&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Hechos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En fecha 31 de marzo de 2023, el director general de Atención a la Dependencia emitió un informe justificativo relativo a la necesidad de aprobar la convocatoria para concertar plazas de atención temprana en el ámbito de los servicios sociales de las Illes Balears, con entidades acreditadas para los años 2023, 2024, 2025, 2026 y 2027 &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Ley 1/2019, de 31 de enero, del Govern de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Ley 9/2019, de 19 de febrero, de la atención y los derechos de la infancia y la adolescencia de las Illes Balears, en concreto el artículo 36 que regula expresamente el derecho de los niños menores de 6 años a acceder al servicio de atención temprana de forma gratuita. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los que deben someterse los conciertos sociales. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. El Decreto 32/2023, de 26 de mayo, por el que se aprueba la Cartera básica de servicios sociales de las Illes Balears 2023-2027, se establecen principios generales para las carteras insulares y locales y se modifican diversas normativas de el ámbito social (BOIB núm.70, de 27 de mayo de 2023) &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. El Decreto 85/2010, de 25 de junio, por el que se regula la red pública y concertada de atención temprana en el ámbito de los servicios sociales de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. El Decreto 9/2019, de 2 de julio, de la presidenta de las Illes Balears, por el que se determina la composición del Govern y se establece la estructura de la Administración de la Comunitat Autònoma de les Illes Balears, mediante el cual se crea la Consejería de Asuntos Sociales y Deportes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. El Decreto 11/2021, de 15 de febrero, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. El Acuerdo del Consell de Govern de 6 de marzo de 2023 por el que se aprueba la previsión de las prestaciones y los servicios que deben concertarse durante el año 2023 y se declaran los servicios de interés económico general (BOIB nº 29, de 7 de marzo), modificado por el Acuerdo del Consell de Govern de fecha 24 de abril de 2023 (BOIB núm. 52, de 25 de abril), en cuanto a la previsión de sesiones y gasto del servicio de desarrollo infantil y atención temprana. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Establecer el procedimiento de tramitación de la convocatoria de la acción concertada del servicio de desarrollo infantil y atención temprana de la red pública y concertada de atención temprana en el ámbito de los servicios sociales de las Illes Balears, con entidades acreditadas, por en los años 2023, 2024, 2025, 2026 y 2027, de acuerdo con el anexo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Aplicar el procedimiento ordinario de convocatoria de acción concertada que prevén la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la Comunitat Autònoma de les Illes Balears, y el Decreto 48/2017 , de 27 de octubre, por el que se establecen los principios generales a los que deben someterse los conciertos sociales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;3. Aprobar el Pliego general de condiciones técnicas para la concertación de sesiones del servicio de desarrollo infantil y atención temprana de la red pública y concertada de atención temprana en el ámbito de los servicios sociales de las Illes Balears, con entidades acreditadas, por en los años 2023, 2024, 2025, 2026 y 2027, que se puede consultar en la Sede Electrónica de la CAIB &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;(https://www.caib.es/seucaib/ca/201/empreses/).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Publicar esta Resolución en el Boletín Oficial de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante la consejera de Asuntos Sociales y Deportes en el plazo de un mes a contar desde el día siguiente de la publicación de la Resolución, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico Administración de la Comunitat Autònoma de les Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También se puede interponer un recurso contencioso administrativo ante la Sala de lo Contencioso Administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de la Resolución, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;1. Objeto y ámbito de aplicación&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.1. Se establece el procedimiento de convocatoria de la acción concertada del servicio de desarrollo infantil y atención temprana de la red pública y concertada de atención temprana en el ámbito de los servicios sociales de las Illes Balears, para los años 2023, 2024, 2025 , 2026 y 2027, para entidades acreditadas, y se dicta al amparo de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.2. Se sujeta a este procedimiento la concertación estimada de 45.000 sesiones anuales de desarrollo infantil y atención temprana de la red pública y concertada de atención temprana de servicios sociales de las Illes Balears, dirigidas a la atención integral de los niños de 0 a 6 años que lo requieran, en el ámbito territorial de de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1.3. De acuerdo con el artículo 3.h) de la Ley 12/2018, también es objeto del concierto