;Delegar en los siguientes regidores las atribuciones de Alcaldía de dirección interna y gestión de los servicios correspondientes, sobre estas materias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Promoción Económica, Ferias y mercados y Fiestas: Margarita Llabrés Deyà&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Educación y Cultura: Catalina Olmo Garcias&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Servicios Sociales, Igualdad, Participación ciudadana, Juventud y Personal: Sonia Daudén Carretero&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Mantenimiento de los servicios generales: Sebastià Company Julià&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Deportes: Manuel Arrom Torres&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Medio Ambiente y Sanidad: Bárbara Vachiano Arrom&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En cuanto a las materias referentes a Hacienda y Presupuestos, Policía y Seguridad y Urbanismo serán competencia del Alcalde-Presidente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt;- Las presentes delegaciones son relativas a un determinado servicio, estando reguladas por el artículo 22.4 del ROM y 43.5.b) del ROF, que supone la dirección interna y gestión de los servicios adscritos a cada materia, pero no incluye la potestad de emitir actos administrativos que afecten en terceros, que estará reservada a la Alcaldía o la Junta de Gobierno Local, según corresponda.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.-&lt;/strong&gt; Las presentes delegaciones se tendrán que ejercitar por los regidores delegados en los términos y dentro de los límites de esta delegación, no siente susceptibles de ser delegadas cabe otro órgano. En caso de ausencia, vacante o enfermedad del regidor delegado, la Alcaldía abogará automáticamente las potestades delegadas, como titular originario, sin necesidad de nueva resolución exprés.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto.-&lt;/strong&gt; Según el artículo 44.2 del Real Decreto 2568/1986, de 28 de noviembre (ROF), estas delegaciones tendrán efecto desde el día siguiente al de la fecha del presente decreto, y serán de carácter indefinido, sin perjuicio de la potestad de advocación por parte de la Alcaldía. Además, según el mismo artículo, se publicará este acuerdo en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quinto.-&lt;/strong&gt; Según el artículo 44.4 del Real Decreto 2568/1986, de 28 de noviembre (ROF), se dará cuenta de las delegaciones en la primera sesión del Pleno municipal que se celebre desde la fecha del presente acuerdo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Consell, en fecha de la firma electrónica&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;em&gt;(19 de junio&amp;nbsp;de 2023)&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;&lt;/em&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El alcalde&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Andreu Isern Pol &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
