    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Transcurrido el periodo de exposición pública del Acuerdo Plenario adoptado por el Pleno municipal en la sesión ordinaria de 22 de marzo de 2023, de aprobación provisional de modificación del artículo 4 de la ordenanza reguladora del precio público del servicio de la escuela municipal, sin que se hayan presentado alegaciones, se eleva a definitivo el acuerdo conforme lo dispuesto en el artículo 17.3 del RD legislativo 2/2004, de 5 de abril por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El texto refundido completo de la ordenanza se inserta a continuación, conforme lo establecido en el artículo 17.4 del mismo precepto legal:&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;ORDENANZA REGULADORA DEL PRECIO PÚBLICO DEL SERVICIO DE LA ESCUELA INFANTIL&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;FUNDAMENTO Y NATURALEZA&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Artículo &lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. El uso de las facultades concedidas por los artículos &lt;/span&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;133.2 y 142 de la Constitución Española y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local en relación al artículo 123.1 apartado d. de la misma norma y del artículo 172 en relación al artículo 41 del Texto refundido de la Ley Reguladora de las Haciendas Locales, aprobado por el RDL 2/2004, de 5 de marzo, este Ayuntamiento establece el precio público por la prestación del servicio de Escuela Infantil 0 a 3 años del municipio de Mancor de la Vall, que regirá para esta Ordenanza.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;HECHO IMPONIBLE&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 2. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;El hecho imponible de este precio público constituye la prestación del servicio de escuela infantil de 0 a 3 años, de Mancor de la Vall. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;SUJETO PASIVO&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 3&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;. Están obligadas al pago del precio público regulado en la Ordenanza las personas beneficiarias de los servicios de Escuela de Educación Infantil de Mancor de la Vall, entendiendo como tal padre, padres o tutores legales del menor beneficiados. El sujeto obligado al pago del precio público lo será desde que se inicie la prestación del servicio de la Escuela de Educación Infantil. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;CUOTA PRECIO PÚBLICO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 4. &lt;/strong&gt;Las cuotas de los precios públicos incluida el seguro, serán los siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Al momento de entrada en vigor de esta ordenanza y en todo caso, al inicio del curso se solicitará por parte de los responsables del niño/a el horario que tendrá que realizar y que servirá de base a la factura del servicio.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En caso de que sea necesario efectuar alguna modificación de este, por variación de las circunstancias personales y familiares, se tendrá que preavisar con 10 días de antelación siempre que sea posible.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Si se tiene necesita un servicio extraordinario puntual, se hará la facturación de conformidad con el precio extraordinario señalado al cuadro anterior. Si este servicio extraordinario se produce durante más de la mitad de los días lectivos de un mes, se tendrá que modificar el horario inicial previsto para el niño y se facturará el mes completo según estas condiciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Serán de aplicación las previsiones de gratuidad previstas por la Comunidad Autónoma en horario de 08.30 a 12:30 horas en los cursos que se indiquen por las Conserjerías&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;OBLIGACIÓN DE PAGO. DEVENGO I NORMAS DE GESTIÓN. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 5.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; La obligación de pago de precio público regulado en esta Ordenanza, nace desde que se presta o realiza el servicio, cualquiera de los servicios o actividades especificadas en el anterior artículo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El precio público se devengará en el momento en que se inicie la prestación del servicio. El pago del precio público se realizara durante los cinco (5) primeros días del mes siguiente a utilizar el servicio. El pago de las cuotas correspondientes, cuando se trata de servicios eventuales, se realizará en el momento de solicitar el servicio. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;EXENCIONES Y BONIFICACIONES. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 6. &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;A instancia de parte y, en todo caso previo informe favorable de los servicios sociales municipales, el Ayuntamiento de Mancor de la Vall por acuerdo de Pleno, podrá otorgar la exención total o parcial de las cuotas devengadas por la asistencia y manutención, cuando las circunstancias socio-económicas del solicitante manifiesten una situación de subsistencia que aconsejen la concesión de las referidas bonificaciones o exenciones. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;El Ayuntamiento podrá solicitar cualquier tipo de prueba que acredite el estado socio económico del solicitante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Las familias con tres hijos o más, menores de 18 años, tendrán una bonificación del 10% del precio público del servicio de guardería si tienen un hijo matriculado, una bonificación de 20% del precio público del servicio si tienen dos hijos matriculados y una bonificación del 30% del precio público del servicio si tienen tres hijos o más matriculados. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;INFRACCIONES Y SANCIONES. &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 7.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; En todo aquello relativo a la cualificación de infracciones tributarias y de las sanciones que les correspondan en cada caso, se ajustará a lo dispuesto en el artículo 178 y siguientes de la Ley General Tributaria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DISPOSICIÓN DEROGATORIA.- &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;Esta Ordenanza deroga cualquier ordenanza anterior aprobada por el Ayuntamiento de Mancor de la Vall referida al precio público del servicio e la escuela infantil. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;DISPOSICIÓN FINAL.- &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;La presente Ordenanza Fiscal fue aprobada inicialmente por el Pleno del Ayuntamiento de Mancor de la Vall, en fecha 22 de marzo de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Contra el presente Acuerdo, conforme a lo dispuesto en el artículo 19 del Texto refundido de la Ley Reguladora de las Haciendas Locales aprobada por el Real decreto legislativo 2/2004, de 5 de marzo, se podrá interponer recurso contencioso-administrativo, delante de la Sala contencioso administrativa del Tribunal Superior de Justicia de les Illes Balear, con sede en Palma, en el plazo de dos meses a contar desde el día siguiente a la publicación del presente anuncio, de conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la jurisdicción Contenciosa – Administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
