&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;1. En fecha 18 de abril de 2023 tiene entrada por correo electrónico en la Subdirección de Presupuestos y Control del Gasto la solicitud del Hospital Universitario Son Espases para tramitar la cesión gratuita de Boston Scientific Ibérica, SA, de una mesa de apoyo quirúrgica, valorada en 13.800 €, a favor del Servicio de Salud de las Islas Baleares y con destino al Servicio de Cardiología del Hospital Universitario Son Espases. La documentación aportada es la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;Informe de necesidad emitido por el Servicio de Cardiología de HUSE en fecha 13 de marzo de 2023. Dispone que la incorporación de la mesa de apoyo quirúrgica mejora la calidad y seguridad en la realización de los procedimientos percutáneos en cardiología.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;Descripción del equipo: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;El equipo que se cede no necesita fungible. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;La cesión no supone gasto para el Servicio de Salud de Illes Balears ni para el HUSE. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;La duración de la cesión comenzará el día en que el Hospital reciba el equipo y firme el acta de instalación y será de 2 años. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;Queda entendido, que BSC, en ningún caso, es propietaria del Equipo y que éste será suministrado, entregado y puesto a disposición del Hospital por el Proveedor, que es Endocore S.L. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;BSC cederá al Hospital el uso del Equipo, al ostentar la posesión de éste como arrendataria, de conformidad con el contrato de arrendamiento (en adelante el Contrato de Arrendamiento) que tiene previsto suscribir con la entidad Siemens Renting (en los sucesivo, la "Arrendadora"). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;Esta cesión se hace efectiva con carácter extraordinario y en ningún caso beneficia a ningún profesional sanitario ni constituye un incentivo para la recomendación, prescripción, compra, suministro, venta o administración de productos de marca determinada […]&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;3. El 15 de mayo de 2023, el director general del Servicio de Salud de las Islas Baleares firma la Resolución de inicio para aceptar la cesión temporal, por el plazo de veinticuatro meses, por parte de Boston Scientific Ibérica, SA, de una mesa de apoyo quirúrgica, valorada en 13.800 €, a favor del Servicio de Salud de las Islas Baleares y con destino al Servicio de Cardiología del Hospital Universitario Son Espases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="background-color:null"&gt;4. En fecha 16 de mayo de 2023 el subdirector de Presupuestos y Control del Gasto emitió un informe favorable a la cesión temporal y gratuita de uso, por el plazo de veinticuatro meses, por parte de Boston Scientific Ibérica, SA, de una mesa de apoyo quirúrgica, valorada en 13.800 €, a favor del Servicio de Salud de las Islas Baleares y destino al Servicio de Cardiología del Hospital Universitario Son Espases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