alcanzar el objetivo de igualdad de género y de innovación en la gestión de las entidades y servicios públicos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;​​​​​​​&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;2. Órgano instructor&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El órgano instructor del procedimiento será la Dirección General de Atención a la Dependencia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. Lugar y plazo de presentación de solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.1. El plazo para presentar las solicitudes es de diez días hábiles a contar desde el día siguiente a la publicación de esta convocatoria en el Boletín Oficial de las Illes Balears. A efectos de lo dispuesto en la cláusula 7.10 y la cláusula 9.1, las entidades que se quieran presentar, podrán hacerlo considerando que la entidad renuncia al concierto anterior a partir del día siguiente a la adjudicación del nuevo concierto, con fecha de inicio 1 de octubre de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3.2. Las solicitudes, debidamente cumplimentadas, deben presentarse en el registro electrónico de la Administración de la Comunitat Autònoma de les Illes Balears, dirigidas al Servicio de Valoración de Atención Temprana de la Consejería de Asuntos Sociales y Deportes, según los artículos 14.2 y 16.4 a) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;4. Requisitos de las entidades&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.1. Pueden presentar solicitudes para esta convocatoria de concierto aquellas entidades que cumplan uno o ambos requisitos siguientes: a) Aquellas entidades que dispongan de la correspondiente acreditación administrativa de Servicio de Desarrollo Infantil y Atención Temprana (SEDIAP) y dispongan de sesiones arraigadas mediante un concierto social cuya vigencia finalice el año 2023. b) Aquellas entidades que dispongan de la correspondiente acreditación administrativa de Servicio de Desarrollo Infantil y Atención Temprana (SEDIAP) y que dispongan de un centro de atención temprana acreditado durante los años 2021 y 2022 que supongan la ampliación de la red pública y concertada de atención temprana en el ámbito de los servicios sociales de las Illes Balears &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.2. Además de lo anterior, las entidades interesadas deberán cumplir los siguientes requisitos: a) Tener una experiencia mínima de 24 meses en la prestación de servicios de atención temprana en el ámbito de los servicios sociales de las Illes Balears. La experiencia sólo puede acreditarse con los documentos que establece el punto 5.3 apartado c), de esta convocatoria. b) Acreditar la disposición de los medios y recursos suficientes para garantizar el cumplimiento de las condiciones previstas en el acuerdo de acción concertada. Estos requisitos deben acreditarse mediante la presentación de los documentos que establece el punto 5.3, apartados d), e) y f) y h), de esta convocatoria. c) Acreditar el cumplimiento de cualquier otra normativa que, con carácter general o específico, les sea de aplicación, tanto por la naturaleza jurídica de la entidad como por el tipo de servicio objeto del concierto, mediante la presentación del documento que establece el punto 5.3, apartado j), de esta convocatoria. d) Comunicar los cambios de accionariado o titularidad, para preservar la identidad institucional que haya justificado el acuerdo de acción concertada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.3. Asimismo, las entidades deben cumplir los requisitos mínimos que se establecen en desarrollo del título VII de la Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears, así como los requisitos que fija el artículo 4 del Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los que deben someterse los conciertos sociales, y los requisitos que fija el artículo 5 de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.4. Visto lo que dispone el anexo II del Acuerdo del Consell de Govern de 6 de marzo de 2023 modificado, por el Acuerdo del Consell de Govern de fecha 24 de abril de 2023 (BOIB núm. 52, de 25 de abril ), el servicio de desarrollo infantil y atención temprana de la red pública y concertada de atención temprana en el ámbito de los servicios sociales de las Illes Balears es un servicio declarado de interés económico general, por lo que pueden suscribir conciertos todas las personas físicas o jurídicas de carácter privado, con o sin ánimo de lucro, cualquiera que sea la forma jurídica que adopten, que presten los servicios objeto del concierto, cumplan los requisitos previstos en esta convocatoria y presenten una solicitud en los plazos y la forma que se determine en esta convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;5. Documentación a presentar&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;5.1. Las entidades interesadas que cumplan los requisitos establecidos en el punto 4 de esta convocatoria deben formular una solicitud, de acuerdo con el modelo general, que debe firmar la persona representante legal de la entidad. Este modelo de solicitud se encuentra disponible en la Sede Electrónica de la CAIB&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt; &lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;(https://www.caib.es/seucaib/ca/201/empreses/). