    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;9.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 10 de julio de 2015 por la&amp;nbsp;que se convocan, subvenciones&amp;nbsp;para Inversiones en las explotaciones agrarias, correspondientes a los años 2015-2019, &amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1 de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de &amp;nbsp;1 de octubre, y&amp;nbsp;del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 12&amp;nbsp;de junio&amp;nbsp;de 2023, firmó la siguiente resolución, &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Entre otros beneficiarios hay ARISTÓTELES MERCADAL MASCARÓ, con NIF ***0984 **, y n&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;úm. de expediente INEA2016_1/163, con un plazo de ejecución de 12 meses.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. El 12 de junio de 2019, el interesado ARISTÓTELES MERCADAL MASCARÓ presentó una solicitud de subrogación, a favor de CICERÓN MERCADAL MASCARÓ, con DNI *** 0984 ** dentro del plazo requerido (RGE 16907) en la Delegación Comarcal de Maó, por el cambio de la titularidad de la explotación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. El 12 de junio de 2019, el interesado CICERÓN MERCADAL MASCARÓ presentó una solicitud de prórroga del plazo de ejecución (RGE 16908) en la Delegación Comarcal de Maó, por demoras en la concesión de permisos municipales. Se concedió una primera prórroga de 12 meses que finalizaba&amp;nbsp;el 26 de junio de 2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4. El 23 de junio de 2020, CICERÓN MERCADAL M&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ASCARÓ, con NIF ***0984**, presentó una solicitud de segunda prórroga del plazo de ejecución (RGE 15408) en la Delegación Comarcal de Maó del FOGAIBA, debido a la demora por parte del A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;j&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;untament de Maó.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;Se concedió la segunda prórroga de 12 meses que finalizaba el 9 de julio de 2021.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;5. El 1 de julio de 2021, CICERÓN MERCADAL MASCARÓ, con NIF *****0984**, presentó una solicitud de tercera prórroga del plazo de ejecución (RGE L95E272746) en la Delegación Comarcal de Maó del FOGAIBA, debido a la demora por parte del Ayuntamiento de Maó. Se concedió la tercera prórroga de 6 meses finalizada el 9 de enero de 2022. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;6. El 5 de enero de 2022, el interesado CICERÓN MERCADAL MASCARÓ ha presentado una solicitud de prórroga del plazo de ejecución (RGE GOIE6669), alegando que no ha podido realizar las inversiones solicitadas por demoras en la concesión de permisos municipales. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. El 19 de febrero de 2022, se publica en el BOIB número 27, en la resolución de denegación de la cuarta prórroga. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. El 8 de mayo de 2023, se publica en la WEB del FOGAIBA el requerimiento de la solicitud de pago de la ayuda concedida en el expediente INEA2016_1/163. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. El 26 de mayo de 2023, Juan Antonio Pons Pons, NIF ***0514**, en representación de Cicerón Mercadal Mascaró, presenta la solicitud de pago con número de registro REGAGE23e00033592799. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10. El 31 de mayo de 2023 se publica en la WEB del FOGAIBA la Notificación de deficiencias de la solicitud de pago, con un plazo de presentación de enmiendas de 10 días hábiles, este plazo termina día 14 de junio de 2023. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;11. El 8 de junio de 2023, Juan Antonio Pons Pons, NIF ***0514**, en representación de Cicerón Mercadal Mascaró, y dentro del plazo establecido, presenta una solicitud de prórroga del plazo de 10 días para subsanar las deficiencias notificadas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;12.El punto 1, del artículo 32 de la Ley 39/2015 del Procedimiento Administrativo Común de las Administraciones públicas dice: «La Administración, salvo precepto en contrario, podrá conceder de oficio o&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/a petición de los interesados, una ampliación de los plazos establecidos, que no exceda de la mitad de los mismos, si las circunstancias lo aconsejan y con ello no se perjudican derechos de tercero. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Orden del Conse&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ll&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;er de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Il&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;le&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s Balears 2014-2020.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;-Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Propuesta de Resolución de aceptación de prórroga&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
