674616 490 CAIB ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. El 3 de julio de 2021, se publicó la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES&nbsp;III)<strong><em> </em></strong>mediante la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021, modificada por la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 3 de agosto de 2022 (BOIB núm. 103, de 6 de agosto de 2022).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La Dirección General de Energía y Cambio Climático concedió una subvención a las personas o entidades que figuran en el anexo de esta resolución en el marco de la convocatoria <span style="color:black">para actuaciones de apoyo a la movilidad eléctrica.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Las personas o entidades que figuran en el anexo aportaron la documentación requerida para la justificación de la realización de las actuaciones subvencionadas.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. El técnico de la Dirección General de Energía y Cambio Climático examinó la documentación aportada y emitió un informe desfavorable a la justificación de los expedientes descritos en el anexo con la motivación que figura en este anexo.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">5. El 3 de mayo de 2023, se emitió una propuesta de revocación de la subvención del director general de Energía y Cambio Climático (BOIB n.º 60, de 11 de mayo de 2023).</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">6. En fecha 26 de mayo de 2023, Vicente Tur Ribas, titular del expediente MOVESIII-1989/2021, presentó un escrito de alegaciones contra la propuesta de revocación mencionada en el punto anterior, en la que se propone revocar la subvención concedida a Vicente Tur Ribas por el motivo siguiente: </span><em>«Cambio del objeto de la subvención. Cambio de modelo y motorización del vehículo, de eléctrico en la solicitud a híbrido enchufable en la justificación.»</em></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">7. En el escrito de alegaciones el señor Vicente Tur Ribas expone:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:black">&nbsp;«Que el pasado28/06/2022 presenté la solicitud de MOVES III para vehículo eléctrico con número de expediente MOVESIII-1989/2021.</span></em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:white"><span style="color:black">Que en fecha 6/10/2022 se publicó la propuesta de resolución por un importe de 70000€.</span></span></em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:white"><span style="color:black">Que en diciembre de 2022 de cambio el vehículo por uno híbrido enchufable porque el que se había solicitado primero tardaba más de un año en llegar.</span></span></em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:white"><span style="color:black">Que en su momento nos comunicamos telefónicamente con un técnico y nos indico que presentado un escrito indicando el cambio de vehículo no era necesario solicitar la ayuda de nuevo ya que la cantidad era menor.</span></span></em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:white"><span style="color:black">Que, junto con la documentación de la segunda parte, en el certificado de pagos, se indicó el citado cambio.</span></span></em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:white"><span style="color:black">Que la cantidad correspondiente a la ayuda por vehículo híbrido enchufable con achatarramiento es de 5000€ y que está de acuerdo en la disminución de la cantidad otorgada en primera instancia.</span></span></em></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><em><span style="background-color:white"><span style="color:black">SOLICITO:</span></span></em></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:white"><span style="color:black">Que se tenga en cuenta el presento escrito y se cambie la cantidad otorgada.»</span></span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">8. En fecha 31 de mayo de 2023, una vez revisada la documentación, se emitió un informe técnico en el que se informa desfavorablemente a las alegaciones presentadas por Vicente Tur Ribas. Este informe concluye: «Una vez valoradas las alegaciones presentadas y dado que la documentación incumple el apartado decimocuarto a) y b)de la convocatoria pública de referencia se informa DESFAVORABLEMENTE la alegación a la revocación de la solicitud de la subvención y se propone la revocación de la ayuda por la adquisición de vehículo eléctrico.»</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El artículo </span><em>14</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> (obligaciones de los beneficiarios) letras </span><em>a) y b)</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> de la convocatoria de referencia establece que:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los beneficiarios de este tipo de ayudas quedan obligados a:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a) Llevar a cabo la actividad o la inversión, o adoptar el comportamiento que fundamenta la concesión de la subvención.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b) Justificar la realización de la actividad, y también el cumplimiento de los requisitos y las condiciones que determinan la concesión de la subvención.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El consejero de Transición Energética, Sectores Productivos y Memoria Democrática es el órgano competente para resolver este procedimiento, dada la estructura orgánica del Gobierno de las Illes Balears y de acuerdo con la Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Decreto Legislativo&nbsp;2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones (BOIB núm.&nbsp;196, de 31 de diciembre de 2005).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB núm.&nbsp;72, de 24 de mayo de 2008).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. La Resolución de consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (Programa MOVES&nbsp;III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo (BOIB núm.&nbsp;88, de 3 de julio de 2021).</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">5. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática por la cual se modifica y amplía el crédito de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 28 de junio de 2021 por la cual se aprueba la convocatoria pública de subvenciones para actuaciones de apoyo a la movilidad eléctrica (programa MOVES III) en el marco del Plan de Recuperación, Transformación y Resiliencia europeo financiado por la Unión Europea – NextGenerationEU (BOIB n.º103, de 6 de agosto de 2022).</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Revocar la subvención a los beneficiarios que figuran en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. Autorizar y disponer negativamente el gasto a favor de los beneficiarios por los importes detallados en el anexo con cargo a la partida presupuestaria que también figura en él.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Declarar concluido el procedimiento y, por lo tanto, archivar los expedientes indicados en el anexo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Publicar esta resolución en el <em>Boletín Oficial de las Illes Balears</em>.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes a contar desde el día siguiente de su publicación, de acuerdo con los artículos&nbsp;123 y 124 de la Ley&nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&nbsp;57 de la Ley&nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">También se puede interponer directamente un recurso contencioso‑administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la publicación de la resolución, de acuerdo con el artículo&nbsp;46 de la Ley&nbsp;29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.</span></p> <p> </p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif;