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.2. Las entidades deben presentar una solicitud independiente para cada SEDIAP, con indicación del número de sesiones que ofrezcan para concertar con la Administración, que no puede ser superior a las sesiones que tienen acreditadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.3. A la solicitud debe adjuntarse la siguiente documentación: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Resolución de autorización y acreditación del centro o centros y número de plazas de atención temprana para los que se presenta la solicitud de concertación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) Acreditación del carácter de entidad del tercer sector social a efectos del criterio de preferencia en la selección, de acuerdo con el artículo 6.4 de la Ley 12/2018. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Declaración responsable de la entidad en relación a la experiencia en la prestación del servicio de atención temprana acompañada del primer concierto firmado con la consejería competente en materia de servicios sociales. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) Declaración responsable de que la entidad no está sometida a las prohibiciones de contratar con la Administración en virtud de sanción administrativa firme, de conformidad con la Ley 38/2003, de 17 de noviembre, general de subvenciones, o la Ley 58/ 2003, de 17 de diciembre, general tributaria, y de acuerdo con el artículo 71 de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, ni en ninguno de los supuestos de prohibición por ser beneficiaria de subvenciones, establecidos en los apartados 1 y 2 del artículo 10 del Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones; así como de no incurrir en la prohibición que establece el artículo 11 de la Ley 11/2016, de 28 de julio de igualdad de mujeres y hombres, y declaración de no haber sido sancionada por resolución firme en los últimos cuatro años por la comisión de infracciones graves o muy graves en materia de relaciones laborales, empleo, empresas usuarias de trabajo temporal, seguridad social, emigración, movimientos migratorios y trabajo de extranjeros. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;e) Acreditación de solvencia financiera, según el documento disponible en la Sede Electrónica de la CAIB &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;(https://www.caib.es/seucaib/ca/201/empreses/). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;f) Acreditación de solvencia técnica, según el documento disponible en la Sede Electrónica de la CAIB &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:null"&gt;&lt;span style="background-color:null"&gt;(https://www.caib.es/seucaib/ca/201/empreses/). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;g) Certificados de la Tesorería General de la Seguridad Social y de la Agencia Estatal de la Administración Tributaria que indiquen que la entidad solicitante está al corriente en el pago de las obligaciones con la Seguridad Social y de las obligaciones tributarias ante la Administración estatal, en caso de que la persona interesada se oponga expresamente a que la administración pueda consultar y obtener estos datos &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;h) Acreditación de la titularidad del equipamiento o centro donde se lleva a cabo el servicio, o de disponibilidad por cualquier título jurídico válido, por un período no inferior a la vigencia del concierto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;i) Declaración, firmada por la dirección del servicio, de que la entidad mantiene vigentes todos los requisitos que condujeron a la acreditación sobre la totalidad de plazas autorizadas y acreditadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;j) Declaración, firmada por la persona responsable de la entidad, de que el servicio cumple con la normativa general o específica aplicable, tanto por la naturaleza jurídica de la entidad como por el tipo de servicio objeto de concertación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5.4. La presentación de la solicitud supone que la entidad autoriza a los técnicos de la Dirección General de Atención a la Dependencia para que puedan pedir a otras administraciones cualquier documentación, datos e informes que consideren necesarios para tramitar el expediente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;6. Criterios de preferencia&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.1. Si la disponibilidad presupuestaria es suficiente para atender a todas las sesiones solicitadas, se adjudicarán directamente a las entidades solicitantes. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6.2. En caso de que no exista la disponibilidad presupuestaria suficiente para atender toda la demanda para el servicio de desarrollo infantil y atención temprana, objeto del concierto, la selección de las entidades se basará en los siguientes criterios: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) El arraigo de la persona en el entorno de atención y las condiciones de atención que requiere. