&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El 1 de octubre de 2020 se publicó la convocatoria pública de subvenciones para actuaciones de apoyo en la movilidad eficiente y sostenible (Programa MOVES II) mediante resolución del consejero de Transición Energética y Sectores Productivos de 25 de septiembre de 2020.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Dirección General de Energía y Cambio Climático concedió una subvención a las personas o entidades que figuran en el anexo de esta Propuesta en el marco de la convocatoria para actuaciones de apoyo a la movilidad eléctrica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Las personas o entidades que figuran en el anexo no aportaron la documentación para la justificación de la realización de las actuaciones subvencionadas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Dirección General de Energía y Cambio Climático hizo un requerimiento a las personas o entidades que figuran en el anexo en el cual se les solicitaba la presentación de la documentación justificativa que acredite la realización de las actuaciones subvencionadas&amp;nbsp; y les concedía un plazo máximo de quince días hábiles para presentarla, además de informarles que, si no presentaban la documentación mencionada, se procedería a la revocación de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Una vez agotado el plazo para aportar la documentación requerida, las personas o entidades que figuran en el anexo no han presentado la documentación pendiente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El consejero de Transición Energética, Sectores Productivos y Memoria Democrática es el órgano competente para resolver este procedimiento de acuerdo con la estructura orgánica del Gobierno de las Islas Baleares y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la cual se establecen las bases reguladoras para la concesión de subvenciones en materia de energía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Decreto Legislativo 2/2005, de 28 de diciembre, por el cual se aprueba el Texto refundido de la Ley de subvenciones (BOIB nº 196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la cual se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB nº 72, de 24 de mayo de 2008).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La resolución del vicepresidente y consejero de Transición Energética y Sectores Productivos de 25 de septiembre de 2020 por la cual se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eficiente y sostenible (Programa MOVES II), (BOIB nº 169, de 1 de octubre de 2020).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Revocar la subvención a los beneficiarios que figuran en el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Declarar concluido el procedimiento y, por lo tanto, archivar los expedientes indicados en el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Publicar la presente Resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta resolución se dicta dentro del ejercicio de la gestión ordinaria de la consejería y bajo una convocatoria que fue aprobada antes de la celebración del proceso electoral.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes contado desde el día siguiente al de su publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contados desde el día siguiente al de la publicación de la resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
