&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. En fecha 17 de febrero de 2022 tiene entrada por correo electrónico a la Subdirección de Presupuestos y Control del Gasto la solicitud del Hospital Universitario Son Llàtzer para tramitar la cesión gratuita de la Fundación de Atención y Apoyo a la Dependencia y de Promoción de la Autonomía Personal de las Islas Baleares de un robot ortesis conductor pasivo de la marcha Lokomat Hocoma Woodway, valorado en 244.806 €, a favor del Servicio de Salud de las Islas Baleares y con destino al Servicio de Rehabilitación del Hospital Universitario Son Llàtzer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. El 18 de febrero de 2022 se solicita un informe a la CITEC/CVIT para la valoración de las tecnologías. El 28 de marzo de 2023 el subdirector de Compras y Logística emite un informe según el cual la cesión sin fungible asociado se considera «procedente».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. En el expediente consta la documentación siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El Acuerdo de colaboración entre la Fundación de Atención y Apoyo a la Dependencia y de Promoción de la Autonomía Personal de las Islas Baleares y la Fundación Hospital Son Llàtzer para la cesión gratuita de un robot ortesis pasivo en marcha, de fecha 30 de octubre de 2009.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La factura núm. 07/1681 del Lokomat Modelo Pro por el valor de 244.806 €.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El escrito de ofrecimiento de la cesión gratuita de un robot ortesis conductor pasivo de la marcha Lokomat Hocoma Woodway, firmado por la presidenta del Patronato de la Fundación en fecha 12 de abril de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La memoria justificativa de la cesión de un equipo robótico para rehabilitación por parte de la Fundación de Atención y Apoyo a la Dependencia para el Servicio de Rehabilitación del Hospital Universitario Son Llàtzer, de fecha 16 de febrero de 2023 en el que se solicita que se formalice la cesión.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. El 4 de abril de 2023 el director general del Servicio de Salud de las Islas Baleares resolvió el inicio del expediente para aceptar la cesión gratuita por parte de la Fundación de Atención y Apoyo a la Dependencia y de Promoción de la Autonomía Personal de las Islas Baleares de un robot ortesis conductor pasivo de la marcha Lokomat Hocoma Woodway, valorado en 244.806 €, a favor del Servicio de Salud de las Islas Baleares y destino al Servicio de Rehabilitación del Hospital Universitario Son Llàtzer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. En fecha 11 de mayo de 2023 el subdirector de Presupuestos y Control del Gasto emitió un informe favorable a la cesión gratuita por parte de la Fundación de Atención y Apoyo a la Dependencia y de Promoción de la Autonomía Personal de las Islas Baleares de un robot ortesis conductor pasivo de la marcha Lokomat Hocoma Woodway, valorado en 244.806 €, a favor del Servicio de Salud de las Islas Baleares y con destino al Servicio de Rehabilitación del Hospital Universitario Son Llàtzer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. El Código civil, aprobado por el Real decreto de 24 de julio de 1889.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. &lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. La Ley 5/2003, de 4 de abril, de salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. La Ley 33/2003, de 3 de noviembre, de patrimonio de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. La Ley 7/2010, de 21 de julio, del sector público instrumental de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. El Real decreto 1373/2009, de 28 de agosto, por el que se aprueba el Reglamento general de la Ley 33/2003, de 3 de noviembre.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. El Decreto 127/2005, de 16 de diciembre, por el que se aprueba el Reglamento de desarrollo de la Ley 6/2001.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Aceptar la cesión gratuita por parte de la Fundación de Atención y Apoyo a la Dependencia y de Promoción de la Autonomía Personal de las Islas Baleares de un robot ortesis conductor pasivo de la marcha Lokomat Hocoma Woodway, valorado en 244.806 €, a favor del Servicio de Salud de las Islas Baleares y destino al Servicio de Rehabilitación del Hospital Universitario Son Llàtzer.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
