    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La directora gerente de la Escuela Balear de Administración Pública ha formulado la siguiente propuesta de resolución:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Hechos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Mediante la Resolución de la consejera de Presidencia, Función Pública e Igualdad, de 14 de febrero de 2022, se publicó la convocatoria del cuerpo facultativo superior, escala de archivos, museos, bibliotecas y documentación, de la Administración especial de la Comunidad Autónoma de las Illes Balears, para la isla de Mallorca (BOIB núm. 28, de 22 de febrero de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. En relación a los requisitos que deben reunir las personas aspirantes con una discapacidad igual o superior al 33%, la base 4.2.f) de las bases generales, establece: &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«f) Las personas aspirantes con discapacidad igual o superior al 33 % deben presentar el certificado que acredite la condición legal de discapacidad. No obstante, no será necesario presentar este documento si el aspirante no se opone a que la Administración lo compruebe de oficio mediante la plataforma de intermediación de datos u otros sistemas habilitados para este fin.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Además de ello, estas personas deben presentar el justificante de haber solicitado un dictamen de los equipos multiprofesionales de la Dirección General de Dependencia, o del organismo público equivalente, sobre las condiciones personales de aptitud para ejercer las funciones correspondientes al cuerpo, escala y/o especialidad de la bolsa a la que la persona candidata aspira, quien debe expresar que está en condiciones de cumplir las tareas fundamentales del cuerpo escala y/o especialidad, mediante, si corresponden a juicio de la Administración, las adaptaciones necesarias del puesto de trabajo. Sin embargo, si la persona aspirante no se opone, la EBAP recaudará de oficio este dictamen».&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En fecha 18 de agosto de 2022, Dª. Carmen María Gordo Herrero presentó solicitud para participar en la citada bolsa. En la solicitud adjuntó un certificado del grado de discapacidad igual o superior al 33%. También adjuntó un dictamen de los equipos multiprofesionales del organismo público equivalente a la Dirección General de Dependencia de la Generalitat Valenciana, en el que no constaba la aptitud de Dª. Carmen María Gordo Herrero por ejercer las funciones correspondientes al cuerpo facultativo superior, escala de archivos, museos, bibliotecas y documentación, objeto de esta bolsa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. En fecha de 11 de mayo de 2023 (BOIB núm. 60) se publicó la Resolución de la consejera de Presidencia, Función Pública e Igualdad, por la que se aprueban las listas definitivas de personas aspirantes admitidas y excluidas de la bolsa citada. En esta Resolución figura con una «admisión condicional informe discapacitado».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En fecha 19 de mayo de 2023, se notificó, mediante requerimiento, a Dª. Carmen María Gordo Herrero el trámite de audiencia y se le concedió 5 días hábiles para alegar y presentar los documentos y justificaciones que considerara pertinentes en relación con el informe de aptitud, previo a la Resolución de exclusión. El mismo día, Dª. Carmen María Gordo Herrero accedió al requerimiento antes citado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. En fecha 29 de mayo de 2023, se entiende desistida de su solicitud a Dª. Carmen María Gordo Herrero, dado que no ha presentado ninguna alegación durante el plazo establecido en el trámite de audiencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. La Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El Decreto 30/2009, de 22 de mayo, por el que se aprueba el procedimiento de selección de personal funcionario interino al servicio de la administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Resolución de la consejera de Presidencia, Función Pública e Igualdad de 14 de febrero de 2022, a propuesta de la directora gerente de Función Pública, por la que se convoca un concurso para constituir una bolsa extraordinaria para cubrir, con carácter de interinidad, plazas vacantes del cuerpo facultativo superior, escala de archivos, museos, bibliotecas y documentación, de la Administración especial de la Comunidad Autónoma de las Illes Balears, para la isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Propuesta de resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Propongo a la consejera de Presidencia, Función Pública e Igualdad que dicte resolución en los siguientes términos:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Excluir a Dª. Carmen María Gordo Herrero del concurso para constituir una bolsa extraordinaria para cubrir, con carácter de interinidad, plazas vacantes del cuerpo facultativo superior, escala de archivos, museos, bibliotecas y documentación, de la administración especial de la Comunidad Autónoma de las Illes Balears, para la isla de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Declarar desistida de su solicitud a Dª. Carmen María Gordo Herrero, dado que no ha presentado ninguna alegación durante el plazo establecido en el trámite de audiencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Publicar la Resolución en el Boletín Oficial de las Illes Balears, en la sede electrónica de la Administración de la Comunidad Autónoma de las Illes Balears y en la web &amp;lt;http://oposicions.caib.es&amp;gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Manifestar la conformidad con la propuesta de resolución y dictar su resolución en los mismos términos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que agota la vía administrativa, se puede interponer un recurso potestativo de reposición ante el mismo órgano que la dicta en el plazo de un mes a contar a partir del día siguiente de haber recibido su notificación, de de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También se puede interponer directamente un recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo de Palma en el plazo de dos meses a contar desde el día siguiente de haber recibido la notificación de la resolución, de acuerdo con los artículos 8.2 y 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