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b) La implantación en la localidad donde debe prestarse el servicio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) La libre elección y la lista de espera de acceso al servicio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d) En caso de empate entre entidades con ánimo de lucro y entidades sin ánimo de lucro, siempre que existan análogas condiciones de eficacia, calidad y costes, así como de eficiencia presupuestaria, tendrán preferencia por formalizar los acuerdos de acción concertada las entidades del tercer sector social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;7. Tramitación del procedimiento de concertación y formalización&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.1. Los servicios técnicos de la Dirección General de Atención a la Dependencia deben examinar las solicitudes y la documentación adjunta para que el órgano instructor pueda determinar si cumplen los requisitos que establece la convocatoria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.2. El órgano instructor, una vez revisadas las solicitudes y la documentación adjunta exigida en el punto 5 de esta convocatoria, debe realizar los requerimientos necesarios a las entidades cuyas solicitudes no incluyan la documentación acreditativa del cumplimiento de los requisitos, para que, en el plazo de diez días hábiles, subsanen el defecto o aporten la documentación que falta, con la indicación de que, si no lo hacen, se considerará que desisten de su solicitud, previa resolución que se debe dictar en los términos que dispone el artículo 21 de la Ley 39/2015. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.3. Una vez subsanadas las solicitudes, debe comprobarse si la cantidad y la oferta que contienen se ajustan al importe y la demanda de la Administración pública. Así, si el importe presupuestado resulta suficiente para atender a todas las solicitudes en los términos presentados, el órgano competente (la Consejería de Asuntos Sociales y Deportes otorgará directamente a cada entidad solicitante el concierto en estos términos). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.4. En caso de que no exista la disponibilidad presupuestaria suficiente para atender toda la oferta para el servicio, el órgano instructor debe aplicar los criterios de preferencia que prevé el punto sexto de esta convocatoria. Dado que se trata de un servicio declarado de interés económico general en el que pueden participar entidades privadas con ánimo de lucro, siempre que existan análogas condiciones de eficacia, calidad y costes, así como de eficiencia presupuestaria, para formalizar los acuerdos de acción concertada tendrán preferencia las entidades del tercer sector de acción social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.5. En caso de que la propuesta del órgano instructor sea parcial o totalmente denegatoria, la entidad interesada dispondrá de un plazo de diez días hábiles, desde el día siguiente de la notificación de la propuesta, para alegar lo que convenga al derecho. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.6. El órgano instructor elaborará la propuesta definitiva de los conciertos solicitados y la elevará a la consejera de Asuntos Sociales y Deportes para la correspondiente resolución. Esta resolución debe notificarse a las personas interesadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.7. Este procedimiento de concertación debe resolverse en el plazo de tres meses a contar desde el día siguiente de la entrada de la solicitud en el registro correspondiente. Si en el plazo indicado no se ha dictado resolución expresa, se entenderá que la solicitud ha sido desestimada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.8. En caso de que una misma entidad haya presentado dos o más solicitudes por los diferentes centros de desarrollo infantil y atención temprana de acuerdo con lo que establece el punto 5.2. de esta convocatoria, se podrán acumular en un mismo expediente y resolver conjuntamente todas las sesiones solicitadas por la propia entidad. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.9. Los conciertos que se establecen al amparo de esta convocatoria deben formalizarse mediante un documento administrativo denominado acuerdo de acción concertada, que debe incluir necesariamente las estipulaciones mencionadas en el artículo 8 de la Ley 12/2018 y demás condiciones exigidas por la legislación vigente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7.10. Si una de las entidades solicitantes dispusiera de un concierto en vigor que finalizara el año 2023, se considerará que la entidad renuncia al concierto anterior a partir del día siguiente a la firma del nuevo concierto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;8. Sesiones y distribución territorial&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.1. La previsión del número aproximado de sesiones/año a concertar es de 45.000 (o la parte proporcional), con una previsión máxima total durante la vigencia del concierto de 180.000 sesiones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.2. Estos conciertos se pueden ampliar de acuerdo con lo que prevén la Ley 12/2018 y el Decreto 48/2017, de 27 de octubre, por el que se establecen los principios generales a los que deben someterse los conciertos sociales, y teniendo en cuenta el procedimiento previsto en el artículo 23.3 del Decreto 48/2017. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8.3. Las sesiones se repartirán en el territorio de las Illes Balears de acuerdo con las solicitudes presentadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;9. Vigencia del concierto&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.1.El concierto estará vigente desde el 1 de octubre de 2023 hasta el 30 de septiembre de 2027. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9.2. Estos conciertos se pueden renovar de acuerdo con lo que prevén la Ley 12/2018 y el Decreto 48/2017. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;10. Presupuesto y precio máximo del servicio&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.1. El importe máximo estimado a asignar es de 7.759.105,12 € (exento de IVA), a distribuir entre los ejercicios presupuestarios 2023, 2024, 2025, 2026 y 2027. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.2. En cualquier caso, este valor estimado tiene carácter orientativo y no vinculante. El gasto real quedará limitado por el número total de sesiones que ofrezcan las entidades y por los servicios que efectivamente requiera la Administración. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.3. Este importe se indica únicamente a efectos de publicidad y no supone ningún compromiso de gasto. Por ello, no consta ninguna consignación presupuestaria, que debe acreditarse en el momento en que se materialice el servicio de concierto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10.4. El precio de referencia máximo por sesión es de 42,37 € para el año 2023 y 43,16 € a partir del año 2024, teniendo en cuenta, de acuerdo con la Resolución de la consejera de Asuntos Sociales y Deportes de fecha 13 de octubre de 2022 (BOIB núm. 135, de 18 de octubre de 2022) por la que se actualizan los precios de los servicios concertados, dado el contenido del acuerdo sectorial en materia salarial para centros especiales de ocupación y centros de atención especializada de las Illes Balears, incluidos en el Convenio colectivo estatal de centros y servicios de atención a personas con discapacidad, por el que se amparan los servicios concertados. En esta Resolución se aprueba la actualización de precios de los servicios concertados de los servicios de tutela judicial, atención temprana, apoyo tecnológico para la autonomía personal, acompañamiento sordoceguera, acompañamiento de personas con discapacidad física, vivienda supervisada, salud mental, soporte la vivienda en sus diferentes intensidades y servicio ocupacional para salud mental durante los años 2022, 2023 y 2024. Por otra parte, en el apartado segundo de esta resolución se indica que estos precios deben aplicarse desde el 1 de enero de 2022. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Comité Técnico de Asesoramiento&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.1. El Comité Técnico de Asesoramiento se reunirá cuando sea necesario ofrecer asesoramiento al director general de Atención a la Dependencia en relación con el procedimiento de concertación y sobre las condiciones específicas que se refieran al servicio objeto del concierto, así como para ejercer el resto de funciones señaladas en el artículo 15 del Decreto 48/2017. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.2. El Comité Técnico de Asesoramiento que se reunirá estará integrado por los siguientes miembros: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a) Presidente: el jefe del Servicio de Valoración de Atención Temprana.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c) Secretaria: la jefa de la Sección XI de la Dirección General de atención a la Dependencia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Secretaria suplente: la técnica administrativa del Servicio de Valoración de Atención Temprana.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11.3. El Comité Técnico de Asesoramiento quedará válidamente constituido con la asistencia, como mínimo, de los siguientes miembros: el presidente o presidente suplente, la secretaria o secretario suplente y tres vocales. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;12. Condiciones técnicas de ejecución&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.1. Las condiciones técnicas de ejecución deben ajustarse al Decreto 85/2010, de 25 de junio, por el que se regula la red pública y concertada de atención temprana en el ámbito de los servicios sociales de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.2. El Pliego general de condiciones técnicas detalla la acción concertada, las características concretas de la población por atender, el sistema de facturación, el régimen de realización con medios ajenos, las penalizaciones que deben aplicarse en caso de incumplimiento del entidad, los requisitos de calidad de la actividad, los aspectos técnicos y económicos que se pueden modificar a lo largo de la ejecución del concierto y los sistemas de seguimiento y control del concierto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12.3. Las aplicaciones informáticas del Servicio de Valoración de Atención Temprana son las únicas válidas para gestionar las sesiones y para cualquier uso aplicable que se derive de la ejecución de este concierto. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;13. Seguimiento&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13.1. Los técnicos del servicio de desarrollo infantil y atención temprana son los responsables del seguimiento de los casos atendidos, y deben coordinarse Servicio de Valoración de Atención Temprana y los servicios sociales comunitarios básicos, de salud y educativos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13.2. Los técnicos del Servicio de Valoración de Atención Temprana pueden realizar visitas de comprobación del funcionamiento del servicio y requerir documentación cuando lo consideren necesario. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13.3. La entidad concertada debe facilitar las actuaciones de seguimiento y comprobación que lleve a cabo la Dirección General de Atención a la Dependencia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13.4. Asimismo, la entidad concertada debe facilitar toda la información que le requieran el órgano instructor, la Intervención General de la Comunitat Autònoma de les Illes Balears, la Sindicatura de Cuentas u otros órganos de control externo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;14. Obligaciones de las entidades concertadas&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14.1. El Pliego general de condiciones técnicas establece las obligaciones de las entidades concertadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14.2. Las entidades concertadas quedan sometidas a las obligaciones de control que pueden afectar al plan de cuentas y al sistema contable, así como a los sistemas de información, el control de calidad, la auditoría de cuentas y las auditorías de protección de datos. En todo caso, debe preservarse el modelo de gestión privada del servicio y su identidad corporativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14.3. Las entidades quedan sometidas a las actuaciones que determine la Dirección General de Atención a la Dependencia en lo que se refiere a las condiciones técnicas y la evaluación de la calidad del servicio, así como a los procesos de seguimiento ya los controles económicos y administrativos que se vayan adoptante para cumplir la acción concertada. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;15. Penalizaciones&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de las condiciones previstas para la prestación del servicio puede dar lugar a la imposición de penalizaciones, de acuerdo con el pliego general de condiciones técnicas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;16. Criterios de acceso de los niños y lista de espera&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Los criterios de acceso de los niños y la gestión de la lista de espera se recogen en el Decreto 85/2010, de 25 de junio, por el que se regula la red pública y concertada de atención temprana en el ámbito de los servicios sociales de las Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;17. Publicidad&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;17.1. Las entidades de iniciativa privada acogidas al concierto social, junto con su denominación, deben hacer constar en la documentación, en todas las comunicaciones (informes, hojas, documentos, trípticos de difusión, mensajes electrónicos, webs, inserciones en prensa, artículos en periódicos y revistas especializadas) y en la publicidad la condición de entidad perteneciente a la red pública y concertada de atención temprana en el ámbito de los servicios sociales de las Illes Balears, según las indicaciones del Manual de identidad corporativa que les facilitará la Administración, siempre con el visto bueno de la Consejería de Asuntos Sociales y Deportes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;17.2. Las entidades de iniciativa privada acogidas al régimen de concierto social deben colocar en un lugar visible de sus instalaciones la indicación “Servicio de desarrollo infantil y atención temprana concertado con el Gobierno de las Illes Balears” con el logotipo correspondiente , que les proporcionará la Consejería de Asuntos Sociales y Deportes. Asimismo, debe hacerse referencia a esta circunstancia en las comunicaciones y en las relaciones que establezcan por escrito con las personas usuarias de las sesiones concertadas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;17.3. Los acuerdos de acción concertada deben publicarse en el Boletín Oficial de las Illes Balears, de conformidad con lo que establece la letra f) del artículo 3 de la Ley 12/2018, y en el portal de transparencia de de acuerdo con el apartado g) del artículo 3 de la Ley 12/2018. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;18. Prerrogativas de la Administración&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;18.1. El órgano competente para resolver el procedimiento de concertación tiene la prerrogativa de interpretarlo, resolver las dudas que surjan durante el cumplimiento, modificarlo por razones de interés público, acordar su resolución y determinar sus efectos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;18.2. Los acuerdos que adopte el órgano competente para resolver el procedimiento a partir de las citadas prerrogativas ponen fin a la vía administrativa y serán inmediatamente ejecutivos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;19. Causas de extinción&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Son causas de extinción del concierto social las que establece el artículo 9 de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la Comunitat Autònoma de les Illes Balears. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;20. Jurisdicción competente&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La jurisdicción contencioso-administrativa es la competente para resolver las cuestiones litigiosas relativas a la formalización de este concierto y también las surgidas entre las partes sobre la interpretación, modificación, cumplimiento, efectos y extinción. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
